और अब उ(cid:6989)त (cid:7079)ानधकरण क(cid:7409) र्अनध समा(cid:7009)त हो गई है, क(cid:7286) (cid:7076)ीय सरकार का यह मत है (cid:7408)क उ(cid:6989)त (cid:7079)ानधकरण का पुनग(cid:6981)ठन (cid:7408)कया ािए;

अतः अब क(cid:7286) (cid:7076)ीय सरकार, पया(cid:6981र्)रण (संर(cid:6979)ण) अनधननयम, 1986 (1986 का 29) (नसिे इसम(cid:7286) इसके प(cid:7019)चात् उ(cid:6989)त अनधननयम कहा गया है) क(cid:7409) धारा 3 क(cid:7409) उपधारा (1) और उपधारा (3) (cid:7367)ारा (cid:7079)द(cid:7004)त न(cid:6989)तय(cid:7298) का (cid:7079)योग करते (cid:7263)ए, और आदे सं(cid:6990)यांक का.आ. 2261(अ) तारीख 9 ुिलाई, 2013 को उन बात(cid:7298) के नर्साय अनध(cid:7059)ांत करते (cid:7263)ए न(िcid:7008)ह(cid:7286) ऐसे अनध(cid:7059)मण से र्पू(cid:6981) (cid:7408)कया गया है या करने का लोप (cid:7408)कया गया है, इस आदे के रापि(cid:7074) म(cid:7286) (cid:7079)कान क(cid:7409) तारीख से तीनर् ष(cid:6981) क(cid:7409) र्अनध के नलए, दमन और र्दी तटीय ोिन (cid:7079)बंध (cid:7079)ानधकरण (नसिे इसम(cid:7286) इसके प(cid:7019)चात् (cid:7079)ानधकरण कहा गया है) का पुनग(cid:6981)ठन करती है, नसिम(cid:7286) नन(cid:7013)ननलनखत (cid:7018)यन(cid:6989)त ह(cid:7298)गे, अा(cid:6981)त् :-

(cid:7079)ानधकरण को तटीय पया(cid:6981र्)रण क(cid:7409) (cid:6989र्)ानलटी के संर(cid:6979)ण और उसम(cid:7286) सुधार करने ता दमन और र्दी संघ रा(cid:6996)य (cid:6979)े(cid:7074)(यूटी) के (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) पया(cid:6981र्)रणीय (cid:7079)दूषण क(cid:7409) रोकाम, उपमन और ननयं(cid:7074)ण के नलए नन(cid:7013)ननलनखत न(cid:6989)तयां ह(cid:7298)गी, अा(cid:6981)त् :-

(i) दमन और र्दी संघ रा(cid:6996)य (cid:6979)े(cid:7074) से (cid:7079)ा(cid:7009)त तटीय र्नननमय ोिन (cid:6979)े(cid:7074)(cid:7298) और तटीय ोिन (cid:7079)बंध योनिा(सीेिडएमपी) के र् ग(cid:7278)करण म(cid:7286) प(cid:7407)र्रत(cid:6981)न या संोधन करने हेतु (cid:7079)ा(cid:7385) (cid:7079)(cid:7021)र्ता(cid:7298) क(cid:7409) ािंच करना और रा(cid:7020)(cid:7069)ीय तटीय ोिन (cid:7079)बंधन (cid:7079)ानधकरण को र्ननन(cid:7416)द(cid:7397) नसा(cid:7407)र(cid:7286) करना;

(ii) (क) उ(cid:6989)त अनधननयम और उसके अधीन बनाए गए ननयम(cid:7298) या (cid:7408)कसी अ(cid:7008)य र्ननध के अधीन ोि उ(cid:6989)त अनधननयम के उ(cid:7374)े(cid:7019)य(cid:7298) से संबंनधत है, के उपबंध(cid:7298) के अनभकनत उ(cid:7016)लंघन के मामल(cid:7298) क(cid:7409) ािंच और य(cid:7408)द (cid:7408)कसी र्ननन(cid:7416)द(cid:7020)ट मामले म(cid:7286) र्आ(cid:7019)यक (cid:7079)तीत हो तो उ(cid:6989)त अनधननयम क(cid:7409) धारा 5 के अधीन ननदे ािरी करना, हिां तक (cid:7408)क ऐसे ननदे क(cid:7286) (cid:7076)ीय सरकार (cid:7367)ारा ग(cid:7407)ठत रा(cid:7020)(cid:7069)ीय तटीय ोिन (cid:7079)बंधन (cid:7079)ानधकरण (cid:7367)ारा उस र्नन(cid:7020)ट मामले म(cid:7286) ािरी (cid:7408)कए गए (cid:7408)कसी ननदे से असंगत न हो;

