सा.का.नन. 34(अ).—कनतपय ननयम(cid:7298) का नन(cid:7013)ननलनखत (cid:7079)ा(cid:7272)प, नसिे क(cid:7286) (cid:7076)ीय सरकार, पु(cid:7312) के (cid:7079)नत (cid:7059)ू रता का नर्नारण अनधननयम, 1960 (1960 का 59) क(cid:7409) धारा 38 (cid:7367)ारा (cid:7079)द(cid:7004)त न(cid:6989)तय(cid:7298) का (cid:7079)योग करते (cid:7263)ए, बनाने का (cid:7079)(cid:7021)र्ता करती है, उन सभी (cid:7018)यन(cid:6989)तय(cid:7298) क(cid:7409) सूचना के नलए, ननिका उसके (cid:7367)ारा (cid:7079)भार्नत होना संभा(cid:7018)य है, उ(cid:6989)त अनधननयम क(cid:7409) धारा 38 क(cid:7409) उपधारा (1) के अधीन अपे(cid:6979)ा के अनुसार (cid:7079)कानत (cid:7408)कया ािता है और यह सूचना दी ािती है (cid:7408)क उ(cid:6989)त ननयम(cid:7298) पर उस तारीख से, नसिको इस अनधसूचनार् ाले रापि(cid:7074) क(cid:7409) (cid:7079)नतयां निता को उपल(cid:7011)ध कराई ािती ह(cid:7289), तीस (cid:7408)दन क(cid:7409) र्अनध क(cid:7409) समान(cid:7009)त के प(cid:7019)चात् र्नचार (cid:7408)कया ािएगा ;

आ(cid:6979)ेप(cid:7298) या सुर्झा(cid:7298) पर, ोि (cid:7408)कसी (cid:7018)यन(cid:6989)त से उ(cid:6989)त ननयम(cid:7298) क(cid:7409) बाबत र्पू(cid:7299)(cid:6989)त र्अनध क(cid:7409) समान(cid:7009)त से पहले (cid:7079)ा(cid:7009)त ह(cid:7298), क(cid:7286) (cid:7076)ीय सरकार (cid:7367)ारा र्नचार (cid:7408)कया ािएगा ;

इन (cid:7079)ा(cid:7272)प ननयम(cid:7298) पर आ(cid:6979)ेप या सुर्झा, पया(cid:6981र्)रण, र्न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय म(cid:7286) भारत सरकार के सनर्च, इं(cid:7408)दरा पया(cid:6981र्)रण र्भन, ोिरबाग रोड, नई (cid:7408)द(cid:7016)ली को भेेि ाि सक(cid:7286) गे ।

(cid:7079)ा(cid:7272)प ननयम

1. संन(cid:6979)(cid:7009)त नाम और (cid:7079)ारंभ-- (1) इन ननयम(cid:7298) का संन(cid:6979)(cid:7009)त नाम पु(cid:7312) के (cid:7079)नत (cid:7059)ू रता का नर्नारण (पुधन बाािर र्नननयमन) ननयम, 2016 है ।

(2) ये रापि(cid:7074) म(cid:7286) उनके अंनतम (cid:7079)कान क(cid:7409) तारीख को (cid:7079र्)ृ(cid:7004)त ह(cid:7298)गे ।

2. प(cid:7407)रभाषाएं-- इन ननयम(cid:7298) म(cid:7286), बि तक संदभ(cid:6981) से अ(cid:7008)या अपेन(cid:6979)त न हो,—

(क) "अनधननयम" से पु(cid:7312) के (cid:7079)नत (cid:7059)ू रता का नर्नारण अनधननयम, 1960 (1960 का 59) अनभ(cid:7079)ेत है ;

(ख) "पु" से र्मेी, भे, बकरी, घोा, ट(cid:6999)टू, गधा, ख(cid:6994)चर, ऊं ट ता सभी अ(cid:7008)य चब(cid:7278) र्ाले पु, सुअर और कु (cid:6989)कु ट अनभ(cid:7079)ेत ह(cid:7289) ;

(ग) "पु बाािर सनमनत" से इस अनधननयम के अधीन बनाई गई ऐसी सनमनत अनभ(cid:7079)ेत है, ोि (cid:7408)कसी बाािर क(cid:7409) मर(cid:7013)मत के नलए यार् हां पर ननयत (cid:7079)सुर्नधा(cid:7312) क(cid:7409) (cid:7018)र्य(cid:7021)ा के नलए और (cid:7018)यापार (cid:7408)कए ािनेर् ाले पु(cid:7312) के क(cid:7016)याण को सुननन(cid:7019)चत करने के नलए उ(cid:7004)तरदायी होगी ;

(ड.) "र्मेी" से कोई गोाितीय पु अनभ(cid:7079)ेत है, नसिके अंतग(cid:6981)त सांड, ब(cid:7289)ल, गाय, भ(cid:7289)स, बर्छा, कलोर और (cid:7011)याना आते ह(cid:7289) और नसिके अंतग(cid:6981)त ऊं (cid:7407)टनी भी है ;

(च) "उ(cid:7374)ंड पु" से ऐसा पु अनभ(cid:7079)ेत है, नसिके (cid:7367)ारा अ(cid:7008)य पु(cid:7312) को (cid:6979)नत का(cid:7407)रत करना संभाव्य है ;

(छ) "ननरी(cid:6979)क" से रा(cid:6996)य बोड(cid:6981) (cid:7367)ारा या (cid:7408)कसी (cid:7021)ानीय (cid:7079)ानधकरण (cid:7367)ारा ननरी(cid:6979)क के (cid:7272)प म(cid:7286) (cid:7079)ानधकृ त कोई (cid:7018)यन(cid:6989)त अनभ(cid:7079)ेत है और बि पुपालन र्नभाग (cid:7367)ारा ननयु(cid:6989)त (cid:7018)यन(cid:6989)त के संबंध म(cid:7286) (cid:7079)यु(cid:6989)त (cid:7408)कया ािए, तो इसके अंतग(cid:6981)त पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क भी है ;

()ि "बाािर" से कोई बाािर (cid:7021)ल या र्न(cid:7059)य बाा या कोई अ(cid:7008)य प(cid:7407)रसर या (cid:7021)ान अनभ(cid:7079)ेत है, हिां पर पु(cid:7312) को अ(cid:7008)य (cid:7021)ान(cid:7298) से लाया ािता है और नब(cid:7059)(cid:7409) के नलए (cid:7079)द(cid:7414)त (cid:7408)कया ािता है और इसके अंतग(cid:6981)त (cid:7408)कसी बाािर या (cid:7408)कसीर् धाला और इसके संबंध म(cid:7286) (cid:7079)यु(cid:6989)त (cid:7021)ान से पा(cid:7019र्)(cid:6981)(cid:7021) कोई मांद भी है और यान(cid:7298) क(cid:7409) पा(cid:7420)कग के नलए बाािर म(cid:7286) आग(cid:7008)तुक(cid:7298) (cid:7367)ारा पा(cid:7420)कग (cid:6979)े(cid:7074) के (cid:7272)प म(cid:7286) (cid:7079)यु(cid:6989)त बाािर के पा(cid:7019र्)(cid:6981)(cid:7021) कोई (cid:7021)ान है ता इसके अंतग(cid:6981)त पु मेला और पु कांीि हौ िभी ह(cid:7289), हिां पर पु(cid:7312) को र्न(cid:7059)य के नलए (cid:7079)(cid:7021)तार्नत या (cid:7079)द(cid:7414)त (cid:7408)कया ािता है ;

(झ) "कु (cid:6989)कु ट" से घरेलू मुगा(cid:6981), पी(cid:7272), हंस, बतख, नगनन मुगा(cid:6981), कबूतर, तीतर और बटेर के ीिर्नत प(cid:6979)ी अनभ(cid:7079)ेत ह(cid:7289) ;

() "(cid:7079)नतनष(cid:7373) (cid:7018)र्यसाय" से ऐसे (cid:7018)र्यसाय अनभ(cid:7079)ेत ह(cid:7289), ोि पु(cid:7312) के नलए अपहाननकर ह(cid:7289) और ोि अर्ना(cid:7019)यक पीा और यातना कारक ह(cid:7289) ;

(ट) "पु(cid:7312) के (cid:7079)नत (cid:7059)ू रता के नर्नारण के नलए सोसाइटी (एसपीसीए)" से पु(cid:7312) के (cid:7079)नत (cid:7059)ू रता का नर्नारण (पु(cid:7312) के (cid:7079)नत (cid:7059)ू रता के नर्नारण के नलए सोसाइ(cid:7407)टय(cid:7298) क(cid:7409) (cid:7021)ापना और र्नननयमन) ननयम, 2001 के अधीन (cid:7021)ानपत एसपीसीए अनभ(cid:7079)ेत है ;

(ठ) "रा(cid:6996)य बोड(cid:6981)" से रा(cid:6996)य पु क(cid:7016)याण बोड(cid:6981) अनभ(cid:7079)ेत है ;

(ड) "अयो(cid:6991)य" के अंतग(cid:6981)त ऐसे पु आते ह(cid:7289), ोि अ(cid:7016)र्पय ह(cid:7289), र्नकनसत गभा(cid:6981र्)(cid:7021)ा म(cid:7286), ननलांग, मृतक, (cid:7271)(cid:6991)ण, आहत या का (cid:7263)आ है, म(cid:7286) आते ह(cid:7289) ;

