5. ननल करने क(cid:7409) न(cid:6989)त.—हिां के (cid:7008)(cid:7076)ीय सरकार क(cid:7409) यह राय है (cid:7408)क ऐसा करना र्आ(cid:7019)यक या समीचीन है, र् हांर् ह उसके नलए ोि कारण ह(cid:7289) उ(cid:7008)ह(cid:7286) लेखब(cid:7373) करके , इन ननयम(cid:7298) के (cid:7408)कसी उपबंध को (cid:7408)कसी र्ग(cid:6981) या (cid:7079र्)ग(cid:6981) के (cid:7018)यन(cid:6989)तय(cid:7298) के बाबत, आदे (cid:7367)ारा ननल कर सके गी ।
6. (cid:7018)र्याृन(cid:7004)त.—इन ननयम(cid:7298) क(cid:7409) कोई बात, ऐसे आर(cid:6979)ण, आयु-सीमा म(cid:7286) छू ट और अ(cid:7008)य (cid:7407)रयायत(cid:7298) पर (cid:7079)र्भा नह(cid:7277) डालेगी, ननिका के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा इस संबंध म(cid:7286) समय-समय पर ािरी (cid:7408)कए गए आदे(cid:7298) के अनुसार अनुसूनचत ािनतय(cid:7298), अनुसूनचत निािनतय(cid:7298), अ(cid:7008)य नपछे र्ग(cid:7300), भूतर्पू(cid:6981) सैननक(cid:7298) और अ(cid:7008)य र्नेष (cid:7079र्)ग(cid:6981) के (cid:7018)यन(cid:6989)तय(cid:7298) के नलए उपबंध करना अपेन(cid:6979)त है ।

New Delhi, the 5th January, 2017
G.S.R. (E).—In exercise of the powers conferred by clause (f) of sub-section (2) of section 87 of the
Information Technology Act, 2000 (21 of 2000) and in supersession of the Department of Information Technology, Ministry of Communications and Information Technology, Controller of Certifying Authorities, Gazetted and Non- Gazetted posts Recruitment Rules, 2009, in so far as they relate to the posts of Private Secretary, Personal Assistant, Assistant and Stenographer, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the post of Private Secretary, Personal Assistant, Assistant and Stenographer in the Office of Controller of Certifying Authorities, a statutory body under the Ministry of Electronics and Information Technology, namely :-
1. Short title and commencement.—(1) These rules may be called the Ministry of Electronics and Information Technology, Office of Controller of Certifying Authorities, (Group 'B' and 'C' posts) Recruitment Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and level in the pay matrix.—The number of posts, its classification and level in the pay matrix attached thereto shall be as specified in the columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age – limit and other qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be specified in columns (5) to (13) of the said Schedule.

(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category or persons.
6. Saving.—Nothing in these rules shall affect reservation, relaxation of age - limit and other concessions required to be provided for persons belonging to the Scheduled Castes, Scheduled Tribes, Other Backward Classes, ex-Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

| Promotion: Six years of approved service as Personal Assistant in level-7 in the pay matrix (Rs. 44900- 142400) in the Office of Controller of Certifying Authorities shall be eligible for promotion. N ote 1: The approved service rendered in the grade, on the 1st day of the Recruitment Year, as the residency period will be counted for promotion. The expression "Approved Service" for the various modes of recruitment, shall be as under,- |
(i) in respect of an officer recruited directly to that grade, period or periods of regular service rendered in that
grade, including period or periods of absence during which he would have held a post on regular basis in that
grade but for his being on leave or otherwise not being available to hold such post, from the first day of the
recruitment year, following the year in which the examination for direct recruitment was held;
(ii) in respect of an officer recruited to that grade on the basis of length of service in the lower grade, period or
periods of regular service rendered in that grade, including period or periods of absence during which he would
have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold
such post, from the first day of the recruitment year for which the recruitment was made:
Provided that where there is delay of more than Ninety days in joining on appointment, in any of the cases
mentioned in the sub-clauses (i) and (ii) above, such delay should not be due to any fault on the part of the
officer.
Note 2: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.
Note 3: For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2016, the date from which the revised pay structure based on the Seventh Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding level in the pay matrix extended based on the recommendations of the Pay Commission.
Deputation or Absorption:
Officers of the Central Government or State Government or Public Sector Undertaking or Autonomous bodies.
i) holding analogous post on regular basis in the parent cadre or department; or
ii) with six years regular service in the grade of Stenographer Grade "C" or Personal Assistant or equivalent in level-7 in the pay matrix (Rs. 44900- 142400).
Note 1: Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or other Organization or Department of the Central Government shall ordinarily not exceed five years. Note 2: The maximum age limit for appointment on deputation shall be not exceeding fifty six years as on the closing date of receipt of applications.

| For Ex-Serviceman: T he Armed Forces personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered.
