का.आका.आका.आका.आ....4127412741274127 (अ)(अ)(अ)(अ) .—राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण, भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी का. आ. 1394(अ) तारीख 30 मई, 2013 और का.आ. 701(अ) तारीख 10 मार्च, 2016 के साथ पठित औषध (कीमत नियंत्रण) आदेश, 2013 के पैरा 4, 10, 11, 14, 16, 17 और 18 द्वारा प्रदत्त शक्तियों का प्रयोग करते 2ए, तथा भारत सरकार के रसायन और उर्वरक मंत्रालय, राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण (संक्षिप्त रूप में एनपीपीए है), नीचे की सारणी के स्तंभ (5) में विनि;दष्ट तत्काल प्रभावी अधिकतम कीमत और उक्त सारणी के स्तंभ (3) और (4) में की ?मशः तत्स्थानी प्रविष्टियों में विनि;दष्ट प्रबलता और इकाई (यूनिट) सहित उस सारणी के स्तंभ (2) में की तत्स्थानी प्रविष्टि में विनि;दष्ट अनुसूचित विनिDमतियों में से प्रत्येक की, स्थानीय कर, यदि कोई है, को छोड़कर अधिकतम कीमत के Gप में नियत करती है।

नोटनोटनोटनोट::::
(क) सरकार द्वारा इस प्रकार नियत की गई और अधिसूचित की गई अधिकतम कीमत (धन स्थानीय कर, जो लागू हों) से अधिक कीमत पर अनुसूचित विनिDमतियों के ब्रांडेड या जेनेरिक या दोनों रूपांतरों को बेच रहे अनुसूचित विनिDमतियों के सभी विनिर्माता, उपयु र्क्त सारणी के स्तंभ (5) में वDणत अधिकतम कीमत (धन स्थानीय कर, जो लागू हों) से अधिक सभी ऐसी विनिDमतियों की कीमत का अधोमुखी पुनरीक्षण करेंगे।
(ख) सभी मौजूदा निर्माताओं को उपयु र्क्त कथित अनुसूचित विनिDमतियों के अधिकतम खुदरा कीमत उपयु र्क्त सारणी के स्तंभ (5) में विनि;दष्ट अधिकतम कीमत स्थानीय कर सहित से कम है तो, जहां कही भी लागू हो, औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 13(2) के अनुसार उसको मौजूदा अधिकतम खुदरा कीमत को बनाए रखना होगा।
(ग) अगर निर्माताओं ने उपयु र्क्त सारणी के स्तंभ (5) में वDणत अधिकतम कीमत पर सरकार को वास्तव में भुगतान किया है या यह देय है तो वे स्थानीय करों को जोड़ सकते है।
(घ) औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 11 में दिए गए प्रावधानों के तहत सम्बन्धित निर्माताओं को उपयु र्क्त सारणी के स्तंभ (5) में विनि;दष्ट अधिकतम कीमत के आधार पर अनुसूचित विनिDमतियों के पैकों के लिए अधिकतम कीमत निर्धारित करें। निर्माता औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 24 के तहत फॉर्म V में अधिसूचना की तारीख से आईपीडीएमएस के माध्यम से भरकर एनपीपीए को एक मूल्य सूची जारी करें। तथा उसकी कॉपी राज्य औशधि नियंत्रकों और विनिर्माता वितरक को जारी करें।
(ड.) औषध (मूल्य नियंत्रण) आदेश, 2013 के 24 (4) के उपबंधों के अनुसार प्रत्येक फु टकर वि?े ता और वितरक विनिर्माता द्वारा दिए गए रूप में ऐसे परिसर, जहां कारबार को इस प्रकार किया जा रहा है कि उससे परामर्श के इ[छु क किसी \क्ति के लिए प2ंच आसान हो, वहां उसके किसी सहजदृश्य भाग पर कीमत सूची और पूरक सूची, यदि कोई हो, को संप्रदDषत करेगा।
(च) उपयु र्क्त सारणी के स्तंभ (5) में विनि;दष्ट अधिकतम कीमत के लिए विनि;दष्ट अनुसूचित विनिDमतियों के विनि;दष्ट विभिन्न तरीके और प्रबलता से भिन्न अगर मौजूदा निर्माताओं द्वारा एक नई औषधि को लांच करता है तो उसे पहले औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 2(न) के अनुसार औषध (मूल्य नियंत्रण) आदेश, 2013 के तहत सूची II में विनि;दष्ट फार्म प् के माध्यम से एनपीपीए में मूल्य निर्धारण हेतु आवेदन करना होगा।
(छ) उपयु र्क्त अनुसूचित विनिDमतियों की उत्पादन/आयात और बि?ी के सम्बन्ध में निर्माताओं को औषध (मूल्य नियंत्रण) आदेश, 2013 के
र्क्त अनुसूचित सूची II के फॉर्म III को आईपीडीएमएस के माध्यम से भरकर एनपीपीए को हर तिमाही की रिपोर्ट प्रस्तुत करेगा। उपयु विनिDमतियों के निर्माण को कोई निर्माता उत्पादन बन्द करने का इ[छु क हो तो इसकी सूचना एनपीपीए को अवगत करायेगा। इसके सम्बन्ध में अगर अनुसूचित विनिDमतियों के उत्पादन और आयात को बन्द करने का इ[छु क है तो बन्द करने की तिथि से छः महीने पहले सूची प्प् के फॉर्म प्ट में भरकर एनपीपीए को प्रस्तुत करेगा।
(ज) विनिर्माता या विपणन कम्पनी, उपरोक्त कथित सारणी में दर्शाये अधिकतम मूल्य और शतb का पालन नहc करती हैं तो वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डीपीसीओ, 2013 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे।
(झ) इस आदेश में उपरोक्त सारणी के स्तंभ (2) में की तत्स्थानी प्रविष्टि में विनि;दष्ट ऐसी विनिDमतियों के पैकों की अधिकतम कीमत नियत होने के परिणामस्वGप, अिधकतम और खुदरा मूल्य निर्धारित आदेश यदि कोई हो, जो कि इस आदेश से पूर्व जारी 2ए है, स्वतः ही अधि?मण हो जायेंगे।