(ख) उ(cid:6989)त अनधननयम और उसके अधीन बनाए गए ननयम(cid:7298) या (cid:7408)कसी अ(cid:7008)य र्ननध के अधीन ोि उ(cid:6989)त अनधननयम के उ(cid:7374)े(cid:7019)य(cid:7298) से संबंनधत है, उपबंध(cid:7298) के उ(cid:7016)लंघन को अंर्त(cid:7414)लत करनेर् ाले मामल(cid:7298) का पुन(cid:7414र्)लोकन करेगा और य(cid:7408)द र्आ(cid:7019)यक हो तो ऐसे मामल(cid:7298) को (cid:7407)ट(cid:7009)पनणय(cid:7298) के सा पुन(cid:7414र्)लोकन के नलए रा(cid:7020)(cid:7069)ीय तटीय ोिन (cid:7079)बंधन (cid:7079)ानधकरण को ननद(cid:7287)नत करेगा ;

परंतु उप पैरा(cid:7312) के खंड (क) और खंड (ख) के अधीन मामल(cid:7298) को (cid:7021र्)तः (cid:7021)ू त(cid:6981) आधार पर र्अा (cid:7408)कसी (cid:7390)न(cid:7334) या (cid:7408)कसी (cid:7079)नतनननध ननकाय या (cid:7408)कसी संगठन (cid:7367)ारा क(cid:7409) गई नकायत के आधार पर (cid:7079)ानधकरण (cid:7367)ारा कार(cid:6981र्)ाई क(cid:7409) ाि सके गी ;

(iii) उप पैरा (i) और उप पैरा (ii) के अधीन ािरी (cid:7408)कए गए ननदे(cid:7298) का अनुपालन न होने क(cid:7409) दा म(cid:7286) उ(cid:7334) अनधननयम क(cid:7409) धारा 19 के अधीन प(cid:7407)र्राद ाइल करना ;

(iv) उप पैरा (i) और उप पैरा (ii) से उ(cid:7006)भूत मु(cid:7374)(cid:7298) से संबंनधत त(cid:7005)य(cid:7298) को स(cid:7004)यानपत करने के नलए उ(cid:7334) अनधननयम क(cid:7409) धारा 10 के अधीन कार(cid:6981र्)ाई करना ;

(cid:7079)ानधकरण, तटीय र्नननयमन ोिन से संबंनधत पया(cid:6981र्)रण मु(cid:7374)(cid:7298), ोि उस यान(cid:7021)नत, दमन और र्दी संघ रा(cid:6996)य (cid:6979)े(cid:7074), रा(cid:7398)ीय तटीय ोिन (cid:7079)बंध (cid:7079)ानधकरण या के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा नन(cid:7416)द(cid:7397) (cid:7408)कए ािएं, पर कार(cid:6981र्)ाई करेगा ।

(cid:7079)ानधकरण, तटीय र्नननयमन ोिन म(cid:7286) पा(cid:7407)रन(cid:7021)तक(cid:7409)य (cid:7272)प से र्संेदनील (cid:6979)े(cid:7074)(cid:7298) क(cid:7409) पहचान करेगा और ऐसे पहचान (cid:7408)कए गए (cid:6979)े(cid:7074)(cid:7298) के नलए (cid:6979)े(cid:7074) र्नन(cid:7020)ट (cid:7079)बंधन योनिा तैयार करेगा;

5. (cid:7079)ानधकरण, (cid:6979)रण या अपचय के नलए अनधक सहभिे(cid:7378) तटीय (cid:6979)े(cid:7074)(cid:7298) क(cid:7409) पहचान करेगा और ऐसे पहचाने गए (cid:6979)े(cid:7074)(cid:7298) के नलए (cid:6979)े(cid:7074) र्ननन(cid:7416)द(cid:7020)ट (cid:7079)बंधन योनिा तैयार करेगा ।

6. (cid:7079)ानधकरण र्पू(cid:7299)(cid:7334) पैरा 3 और पैरा 4 के अधीन तैयार क(cid:7409) गई योनिाएं और उनम(cid:7286) उपांतरण(cid:7298) को रा(cid:7398)ीय तटीय ोिन (cid:7079)बंध (cid:7079)ानधकरण को ािंच और उसके अनुमोदन के नलए (cid:7079)(cid:7021)तुत करेगा ।