(ढ) "यान" से सक पर उपयोग के नलए संनन(cid:7414)मत या अनुकू नलत कोई यान (नसिके अंतग(cid:6981)त (cid:7408)कसी भी भांनत का कोई (cid:7069)ेलर या (cid:7408)कसी यान से र्नल(cid:6991)न बाडी भी है) अनभ(cid:7079)ेत है ;

(ण) "पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क" से (cid:7408)कसी (cid:7021)ानीय (cid:7079)ानधकरण (cid:7367)ारा (cid:7079)ानधकृ त कोई रन(िcid:7021)(cid:7069)ीकृ त पु नच(cid:7408)क(cid:7004)सक अनभ(cid:7079)ेत है ;

(त) "अ(cid:7016)र्पय पु" से छह मास क(cid:7409) आयु से कम का कोई पु अनभ(cid:7079)ेत है ;

() उन (cid:7011)द(cid:7298) और पद(cid:7298) के , ोि इन ननयम(cid:7298) म(cid:7286) (cid:7079)यु(cid:6989)त ह(cid:7289) और प(cid:7407)रभानषत नह(cid:7277) ह(cid:7289) (cid:7408)क(cid:7008)तु अनधननयम म(cid:7286) प(cid:7407)रभानषत ह(cid:7289),र् ही अ(cid:6981) ह(cid:7298)गे ोि (cid:7059)म: उस अनधननयम म(cid:7286) उनके ह(cid:7289) ।

3. नलिा पु बाािर मानीटरी सनमनत क(cid:7409) (cid:7021)ापना- (1) यान(cid:7021)नत, नलिा कल(cid:6989)टर या नलिा मन(िcid:7021)(cid:7069)ेट रा(cid:6996)य बोड(cid:6981) के पराम(cid:6981) से नलिे म(cid:7286) पु बाािर(cid:7298) के र्नननयमन के नलए पु बाािर मानीटरी सनमनत ग(cid:7407)ठत करेगा ।

(2) उपननयम (1) म(cid:7286) नन(cid:7416)द(cid:7020)ट सनमनत म(cid:7286) नन(cid:7013)ननलनखत सद(cid:7021)य ह(cid:7298)गे, अा(cid:6981)त् :--

(क) नलिा कल(cid:6989)टर या नलिा मन(िcid:7021)(cid:7069)ेट —अ(cid:7007)य(cid:6979) ;

(ख) मु(cid:6990)य पु नच(cid:7408)क(cid:7004)सा अनधकारी —सद(cid:7021)य सनर्च ;

(ग) अनधका(cid:7407)रतार् ाला (cid:7079)भागीयर् न अनधकारी ;

(घ) अनधका(cid:7407)रतार् ाला पुनलस अधी(cid:6979)क ;

(ड.) एसपीसीए का कोई (cid:7079)नतनननध ;

(च) बोड(cid:6981) (cid:7367)ारा मा(cid:7008)यता(cid:7079)ा(cid:7009)त और रा(cid:6996)य सरकार (cid:7367)ारा या अनुमो(cid:7408)दत पु क(cid:7016)याण संगठन से दो (cid:7079)नतनननध ।

(3) सनमनत के अनर्धेन क(cid:7409) गणपू(cid:7414)त छह सद(cid:7021)य(cid:7298) से होगी ।

(4) कोई ऐसा (cid:7018)यन(cid:6989)त, ोि इस अनधननयम या (cid:7408)कसी रा(cid:6996)य सरकार (cid:7367)ारा बनाए गए (cid:7408)कसी भी पु प(cid:7407)रि(cid:6979)ण र्ननध के अधीन आरोनपत (cid:7408)कया गया है, सनमनत का सद(cid:7021)य बनने से (cid:7079)नतनष(cid:7373) होगा और पु बाािर के र्नननयमन म(cid:7286) सन(cid:7013)मनलत नह(cid:7277) (cid:7408)कया ािएगा ।

4. पु बाािर सनमनत क(cid:7409) (cid:7021)ापना- (1) (cid:7021)ानीय (cid:7079)ानधकरण रा(cid:6996)य बोड(cid:6981) के पराम(cid:6981) से नलिे म(cid:7286) पु बाािर(cid:7298) के (cid:7079)बंध के नलए पु बाािर सनमनत ग(cid:7407)ठत करेगा ।

(क) (cid:7021)ानीय (cid:7079)ानधकरण का अ(cid:7007)य(cid:6979) -- अ(cid:7007)य(cid:6979) ;

(ख) मु(cid:6990)य नगरपानलक अनधकारी या (cid:7021)ानीय (cid:7079)ानधकरण का मु(cid:6990)य अनधकारी – सद(cid:7021)य सनर्च ;

(ग) अनधका(cid:7407)रतार् ाला तहसीलदार ;

(घ) अनधका(cid:7407)रतार् ालार् न खंड अनधकारी ;

(ड.) अनधका(cid:7407)रतार् ाला पु नच(cid:7408)क(cid:7004)सा अनधकारी ;

(च) अनधका(cid:7407)रतार् ाला पुनलस ननरी(cid:6979)क ;

(छ) एसपीसीए का कोई (cid:7079)नतनननध ;

()ि बोड(cid:6981) (cid:7367)ारा मा(cid:7008)यता(cid:7079)ा(cid:7009)त या रा(cid:6996)य सरकार (cid:7367)ारा या अनुमो(cid:7408)दत पु क(cid:7016)याण संगठन से दो (cid:7079)नतनननध ।

(3) सनमनत के अनर्धेन क(cid:7409) गणपू(cid:7414)त चार सद(cid:7021)य(cid:7298) से होगी ।

(4) कोई ऐसा (cid:7018)यन(cid:6989)त, ोि इस अनधननयम या (cid:7408)कसी रा(cid:6996)य सरकार (cid:7367)ारा बनाए गए (cid:7408)कसी भी र्मेी प(cid:7407)रि(cid:6979)ण र्ननध के अधीन आरोनपत (cid:7408)कया गया है, सनमनत का सद(cid:7021)य बनने से (cid:7079)नतनष(cid:7373) होगा और पु बाािर के र्नननयमन म(cid:7286) सन(cid:7013)मनलत नह(cid:7277) (cid:7408)कया ािएगा ।

(5) सद(cid:7021)य सनर्च इन ननयम(cid:7298) क(cid:7409) अनुपालना सुननन(cid:7019)चत करेगा ।

5. र्न(cid:7378)मान बाािर(cid:7298) का रन(िcid:7021)(cid:7069)ीकरण- (1) (cid:7021)ानीय (cid:7079)ानधकरण, इन ननयम(cid:7298) के (cid:7079)ारंभ से पहले (cid:7408)(cid:7059)याील बाािर(cid:7298) क(cid:7409) सूची बनाएगा ।

(2) इन ननयम(cid:7298) के (cid:7079)ारंभ से पहले (cid:7408)(cid:7059)याील (cid:7079)(cid:7004)येक बाािर ऐसे (cid:7079)ारंभ क(cid:7409) तारीख से तीन मास के भीतर नलिा पु बाािर मानीटरी सनमनत के पास सनमनत को र्आेदन करके (cid:7021र्)यं को रन(िcid:7021)टर कर(cid:7286)गे ।

(3) नलिा पु बाािर मानीटरी सनमनत रन(िcid:7021)(cid:7069)ीकरण (cid:7079)दान करने से पहले यह सुननन(cid:7019)चत करेगी (cid:7408)क बाािर म(cid:7286) इन ननयम(cid:7298) म(cid:7286) या ननयत सभी अपे(cid:6979)ा(cid:7312) को पूरा करते ह(cid:7289) ।

(4) नलिा पु बाािर मानीटरी सनमनत यह सुननन(cid:7019)चत करेगी (cid:7408)क पु बाािर म(cid:7286) समुनचत—

(i) र्आास ;

(ii) आड ;

(iii) चारा (cid:7076)ोनणकाएं, अनेक नल(cid:7298) और बान(cid:7016)टय(cid:7298) सनहत पानी क(cid:7409) टं(cid:7408)कयां ;

(iv) (cid:7079)का ;

(v) यान(cid:7298) के समुनचत ऊं चाई तक ढलान ;

(vi) बीमार और ननलांग पु(cid:7312) के नलए पृक् बाे ;

(vii) अ(cid:7016)र्पय और गभ(cid:6981र्)ती पु(cid:7312) के नलए पृक् बाे ;

(viii) पु नच(cid:7408)क(cid:7004)सा (cid:7079)सुर्नधा ;

(ix) चारा भंडारण (cid:6979)े(cid:7074) ;

(x) लि (cid:7079)दाय ;

(xi) ौचघर,

ह(cid:7289) ।

(5) नलिा पु बाािर मानीटरी सनमनत बाािर क(cid:7409) अनधकतम र्मिा (cid:6979)मता र्अधा(cid:7407)रत करेगी और उसे बाािर के (cid:7079)मुख (cid:7021)ान पर (cid:7079)द(cid:7414)त (cid:7408)कया ािएगा ।

(6) नलिा पु बाािर सनमनत रन(िcid:7021)(cid:7069)ीकरण (cid:7079)दान करते समय ऐसी त(cid:7288) अनधरोनपत कर सके गी, ोिर् ह इन ननयम(cid:7298) क(cid:7409) अनुपालना सुननन(cid:7019)चत करने के नलए उनचत समझे ।