New Delhi, the 22nd December, 2016
S.O. 4127 (E).—In exercise of the powers conferred by paragraphs 4, 6, 10, 11, 14, 16, 17 and 18 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated the 30th May, 2013 and S.O. 701(E) dated 10th March, 2016 issued by the Government of India in the Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority (hereinafter referred as NPPA) hereby fixes the prices as specified in column (5) of the table herein below as ceiling price exclusive of local tax applicable, if any, in respect of the Scheduled formulations specified in the corresponding entry in column (2) of the said Table with the strength and unit specified respectively in the corresponding entries in columns (3) and (4) thereof:

Note : (a) All manufacturers of scheduled formulations, selling the branded or generic or both the versions of scheduled formulations at a price higher than the ceiling price (plus local taxes as applicable) so fixed and notified by the Government, shall revise the prices of all such formulations downward not exceeding the ceiling price specified in column (5) in the above table plus local taxes as applicable, if any.
(b) All the existing manufacturers of above mentioned scheduled formulations having MRP lower than the ceiling price specified in column (5) in the above table plus local taxes as applicable, if any, shall continue to maintain the existing MRP in accordance with paragraph 13 (2) of the DPCO, 2013.
(c) The manufacturers may add local taxes only if they have paid actually or if it is payable to the Government on the ceiling price mentioned in column (5) of the above said table.
(d) The ceiling price for a pack of the scheduled formulation shall be arrived at by the concerned manufacturer in accordance with the ceiling price specified in column (5) of the above table as per provisions contained in paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issue a price list in Form–V from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers.
(e) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same.
(f) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in the above table launches a new drug as per paragraph 2 (u) of the DPCO, 2013 such existing manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I as specified under Schedule-II of the DPCO, 2013.
(g) The manufacturers of above said scheduled formulations shall furnish quarterly return to the NPPA, in respect of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO, 2013 through IPDMS. Any manufacturer intending to discontinue production of above said scheduled formulation shall furnish information to the NPPA, in respect of discontinuation of production and / or import of scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation. (h) The manufacturers not complying with the ceiling price and notes specified hereinabove shall be liable to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Prices Control) Order, 2013 read with Essential Commodities Act, 1955.
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)](i) Consequent to the issue of ceiling price of such formulation as specified in column (2) of the above table in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of notification, stand(s) superseded.