7. (cid:7079)ानधकरण, पया(cid:6981र्)रण औरर् न मं(cid:7074)ालय, के (cid:7008)(cid:7076)ीय सरकार क(cid:7409) भारत के रापि(cid:7074) असाधारण भाग-2 धारा-3, उप धारा (ii) म(cid:7286) (cid:7079)कानत अनधसूचना सं. का.आ. 19(अ) तारीख 6 र्निरी, 2011 म(cid:7286) अनधकनत (cid:7079)(cid:7408)(cid:7059)या के अनुसार रा(cid:6996)य के तटीय (cid:6979)े(cid:7074)(cid:7298) के तटीय र्नननयमन ोिन का माननच(cid:7074) तैयार करेगा और उसे रा(cid:7398)ीय तटीय ोिन (cid:7079)बंध (cid:7079)ानधकरण और पया(cid:6981र्)रण, र्न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय, के (cid:7008)(cid:7076)ीय सरकार को (cid:7079)(cid:7021)तुत करेगा।

8. (cid:7079)ानधकरण, अनुमो(cid:7408)दत दमन और र्दी संघ रा(cid:6996)य (cid:6979)े(cid:7074) के नलए तटीय (cid:7079)बंध ोिन योनिा म(cid:7286) अनधकनत सभी र्नन(cid:7397) त(cid:7300) के अनुपालन को सुननन(cid:7019)चत करेगा।

9. (cid:7079)ानधकरण, अपने (cid:7408)(cid:7059)याकलाप(cid:7298) क(cid:7409) (cid:7407)रपोट(cid:6981) तटीय ोिन (cid:7079)बंधन (cid:7079)ानधकरण को छह मास म(cid:7286) कम से कम एक बार (cid:7079)(cid:7021)तुत करेगा ।

10. (cid:7079)ानधकरण क(cid:7409) बैठक(cid:7298) क(cid:7409) गणपू(cid:7414)त कु ल सद(cid:7021)य(cid:7298) क(cid:7409) कु ल सं(cid:6990)या के दो-नतहाई से होगी ।

11. रा(cid:6996)य सरकार यह सुननन(cid:7391)त करेगी (cid:7408)क इस आदे और उ(cid:7334) अनधननयम म(cid:7286) या र्ननन(cid:7416)द(cid:7020)ट इसके कृ (cid:7004)य(cid:7298) का (cid:7079)र्भाी (cid:7272)प से नर्न(cid:6981)हन करने के नलए (cid:7079)ानधकरण को पया(cid:6981)(cid:7385) मा(cid:7074)ा म(cid:7286) संसाधन, मार्न न(cid:7334), नननधयां उपल(cid:7011)ध ह(cid:7298)।

12. (cid:7079)ानधकरण, सभी र्आ(cid:7019)यक उपाय और पहल करेगा, नसिम(cid:7286) काय(cid:6981)(cid:7059)म का नन(cid:7020)पादन, अनुसंधान, सूचना (cid:7079)सार, (cid:7079)न(cid:6979)ण, (cid:7408)दन-(cid:7079)नत(cid:7408)दन के कृ (cid:7004)य(cid:7298) के (cid:7079)नत ािग(cid:7271)कता और सम(cid:6981)न आ(cid:7408)द सन(cid:7013)मनलत है और ऐसे उपयु(cid:7334) (cid:7079)नत(cid:7408)(cid:7059)या(cid:7312) और साधन(cid:7298) को अंगीकृ त करेगा नसिम(cid:7286) उसके नलए संसाधन ुिटाना, र्न(cid:7275)पोषण आ(cid:7408)द भी सन(cid:7013)मनलत ह(cid:7289) ।

13. (cid:7079)ानधकरण, नलिा तटीय ोिन मानीटरी सनमनतय(cid:7298) के कृ (cid:7004)य(cid:7298) का ननयनमत (cid:7271)प से र्पु(cid:7414र्)लोकन करेगा।

14. (cid:7079)ानधकरण, सभी संब(cid:7373) योनिा (cid:7079)ानधका(cid:7407)रय(cid:7298), (cid:6979)े(cid:7074) अनभकरण(cid:7298), नलिा कले(cid:6989)टर(cid:7298) को भारत के रापि(cid:7074), असाधारण भाग-2 धारा-3, उप धारा (ii) म(cid:7286) (cid:7079)कानत अनधसूचना सं. का.आ. 19(अ) तारीख 6 र्निरी, 2011 के सभी उपबंध(cid:7298) के अनुपालन को सुननन(cid:7391)त करेगा और उ(cid:7016)लंघन(cid:7298) या अननुपालन के मामले म(cid:7286) समुनचत कार(cid:6981र्)ाई करने का ननदे देगा।

