का.आ. 4079(अ).—भारतीय पुनच(cid:7408)क(cid:7004)सा प(cid:7407)रषद अनधननयम, 1984 (1984 का 52) क(cid:7409) धारा 3 क(cid:7409) उप-धारा 3 ख(cid:7003)ड (i) यह उपबंध करता है (cid:7408)क ननि रा(cid:6996)य(cid:7298) पर इस अनधननयम का र्न(cid:7021)तार है, उनक(cid:7409) रा(cid:6996)य पुनच(cid:7408)क(cid:7004)सा संगम(cid:7298) के अ(cid:7007)य(cid:6979)(cid:7298) म(cid:7286) से क(cid:7286) (cid:7076)ीय सरकार (cid:7367)ारा एक सद(cid:7021)य नानमत (cid:7408)कया ािएगा;
और, उ(cid:6989)त अनधननयम क(cid:7409) धारा-3 के उप-धारा (3) के ख(cid:7003)ड (i) के अधीन (cid:7079)द(cid:7004)त न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए क(cid:7286) (cid:7076)ीय सरकार (cid:7367)ारा तारीख 28 अग(cid:7021)त, 2014 के का.आ. 2181 (अ) क(cid:7409) अनधसूचना के (cid:7367)ारा डा. उमे च(cid:7008)(cid:7076) मा(cid:6981), अ(cid:7007)य(cid:6979), (cid:7079)ांतीय रापिन(cid:7074)त पुनच(cid:7408)क(cid:7004)सक संघ, भोपाल को भारतीय पुनच(cid:7408)क(cid:7004)सा प(cid:7407)रषद के एक सद(cid:7021)य के (cid:7272)प म(cid:7286) नानमत (cid:7408)कया गया ा;
और, क(cid:7286) (cid:7076)ीय सरकार के (cid:7007)यान म(cid:7286) यह लाया गया है (cid:7408)क अ(cid:7007)य(cid:6979), (cid:7079)ांतीय रापिन(cid:7074)त पुनच(cid:7408)क(cid:7004)सक संघ, भोपाल के (cid:7272)प म(cid:7286) डा. उमे चं(cid:7076) मा(cid:6981) का काय(cid:6981)काल के र्ल 30.04.2016 तक ा ता म(cid:6981) और सं(cid:7021)ान म(cid:7007)य (cid:7079)दे के सहायक रन(िcid:7021)(cid:7069)ार से (cid:7079)ा(cid:7009)त द(cid:7021)र्ताे(िcid:7298) से भी यह पता चला है (cid:7408)क उ(cid:6989)त (cid:7079)ांतीय रापिन(cid:7074)त पुनच(cid:7408)क(cid:7004)सक संघ का काय(cid:6981)काल 1.5.2013 से लेकर 30.04.2016 तक, तीनर् ष(cid:7300) का ा;
और, डा. उमे चं(cid:7076) मा(cid:6981) अपने काय(cid:6981)काल क(cid:7409) समान(cid:7385) या र्ननधपूण(cid:6981) उपर्ननधय(cid:7298), ननयम(cid:7298), र्नननयम(cid:7298), (cid:7408)दाननद(cid:7287)(cid:7298), इ(cid:7004)या(cid:7408)द के अधीन उसके र्न(cid:7021)तार के (cid:7408)कसी (cid:7079)कार को क(cid:7286) (cid:7076)ीय सरकार को सूनचत करने म(cid:7286) असल रहे ह(cid:7289);
और, ऐसा (cid:7079)तीत होता है (cid:7408)क संघ ने 2015 म(cid:7286) संघ के अ(cid:7007)य(cid:6979) ता अ(cid:7008)य काय(cid:6981)कारी सद(cid:7021)य(cid:7298) के काय(cid:6981)काल को बाने के संबंध म(cid:7286) (cid:7079)ांतीय रापिन(cid:7074)त पुनच(cid:7408)क(cid:7004)सक संघ ता म(cid:7007)य (cid:7079)दे सोसायटी रन(िcid:7021)(cid:7069)ीकरण अनधननयम, 1973 क(cid:7409) उप-र्ननधय(cid:7298) म(cid:7286) यार्ननहत सम्यक र्ननधक (cid:7079)(cid:7408)(cid:7059)या के नबना अपनी ही उप-र्ननधय(cid:7298) का उ(cid:7016)लंघन करते (cid:7263)ए अपनी उप-र्ननधय(cid:7298) को संोनधत (cid:7408)कया है;
और बि(cid:7408)क, क(cid:7286) (cid:7076)ीय सरकार ने इस मामले म(cid:7286) एक र्न(cid:7021)तृत ािंच क(cid:7409) और क(cid:7409) गई ािंच ता (cid:7079)ा(cid:7009)त द(cid:7021)र्ताे(िcid:7298) के आधार पर, उसने यह देखा (cid:7408)क-
(i) संघ के मूल उप-र्ननधय(cid:7298) म(cid:7286) (cid:7408)कए गए उपबंध के अनुसार उप-र्ननधय(cid:7298) का संोधन, अ(cid:7007)य(cid:6979) ता ासी ननकाय के सद(cid:7021)य(cid:7298) के काय(cid:6981)काल म(cid:7286) र्ृन(cid:7373) हेतु उप-र्ननधय(cid:7298) सनहत, क(cid:7409) (cid:7079)(cid:7408)(cid:7059)या म(cid:7286) संघ के अपेन(cid:6979)त सद(cid:7021)य(cid:7298) क(cid:7409) अपेन(cid:6979)त सं(cid:6990)या क(cid:7409) न तो नसा(cid:7407)र है और न ही सम(cid:6981)न है।