6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)](ख) सभी मौजूदा निर्माताओं को उपयु र्क्त कथित अनुसूचित विनिDमतियों के अधिकतम खुदरा कीमत उपयु र्क्त सारणी के स्तंभ (5) में विनि;दष्ट अधिकतम कीमत स्थानीय कर सिहत से कम है तो, जहां कही भी लागू हो, औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 13(2) के अनुसार उसको मौजूदा अधिकतम खुदरा कीमत को बनाए रखना होगा।
(ग) अगर निर्माताओं ने उपयु र्क्त सारणी के स्तंभ (5) में वDणत अधिकतम कीमत पर सरकार को वास्तव में भुगतान किया है या यह देय है तो वे स्थानीय करों को जोड़ सकते है।
(घ) औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 11 में दिए गए प्रावधानों के तहत सम्बन्धित निर्माताओं को उपयु र्क्त सारणी के स्तंभ (5) में विनि;दष्ट अधिकतम कीमत के आधार पर अनुसूचित विनिDमतियों के पैकों के लिए अधिकतम कीमत निर्धारित करें। निर्माता औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 24 के तहत फॉर्म V में अधिसूचना की तारीख से आईपीडीएमएस के माध्यम से भरकर एनपीपीए को एक मूल्य सूची जारी करें। तथा उसकी कॉपी राज्य औशधि नियंत्रकों और विनिर्माता वितरक को जारी करें।
(ड.) औषध (मूल्य नियंत्रण) आदेश, 2013 के 24 (4) के उपबंधों के अनुसार प्रत्येक फु टकर वि?े ता और वितरक विनिर्माता द्वारा दिए गए रूप में ऐसे परिसर, जहां कारबार को इस प्रकार किया जा रहा है कि उससे परामर्ष के इ[छु क किसी \क्ति के लिए प2ंच आसान हो, वहां उसके किसी सहजदृष्य भाग पर कीमत सूची और पूरक सूची, यदि कोई हो, को संप्रदDषत करेगा।
(च) उपयु र्क्त सारणी के स्तंभ (5) में विनि;दष्ट अधिकतम कीमत के लिए विनि;दष्ट अनुसूचित विनिDमतियों के विनि;दष्ट विभिन्न तरीके और प्रबलता से भिन्न अगर मौजूदा निर्माताओं द्वारा एक नई औषधि को लांच करता है तो उसे पहले औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 2(न) के अनुसार औषध (मूल्य नियंत्रण) आदेश, 2013 के तहत सूची II में विनि;दष्ट फार्म I के माध्यम से एनपीपीए में मूल्य निर्धारण हेतु आवेदन करना होगा।
(छ) उपयु र्क्त अनुसूचित विनिDमतियों की उत्पादन/आयात और बि?ी के सम्बन्ध में निर्माताओं को औषध (मूल्य नियंत्रण) आदेश, 2013 के सूची प्प् के फॉर्म प्प्प् को आईपीडीएमएस के माध्यम से भरकर एनपीपीए को हर तिमाही की रिपोर्ट प्रस्तुत करेगा। उपयु र्क्त अनुसूचित विनिDमतियों के निर्माण को कोई निर्माता उत्पादन बन्द करने का इ[छु क हो तो इसकी सूचना एनपीपीए को अवगत करायेगा। इसके सम्बन्ध में अगर अनुसूचित विनिDमतियों के उत्पादन और आयात को बन्द करने का इ[छु क है तो बन्द करने की तिथि से छः महीने पहले सूची प्प् के फॉर्म प्ट में भरकर एनपीपीए को प्रस्तुत करेगा।
(ज) विनिर्माता या विपणन कम्पनी, उपरोक्त कथित सारणी में दर्शाये अधिकतम मूल्य और शतb का पालन नहc करती हैं तो वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डीपीसीओ, 2013 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित रािश को जमा करने के िलए दायी होंगे।
(झ) इस आदेश में उपरोक्त सारणी के स्तंभ (2) में की तत्स्थानी प्रविष्टि में विनि;दष्ट ऐसी विनिDमतियों के पैकों की अधिकतम कीमत नियत होने के परिणामस्वGप, अधिकतम और खुदरा मूल्य निर्धारित आदेश यदि कोई हो, जो कि इस आदेश से पूर्व जारी 2ए है, स्वतः ही अधि?मण हो जायेंगे।