(7) य(cid:7408)द नलिा पु बाािर मानीटरी सनमनत र्आेदन को नामंूिर करती है, तो बाािर नामंूिर (cid:7408)कए ािने क(cid:7409) तारीख से र्न(cid:7378)मान नह(cid:7277) रहेगा ।

(8) नलिा पु बाािर मानीटरी सनमनत रन(िcid:7021)(cid:7069)ीकरण के नलए र्आेदन का ननपटारा, र्आेदन ाइल (cid:7408)कए ािने क(cid:7409) तारीख से एक मास के भीतर करेगी ।

6. नए बाािर(cid:7298) क(cid:7409) (cid:7021)ापना- (1) बि (cid:7021)ानीय (cid:7079)ानधकरण अपनी अनधका(cid:7407)रता के भीतर (cid:7408)कसी पु बाािर को (cid:7021)ानपत करना उनचत और र्आ(cid:7019)यक समझती है, तोर् ह (cid:7408)कसी उपयु(cid:6989)त (cid:7021)ान क(cid:7409) पहचान करेगी और बाािर का एक (cid:7011)लू (cid:7410)(cid:7079)ट तैयार करेगी ।

(2) नलिा पु बाािर मानीटरी सनमनत बाािर के (cid:7011)लू (cid:7410)(cid:7079)ट का अनुमोदन कर सके गी या उसके और उपांतरण क(cid:7409) मांग कर सके गी या लेखब(cid:7373) (cid:7408)कए ािनेर् ाले कारण(cid:7298) से (cid:7079)(cid:7021)र्ता को नामंूिर कर सके गी ।

(3) (cid:7079)(cid:7004)येक नया बाािर रन(िcid:7021)(cid:7069)ीकरण के नलए नलिा पु बाािर मानीटरी सनमनत को र्आेदन करेगा ।

(4) नलिा पु बाािर मानीटरी सनमनत रन(िcid:7021)(cid:7069)ीकरण (cid:7079)दान करने से पहले और बाािर को चालू करने से पहले यह सुननन(cid:7019)चत करेगी (cid:7408)क बाािर म(cid:7286) इन ननयम(cid:7298) म(cid:7286) या ननयत सभी अपे(cid:6979)ा(cid:7312) को पूरा (cid:7408)कया गया है ।

(5) नलिा पु बाािर मानीटरी सनमनत यह सुननन(cid:7019)चत करेगी (cid:7408)क पु बाािर म(cid:7286) समुनचत—

(i) र्आास ;

(ii) आड ;

(iii) चारा (cid:7076)ोनणकाएं, अनेक नल(cid:7298) और बान(cid:7016)टय(cid:7298) सनहत पानी क(cid:7409) टं(cid:7408)कयां ;

(iv) (cid:7079)का ;

(v) यान(cid:7298) के समुनचत ऊं चाई तक ढलान ;

(vi) बीमार और ननलांग पु(cid:7312) के नलए पृक् बाे ;

(vii) अ(cid:7016)र्पय और गभ(cid:6981र्)ती पु(cid:7312) के नलए पृक् बाे ;

(viii) पु नच(cid:7408)क(cid:7004)सा (cid:7079)सुर्नधा ;

(ix) चारा भंडारण (cid:6979)े(cid:7074) ;

(x) लि (cid:7079)दाय ;

(xi) ौचघर,

ह(cid:7289) ।

(6) नलिा पु बाािर मानीटरी सनमनत बाािर क(cid:7409) अनधकतम र्मिा (cid:6979)मता र्अधा(cid:7407)रत करेगी और उसे बाािर के (cid:7079)मुख (cid:7021)ान पर (cid:7079)द(cid:7414)त (cid:7408)कया ािएगा ।

(7) नलिा पु बाािर सनमनत रन(िcid:7021)(cid:7069)ीकरण (cid:7079)दान करते समय ऐसी त(cid:7288) अनधरोनपत कर सके गी, ोिर् ह इन ननयम(cid:7298) क(cid:7409) अनुपालना सुननन(cid:7019)चत करने के नलए उनचत समझे ।

7. सीमा (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) बाािर(cid:7298) के बारे म(cid:7286) रखी ािने र्ाली अनत(cid:7407)र(cid:6989)त र्पूा(cid:6981र्)धाननयां -- नलिा पु बाािर मानीटरी सनमनत यह सुननन(cid:7019)चत करने के नलए दिम उठाएगी (cid:7408)क (cid:7408)कसी भी ऐसे (cid:7021)ान म(cid:7286) पु बाािर आयोनति नह(cid:7277) (cid:7408)कया ािए, ोि (cid:7408)कसी भी रा(cid:6996)य सीमा से पचास (cid:7408)कलोमीटर के भीतर न(cid:7021)त है या ोि (cid:7408)कसी भी अंतरिा(cid:7020)(cid:7069)ीय सीमा से सौ (cid:7408)कलोमीटर के भीतर न(cid:7021)त है ।

9. रा(cid:6996)य बोड(cid:6981) क(cid:7409) ननदे ािरी करने, इ(cid:7004)या(cid:7408)द क(cid:7409) न(cid:6989)त- (1) रा(cid:6996)य बोड(cid:6981) समय-समय पर (cid:7021)ानीय (cid:7079)ानधकरण और रा(cid:6996)य पुपालन र्नभाग को ऐसे ननदे दे सके गी ोिर् ह इन ननयम(cid:7298) क(cid:7409) अनुपालना को सुकर बनाने के नलए ठीक समझे ।

(2) नलिा पु बाािर मानीटरी सनमनत और पु बाािर सनमनत रा(cid:6996)य बोड(cid:6981) को बाािर के (cid:7408)(cid:7059)याील होने के संबंध म(cid:7286) सभी अनभलेख और सूचना, बि कभी उसक(cid:7409) अपे(cid:6979)ा क(cid:7409) ािए, उपल(cid:7011)ध कराएगी और रा(cid:6996)य बोड(cid:6981) ऐसे अनत(cid:7407)र(cid:6989)त अनभलेख और सूचना मांग सके गा ोिर् ह ठीक समझे ।

(क) बाािर के ननरी(cid:6979)ण के नलए युन(cid:6989)तयु(cid:6989)त समय पर (cid:7079र्)े कर सके गा ;

(ख) (cid:7408)कसी भी (cid:7018)यन(cid:6989)त से बाािर क(cid:7409) बाबत उसके (cid:7367)ारा रखे गए (cid:7408)कसी भी अनभलेख को पे करने क(cid:7409) अपे(cid:6979)ा कर सके गा ;

(ग) (cid:7408)कसी पु को अनभगृहीत कर सके गा, य(cid:7408)द उसके पास यह र्न(cid:7019र्)ास करने का कारण है (cid:7408)क पु(cid:7312) के सा (cid:7059)ू रता का बता(cid:6981र्) (cid:7408)कया गया है और इस (cid:7079)कार अनभगृहीत पु(cid:7312) को (cid:7021)ानीय एसपीसीए या बोड(cid:6981) (cid:7367)ारा मा(cid:7008)यता(cid:7079)ा(cid:7009)त (cid:7408)कसी पु क(cid:7016)याण संगठन क(cid:7409) अनभर(cid:6979)ा म(cid:7286) रखा ािएगा ;

(घ) पु(cid:7312) क(cid:7409) (cid:7059)ू रता के ोटो नच(cid:7074)ा(cid:7004)मक औरर् ीनडयो (cid:7272)प म(cid:7286) सबूत ले सके गा ।

11. बाािर(cid:7298) म(cid:7286) पु नच(cid:7408)क(cid:7004)सक- (1) (cid:7079)(cid:7004)येक बाािर म(cid:7286) पया(cid:6981)(cid:7009)त सं(cid:6990)या म(cid:7286) नलिा पु बाािर मानीटरी सनमनत (cid:7367)ारा (cid:7079)ानधकृ त पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क ह(cid:7298)गे ।

(2) पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क बाािर म(cid:7286) (cid:7079र्)े करने से पहले पु(cid:7312) के मु(cid:6990)य ल(cid:6979)ण(cid:7298) को देखकर संदेहा(cid:7021)पद सांस(cid:7414)गक और सं(cid:7059)ामक रोग(cid:7298) ैिसे पैर और मु ंह के रोग, कनार, (cid:7263)बक, पे(cid:7021)टे डेस पे(cid:7407)ट(cid:6999)स, (cid:7411)रडर पे(cid:7021)ट (चेचक) आ(cid:7408)द के नलए ािंच करेगा और संदेहा(cid:7021)पद पु(cid:7312) को बाािर (cid:6979)े(cid:7074) म(cid:7286) (cid:7079र्)े करने के नलए अनु(cid:6980)ात नह(cid:7277) (cid:7408)कया ािएगा और उनका समीपतम पु नच(cid:7408)क(cid:7004)सालय म(cid:7286) उपचार (cid:7408)कया ािएगा या उ(cid:7008)ह(cid:7286) र्आ(cid:7019)यक उपचार और देखरेख के नलएर् ापस भे ि(cid:7408)दया ािएगा ।

