काकाकाका....आआआआ. 4252(. 4252(. 4252(. 4252(अअअअ))))....––––राष्ट्रपित, संविधान के अनु(cid:24)छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते %ए, रेल सेवा (पेंशन) िनयम, 1993 का और संशोधन करने के लिए निम्निलिखत नियम बनाते हैं, अर्थात्:-
1. (1) इन नियमों का संक्षिप्त नाम रेल सेवा (पेंशन) संशोधन िनयम, 2016 है।
(2) ये 17 िसतंबर 2015 को प्रवृत्त %ए समझे जाएंगे।
2. रेल सेवा (पेंशन) िनयम, 1993 में, प्ररूप-1,-
7म सं. 7 में, मद (क) के स्थान पर िनम्निलिखत रखा जाएगा, अर्थात्:-
(1)
''(क) (i) संगठन का नाम (फर्म अथवा कम्पनी अथवा सहकारी सोसाइटी, आदि);
(ii) संगठन की संक्षिप्त प्रकृ ति;

(iv) संगठन का स्थायी खाता संख्या अथवा कर पहचान संख्या अथवा रजिस्ट्रीकृ त संख्या'';
(2) 7म सं.9 के स्थान पर, निम्निलिखत रखा जाएगा,, अर्थात्:-

मैं घोषणा करता Dं कि :--
(क) मैंने सेवा के पिछले तीन वषE में ऐसी कोई संवेदनशील अथवा सामरिक महत्व की सूचना नहH छिपाई है, जो उस संगठन जिसमें मेरा कार्यभार Kहण करने का प्रस्ताव है अथवा उस क्षेत्र जिसमें मेरा Nयवसाय अथवा परामर्श करने का प्रस्ताव है, के हित अथवा कार्य के क्षेत्रों से प्रत्यक्ष रूप से संबंधित है।
(ख) प्रस्तावित नियोजन में गत तीन वषE के दौरान मेरे द्वारा धारित पद की नीतियों के साथ हित संघर्ष अंतर्वलिन नहH होगा तथा उस संगठन, जिसमें मेरा कार्यभार Kहण करने का प्रस्ताव है, द्वारा Nयपदिष्ट हित अथवा किए गए कार्य से मेरे और सरकार के बीच कार्यकरण कोई विरोध उत्पन्न नहH होगा।
(ग) वह संगठन जिसमें मैं नियोजन की मांग कर रहा Dं, वह किन्ही ऐसे 7ियाकलापों में लिप्त नहH है, जिसमें भारत के विदेशी संबंधों, राष्ट्रीय सुरक्षा एवं घरेलू सामंजस्य पर कोई विवाद हो या इन पर कोई प्रतिकू ल प्रभाव पड़े। संगठन आसूचना संचयन के लिए कोई कार्य नहH कर रहा है। मैं संगठन में जिस नियोजन को स्वीकार करने का प्रस्ताव कर रहा Dं, उसमें ऐसे 7ियाकलाप भी शामिल नहH होंगे जिनमें भारत के विदेशी संबंधों, राष्ट्रीय सुरक्षा एवं घरेलू सामंजस्य पर िववाद हो अथवा प्रतिकू ल प्रभाव डालने वाले 7ियाकलाप अन्तर्वलिन हो।
(घ) मेरा सेवा अिभलेख, विशेषरूप से गैर-सरकारी संगठनों के साथ निष्ठा एवं कार्रवाई के संबंध में सुस्पष्ट है।
(ड) प्रस्तावित परिलब्धियां एवं धन संबंधी लाभ औद्योगिक मानकों के अनुरूप हैं।
(च) मैं, सरकार द्वारा किसी आपत्ति के मामले में वाणिज्यिक नियोजन छोड़ने के लिए सहमत Dं।

NOTIFICATION

S.O. 4252(E).—-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Railway Services (Pension) Rules, 1993, namely:-
1. (1) These rules may be called the Railway Services (Pension) Amendment Rules, 2016.
(2) They shall be deemed to have come into force on the 17th day of September, 2015.
2. In the Railway Services (Pension) Rules, 1993, in Form-1, -
(a) in serial No.7, for item (a), the following shall be substituted, namely:
"(a) (i) Name of organisation (firm or company or co-operative society, etc.);
(ii) Brief nature of the organisation;
(iii) Full address of the registered office of the organisation.
(b) for serial number 9, the following shall be substituted, namely :-
"DECLARATION :
I hereby declare that --
(a) I have not been privy to sensitive or strategic information in the last three years of service, which is directly related to the areas of interest or work of the organisation that I propose to join or to the areas in which I propose to practice or consult.
(b) The proposed employment will not involve conflict of interest with the policies of the office held by me during the last three years and the interest represented or work undertaken by the organisation I propose to join will not bring me into conflict with the working of the Government.
(c) The organisation in which I am seeking employment is not involved in activities which are in conflict with or prejudicial to India's foreign relations, national security and domestic harmony. The organisation is not undertaking any activity for intelligence gathering. The employment, which I propose to take up with the organisation also will not entail activities which are in conflict with or involve activities prejudicial to India's foreign relations, national security and domestic harmony.
(d) My service record is clear, particularly with respect to integrity and dealings with Non-Government Organisations.
(e) The proposed emoluments and pecuniary benefits are in conformity with the industry standards.
(f) I agree to withdraw from the commercial employment in case of any objection by the Government.
UNDERTAKING
I hereby solemnly declare that the above information is true to the best of my knowledge and belief and that no material information has been concealed. In the event of any of the information being found to be false, the permission may be withdrawn without assigning any reason and without prejudice to any other action that the Government may consider appropriate, including action under the Railway Services (Pension) Rules, 1993 and criminal proceedings.

5 भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)]EXPLANATORY MEMORANDUM
1. The Railway Services(Pension)Rules, 1993 came into force on the 3rd December, 1993.
2. In order to maintain uniformity with the Department of Personnel and Training's Notification on the issue published in the Gazette of India, vide number S.O. 713(E), dated the 17th September, 2015, this notification is given retrospective effect from the 17th September, 2015.
3. The amendments to the said rules with retrospective effect will not adversely affect the interest of any person.
