एवं यत:, उ0त अिधिनयम क(cid:29) धारा 3ए क(cid:29) उपधारा (3) के तहत उ0त अिधसूचना का सार (cid:1)दनांक 02.06.2016 के ''टेलीNाफ'' (अंNेजी दैिनक) एवं (cid:1)दनांक 02.06.2016 के 'आनंद बाजार पि(cid:25)का' (बंगाली दैिनक) म) *कािशत (cid:1)कया गया है।

एवं यत: सEम *ािधकारी को (cid:1)कसी भी RयिS से कोई आपिT *ाUत नहV Wई है।

एवं यत:, उ0त अिधिनयम क(cid:29) धारा 3डी क(cid:29) उपधारा (1) के अनुसरण म), सEम *ािधकारी ने के 67 सरकार को अपनी (cid:13)रपोट(cid:24) *?तुत कर दी है।

और इसके आगे, उ0त अिधिनयम क(cid:29) धारा 3(डी) क(cid:29) उपधारा (2) के अनुसरण म), के 67 सरकार एतद$ारा यह घोषणा करती है (cid:1)क सरकारी राजप(cid:25) म) इस अिधसूचना के *काशन पर उ0त अनुसूची म) िविनGद,ट भूिम सभी *कार क(cid:29) बाधा] से मुS होकर पूरी तरह से के 67 सरकार म) िनिहत हो जाएगी।

MINISTRY OF ROAD TRANSPORT AND HIGHWAYS

NOTIFICATION

New Delhi, the 30th December, 2016

S.O. 4249(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1750 (E) dated the 12.05.2016, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) and issued under sub-section (1) of section 3A of the National Highways Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for building (widening/two-laning/four-laning etc.) including the bypasses, maintenance, management and operation of National Highway No. 327B (Asian Highway No. 02)on the stretch of land from Km. 0.000 to Km. 1.500 in Darjeeling District in the State of West Bengal;

And whereas the substance of the said notification has been published in "Telegraph'' (Daily English) dated 02.06.2016, and "Anand Bazaar Patrika'' (Daily Bengali) dated 02.06.2016; under sub-section (3) of section 3A of the said Act;

And whereas no objection has been received from any person by the competent authority;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.

SCHEDULE

Brief description of the land to be acquired, with or without structures, on National Highway No 327B (Asian Highway No. 02) falling within the stretch of land from Km. 0.000 to 1.500 in Darjeeling District in the State of West Bengal.