(3) पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क बाािर म(cid:7286) पु(cid:7312) क(cid:7409) उतराई और प(cid:7263)ंच को पय(cid:6981र्)ेन(cid:6979)त करेगा और उनके प(cid:7263)ंचने के प(cid:7019)चात् या(cid:6989)यी(cid:7062) सभी पु(cid:7312) का ननरी(cid:6979)ण करेगा और ऐसे (cid:7408)क(cid:7008)ह(cid:7277) पु(cid:7312) के सा समुनचत (cid:7018)यौहार करेगा, ोि (cid:7271)(cid:6991)ण, बीमार या आहत ह(cid:7289) ।

(4) पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क उसके सम(cid:6979) पे (cid:7408)कए गए प(cid:7407)र्रहन (cid:7079)लेखीकरण के र्न(cid:7271)(cid:7373) लदाई क(cid:7409) अपेन(cid:6979)त ािंच करेगा ।

(5) पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क ऐसे (cid:7408)क(cid:7008)ह(cid:7277) पु(cid:7312) का, बाािर म(cid:7286) पा(cid:6981)(cid:6989)य (cid:7079)सुर्नधा(cid:7312) म(cid:7286) उपचार करेगा या उपचार का पय(cid:6981र्)े(cid:6979)ण करेगा ोि (cid:7271)(cid:6991)ण, बीमार या आहत ह(cid:7289) ।

(6) पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क बाािर म(cid:7286) सभी पु(cid:7312) क(cid:7409) संभाल को मानीटर करेगा और यह सुननन(cid:7019)चत करेगा (cid:7408)क पु(cid:7312) के संभाल सम(cid:7021)त समय पर दयालुता के सा क(cid:7409) ािती है ।

(7) पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क बाािर से पु(cid:7312) क(cid:7409) लदाई का पय(cid:6981र्)े(cid:6979)ण करेगा और यह सुननन(cid:7019)चत करेगा (cid:7408)क सभी पु आनयत या(cid:7074)ा के नलए यो(cid:6991)य ह(cid:7289) और उ(cid:7008)ह(cid:7286) र्आ(cid:7019)यक पु नच(cid:7408)क(cid:7004)सा (cid:7079)माणीकरण उपल(cid:7011)ध कराएगा ।

(8) पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क सभी ननरीन(cid:6979)त और उपचा(cid:7407)रत पु(cid:7312) के , ािरी (cid:7408)कए गए पु नच(cid:7408)क(cid:7004)सा (cid:7079)माणीकरण(cid:7298) क(cid:7409) सं(cid:6990)या का, प(cid:7407)र्रहन के नलए अयो(cid:6991)य पाए गए पु(cid:7312) क(cid:7409) सं(cid:6990)या का और बि कोई पु प(cid:7407)र्रहन के नलए अयो(cid:6991)य पाया गया ा तो (cid:6989)या कार(cid:6981र्)ाई क(cid:7409) गई ी इसका, अनभलेख रखेगा ।

(9) पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क यह सुननन(cid:7019)चत करेगा (cid:7408)क ऐसे पु(cid:7312) क(cid:7409), ननिको अपूण(cid:6981)नीय गु(cid:7271)तर (cid:6979)नत हो गई है या ोि अ(cid:7008)(cid:7004)य (cid:7272)प से (cid:7271)(cid:6991)ण ह(cid:7289) और न(िcid:7008)ह(cid:7286) यान(cid:7298) पर नह(cid:7277) लादा ाि सकता, (cid:6989)य(cid:7298)(cid:7408)क ऐसा करना उ(cid:7008)ह(cid:7286) अर्ना(cid:7019)यक पीा या यातना देना होगा, आपात सहमिृ(cid:7004)यु के नलए (cid:7018)र्य(cid:7021)ा बाािर म(cid:7286) उपल(cid:7011)ध है ।

12. अयो(cid:6991)य पु या (िcid:7008)म देने के संभा(cid:7018)य पु-- (1) कोई भी (cid:7018)यन(cid:6989)त (cid:7408)कसी अयो(cid:6991)य पु को बाािर म(cid:7286) बेचे ािने क(cid:7409) अनु(cid:6980)ा नह(cid:7277) देगा ।

(2) कोई भी (cid:7018)यन(cid:6989)त (cid:7408)कसी पु को बाािर म(cid:7286) र्न(cid:7059)य के नलए (cid:7079)(cid:7021)तार्नत या (cid:7079)द(cid:7414)त (cid:7408)कए ािने क(cid:7409) अनु(cid:6980)ा नह(cid:7277) देगा, य(cid:7408)द उसका, र्हां रहते (cid:7263)ए या उसके प(cid:7407)र्रहन के दौरान, (िcid:7008)म (cid:7408)दया ािना संभा(cid:7018)य है ।

13. ऐसे (cid:7079)नतनष(cid:7373) आचरण, ोि (cid:7059)ू र और अपहाननकर ह(cid:7289)- नन(cid:7013)ननलनखत (cid:7059)ू र और अपहाननकर आचरण (cid:7079)नतनष(cid:7373) ह(cid:7298)गे, अा(cid:6981)त् :--

(क) पु पहचान प(cid:7373)नतयां, ैिसे त(cid:7009)त छापा और ीत छापा ;

(ख) स(cid:7277)ग(cid:7298) क(cid:7409) कतरन और रंग-रोगन ;

(ग) योनचत (cid:7014)या के नबना (नालबंदी के दौरान) पु को कठोर सतह पर नगराना ;

(घ) पु(cid:7312) के रीर के अंग(cid:7298) पर (cid:7408)क(cid:7008)ह(cid:7277) रसायन(cid:7298) और रंग(cid:7298) का (cid:7079)योग ;

(ङ) (cid:7408)कसी साम(cid:7061)ी का (cid:7079)योग करके न क(cid:7409) चू ंची को बंद करना, ैिसे बछे को दूध पीने से रोकने के नलए नचपकनेर् ाला टेप ;

(च) उपचार के (cid:7079)योनि के नलए (cid:7408)कसी पु नच(cid:7408)क(cid:7004)सक से नभ(cid:7008)न (cid:7408)कसी (cid:7018)यन(cid:6989)त (cid:7367)ारा कोई भी तरल या (cid:7076र्) बलर्पू(cid:6981)क नपलाना ;

(छ) पु पर कोई भी अ(cid:7079)ाकृ नतक काय(cid:6981) करने के नलए बल (cid:7079)योग करना, ैिसे नृ(cid:7004)य ;

()ि पु को कोई आभूषण या र्सािटी साम(cid:7061)ी पहनाना ;

(झ) पु को दूध पीने या खाना खाने से रोकने के नलए (cid:7408)कसी भी (cid:7079)कार के छीका का (cid:7079)योग करना ।

14. (cid:6979)नत या अर्ना(cid:7019)यक पीा या यातना से पु(cid:7312) का संर(cid:6979)ण- (1) कोई भी (cid:7018)यन(cid:6989)त बाािर म(cid:7286) (cid:7408)कसी पु को (cid:7408)कसी (cid:6979)नत या अर्ना(cid:7019)यक पीा या यातना नह(cid:7277) देने देगा या उसके नलए अनु(cid:6980)ात नह(cid:7277) करेगा ।

(2) बाािर म(cid:7286) (cid:7408)कसी पु के (cid:7079)भारी (cid:7018)यन(cid:6989)त का यह सुननन(cid:7019)चत करने का कत(cid:6981)(cid:7018)य होगा (cid:7408)क पु को नन(cid:7013)ननलनखत कारण से (cid:6979)नत या अर्ना(cid:7019)यक पीा या यातना का(cid:7407)रत नह(cid:7277) क(cid:7409) ािए या का(cid:7407)रत (cid:7408)कया ािना संभा(cid:7018)य न हो—

(क) पु को मौसम म(cid:7286) अरन(cid:6979)त छोना ;

(ख) पु के नलए उपल(cid:7011)ध होनेर् ाला र्संातन अपया(cid:6981)(cid:7009)त होना ;

(ग) पु को (cid:7408)कसी उपकरण या अ(cid:7008)य ची िसे मारना या क(cid:7298)चना ; ना या नके ल या लगाम को ख(cid:7277)चना, झटकना और झकझोरना, नसिसे अपार पीा और यातना का(cid:7407)रत हो या कोई अ(cid:7008)य कारण ;

(घ) अयुन(cid:6989)तयु(cid:6989)त र्अनध के नलए छोटी र(cid:7021)सी पर खू ंटे से बांधा ;

(ङ) (cid:7009)यासा और भूखा रखना ।

15. पु(cid:7312) क(cid:7409) संभाल करना और बांधना-- (1) कोई भी (cid:7018)यन(cid:6989)त बाािर म(cid:7286) (cid:7408)कसी भी पु के सा नन(cid:7013)ननलनखत नह(cid:7277) करेगा, —

(क) भारतोलन (cid:7079)योनि के नलए, कु (cid:6989)कु ट से नभ(cid:7008)न, भूनम से ऊपर उठाना ;

(ख) भूनम के सा-सा घसीटना ;

(ग) भूनम से अलग करके उसको टांगना ;

(घ) नसर, गद(cid:6981)न, कान स(cid:7277)ग, टांग, पैर, पू ंछ, ऊन कतरना या पंख ;

(2) कोई भी (cid:7018)यन(cid:6989)त,—

(क) (cid:7408)कसी पछे को नह(cid:7277) बांधेगा या उसे छ(cid:7277)का नह(cid:7277) लगाएगा ;