(iii) (cid:7079)ांतीय रापिन(cid:7074)त पुनच(cid:7408)क(cid:7004)सक संघ का नाम म(cid:7007)य (cid:7079)दे रा(cid:6996)य क(cid:7409) सरकार (cid:7367)ारा मा(cid:7008)यता (cid:7079)ा(cid:7009)त संगम(cid:7298) क(cid:7409) सूची म(cid:7286) सूचीब(cid:7373) नह(cid:7277) है।
और बि(cid:7408)क, इस अनधननयम क(cid:7409) धारा 6 क(cid:7409) उप-धारा (1) के खंड (ख) म(cid:7286) यह उपबंध है (cid:7408)क (cid:7408)कसी सद(cid:7021)य के बारे म(cid:7286) उसका पद (cid:7407)र(cid:6989)त कर (cid:7408)दया समझा ािएगा य(cid:7408)दर् ह उस पद पर नह(cid:7277) रह ािता है नसि पर उसे नाम नन(cid:7416)द(cid:7020)ट (cid:7408)कया गया ा।
और बि(cid:7408)क, डॉ उमे च(cid:7008)(cid:7076) मा(cid:6981) का (cid:7079)ांतीय रापिन(cid:7074)त पु नच(cid:7408)क(cid:7004)सक संघ, भोपाल के अ(cid:7007)य(cid:6979) के (cid:7272)प म(cid:7286) काय(cid:6981)काल र्ननध के अनुसार ता (cid:7079)ांतीय रापिन(cid:7074)त पु नच(cid:7408)क(cid:7004)सा संघ ता म(cid:7007)य (cid:7079)दे सोसायटी रन(िcid:7021)(cid:7069)ीकरण अनधननयम, 1973 क(cid:7409) उप-र्ननधय(cid:7298) के अधीन (cid:7021)ानपत र्ननधपूण(cid:6981) प(cid:7367)नतय(cid:7298) ता (cid:7079)(cid:7408)(cid:7059)या(cid:7312) के अनुसार नबना (cid:7408)कसी और र्ननधक र्न(cid:7021)तार के 30/04/2016 को समा(cid:7009)त हो गया ा और इस (cid:7079)कार उसके बारे म(cid:7286) यह मान नलया ािए (cid:7408)क उसने अपना पद (cid:7407)र(cid:6989)त कर (cid:7408)दया है;
अत:, अब, भारतीय पु नच(cid:7408)क(cid:7004)सा प(cid:7407)रषद अनधननयम, 1984 (1984 का 52) क(cid:7409) धारा 3 क(cid:7409) उप-धारा (3) ता उप-धारा (6) के अधीन (cid:7079)द(cid:7004)त न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए क(cid:7286) (cid:7076)ीय सरकार भारत के रापि(cid:7074), असाधारण, भाग-2, ख(cid:7003)ड 3, उप-ख(cid:7003)ड (ii) म(cid:7286) (cid:7079)कानत भारत सरकार के कृ नष मं(cid:7074)ालय (पुपालन, डेयरी और म(cid:7004)(cid:7021)यपालन र्नभाग) क(cid:7409) तारीख 28 अग(cid:7021)त, 2014 के का.आ. 2181 (अ) क(cid:7409) अनधसूचना का संधोधन करती है, अा(cid:6981)त:-
उ(cid:6989)त अनधसूचना म(cid:7286), (cid:7059)म सं(cid:6990)या 14 ता उससे संबंनधत (cid:7079)र्नन(cid:7397)य(cid:7298) का लोप (cid:7408)कया ािएगा।

(cid:7407)ट(cid:7009)पण : मूल अनधसूचना सं. का आ. 2181(अ), तारीख 28 अग(cid:7021)त, 2014 को अंनतम बार तारीख 11 मई, 2016 क(cid:7409) का.आ. 1755(अ) के (cid:7367)ारा संधोनधत (cid:7408)कया गया ा।

NOTIFICATION
New Delhi, the 16th December, 2016
S.O. 4079(E).—WHEREAS, the clause (i) of sub-section 3 of section 3 of the Indian Veterinary Council Act,1984 (52 of 1984) provides that one member to be nominated by the Central Government from amongst the Presidents of the State Veterinary Associations of those States to which this Act extends;
