काकाकाका....आआआआ.... 4116411641164116(अअअअ).—केन्द्रीय सरकार ने कोयला धारक क्षेत्र (अर्जन और विकास) अधिनियम, 1957 (1957 का 20), (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 7 की उप -धारा (1) के अधीन जारी, भारत सरकार के कोयला मंत्रालय की अधिसूचना संख्याक का.आ. 2318(अ), तारीख 4 जुलाई, 2016, जो भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii), तारीख 6 जुलाई, 2016 प्रकाशित की गई थी, उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट परिक्षेत्र की 64.43 हेक्टेयर (लगभग) या 159.20 एकड ़(लगभग) ऐसी भूमि में के और उस पर के सभी अधिकारों के अर्जन के अपने आशय की सूचना दी थी;

और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 8 के अनुसरण में केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ।

और केन्द्रीय सरकार का पूर्वोक्त रिपोर्ट पर विचार करने के पश्चात्‌ और झारखण्ड सरकार से परामर्श करने के पश्चात्‌ यह समाधान हो गया है कि इससे उपाबंध अनुसूची में वर्णित 64.43 हेक्टेयर (लगभग) या 159.20 एकड़ (लगभग) माप वाली भूमि में या उस पर के सभी अधिकारों का अर्जन किया जाना चाहिए;

अतः, अब, केन्द्रीय सरकार उक्त अधिनियम की धारा 9 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि उक्त अनुसूची में यथा वर्णित 64.43 हेक्टेयर (लगभग) या 159.20 एकड़ (लगभग) माप वाली भूमि में या उस पर के सभी अधिकार अर्जित किये जाते हैं ।

इस अधिसूचना के अधीन आने वाले संपूर्ण क्षेत्र के रेखांक संख्या पीबीसीएमपी/सीबीए/फेज-VI/सेक्शन-9/16/01, तारीख 19 सितम्बर, 2016 का निरीक्षण उपायुक्त, जिला हजारीबाग (झारखण्ड) के कार्यालय में या कोयला नियंत्रक, 1, काउसिल हाऊस स्ट्रीट, कोलकाता-700001 के कार्यालय में या महाप्रबंधक, पकरी बरवाडीह कोल माईनिंग परियोजना, एनटीपीसी लिमिटेड, उज्जवल काम्पलेक्स, पगमिल रोड, हजारीबाग, झारखण्ड़-825301 के कार्यालय में या अतिरिक्त महाप्रबंधक (कोयला खनन), एनटीपीसी भवन, स्कोप काम्प्लेक्स, 7, इंस्टीट्‌यूशनल एरिया, लोधी रोड़, नई दिल्ली-110003 के कार्यालय में किया जा सकता है।

(2) रेखा क1- क2ः यह रेखा, ग्राम कण्डाबेर के उत्तर-पश्चिम कोने से में स्थित बिन्दु 'क1' प्लॉट संख्याक 375 से प्रारम्भ होकर, उत्तर-पूर्व दिशा में बढ़ती हुई उक्त गांव के प्लाट संख्याक 484, 430, 431, 439, 441, 48, 443, 271, 272, 269, 275, 118, 147, 146, 141, 140, 159, 163, 165, 166, 167 और 168 से गुजरती है और उक्त बिन्दु 'क2' ग्राम कण्डाबेर और नावाडीह की सीमा पर समाप्त होती है।

(11) रेखा क10- क11ः यह रेखा, ग्राम सिरमा के दक्षिण कोने में स्थित बिन्दु 'क10' से प्रारम्भ होकर, उत्तर-पश्चिम दिशा से बढ़ती हुई उक्त गांव में नाला के मध्य रेखा के प्लाट संख्या 634 से गुजरती है और उक्त बिन्दु 'क11' ग्राम उरूब और सिरमा की सीमा पर समाप्त होती है।

NOTIFICATION

New Delhi, the 21st December, 2016

S.O. 4116(E).—Whereas, by the notification of the Government of India in the Ministry of Coal number S.O. 2318(E), dated the 4th July, 2016, issued under sub-section (1) of section 7 of the Coal Bearing Area (Acquisition and Development ) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) and published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 6th July, 2016, the Central Government gave notice of its intention to acquire 64.43 hectares (approximately) or 159.20 acres (approximately) lands and all rights in or over such lands specified in the Schedule annexed to that notification;

And, whereas, the competent authority in pursuance of section 8 of the said Act has made his report to the Central Government;

And, whereas, the Central Government, after considering the report aforesaid and after consulting the Government of Jharkhand, is satisfied that the lands measuring 64.43 hectares (approximately) or 159.20 acres (approximately) and all rights in or over such lands as described in the Schedule appended hereto, should be acquired;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 9 of the said Act, the Central Government hereby declares that the lands measuring 64.43 hectares (approximately) or 159.20 acres (approximately) and all rights in or over such lands as described in the Schedule are hereby acquired.

The plan bearing number PBCMP/CBA/PH-VI/SEC-9/16/01, dated the 19th September, 2016 of the area covered by this notification may be inspected in the office of the Deputy Commissioner, District Hazaribagh (Jharkhand) or in the office of the Coal Controller, 1, Council House Street, Kolkata-700001, or in the Office of the General Manager, Pakri Barwadih Coal Mining Project, NTPC Limited, Ujjwal Complex, Pugmil, Post Office–Hazaribagh, District- Hazaribagh, Jharkhand – 825301 or in the office of the Additional General Manager (Coal Mining) , NTPC Bhawan, Scope Complex, 7, Institutional Area, Lodhi Road, New Delhi-110003.