(ख) (cid:7408)कसी पु को आगे क(cid:7409) दोन(cid:7298) टांग(cid:7298) से और र्पां(cid:7298) को इस (cid:7079)कार खू ंटे से नह(cid:7277) बांधेगा (cid:7408)क उससे पु को एक दिम आगे या पीछे करने से रोक दे नसिसे उसे लंबे समय तक एक ही (cid:7021)ान पर खे होने क(cid:7409) असुर्नधा आराम नमल सके ;

(ग) (cid:7408)कसी पु को नसर या गद(cid:6981)न से दोन(cid:7298) तर से नह(cid:7277) बांधेगा, नसिसे पु को (cid:7408)कसी भी (cid:7408)दा म(cid:7286) अपना नसर और गद(cid:6981)न नहलाने से या अपनी (cid:7021र्)यं क(cid:7409) र्आ(cid:7019)यकताएं पूरी करने, ैिसे मन(cid:6989)खयां उाना या अपने रीर के अंग(cid:7298) को चाटना, से रोक (cid:7408)दया ािएगा ;

(घ) एक ही र(cid:7021)सी का (cid:7079)योग करके एक से अनधक पु(cid:7312) को बांधना ;

(ड.) पु(cid:7312) को खू ंटे से लगाने या बांधने के नलए खर(cid:7298)चदार या नुक(cid:7409)ली साम(cid:7061)ी का (cid:7079)योग, नसिसे (cid:6979)नतयां हो ािएं ;

(च) (cid:7408)कसी भी कु (cid:6989)कु ट को गद(cid:6981)न, टांग या पंख से बांधना या कु (cid:6989)कु ट को उलटा लटकाकर ले ािना ।

16. पु(cid:7312) का ननयं(cid:7074)ण-- (1) कोई भी (cid:7018)यन(cid:6989)त (cid:7408)कसी भी बाािर म(cid:7286) (cid:7408)कसी भी पु को ननयंन(cid:7074)त करने के नलए अ(cid:7004)यनधक बल का (cid:7079)योग नह(cid:7277) करेगा, नसिके अंतग(cid:6981)त पू ंछ को तोना, डंडे, पैना या अ(cid:7008)य उपकरण से (cid:7079)हार नह(cid:7277) करेगा, आंख(cid:7298) या नके ल म(cid:7286) लाल नमच(cid:7278) या अ(cid:7008)य (cid:7076र्) नह(cid:7277) लगाएगा ।

(2) कोई (cid:7018)यन(cid:6989)त (cid:7408)कसी भी पु को भूनम या (cid:6981) के ऊपर नह(cid:7277) चलाएगा या नह(cid:7277) ले ािएगा, नसिसे (cid:7079)कृ नत या न(cid:7021)नत से पु का (cid:7408)सलना या नगर ािना संभा(cid:7018)य हो ।

17. पु(cid:7312) को बाे या (cid:7410)परिे म(cid:7286) बंद करना -(1) पु बाािर सनमनत के सद(cid:7021)य सनर्च का यह सुननन(cid:7019)चत करने का कत(cid:6981)(cid:7018)य होगा (cid:7408)क (cid:7408)कसी पु को ऐसे बाे म(cid:7286) या (cid:7410)परि(cid:7286) म(cid:7286) या अ(cid:7008)य आहाते म(cid:7286) नह(cid:7277) रखा गया है, ोि उस पु के आकार और (cid:7079)ािनत के अनु(cid:7079)यु(cid:6989)त है ।

(2) पु बाािर सनमनत के सद(cid:7021)य सनर्च का यह सुननन(cid:7019)चत करने का कत(cid:6981)(cid:7018)य होगा (cid:7408)क,-भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(i)] 7 (क) कोई ऐसा बाा, नसिम(cid:7286) (cid:7408)कसी (cid:7011)याने या सुअर को रखा ािता है, उसम(cid:7286) रखे गए सभी (cid:7011)यान(cid:7298) और सुअर(cid:7298) को लेटने, खे होने और घूमने ता उसी समय सामा(cid:7008)य अंग न(cid:7021)नत समायोनि करने म(cid:7286) सम(cid:6981) बनाने के नलए पया(cid:6981)(cid:7009)त आकार का है ;

(ख) कोई ऐसा बाा या आहाता, नसिम(cid:7286) (cid:7408)कसी कु (cid:6989)कु ट को रखा ािता है—

(i) ऐसे नडािइन का है, नसिसे कु (cid:6989)कु ट का खा होने, लेटने, पंख ै लाने, घूमने और उसक(cid:7409) नैस(cid:7414)गक न(cid:7021)नत म(cid:7286) सामा(cid:7008)य अंग न(cid:7021)नतक समायोनि करने म(cid:7286) सम(cid:6981) हो सके ;

(ii) उसम(cid:7286) ऐसा (cid:7367)ार है, ोि कु (cid:6989)कु ट को (cid:7410)परिे या आहाते म(cid:7286) रखने, ननकालने म(cid:7286) कोई (cid:6979)नत का(cid:7407)रत (cid:7408)कए नबना या अर्ना(cid:7019)यक पीा या यातना के नबना सम(cid:6981) बनाने के नलए पया(cid:6981)(cid:7009)त आकार है ;

(3) पु बाािर सनमनत के सद(cid:7021)य सनर्च का यह सुननन(cid:7019)चत करने का कत(cid:6981)(cid:7018)य होगा (cid:7408)क बाािर के भीतर, —

(क) बि पु(cid:7312) को बाे म(cid:7286) बंद (cid:7408)कया गया है,—

(i) एक (cid:7079)ािनत के पु, दूसरी (cid:7079)ािनत के पु(cid:7312) से पृक् बाे म(cid:7286) रखे गए ह(cid:7289) ;

(ii) उ(cid:7008)ह(cid:7286) आयु और आकार म(cid:7286) नभ(cid:7008)नता को (cid:7007)यान म(cid:7286) रखते (cid:7263)ए बा(cid:7298) म(cid:7286) र्नत(cid:7407)रत (cid:7408)कया गया है, नसिसे उ(cid:7008)ह(cid:7286) अर्ना(cid:7019)यक पीा या यातना से बचाया ाि सके ;

(iii) (cid:7408)कसी उ(cid:7374)ंड पु को अ(cid:7008)य पु(cid:7312) से पृक् बाे, (cid:7410)परिे या आहाते म(cid:7286) रखा गया है ;

(iv) उ(cid:7008)ह(cid:7286) ऐसे बाो, (cid:7410)परि(cid:7298) या आहात(cid:7298) म(cid:7286) नह(cid:7277) रखा गया है ोि भी भार् ाले ह(cid:7289) ;

(ख) पु(cid:7312) को—

(i) बाािर से ननकल भागने से ;

(ii) बाािर म(cid:7286) (cid:7408)कसी भी उ(cid:7061) या उ(cid:7374)ंड पु के संपक(cid:6981) म(cid:7286) आने से,

रोकने के नलए पया(cid:6981)(cid:7009)त (cid:7018)र्य(cid:7021)ा क(cid:7409) गई है ।

(ग) (cid:7408)कसी सांड को (cid:7408)कसी अ(cid:7008)य पु के नलए उसी अर्नभानति बाे म(cid:7286) नन(cid:7013)ननलनखत के नर्साय नह(cid:7277) रखा गया है—

(i) सांड(cid:7298) को उसी अर्नभानति बाे म(cid:7286) एक सा रखा ाि सकता है, य(cid:7408)दर् े सभी नसर और गद(cid:6981)न से सुरन(cid:6979)त ह(cid:7289) ;

या

(ii) ऐसे सांड(cid:7298) को, ननिको एक सा पाला गया है, उसी अर्नभानति बाे म(cid:7286) रखा ाि सकता है । (नसर या गद(cid:6981)न से सुरन(cid:6979)त (cid:7408)कए नबना) ।

(घ) छह मास से अनधक क(cid:7409) आयु के (cid:7408)कसी ूकर को उसी अर्नभानति बाे म(cid:7286) नह(cid:7277) रखा गया है नसिम(cid:7286) अ(cid:7008)य पु(cid:7312) को रखा गया है ; और

18. पु(cid:7312) को खाना और पानी देना- (1) पु(cid:7312) के (cid:7079)भारी (cid:7018)यन(cid:6989)त का यह सुननन(cid:7019)चत करने का कत(cid:6981)(cid:7018)य होगा (cid:7408)क बाािर म(cid:7286) पु के नलए, नतिनी बार भी र्आ(cid:7019)यकता हो, (cid:7009)यास के क(cid:7020)ट से नर्ना(cid:7407)रत करने के नलए (cid:7021र्)ा(cid:7021)(cid:7005)य(cid:7079)द लि क(cid:7409) योनचत मा(cid:7074)ा क(cid:7409) (cid:7018)र्य(cid:7021)ा क(cid:7409) गई है ।

(2) पु बाािर सनमनत यह सुननन(cid:7019)चत करेगी (cid:7408)क बाािर म(cid:7286) पु खा(cid:7378) साम(cid:7061)ी र्ननन(cid:7416)द(cid:7020)ट क(cid:7409)मत पर बेची गई है ।