S.O. 4128(E).—In exercise of the powers conferred by paragraphs 4, 6, 10, 11, 14, 16, 17 and 18 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated the 30th May, 2013 and S.O. 701(E) dated 10th March, 2016 issued by the Government of India in the Ministry of Chemicals and Fertilizers, and in supersession of the Order of the Government of India in the Ministry of Chemicals and Fertilizers (National Pharmaceutical Pricing Authority) No. S.O. 644(E), dated 2nd March, 2016, in so far as it relates to formulation packs mentioned in the table below, except in respect of things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority, hereby fixes the price as specified in column (5) of the table herein below as ceiling price exclusive of local tax applicable, if any in respect of the Scheduled formulations specified in the corresponding entry in column (2) of the said Table with the strength and unit specified respectively in the corresponding entries in columns (3) and (4) thereof:

Note:
(a) All manufacturers of scheduled formulations, selling the branded or generic or both the versions of scheduled formulations at a price higher than the ceiling price (plus local taxes as applicable) so fixed and notified by the Government, shall revise the prices of all such formulations downward not exceeding the ceiling price specified in column (5) in the above table plus local taxes as applicable, if any.
(b) All the existing manufacturers of above mentioned scheduled formulations having MRP lower than the ceiling price specified in column (5) in the above table plus local taxes as applicable, if any, shall continue to maintain the existing MRP in accordance with paragraph 13 (2) of the DPCO, 2013.
(c) The manufacturers may add local taxes only if they have paid actually or if it is payable to the Government on the ceiling price mentioned in column (5) of the above said table.
(d) The ceiling price for a pack of the scheduled formulation shall be arrived at by the concerned manufacturer in accordance with the ceiling price specified in column (5) of the above table as per provisions contained in paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issue a price list in Form–V from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers.
(e) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same.
(f) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in the above table launches a new drug as per paragraph 2 (u) of the DPCO, 2013 such existing manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I as specified under Schedule-II of the DPCO, 2013.
(g) The manufacturers of above said scheduled formulations shall furnish quarterly return to the NPPA, in respect of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO, 2013 through IPDMS. Any manufacturer intending to discontinue production of above said scheduled formulation shall furnish information to the NPPA, in respect of discontinuation of production and / or import of scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation.
(h) The manufacturers not complying with the ceiling price and notes specified hereinabove shall be liable to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Prices Control) Order, 2013 read with Essential Commodities Act, 1955.
(i) Consequent to the issue of ceiling prices of such formulations as specified in column (2) of the above table in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of notification, stand(s) superseded.