AND WHEREAS, vide notification S.O. 2181 (E), dated 28th August, 2014, Dr. Umesh Chandra Sharma, President, Prantiya Rajpatrit Pashuchikitsak Sangh, Bhopal was nominated as a member to the Veterinary Council of India by the Central Government in exercise of the powers conferred under clause (i) of sub section (3) of section 3 of the said Act; AND WHEREAS, it has been brought to the notice of the Central Government that the tenure of Dr. Umesh Chandra Sharma as the President, Prantiya Rajpatrit Pashuchikitsak Sangh, Bhopal was only up to 30.04.2016 and the documents received from the Assistant Registrar of the Firms and Institution Madhya Pradesh, also revealed that the said Prantiya Rajpatrit Pashuchikitsak Sangh had a term of three years from 01.05.2013 to 30.04.2016;
AND WHEREAS, Dr. Umesh Chandra Sharma failed to intimate the Central Government either of the expiry of the tenure or any type of extension thereof under lawful bye-laws, rules, regulations, guidelines, etc;
AND WHEREAS, it seems that the Sangh has amended its bye-laws in 2015 without due legal processes as prescribed in the bye-laws of Prantiya Rajpatrit Pashuchikitsak Sangh and the Madhya Pradesh Society Registrikaran Adhiniyam, 1973 to increase the tenure of President and other Executive Members of the Sangh in violation of its own bye-laws;
AND WHEREAS, the Central Government made a detailed enquiry in the matter and based on the enquiry made and documents received, it noticed that-
(i) The procedure for amendment of bye-laws as provided in the original bye-laws of the Sangh does not have the recommendation or support of the requisite number of members of the Sangh including the amendment of bye-laws for increase in tenure of the President and Governing body members.
(ii) The tenure of the President of the Sangh has been increased without following specific lawful procedures, processes, steps, rules, regulations, guidelines or bye-laws of the Sangh.
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 3(iii) The name of the Prantiya Rajpatrit Pashuchikitsak Sangh has not been listed in the list of recognised associations by State Government of Madhya Pradesh;
AND WHEREAS clause (b) of sub-section (1) of section 6 of the Act provides that a member shall be deemed to have vacated his office, if he ceases to hold the post from which he has been nominated; AND WHEREAS, the term of Dr. Umesh Chandra Sharma as President, Prantiya Rajpatrit Pashuchikitsak Sangh, Bhopal has therefore ended on 30.04.2016 without further legal extension as per law and established lawful process and procedures under the bye-laws of Prantiya Rajpatrit Pashuchikitsak Sangh and the Madhya Pradesh Society Registrikaran Adhiniyam, 1973 and so deemed to have vacated his office; NOW, THEREFORE, in exercise of the power conferred under sub-sections (3) and (6) of section 3 of the Indian Veterinary Council Act, 1984 (52 of 1984), the Central Government hereby amends the notification of the Government of India in the Ministry of Agriculture (Department of Animal Husbandry, Dairying and Fisheries) number S.O. 2181(E), dated the 28th August, 2014, published in Gazette of India, Extraordinary, Part-II, Section 3, sub-section (ii), namely:-
In the said notification, serial no.14 and the entries relating thereto shall be omitted.