(3) (cid:7408)कसी ऐसे पु के , नसिे बाािर म(cid:7286) एक (cid:7408)दन से आगे के नलए रखा गया है, (cid:7021र्)ामी (या उसके स(cid:7013)यक् (cid:7272)प से (cid:7079)ानधकृ त अनभकता(cid:6981)) का यह कत(cid:6981)(cid:7018)य होगा (cid:7408)क पु के नलए (cid:7021र्)ा(cid:7021)(cid:7005)य(cid:7079)द खा(cid:7378) और (cid:7021र्)ा(cid:7021)(cid:7005)य(cid:7079)द लि क(cid:7409) योनचत मा(cid:7074)ा क(cid:7409) (cid:7018)र्य(cid:7021)ा क(cid:7409) गई है—

(क) उस (cid:7408)दन के रान(cid:7074) नौ बेि से पहले, नसिको पु बाािर म(cid:7286) प(cid:7263)ंचता है या य(cid:7408)दर् ह बाािर म(cid:7286) रान(cid:7074) नौ बेि प(cid:7263)ंचता है तो उसके र् हां प(cid:7263)ंचने पर तुरंत ; और

(ख) उसके प(cid:7019)चात् (cid:7079)(cid:7004)येक छह घंटे क(cid:7409) संपूण(cid:6981) र्अनध म(cid:7286) कम से कम एक बार (उसके बाािर म(cid:7286) प(cid:7263)ंचने के (cid:7408)दन रान(cid:7074) नौ बेि से संगनणत), नसिके दौरान पु को बाािर म(cid:7286) रखा ािता है ।

19. (cid:7079)का और (cid:7014)या क(cid:7409) (cid:7018)र्य(cid:7021)ा- (1) पु बाािर सनमनत के सद(cid:7021)य सनर्च और (cid:7408)कसी बाािर म(cid:7286) (cid:7408)कसी पु के (cid:7079)भारी होने के समय (cid:7408)कसी अ(cid:7008)य (cid:7018)यन(cid:6989)त का यह सुननन(cid:7019)चत करने का कत(cid:6981)(cid:7018)य होगा (cid:7408)क बाािर म(cid:7286) पु का ननरी(cid:6979)ण करने और उसे खा(cid:7378) और लि देने म(cid:7286) सम(cid:6981) बनाने के नलए योनचत (cid:7079)का उपल(cid:7011)ध है ।

(2) पु बाािर सनमनत के सद(cid:7021)य सनर्च और (cid:7408)कसी बाािर म(cid:7286) (cid:7408)कसी पु के (cid:7079)भारी होने के समय (cid:7408)कसी अ(cid:7008)य (cid:7018)यन(cid:6989)त का यह सुननन(cid:7019)चत करने का कत(cid:6981)(cid:7018)य होगा (cid:7408)क पु(cid:7312) के नलए उपयु(cid:6989)त (cid:7014)या के योनचत (cid:7079)दाय क(cid:7409) (cid:7018)र्य(cid:7021)ा क(cid:7409) गई है ।

21. र्मेी के र्न(cid:7059)य पर ननब(cid:7304)धन.— पु बाािर सनमनत का सद(cid:7021)य सनर्च यह सुननन(cid:7019)चत करेगा (cid:7408)क-

(क) कोई (cid:7018)यन(cid:6989)त (cid:7408)कसी अ(cid:7016)र्पय पु को बाािर म(cid:7286) नह(cid:7277) लाएगा ;

(ख) कोई (cid:7018)यन(cid:6989)त (cid:7408)कसी र्मेी को बाािर म(cid:7286) तब तक नह(cid:7277) लाएगा, बि तक उसने प(cid:7263)ंचने पर र्मेी के (cid:7021र्)ामी या उसके (cid:7079)ानधकृ त अनभकता(cid:6981) (cid:7367)ारा -

(i) र्मेी के (cid:7021र्)ामी का नाम और पता बताते (cid:7263)ए ; ोटो पहचान सबूत क(cid:7409) एक (cid:7079)नत के सा ;

(ii) र्मेी के पहचान के (cid:7011)यौरे देते (cid:7263)ए;

(iii) यह कन करते (cid:7263)ए (cid:7408)क र्मेी को बाािर म(cid:7286)र् ध हेतु र्न(cid:7059)य के नलए नह(cid:7277) लाया गया है,

ह(cid:7021)ता(cid:6979)(cid:7407)रत नलनखत घोषणा नह(cid:7277) दे दी हो ।

(ग) पु बाािर सनमनत को दी गई (cid:7079)(cid:7004)येक घोषणा को उस तारीख से, नसिको यह उनको दी गई है, छह मास क(cid:7409) र्अनध के नलए रखा ािएगा और पु बाािर सनमनत उस र्अनध के दौरान (cid:7408)कसी भी युन(cid:6989)तयु(cid:6989)त समय पर ननरी(cid:6979)क (cid:7367)ारा क(cid:7409) गई मांग पर ऐसी घोषणा पे करेगी ता उसक(cid:7409) या उसके उ(cid:7373)रण क(cid:7409) एक (cid:7079)नत लेने के नलए अनु(cid:6980)ात करेगी ;

(घ) हिां (cid:7408)कसी पु को बेचा गया है और उसके बाािर से ले ािने से पहले पु बाािर सनमनत-

(i) (cid:7079)(cid:7004)येक पु के नलए उपगत, नलिा पु बाािर मानीटरी सनमनत (cid:7367)ारा या अनुमो(cid:7408)दत खच(cid:7287) अनभ(cid:7079)ा(cid:7009)त करेगी, नसिसे पु(cid:7312) और निता को आधारभूत (cid:7079)सुर्नधाएं (cid:7079)दान क(cid:7409) ाि सक(cid:7286) ;

(ii) यहर् चनबंध लेगी (cid:7408)क पु को कृ नष (cid:7079)योनि(cid:7298) के नलए लाया गया है औरर् ध के नलए नह(cid:7277) लाया गया है ;

(iii) (cid:7059)े ता के नाम और पते का अनभलेख रखेगी और उसका पहचान सबूत उपा(cid:7009)त करेगी ;

(iv) (cid:7408)कसी रा(िcid:7021र्) द(cid:7021)र्ताे िको देखकर यह स(cid:7004)यानपत करेगी (cid:7408)क (cid:7059)े ता एक कृ षक है ;

(v) यह सुननन(cid:7019)चत करेगी (cid:7408)क पु के (cid:7059)े ता ने यह घोषणा क(cid:7409) है (cid:7408)कर् ह पु को (cid:7059)य (cid:7408)कए ािने क(cid:7409) तारीख से छह मास तक नह(cid:7277) बेचेगा और पु क(cid:7409) मृ(cid:7004)यु क(cid:7409) दा म(cid:7286) (cid:7408)कसी सरकारी पु नच(cid:7408)क(cid:7004)सा अ(cid:7021)पताल सेर् परी(cid:6979)ा कराएगा और इस अनधननयम या त(cid:7004)समय (cid:7079र्)ृ(cid:7004)त (cid:7408)कसी अ(cid:7008)य र्ननध के अधीन पु(cid:7312) के प(cid:7407)र्रहन से संबंनधत ननयम(cid:7298) का पालन करेगा ;

(vi) ऐसे अनभलेख को र्न(cid:7059)य क(cid:7409) तारीख से छह मास क(cid:7409) र्अनध के नलए रखेगा ;

(vii) ऐसे अनभलेख को उस र्अनध के दौरान (cid:7408)कसी भी युन(cid:6989)तयु(cid:6989)त समय पर ननरी(cid:6979)क (cid:7367)ारा मांग (cid:7408)कए ािने पर उसके सम(cid:6979) (cid:7079)(cid:7021)तुत करेगा और उसक(cid:7409) या उसके उ(cid:7373)रण क(cid:7409) (cid:7079)नत लेने के नलए अनु(cid:6980)ात करेगा ।

(ड.) र्मेी का (cid:7059)े ता-

(i) पु कोर् ध के (cid:7079)योनि के नलए नह(cid:7277) बेचेगा ;

(ii) रा(cid:6996)य र्मेी संर(cid:6979)ण या प(cid:7407)रि(cid:6979)ण र्ननधय(cid:7298) का अनुसरण करेगा ;

(iii) (cid:7408)कसी धा(cid:7414)मक (cid:7079)योनि के नलए पु क(cid:7409) बनल नह(cid:7277) देगा ;

(iv) रा(cid:6996)य र्मेी संर(cid:6979)ण या प(cid:7407)रि(cid:6979)ण र्ननधय(cid:7298) के अनुसार अनु(cid:6980)ा के नबना रा(cid:6996)य के बाहर (cid:7408)कसी (cid:7018)यन(cid:6989)त को र्मेी नह(cid:7277) बेचेगा ।

(च) हिां (cid:7408)कसी र्मेी को बेचा ािता है, उसके बाािर से ले ािने से पहले र्न(cid:7059)य का सबूत पांच (cid:7079)नतय(cid:7298) म(cid:7286) ािरी (cid:7408)कया ािएगा, नसिम(cid:7286) से पहली (cid:7079)नत (cid:7059)े ता को, दूसरी (cid:7079)नत र्न(cid:7059)े ता को, तीसरी (cid:7079)नत (cid:7059)े ता के नर्नास के तहसीलदार काया(cid:6981)लय को, चौी (cid:7079)नत (cid:7059)े ता के नलिा म(cid:7286) मु(cid:6990)य पु नच(cid:7408)क(cid:7004)सक अनधकारी को स(cid:7301)पी ािएगी और अंनतम (cid:7079)नत पु बाािर सनमनत (cid:7367)ारा अनभलेख म(cid:7286) अर्नकल रखी ािएगी ।

