का (cid:7079)ा(cid:7272)प र्ायुयान अनधननयम, 1934 (1934 का 22) क(cid:7409) धारा 14 क(cid:7409) अपे(cid:6979)ानुसार भारत सरकार, नागर र्नमानन मं(cid:7074)ालय क(cid:7409) तारीख 18 अ(cid:7334)ू बर, 2016 क(cid:7409) अनधसूचना सं. सा.का.नन. 998(अ) के (cid:7367)ारा भारत सरकार के रापि(cid:7074), असाधारण, भाग-II, खंड 3, उप-खंड (i) म(cid:7286) (cid:7079)कानत (cid:7408)कए गए, नसिे ऐसे सभी (cid:7390)न(cid:7334)य(cid:7298) ननिके उससे (cid:7079)भार्नत होने क(cid:7409) संर्भाना है, से रापि(cid:7074) म(cid:7286) इस अनधसूचना के (cid:7079)कानत होने के तीस (cid:7408)दन क(cid:7409) र्अनध क(cid:7409) समान(cid:7385) से र्पू(cid:6981) आ(cid:6979)ेप और सुर्झा आमंन(cid:7074)त करते (cid:7263)ए भारत के रापि(cid:7074) क(cid:7409) (cid:7079)नतयां र्सा(cid:6981)निनक (cid:7272)प से उपल(cid:7011)ध कराई गई;
और चू ं(cid:7408)क उ(cid:7334) अनधसूचना क(cid:7409) रापि(cid:7074) म(cid:7286) (cid:7079)कानत (cid:7079)नतयां तारीख 24 अ(cid:7334)ू बर, 2016 को र्सा(cid:6981)निनक (cid:7272)प से उपल(cid:7011)ध करा दी गई ी;
और चू ं(cid:7408)क उ(cid:7334) अनधसूचचना म(cid:7286) र्ननन(cid:7416)द(cid:7397) र्अनध के अंदर (cid:7079)ा(cid:7272)प ननयम(cid:7298) के र्बात (cid:7079)ा(cid:7385) आ(cid:6979)ेप(cid:7298) या सुर्झा(cid:7298) पर र्नचार (cid:7408)कया गया है;
अतः अब क(cid:7286) (cid:7076)ीय सरकार, उ(cid:7334) र्ायुयान अनधननयम क(cid:7409) धारा 5 (cid:7367)ारा (cid:7079)द(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए र्ायुयान ननयम, 1937 म(cid:7286) और आगे संोधन करने के नलए नन(cid:7388)नलनखत ननयम बनाती है, अा(cid:6981)त-:
1. (1) इन ननयम(cid:7298) का संन(cid:6979)(cid:7385) नामर् ायुयान ( छठा संोधन), ननयम, 2016 है
(2) ये सरकारी रापि(cid:7074) म(cid:7286) (cid:7079)कान क(cid:7409) तारीख को (cid:7079र्)ृ(cid:7275) ह(cid:7298)गे।

2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]2. र्ायुयान ननयम, 1937 (इसम(cid:7286) इसके प(cid:7391)ात उ(cid:7334) ननयम कहा गया है) म(cid:7286), ननयम 82 के उप-ननयम म(cid:7286),- (क) ''हर उपयु(cid:7334) समय पर'' (cid:7011)द(cid:7298) के (cid:7021)ान पर ''हर उपयु(cid:7334) समय या अंतराल पर'' (cid:7011)द(cid:7298) को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािए;
(ख) ''र्नमान (cid:6979)े(cid:7074) पर सुर(cid:6979)ा और (cid:7390र्)(cid:7021)ा सुननन(cid:7391)त करने के (cid:7079)योनि के नलए'' (cid:7011)द(cid:7298) के (cid:7021)ान पर ''र्नमान (cid:6979)े(cid:7074) पर सुर(cid:6979)ा और (cid:7390र्)(cid:7021)ा सुननन(cid:7391)त करने के नलए ननगरानी के (cid:7079)योनि के नलए'' (cid:7011)द(cid:7298) को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािए।
3. उ(cid:7334) ननयम(cid:7298) के ननयम 83 म(cid:7286), उप-ननयम (5) के प(cid:7391)ात, नन(cid:7388)नलनखत उप-ननयम को अंतः(cid:7021)ानपत (cid:7408)कया ािए, अा(cid:6981)तः-
''(6) महाननदेक, उप-ननयम (1) के तहत अनधरोनपत (cid:7408)कसी त(cid:6981) का अनुपालन न होने या र्नमान (cid:6979)े(cid:7074) ननरी(cid:6979)ण के दौरान सुर(cid:6979)ा संबंधी सम(cid:7021)या उ(cid:7004)प(cid:7382) होने और महाननदेक (cid:7367)ारा र्ननन(cid:7416)द(cid:7397) र्अनध के प(cid:7391)ात, सम(cid:7021)या का समाधान न होने क(cid:7409) दा म(cid:7286) अनु(cid:6980)न(cid:7385) पर (cid:7079)चालन ननब(cid:7304)धन अनधरोनपत कर सक(cid:7286) गे।''

NOTIFICATION
New Delhi, the 15th December, 2016
G.S.R. 1156(E).—Whereas the draft of certain rules further to amend the Aircraft Rules, 1937, was published, as required by section 14 of the Aircraft Act, 1934 (XXII of 1934), vide notification of the Government of India in the Ministry of Civil Aviation, published in the Gazette of India, Extraordinary Part-II, Section 3, sub-section (i), vide number G.S.R. 998(E), dated 18thOctober, 2016, for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette of India in which the said notification was published, were made available to public;
And whereas copies of the Gazette in which the said notification was published were made available to the public on the 24th October, 2016;
And whereas objections or suggestions received in respect of the draft rules within the period specified have been taken into consideration;
Now, therefore, in exercise of the powers conferred by Section 5 of the said Aircraft Act, the Central Government hereby makes the following rules further to amend the Aircraft Rules, 1937, namely: ─
1. (1) These rules may be called the Aircraft (Fifth Amendment) Rules, 2016.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Aircraft Rules, 1937 (hereinafter referred to as the said rules), in sub-rule (1) of rule 82,—
(a) for the words "at all reasonable times", the words "at all reasonable times or intervals" shall be substituted;
(b) for the words "for the purpose of ensuring safety and order at the aerodrome", the words "for the purpose of surveillance to ensure safety and order at the aerodrome" shall be substituted.
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(i)] 33. In rule 83 of the said rules, after sub-rule (5), the following sub-rule shall be inserted, namely:-
"(6) The Director-General may impose operating restriction on the license in the event of non-compliance with any condition imposed under sub-rule (1) or if any safety concern emerges during the aerodrome inspection and remains unresolved beyond the period specified by the Director-General.".
