काकाकाका....आआआआ. . . . 4206420642064206(अ).(अ).(अ).(अ).————केन्द्रीय सरकार, रेल अधिनियम, 1989 (1989 का 24)24)24)24) (जिसे इसमेेें इसके पष्चात्‌ उक्त अधिनियम कहा गया है), की धारा 20क की उप-धारा (1) के अधीन जारी की गई भारत का राजपत्र, असाधारण, भाग II, खण्ड 3, उप-खण्ड (ii) में तारीख 20 अक्तूबर 2016 को प्रकाषित भारत सरकार के रेल मंत्रालय की अधिसूचना संख्यांक का.आ. 3254 (अ), तारीख 18 अक्तूबर 2016 (जिसे इनमें इनके पष्चात्‌ उक्त अधिसूचना कहा गया है) द्वारा उक्त अधिसूचना से उपाबद्व अनुसूची में विनिर्दिष्ट भूमि को, बिहार राज्य के मधेपुरा जिले में विषेष रेल परियोजना अर्थात्‌ मधेपुरा-ग्रीनफील्ड विद्युत लोको विनिर्माण कारखाना की स्थापना के निष्पादन, अनुरक्षण, प्रबंधन और प्रचालन के लिए लोक प्रायोजन के लिए अर्जित करने के अपने आषय की घोषणा की थी ;

और उक्त अधिसूचना का सार, उक्त अधिनियम की धारा 20ख की उप-धारा (4) के अधीन तीन स्थानीय समाचार पत्रों में अर्थात्‌ हिन्दुस्तान टाइम्स ( अंग्रेजी संस्करण), तारीख 04 नवम्बर 2016 और हिन्दुस्तान और दैनिक जागरण (हिन्दी संस्करण), तारीख 04 नवम्बर, 2016 को प्रकाषित किया गया था ;

और, सक्षम प्राधिकारी अर्थात्‌ जिला भूमि अर्जन अधिकारी, मधेपुरा द्वारा किसी व्यक्ति से कोई आक्षेप प्राप्त नही हुआ है ;

उक्त अधिनियम की धारा 20ड. की उप धारा (1) के अनुसरण में, सक्षम प्राधिकारी ने अपनी रिपोर्ट केन्दीय सरकार को प्रस्तुत कर दी है ;

अतः, अब, केन्द्रीय सरकार, सक्षम प्राधिकारी की उक्त रिपोर्ट के प्राप्त होने पर और उक्त अधिनियम की धारा 20ड. की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इस अधिसूचना के उपाबद्व अनुसूची में भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जाएगी ;

और, अब केन्द्रीय सरकार, उक्त अधिनियम की धारा 20ड. की उप-धारा (2) के अनुसरण में यह घोषणा करती है कि राजपत्र में इस अधिसूचना के राजपत्र में प्रकाषित होने पर, इस अनुसूची में विनिर्दिष्ट भूमि आत्यांतिक रूप से सभी विल्लंगमों से मुक्त होकर केन्द्रीय सरकार में निहित हो जाएगी।

NOTIFICATION

New Delhi, the 28th December, 2016

S.O. 4206(E).—Whereas, by the notification of the Government of India in the Ministy of Railways, number S.O 3254 (E), dated the 18th October 2016 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-Section (ii) dated the 20th October 2016 (hereinafter referred to as the said notification) and issued under sub-section (1) of section 20A of the Railways Act, 1989 (24 of 1989) (hereinafter referered to as the said Act ), the Central Government declared its intension to acquired the land specified in the schedule annexed to the said notification for the public purpose of execution, maintenance, management and operation of Special Railway Project, namely, Madhepura-Setting up of Greenfield Electric Loco Manufacturing Factory, in the district of Madhepura, in the State of Bihar;

And, whereas, the substance of the said notification was published in the three local newspapers, namely, Hindustan Times (English Edition), dated the 04th November, 2016 and Hindustan and Dainik Jagran (Hindi Edition), dated the 04th November 2016 under sub-section (4) of section 20B of the said Act;

And, whereas no objection has been received from any person by the competent authority, namely, District Land Acquisition Officer, Madhepura.

And, whereas, in pursuance of sub-section (1) of section 20E of the said Act, the competent authority has submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the Competent Authority and in exercise of the powers conferred by sub-section (1) 20E of the said Act, the Central Government, hereby declares that the land specified in the schedule annexed to this notification shall be acquired for the aforesaid purpose;

And, further, in pursuance of sub-section (2) of Section 20E of the said Act, the Central Government, hereby declares that on the publication of this notification in the official Gazette, the land specified in the schedule annexed to this notification, shall vest absolutely in the Central Government free from all encumbrances.