22. पु बाािर सनमनत के अनत(cid:7407)र(cid:6989)त कत(cid:6981)(cid:7018)य.—पु बाािर सनमनत का यह सुननन(cid:7019)चत करने का कत(cid:6981)(cid:7018)य होगा (cid:7408)क बाािर म(cid:7286) गुरिने के सभी रा(cid:7021)त(cid:7298) को और ऐसे सभी बा(cid:7298) को, ननिम(cid:7286) पु(cid:7312) को रखा ािता है-

(क) (i) ऐसी रीनत म(cid:7286) संनन(cid:7414)मत और अनुरन(cid:6979)त (cid:7408)कया गया है, नसिसे पु(cid:7312) को कोई (cid:6979)नत का(cid:7407)रत होना या अर्ना(cid:7019)यक पीा या यातना होना संभा(cid:7018)य नह(cid:7277) हो ;

(ii) उसम(cid:7286) कोई ऐसे नुक(cid:7409)ले या बाहर ननकले (cid:7263)ए भाग नह(cid:7277) ह(cid:7289), नसिसे पु का संपक(cid:6981) हो सके ;

(ख) बाािर म(cid:7286) पु(cid:7312) के नलए (cid:7021र्)ा(cid:7021)(cid:7005)य(cid:7079)द लि का योनचत (cid:7079)दाय उपल(cid:7011)ध है ;

(ग) बाािर म(cid:7286) पु(cid:7312) को लि नपलाने के नलए (cid:7076)ोनणका, बान(cid:7016)टयां, पानी पीने के पा(cid:7074) या पानी पीने के अ(cid:7008)य साधन(cid:7298) के (cid:7272)प म(cid:7286) योनचत (cid:7079)सुर्नधाएं ह(cid:7289) ; और

(घ) बाािर म(cid:7286) छतदार र्आास, नसिम(cid:7286) पु(cid:7312) को रखा ािता है, योनचत (cid:7272)प से र्संानतत ह(cid:7298)गे ।

23. अयो(cid:6991)य पु(cid:7312) के नलए र्आास.—पु बाािर सनमनत का यह सुननन(cid:7019)चत करने का कत(cid:6981)(cid:7018)य होगा (cid:7408)क-

(क) ऐसे उपयु(cid:6989)त बाे उपल(cid:7011)ध ह(cid:7289), ननिम(cid:7286) (cid:7408)क(cid:7008)ह(cid:7277) अयो(cid:6991)य पु(cid:7312) को अ(cid:7008)य पु(cid:7312) से अलग रखा ाि सके ; और

(ख) ऐसा कोई भी बाा, नसिम(cid:7286) अयो(cid:6991)य पु को रखा गया है, (cid:7021)प(cid:7020)ट (cid:7272)प से नचन(cid:7022)नत (cid:7408)कया गया है, नसिसे यह द(cid:7414)त (cid:7408)कया ाि सके (cid:7408)क उसका (cid:7079)योग इस (cid:7079)योनि के नलए (cid:7408)कया गया है और यह (cid:7408)क बाे म(cid:7286) (cid:7079र्)े (cid:7408)कसी ननरी(cid:6979)क के (cid:7079)ानधकार के अधीन (cid:7408)दए ािने तक (cid:7079)नतनष(cid:7373) है ;

24. अयो(cid:6991)य पु(cid:7312) का ननरोध और उपचार.—(1) हिां (cid:7408)कसी पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क के पास यह र्न(cid:7019र्)ास करने का युन(cid:6989)तयु(cid:6989)त आधार है (cid:7408)क बाािर म(cid:7286) कोई पु अयो(cid:6991)य है, तोर् ह अयो(cid:6991)य पु(cid:7312) के र्आास के नलए बाािर म(cid:7286) उपल(cid:7011)ध (cid:7408)कसी बाे म(cid:7286) या बाािर म(cid:7286) (cid:7408)कसी अ(cid:7008)य उपयु(cid:6989)त (cid:7021)ान पर उसे भे िसके गा या नर्भाि सके गा और पु बाािर सनमनत से ऐसे पु को (cid:7408)कसी पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क (cid:7367)ारा उसक(cid:7409) परी(cid:6979)ा (cid:7408)कए ािने के लंनबत रहने तकर् हां नन(cid:7271)(cid:7373) करने क(cid:7409) अपे(cid:6979)ा कर सके गा ।

(2) हिां (cid:7408)कसी पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क क(cid:7409) यह राय है (cid:7408)क बाािर म(cid:7286) कोई भी पु अयो(cid:6991)य है, तोर् ह उसका उपचार कर सके गा, उपचार कर्रा सके गा और ऐसे अ(cid:7008)य दिम उठा सके गा या उर्ठा सके गा ोिर् ह उसे अर्ना(cid:7019)यक पीा या यातना से संरन(cid:6979)त करने के नलए र्आ(cid:7019)यक समझे औरर् ह (cid:7408)कसी ऐसे (cid:7079)योनि के नलए पु बाािर सनमनत से (cid:7408)कसी पु को इतने समय तक के नलए (cid:7408)कसी बाे म(cid:7286) नन(cid:7271)(cid:7373) करने क(cid:7409) अपे(cid:6979)ा कर सके गा, ोिर् ह आगे और उपचार के (cid:7079)योनि के नलए या उसे अर्ना(cid:7019)यक पीा या यातना से अ(cid:7008)या संरन(cid:6979)त करने के नलए र्आ(cid:7019)यक समझे ।

(3) हिां (cid:7408)कसी पु को इस ननयम के अधीन नन(cid:7271)(cid:7373) (cid:7408)कया गया है,र् हां कोई भी (cid:7018)यन(cid:6989)त (cid:7408)कसी पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क के अनुमोदन के नर्साय और ऐसी त(cid:7300) के अनुसार ले ािने के नर्साय, ननिके अ(cid:7007)यधीन अनुमोदन (cid:7408)कया गया है, उसके ननरोध के (cid:7021)ान से नह(cid:7277) ले ािएगा ।

(4) पु बाािर सनमनत-

(i) (cid:7408)कसी पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क को ऐसी सहायता देगी ोिर् ह इन ननयम(cid:7298) के अधीन उसक(cid:7409) न(cid:6989)तय(cid:7298) के (cid:7079)योग को सुकर बनाने के (cid:7079)योनि के नलए अपे(cid:6979)ा करे ;

(ii) (cid:7408)कसी पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क को ऐसी सूचना देगी, ोिर् ह (cid:7408)कसी ऐसे पु के (cid:7021र्)ानम(cid:7004र्) के बारे म(cid:7286) रखती है, नसिक(cid:7409) बाबत ऐसी न(cid:6989)त का (cid:7079)योग (cid:7408)कया गया है ।

(5) (cid:7408)कसी पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क (cid:7367)ारा (cid:7408)कसी अयो(cid:6991)य पु के उपचार करने म(cid:7286) या उपचार कराए ािने म(cid:7286) इन अनधननयम(cid:7298) (cid:7367)ारा उसको (cid:7079)द(cid:7004)त न(cid:6989)तय(cid:7298) के (cid:7079)योग म(cid:7286) उपगत खच(cid:7300) को पु के (cid:7021र्)ामी (cid:7367)ारार् हन (cid:7408)कया ािएगा ।

25. पु(cid:7312) का नच(cid:7022)नांकन.—पु नच(cid:7408)क(cid:7004)सा ननरी(cid:6979)क (cid:7408)कसी पु को नच(cid:7022)नां(cid:7408)कत कर सके गा या नच(cid:7022)नां(cid:7408)कत कर्रा सके गा, नसिके अंतग(cid:6981)त कण(cid:6981) टैग (cid:7367)ारा भी ह(cid:7289) (cid:7408)क(cid:7008)तु त(cid:7009)त छापा, ीत छापा और अ(cid:7008)य (cid:6979)नतकर नच(cid:7022)नांकन (cid:7079)नतनष(cid:7373) ह(cid:7298)गे ।

New Delhi, the 16th January, 2017

G.S.R. 34(E).—The following draft of certain rules, which the Central Government proposes to make in exercise of the powers conferred by section 38 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960), is hereby published, as required under subsection (1) of section 38 of the said Act, for the information of all the persons likely to be affected thereby; and notice is hereby given that the said rules shall be taken into consideration after the expiry of a10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public;

Objections or suggestions which may be received from any person with respect to the said draft rules before expiry of the period aforesaid will be considered by the Central Government;

Objections or suggestions to these draft rules may be addressed to the Deputy Secretary (Animal Welfare) to the Government of India in the Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, New Delhi.