उर्वरक मंत्रालय द्वारा जारी का. आ. 1394(अ) तारीख 30 मई, 2013 और का. आ. 701(अ) तारीख 10 मार्च, 2016 के साथ पठित

(छ) उपयु र्क्त अनुसूचित विनिDमतियों की उत्पादन/आयात और बि?ी के सम्बन्ध में निर्माताओं को औषध (मूल्य नियंत्रण) आदेश, 2013 के

(f) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in the above table launches a new drug as per paragraph 2 (u) of the DPCO, 2013 such existing manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I as specified under Schedule-II of the DPCO, 2013. (g) The manufacturers of above said scheduled formulations shall furnish quarterly return to the NPPA, in respect of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO, 2013 through IPDMS. Any manufacturer intending to discontinue production of above said scheduled formulation shall furnish information to the NPPA, in respect of discontinuation of production and / or import of scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation.
(h) The manufacturers not complying with the ceiling price and notes specified hereinabove shall be liable to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Prices Control) Order, 2013 read with Essential Commodities Act, 1955.
(i) Consequent to the issue of ceiling prices of such formulations as specified in column (2) of the above table in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of notification, stand(s) superseded.

(घ) औषध (मूल्य नियंत्रण) आदेश, 2013 के 24 (4) के उपबंधों के अनुसार प्रत्येक फु टकर वि?े ता और वितरक विनिर्माता द्वारा दिए गए रूप में ऐसे परिसर, जहां कारबार को इस प्रकार किया जा रहा है कि उससे परामर्श के इ[छु क किसी \क्ति के लिए प2ंच आसान हो, वहां उसके किसी सहजदृश्य पर कीमत सूची और पूरक सूची, यदि कोई हो, को संप्रदDशत करेगा।
(ड.) उपयु र्क्त गैर अधिकत कीमत (खुदरा मूल्य) के वल उपयु र्क्त निर्माता/विपणन के लिए लागू है जैसा कि उन्होंने औषध (मूल्य नियंत्रण) आदेश, 2013 के तहत अनुबs मूल्य निर्धारण/संशोधन के लिए फॉर्म I पर जमा किया गया था और सरकार द्वारा निर्धारित सभी लागू वैधानिक आवश्यकताओं की पूDत के अधीन प्रासंगिक विधियों/नियमों के अन्तर्गत जैस कि के न्tीय/राज्य लाइसेसिग ऑथिरिटी के सक्षम प्राधिकारी द्वारा मेन्यूफे क्चuरग लाइसेंस मंजूरी के तहत संबंधित विनिDमत निर्माता/विपणन कम्पनियां जो अनुपालन करती है।
(च) उपयु र्क्त विनिDमतियों की उत्पादन/आयात और बि?ी के सम्बन्ध में सम्बन्धित निर्माताओं को औषध (मूल्य नियंत्राण) आदेश, 2013 के
र्क्त विनिDमतियों के सूची II के फॉर्म III को आईपीडीएमएस के माध्यम से भरकर एनपीपीए को हर तिमाही की रिपोर्ट प्रस्तुत करेगा। उपयु निर्माण को कोई निर्माता उत्पादन बन्द करने का इ[छु क हो तो इसकी सूचना एनपीपीए को अवगत करायेगा। इसके सम्बन्ध में अगर विनिDमतियों के उत्पादन और आयात को बन्द करने का इ[छु क है तो बन्द करने की तिथि से छः महीने पहले सूची II के फॉर्म IV में भरकर एनपीपीए को प्रस्तुत करेगा।

S.O.4130(E).— In implementation of directions given in line with review order issued vide letter no. 31015/3/2016-PI.I dated 22.7.2016 passed by the Department of Pharmaceuticals and in exercise of the powers conferred by paragraphs 5, 11, and 15 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated the 30th May, 2013 and S.O. 701(E) dated 10th March, 2016 issued by the Government of India in the Ministry of Chemicals and Fertilizers, and in supersession of the Order of the Government of India in the Ministry of Chemicals and Fertilizers (National Pharmaceutical Pricing Authority) No. S.O. 583(E), dated 24th February, 2016 regarding formulation pack mentioned in the table at Sl. No. 25 , in so far as it relates to formulation pack mentioned in the table below, except in respect of things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority, hereby fixes the price as specified in column (5) of the table herein below as retail price exclusive of local tax applicable, if any in respect of the Scheduled formulation specified in the corresponding entry in column (2) of the said Table with the strength and unit specified respectively in the corresponding entries in columns (3) and (4) thereof:

Note : (a) The manufacturers of above mentioned formulations i.e. "new drug" under paragraph 2(u) of the DPCO, 2013 shall fix the retail price as specified in column (6) of the table hereinabove.
(b) The manufacturers may add local taxes only if they have paid actually or it is payable to the Government on the retail price mentioned in column (6) of the above said table.
(c) The retail price for a pack of the aforesaid formulation shall be arrived at by the concerned manufacturers in accordance with the retail price specified in column (6) of the above table as per provisions contained in paragraph 11 of the DPCO, 2013. The manufacturers shall issue a price list in Form–V from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers.
(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same.
(e) The above mentioned retail price is applicable only to the individual manufacturers / marketeers as mentioned above i.e. who have applied for the same by submitting Form-I for price fixation / revision as stipulated under DPCO, 2013 and subject to fulfillment of all the applicable statutory requirements as laid down by the Govt. under relevant statutes/ rules, including manufacturing license permission from the Competent Authority i.e. the Central/State Licensing Authority, as may be applicable, by the concerned manufacturers/marketing companies.
(f) The concerned manufacturers of above said formulations shall furnish quarterly return to the NPPA, in respect of production/import and sale of product in Form-III of Schedule-II of the DPCO, 2013 through IPDMS. Manufacturers, in case intending to discontinue above said formulations, shall furnish information to the NPPA, in respect of discontinuation of the production and / or import of above said formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation.

(क) विनिर्माता उपयु र्क्त दी गई विनिदिष्ट फॉमू र्लेशन जो "नई pग" डीपीसीओ, 2013 के पैराJाफ 2(न) के तहत उपयु र्क्त दी गई सारणी के स्तंभ (6) में विनि;दष्ट खुदरा मूल्य निर्धारित करेंगे।
(ख) अगर निर्माताओं ने उपयु र्क्त सारणी के स्तंभ (6) में वDणत अधिकतम कीमत पर सरकार को वास्तव में भुगतान किया है या यह देय है तो वे स्थानीय करों को जोड़ सकते है।
(ग) औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 11 में दिए गए प्रावधानों के तहत निर्माताओं को उपयु र्क्त सारणी के स्तंभ (6) में विनि;दष्ट खुदरा मूल्य के आधार पर अनुसूचित विनिDमतियों के पैकों के लिए खुदरा मूल्य निर्धारित करें। निर्माता औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराJाफ 24 के तहत फॉर्म V में अधिसूचना की तारीख से एक मूल्य सूची एनपीपीए को आईपीडीएमएस के माध्यम से जारी करें। तथा उसकी कॉपी राज्य औशधि नियंत्रकों और विनिर्माता वितरक को जारी करें।
(घ) औषध (मूल्य नियंत्रण) आदेश, 2013 के 24 (4) के उपबंधों के अनुसार प्रत्येक फु टकर वि?े ता और वितरक विनिर्माता द्वारा दिए गए रूप में ऐसे परिसर, जहां कारबार को इस प्रकार किया जा रहा है कि उससे परामर्ष के इ[छु क किसी \क्ति के लिए प2ंच आसान हो, वहां उसके किसी सहजदृश्य भाग पर कीमत सूची और पूरक सूची, यदि कोई हो, को संप्रदDशत करेगा।
(ड.) उपयु र्क्त गैर अधिकतम कीमत (खुदरा मूल्य) के वल उपयु र्क्त निर्माता/विपणन के लिए लागू है जैसा कि उन्होंने औषध (मूल्य नियंत्रण)
आदेश, 2013 के तहत अनुबs मूल्य निर्धारण/संशोधन के लिए फॉर्म I पर जमा किया गया था और सरकार द्वारा निर्धारित सभी लागू वैधानिक आवश्यकताओं की पूDत के अधीन प्रासंगिक विधियों/नियमों के अन्तर्गत जैसा कि के न्tीय/राज्य लाइसेसिग ऑथोरिटी के सक्षम प्राधिकारी द्वारा मेन्यूफे क्चuरग लाइसेंस मंजूरी के तहत संबंधित विनिDमत निर्माता/विपणन कम्पनियां जो अनुपालन करती है।