15. (cid:7079)ानधकरण, बि कभी र्आ(cid:7019)यकता हो, अ(cid:7008)य र्नेष(cid:6980) को बैठक के दौरान सद(cid:7021)य के (cid:7271)प म(cid:7286) आमंन(cid:7074)त करेगा औरर् ेतन और या(cid:7074)ा भ(cid:7275)ा, महगाई भ(cid:7275)ा, आसन (cid:7409)स, (cid:6979)े(cid:7074) दौरा (cid:7409)स आ(cid:7408)द ैिसे भ(cid:7275)े के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा र्नननन(cid:7391)त (cid:7408)कए गए संननयम(cid:7298) के अनुसार ह(cid:7298)गे।

16. उ(cid:6989)त अनधननयम क(cid:7409) घारा 5 के सा प(cid:7407)ठत भारत के रापि(cid:7074) असाधारण भाग-2 धारा-3, उप धारा (ii) म(cid:7286) (cid:7079)कानत अनधसूचना सं.

का.आ. 19 (अ) तारीख 6 र्निरी, 2011 के अधीन ननदे ािरी करने क(cid:7409) न(cid:7334)यां अ(cid:7007)य(cid:6979) और (cid:7079)ानधकरण के अ(cid:7007)य(cid:6979) को (cid:7079)(cid:7004)यायोनति क(cid:7409) ािती है ।

17. तटीय ोिन (cid:7079)बंध (cid:7079)ानधकरण(cid:7298) क(cid:7409) काय(cid:6981)(cid:7079)णाली म(cid:7286) (cid:7079)ाद(cid:7414)ता बनाए रखने के नलए तटीय ोिन (cid:7079)बंध (cid:7079)ानधकरण का यह उ(cid:7275)र दानय(cid:7004र्) होगा (cid:7408)कर् ह एक सम(cid:7414)पतर् ेबसाइट का सृनि करे और उस पर काय(cid:6981)सूची, काय(cid:6981र्)ृत, (cid:7408)कए गए र्ननन(cid:7391)य अनापन(cid:7275) प(cid:7074), उ(cid:7016)लंघन, उ(cid:7016)लघन(cid:7298) पर कार(cid:6981र्)ाई और (cid:7008)यायालय मामले नसिम(cid:7286) माननीय (cid:7008)यायालय के आदे स(cid:7013)मनलत ह(cid:7289) ता संबंनधत रा(cid:6996)य सरकार क(cid:7409) अनुमो(cid:7408)दत तटीय ोिन (cid:7079)बंध योनिा भी डालेगा।

18. (cid:7079)ानधकरण क(cid:7409) र्पू(cid:6981)गामी न(cid:7334)यां और कृ (cid:7004)य क(cid:7286) (cid:7008)(cid:7076)ीय सरकार के अधी(cid:6979)ण और ननयं(cid:7074)ण के अधीन ह(cid:7298)गे।

19. (cid:7079)ानधकरण का मु(cid:6990)यालय मोती दमन म(cid:7286) न(cid:7021)त होगा ।

20. अ(cid:7008)य मामला, ोि र्नन(cid:7020)टतया (cid:7079)ानधकरण के (cid:6979)े(cid:7074) या अनधका(cid:7407)रता के भीतर नह(cid:7277) आता, पर संब(cid:7373) कानूनी (cid:7079)ानधका(cid:7407)रय(cid:7298) (cid:7367)ारा र्नचार (cid:7408)कया ािएगा ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

ORDER

New Delhi, the 14th December, 2016

S.O. 4097(E).—Whereas by an order of the Government of India in the Ministry of Environment and Forests, number S.O. 2261(E), dated the 9th July, 2013, the Central Government constituted the Daman and Diu Coastal Zone Management Authority with effect from the date of publication of the said order in the Official Gazette and up to the 20th December, 2015;

And whereas, as the term of the said Authority has been expired, the Central Government is of the view that such an Authority should be reconstituted.

