का.आ.का.आ.का.आ.का.आ. 4225422542254225(अ)(अ)(अ)(अ)....————यत:, सड़क परिवहन एवं राजमार्ग िवभाग, सड़क परिवहन एवं राजमार्ग मंत्रालय, भारत सरकार की अधिसूचना संख्या का.आ. 544 (अ), दिनांक 19 फरवरी 2016 द्वारा भारत के राजपत्र, असाधारण, भाग-II, ख'ड-3, उपखंड-(ii) में प्रकाशित एवं राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) (इसमें इसके बाद उक् त अधिनियम के रूप में देखें) की धारा 3ए की उपधारा (1) के तहत जारी, के न्7 सरकार ने असमअसमअसमअसम राज्य के कचारकचारकचारकचार जिले में राष्ट्रीय राजमार्ग संख्या 53 के किमी.6.25 से किमी.10.40 (िसलचर-बदरपुर सेक्शन) तक के भूमि के हिस्से में निर्माण (चौड़ा करने/दो लेन का बनाने आदि) अनुरक्षण, प्रबंधन एवं प्रचालन के लिए उक्त अधिसूचना की अनुब@ अनुसूची में विनिAदष्ट भूमि के अर्जन के आशय की घोषणा की है।

एवं यत:, उक्त अधिनियम की धारा 3ए की उपधारा (3) के तहत उक्त अधिसूचना का सार दिनांक 23 अप्रैल 2016 के ''असम ट्रिब्यून'' और दिनांक 23 अप्रैल, 2016 ''दैिनक जुगासंखा'' में प्रकाशित किया गया है।

एवं यत: आपत्तियां प्राप्त Lई एवं सक्षम प्राधिकारी द्वारा उन पर विचार करके उन्हें नामंजूर किया गया।

एवं यत:, उक्त अधिनियम की धारा 3 डी की उपधारा (1) के अनुसरण में, सक्षम प्राधिकारी ने के न्7 सरकार को अपनी रिपोर्ट प्रस्तुत कर दी है।

अब, अत:, सक्षम प्राधिकारी की उक्त रिपोर्ट की प्राप्ति के बाद एवं उक्त अधिनियम की धारा 3 डी की उपधारा(1) के द्वारा प्रदत्त शक्तियों का प्रयोग करते Lए, के न्7 सरकार एतRारा यह घोषणा करती है कि उक् त अनुसूची में विनिAदष्ट भूिम पूवSक्त उद्देश्य हेतु अVजत की जानी चाहिए।

और इसके आगे, उक्त अधिनियम की धारा 3 (डी) की उपधारा (2) के अनुसरण में, के न्7 सरकार एतRारा यह घोषणा करती है कि सरकारी राजपत्र में इस अधिसूचना के प्रकाशन पर उक्त अनुसूची में विनिAदष्ट भूमि सभी प्रकार की बाधाओं से मुक्त होकर पूरी तरह से के न्7 सरकार में निहित हो जाएगी।

NOTIFICATION

New Delhi, the 16th December, 2016

S.O. 4225(E).— Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways, Department of Road Transport and Highways number S.O. 544(E) dated 19th February, 2016, published in Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii) issued under sub-section (I) of section 3A of the National Highways Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule Annexed to the said notification for construction (widening/two laning, etc.), maintenance, management and operation of the National Highway No. 53, on the stretch of land from km 6.25 to km 10.40 (Silchar-Badarpur Section) in the district of Cachar in the State of Assam.

And whereas the substance of the said notification has published in " The Assam Tribune" dated 23rd April, 2016 and "Dainik Jugasankha" dated 23rd April, 2016; under sub-section (3) of section 3A of the said Act;

And whereas objections have been received and the same have been considered and disallowed by the competent authority;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government;

Now, therefore upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of the sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in then said Schedule shall vest absolutely in the Central Government, free from all encumbrances.

SCHEDULE

Brief description of the land to be acquired, with or without structure, falling within the stretch of land from km 6.25 to km 10.40 (Silchar-Badarpur Section) on the National Highway No. 53 in the State of Assam.
