और रा(cid:7020)(cid:7069)ीय तटीय (cid:6979)े(cid:7074) (cid:7079)बंध (cid:7079)ानधकरण ने 16 ुिलाई, 2012 को (cid:7263)ई अपनी बैठक म(cid:7286) इस र्नषय क(cid:7409) समी(cid:6979)ा क(cid:7409) और उ(cid:6989)त (cid:7079)ानधकरण ने र्नचार-र्नम(cid:6981) करने के प(cid:7019)चात् उ(cid:6989)त अनधसूचना, 2011 म(cid:7286) संोधन क(cid:7409) नसा(cid:7407)र करने का र्ननन(cid:7019)चय (cid:7408)कया ;
और क(cid:7286) (cid:7076)ीय सरकार क(cid:7409) यह राय है (cid:7408)क उ(cid:6989)त अनधसूचना का संोधन (cid:7408)कया ािना चानहए ;
और पया(cid:6981र्)रण (संर(cid:6979)ण) ननयम, 1986 के ननयम 5 के उपननयम (4) के उपबंध को (cid:7007)यान म(cid:7286) रखते (cid:7263)ए, क(cid:7286) (cid:7076)ीय सरकार क(cid:7409) यह राय है (cid:7408)क उ(cid:6989)त अनधसूचना का संोधन करने के नलए उ(cid:6989)त ननयम के ननयम 5 के उपननयम (3) के खंड (क) के अधीन सूचना क(cid:7409) अपे(cid:6979)ा से अनभमु(cid:6989)त करना लोकनहत म(cid:7286) है ;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अत: अब, क(cid:7286) (cid:7076)ीय सरकार, पया(cid:6981र्)रण (संर(cid:6979)ण) ननयम, 1986 के ननयम 5 के उपननयम (3) और उपननयम (4) के सा प(cid:7407)ठत पया(cid:6981र्)रण (संर(cid:6979)ण) अनधननयम, 1986 (1986 का 29) क(cid:7409) धारा 3 क(cid:7409) उपधारा (1) और उपधारा (2) के खंड (v) (cid:7367)ारा (cid:7079)द(cid:7004)त न(cid:6989)तय(cid:7298) का (cid:7079)योग करते (cid:7263)ए र्पू(cid:7299)(cid:6989)त अनधसूचना म(cid:7286) नन(cid:7013)ननलनखत संोधन करती है, अा(cid:6981)त् :--
उ(cid:6989)त तटीय र्नननयमन खंड क(cid:7409) अनधसूचना, 2011 के पैरा 8 के उपपैरा ''(v) ऐसे (cid:6979)े(cid:7074) ननि पर र्नेष (cid:7007)यान देने क(cid:7409) र्आ(cid:7019)यकता है,-'' म(cid:7286) ''1.ऐसे सीआरेिड (cid:6979)े(cid:7074), ोि (cid:7061)ेटर मु(cid:7013)बई के नगरपानलका के अनधकार (cid:6979)े(cid:7074) म(cid:7286) आता है'' ीष(cid:6981)क के अधीन, ''(iii) सीआरेिड-II (cid:6979)े(cid:7074)(cid:7298) म(cid:7286)-'' उपीष(cid:6981)क के अधीन, मद ()ि के प(cid:7019)चात् नन(cid:7013)ननलनखत मद अंत:(cid:7021)ानपत क(cid:7409) ािएगी, अा(cid:6981)त् :-- ''(झ) इ(cid:7008)दू 6 नम(cid:7016)स भूनम पर मु(cid:7013)बई म(cid:7286) भारत र(cid:7004)न डा. बाबा साहेब अ(cid:7013)बेडकर के स(cid:7013)मान म(cid:7286) (cid:7021)मारक के संननमा(cid:6981)ण को लागू नगर और (cid:7061)ाम योनिा र्नननयम के अनुसार औ(cid:7378)ोनगक उपयोग से (cid:7021)मारक के संननमा(cid:6981)ण के नलए भू उपयोग म(cid:7286) प(cid:7407)र्रत(cid:6981)न करने को अनु(cid:6980)ात (cid:7408)कया ािएगा ।''

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE
NOTIFICATION
New Delhi, the 23rd December, 2016
S.O. 4162(E).—Whereas, by the notification of the Government of India in the Ministry of Environment and Forests vide number S.O.19(E), dated the 6th January, 2011 (hereinafter referred to as the said notification), the Central Government declared coastal stretches as Coastal Regulation Zone, and restrictions were imposed on setting up and expansion of industries, operations and processes in the said zone;
And whereas, the State Government of Maharashtra has requested the Maharashtra Coastal Zone Management Authority to incorporate special provisions in the said notification, 2011 to enable development of 'Memorial of Dr. Babasaheb Ambedkar' on Indu 6 Mills land in Mumbai;
And whereas, the issue was earlier examined by the Maharashtra Coastal Zone Management Authority in its meeting held on the 23th April, 2011 and recommended for amendment to the said notification, 2011;
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 3And whereas, the National Coastal Zone Management Authority examined the matter in its meeting held on 16th July, 2012 and the said Authority, after deliberation, decided to recommend the amendment to the said notification, 2011;
And whereas, the Central Government is of the opinion that the said notification should be amended;
And whereas, the Central Government, having regard to provision of sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules for amending the said notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule(3) and sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendment in the aforesaid notification, namely:-
In the said Coastal Regulation Zone, Notification, 2011, in paragraph 8, in sub-paragraph "V. Areas requiring special consideration,-", under the heading "1. CRZ areas falling within municipal limits of the Greater Mumbai.", under the sub-heading "(iii) In CRZ-II areas-", after item (h), the following item shall be inserted, namely:-
"(i) Construction of Memorial in the honour of Bharat Ratna Dr. Babasaheb Ambedkar in Mumbai on Indu 6 Mills land shall be allowed with change in land use from industrial to construction of Memorial in accordance with the applicable Town and Country Planning Regulations".