Now therefore, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act) and in supersession of the order number S.O. 2261 (E), dated the 9th July, 2013, except as respects thing done or omitted to be done before such supersession, the Central Government hereby reconstitutes the Daman and Diu Coastal Zone Management Authority (hereinafter referred to as the Authority) for a period of three years with effect from the date of publication of this order in the Official Gazette, consisting of the following persons, namely:-

2. The Authority shall have the power to take the following measures for protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in areas of the Union territory (UT) of Daman and Diu, namely:-

(i) examination of proposals for changes or modifications in classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan (CZMP) received from the Daman and Diu UT and making specific recommendations to the National Coastal Zone Management Authority;

(ii) (a) inquiry into cases of alleged violation of the provisions of the said Act or the rules made thereunder or any other law which is relatable to the objects of the said Act and, if found necessary in a specific case, issuing directions under section 5 of the said Act, insofar as such directions are not inconsistent with any direction issued in that specific case by the National Coastal Zone Management Authority or by the Central Government;

(b) review of cases involving violations of the provisions of the said Act and the rules made thereunder or under any other law which is relatable to the objects of the said Act, and if found necessary, referring such cases, with comments, for review to the National Coastal Zone Management Authority:

Provided that the cases under clauses (a) and (b) of this sub-paragraph may be taken up suo-moto or on the basis of complaint made by an individual or representative body or an organisation;

(iii) filing complaints under section 19 of the said Act, in cases of non-compliance of the directions issued by it under sub-paragraphs (i) and (ii) of this paragraph;

(iv) to take action under section 10 of the said Act to verify the facts concerning the issues arising from sub-paragraphs (i) and (ii) of this paragraph.

3. The Authority shall deal with environmental issues relating to Coastal Regulation Zone, which may be referred to it by the UT of Daman and Diu, the National Coastal Zone Management Authority or the Central Government.

4. The Authority shall identify ecologically sensitive areas in the Coastal Regulation Zone and formulate area-specific management plans for such identified areas.

5. The Authority shall identify coastal areas highly vulnerable to erosion or degradation and formulate area-specific management plans for such identified areas.

6. The Authority shall submit the plans prepared by it under paragraphs 4 and 5 above and modifications thereof, to the National Coastal Zone Management Authority for examination and its approval.

7. The Authority shall prepare and submit Coastal Regulation Zone maps of the coastal areas in the UT as per the procedure laid down in the notification of the Government of India in the Ministry of Environment and Forests number S.O. 19 (E), dated the 06th January, 2011, to the National Coastal Zone Management Authority and the Ministry of Environment, Forest and Climate Change.

8. The Authority shall ensure compliance of all specific conditions laid down in the approved Coastal Zone Management Plan for Daman and Diu UT.

9. The Authority shall furnish report of its activities at least once in six months to the National Coastal Zone Management Authority.

10. The Authority shall ensure that at least two third members of the Authority are present during the meetings.

11. The Union Territory Administration shall ensure that sufficient resources, manpower, funds are available to the Authority to discharge its functions effectively as specified in this order and the said Act.

12. The Authority shall take all necessary measures and initiatives including programme execution, research, information dissemination, training, awareness day to day functioning, and advocacy, etc. and adopt suitable procedures and means including raising resources, funding, etc., for the same.

13. The Authority shall regularly review the functioning of District Coastal Zone Monitoring Committees.

14. The Authority shall direct all concerned planning authorities, field agencies, District Collector to ensure compliance of the provisions of the notification of the Government of India in the Ministry of Environment and Forests number S.O. 19 (E), dated the 6th January, 2011 and take suitable action in case of violations or non- compliance.

15. The Authority, whenever required, shall invite other experts as members during its meetings and the pay and allowances such as traveling allowance, dearness allowance, sitting fees, Field visit fees, etc., shall be as per the norms decided by the Central Government.

16. The powers of issuing directions under section 5 of the said Act, read with the notification of the Government of India in the Ministry of Environment and Forests number S.O. 19 (E), dated the 6th January, 2011 are delegated to the Authority.

17. To maintain transparency in working of the Coastal Zone Management Authority, it shall be the responsibility of the Authority to create a dedicated website and post the agenda, minutes, decisions taken, clearance letters, violations, action taken on violations and court matters including the Orders of the Court and National Green Tribunal, and also the approved Coastal Zone Management Plan of the UT Administration.

18. The powers and functions of the Authority shall be subject to supervision and control of the Central Government.

19. The Authority shall have its headquarters at Moti Daman.

20. Any matter specifically not falling within the scope and jurisdiction of the Authority shall be dealt with by the statutory authorities concerned.