र्क्त विनिDमतियों के सूची II के फॉर्म III को आईपीडीएमएस के माध्यम से भरकर एनपीपीए को हर तिमाही की रिपोर्ट प्रस्तुत करेगा । उपयु निर्माण को कोई निर्माता उत्पादन बन्द करने का इ[छु क हो तो इसकी सूचना एनपीपीए को अवगत करायेगा । इसके सम्बन्ध में अगर विनिDमतियों के उत्पादन और आयात को बन्द करने का इ[छु क है तो बन्द करने की तिथि से छः महीने पहले सूची II के फॉर्म IV में भरकर एनपीपीए को प्रस्तुत करेगा।
(छ) विनिर्माता या विपणन कम्पनी, उपरोक्त विनिDमतियों और विनि;दष्ट शतb का पालन नहc करती हैं तो वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डीपीसीओ, 2013 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे।
(ज) इस आदेश में उपरोक्त सारणी के स्तंभ (2) में की तत्स्थानी प्रविष्टि में विनि;दष्ट विनिDमतियों के पैकों की खुदरा मूल्य नियत होने के परिणामस्वरूप, आदेश जो कि इस आदेश से पूर्व जारी 2ए हैं, स्वतः ही निरस्त हो जायेंगे।

S.O.4131(E).—In exercise of the powers conferred by paragraphs 5, 11 and 15 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E), dated the 30th May, 2013 and S. O. 701(E), dated 10th March, 2016 issued by the Government of India in the Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority (hereinafter referred as NPPA), hereby fixes, the price as specified in column (6) of the table herein below as the retail price, exclusive of local taxes, if any, in relation to the formulation specified in the corresponding entry in column (2) of the said Table with the strength, unit and name of manufacturer & marketing company respectively, as specified in the corresponding entries in columns (3), (4) and (5) thereof;

(a) The manufacturers of above mentioned formulations i.e. "new drug" under paragraph 2(u) of the DPCO, 2013 shall fix the retail price as specified in column (6) of the table hereinabove.
(b) The manufacturers may add local taxes only if they have paid actually or it is payable to the Government on the retail price mentioned in column (6) of the above said table.
(c) The retail price for a pack of the aforesaid formulation shall be arrived at by the concerned manufacturers in accordance with the retail price specified in column (6) of the above table as per provisions contained in paragraph 11 of the DPCO, 2013. The manufacturers shall issue a price list in Form–V from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers.
(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same.
(e) The above mentioned retail price is applicable only to the individual manufacturers/marketeers as mentioned above i.e. who have applied for the same by submitting Form-I for price fixation /revision as stipulated under DPCO, 2013 and subject to fulfillment of all the applicable statutory requirements as laid down by the Govt. under relevant statutes/ rules, including manufacturing license permission from the Competent Authority i.e. the Central/State Licensing Authority, as may be applicable, by the concerned manufacturers/marketing companies.
(f) The concerned manufacturers of above said formulations shall furnish quarterly return to the NPPA, in respect of production / import and sale of product in Form-III of Schedule-II of the DPCO, 2013 through IPDMS.
Manufacturers, in case intending to discontinue above said formulations, shall furnish information to the NPPA, in respect of discontinuation of the production and/or import of above said formulation in Form-IV of Schedule- II of the DPCO, 2013 at least six months prior to the intended date of discontinuation.
(g) In case the retail price of any of the aforesaid formulations is not complied with, as per instant price notification and notes specified hereinabove, then the concerned manufacturer/marketing company shall be liable to deposit the overcharged amount along with the interest thereon under the provisions of the DPCO, 2013 read with the Essential Commodities Act, 1955.
(h) Consequent to the issue of retail price of the aforesaid formulations as specified in column (2) of the above mentioned table in this notification, the price order(s) if any, issued for concerned manufacturer / marketer prior to the above said date of notification, stand(s) superseded.