DRAFT RULES

1. Short title and commencement.—(1) These rules may be called the Prevention of Cruelty to Animals (Regulation of Livestock Markets) Rules, 2016.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. Definitions.—In the rules, unless the context otherwise requires, -

(a) "Act" means the Prevention of Cruelty to Animals Act, 1960 (59 of 1960);

(b) "animals" means cattle, sheep, goat, horse, pony, donkey, mule, camel and all other ruminating animals, pig and poultry;

(c) "Animal Market Committee" means the committee formed under these rules which shall be responsible for the upkeep of a market or for the provision of fixed facilities there and for ensuring the welfare of the animals being traded;

(d) "calf" means a bovine animal under the age of six months;

(e) "cattle" means a bovine animal including bulls, bullocks, cows, buffalos, steers, heifers and calves and shall include camels;

(f) "fractious animal" means an animal that is likely to cause injury to other animals;

(g) "Inspector" means a person authorised as an inspector by the State Board or by a local authority or when used in relation to a person appointed by the Animal Husbandry Department, includes a veterinary inspector;

(h) "market" means a market place or sale-yard or any other premises or place to which animals are brought from other places and exposed for sale and includes any lairage adjoining a market or a slaughterhouse and used in connection with it and any place adjoining a market used as a parking area by visitors to the market for parking vehicles and includes animal fair and cattle pound where animals are offered or displayed for sale;

(i) "Poultry" means live birds of domestic fowls, turkeys, geese, ducks, guinea-fowls, pheasants, partridges and quails;

(j) "Prohibited practices" means practices that are harmful to animals and that cause unnecessary pain or suffering.

(k) "Society for Prevention of Cruelty to Animals (SPCA)" means a SPCA established under the Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of Cruelty to Animals) Rules 2001;

(l) "State Board" means the State Animal Welfare Board;

(m) "Unfit" includes animals who are young, in advanced pregnancy, infirm, diseased, ill, injured or fatigued;

(n) "Vehicle" means any vehicle (including a trailer of any description and the detachable body of a vehicle) constructed or adapted for use on a road;

(o) "veterinary inspector" means a registered veterinarian authorised by the local authority;

(p) "young animal" means any animal below the age of six months;

(q) words and expressions used in these rules and not defined but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Establishment of District Animal Market Monitoring Committee.— The District Collector or District Magistrate, as the case may be, in consultation with State Board shall constitute Animal Market Monitoring Committee for regulation of animal markets in the district.

(2) The Committee referred to in sub-rule (1) shall consist of the following members, namely:-

(a) District Collector or District Magistrate – Chairman;

(b) Chief Veterinary Officer – Member Secretary;

(d) Jurisdictional Superintendent of Police;

(e) a representative of the SPCA;

(f) two representatives from Animal Welfare Organisation recognised by the Board and as approved by the State Government.

(3) Six members shall form the quorum for the meeting of the Committee.

(4) A person who has been charged under the Act or any cattle preservation law made by a State Government shall be prohibited from being the member of the Committee and shall not be involved in the regulation of the animal market.

4. Establishment of Animal Market Committee.— The local authority, in consultation with State Board, shall constitute Animal Market Committee for the management of animal markets in the district.

(2) The Committee referred to in sub-rule (1) shall consist of the following members, namely:-

(a) Chairman of local authority - Chairman;

(b) Chief Municipal Officer or Chief Officer of local authority - Member Secretary;

(d) Jurisdictional Forest Range Officer;

(e) Jurisdictional Veterinary Officer;

(f) Jurisdictional Police Inspector;

(g) a representative of the SPCA;

(h) two representatives from Animal Welfare Organisation recognised by the Board and as approved by the State Government.

(3) Four members shall form the quorum for the meeting of the Committee.

(4) A person who has been charged under the Act or any cattle preservation law made by a State Government shall be prohibited from being a member of the Committee and shall not be involved in the management of the animal market.

(5) The Member Secretary shall ensure the compliance of these rules.

5. Registration of existing markets.—(1) The local authority shall make a list of markets functional prior to the commencement of these rules.

(2) Every market functional prior to the commencement of these rules shall within three months from the date such commencement register themselves with the District Animal Market Monitoring Committee by making an application to the Committee.

(3) The District Animal Market Monitoring Committee before granting registration shall ensure that all requirements as stipulated in these rules are fulfilled in the market.

(4) The District Animal Market Monitoring Committee shall ensure that the animal market has adequate- (i) housing;

(ii) shade;

(iii) feeding troughs, water tanks with multiple taps and buckets;

(iv) lighting;

(v) ramps at the appropriate height of vehicles;

(vi) separate enclosures for sick and infirm animals;

(vii) separate enclosures for young and pregnant animals;

(viii) veterinary facility;

(ix) feed storage area;

(x) water supply;

(xi) toilets.

(5) The District Animal Market Monitoring Committee shall determine the maximum holding capacity of the market and that shall be displayed in a prominent place in the market.

(6) The District Animal Market Monitoring Committee, while granting registration, may impose such conditions as it deems fit to ensure compliance of these rules.

(7) If the District Animal Market Monitoring Committee rejects the application then the market shall cease to exist from the date of rejection.

(8) The District Animal Market Monitoring shall dispose of the application for registration within one month from the date of filing the application.

6. Establishment of new markets.—(1) When local authority deems fit and necessary to establish an animal market within its jurisdiction, it shall identify a suitable location and develop a blueprint of the market.

(2) The District Animal Market Monitoring Committee may approve the blueprint of the market or seek further modification or reject the proposal for reasons to be recorded in writing.

(3) Every new market shall apply for registration, to the District Animal Market Monitoring Committee.

(4) The District Animal Market Monitoring Committee shall, before granting registration and before commissioning of the market, ensure that all requirements as stipulated in these rules are fulfilled in the market.

(5) The District Animal Market Monitoring Committee shall ensure that the animal market has adequate- (i) housing;

(ii) shade;

(iii) feeding troughs, water tanks with multiple taps;

(iv) lighting;

(v) ramps at the height of vehicles;

(vi) separate enclosures for sick and infirm animals;

(vii) separate enclosures for young and pregnant animals;

(viii) veterinary facility;

(ix) feed storage area;

(x) water supply;

(xi) toilets.

(6) The District Animal Market Monitoring Committee shall determine the maximum holding capacity of the market and that shall be displayed in a prominent place in the market.

(7) The District Animal Market Monitoring Committee, while granting registration, may impose such conditions as it deems fit to ensure compliance of these rules.

(8) The District Animal Market Monitoring Committee shall dispose of the application for registration within one month from the date of filing the application.

7. Additional precaution to be taken with markets in border area.—The District Animal Market Monitoring Committee shall take steps to ensure that no animal market is organised in a place which is situated within fifty kilometers from any State border or which is situated within hundred kilometers from any international border.

8. Cancellation of registration of market.—If the District Animal Market Monitoring Committee, suo moto or on receipt of a complaint, comes to the conclusion that a market is functioning in contravention of these rules, it may direct the cancellation of registration of such market after giving reasonable opportunity of being heard.

9. Powers of State Board to issue directions, etc.—(1) The State Board may from time to time give such directions to the local authority and the State Animal Husbandry Department as it may deem fit to facilitate compliance with these rules.

(2) The District Animal Market Monitoring Committee and Animal Market Committee shall provide all records and information pertaining to the functioning of market to the State Board as and when it is required and the State Board may call for additional records and information as it deems fit.

10. Powers of State Board, etc. to authorise inspection and seizure.— For the purpose of ensuring compliance with these rules, the State Board, local authority, District Animal Market Monitoring Committee or State Animal Husbandry Department may authorise any of its officers in writing to inspect any market, and report to the State Board, local authority, District Animal Market Monitoring Committee or State Animal Husbandry Department, as the case may be, the result of such inspection, and any officer or person so authorised may –

(a) enter at reasonable time to inspect the market;

(b) require any person to produce any record kept by him with respect to the market;

(c) seize any animal if he has reason to believe that the animals are being treated cruelly and the animals so seized shall be kept in the custody of the local SPCA or an animal welfare organisation recognised by the Board;

(d) take photographic and video proof of cruelty to animals.

11. Veterinarians at markets.—(1) Every market shall have adequate number of veterinary inspectors authorised by the District Animal Market Monitoring Committee.

(2) The veterinary inspector shall screen the animals before entering the market, for suspected contagious and infectious diseases such as Foot and Mouth Disease, Glanders, Strangles, Peste des petits, Rinder Pest, etc. by looking for the cardinal symptoms and the suspected animals shall not be allowed to enter the market area and shall be treated at the nearest veterinary hospital or sent back for necessary treatment and care.

(3) The veterinary inspector shall supervise the unloading and arrival of animals at the market and inspect all animals as soon as practical after their arrival and deal appropriately with any animals that are ill, sick or injured.

(4) The veterinary inspector shall make the required checks of the load against the transport documentation produced before him.

(5) The veterinary inspector shall treat or supervise the treatment of any animals that are ill, sick or injured in the isolation facilities in the market.

(6) The veterinary inspector shall monitor the handling of all animals in the market and ensure that animals are handled humanely at all times.

(7) The veterinary inspector shall supervise the loading of animals from the market and ensure that all animals are fit for the intended journey and provide the necessary veterinary certification.

(8) The veterinary inspector shall maintain records of all animals inspected, treated, number of veterinary clarifications issued, number of animals found unfit for transport and what actions was initiated when an animal was found unfit for transport.

(9) The veterinary inspector shall ensure that the provision for emergency euthanasia of animals that have irreparable severe injury or are terminally ill and cannot be uploaded on vehicles because to do so would cause unnecessary pain or suffering, are available in a market.

12. Unfit animals and animals likely to give birth.—(1) No person shall permit an unfit animal to be sold in a market.

(2) No person shall permit an animal to be offered or displayed for sale in a market if it is likely to give birth while it is there or during its transportation.

13. Prohibited practices that are cruel and harmful.—The following cruel and harmful practices shall be prohibited, namely:-

(a) animal identification methods such as hot branding and cold branding;

(b) shearing and painting of horns;

(d) use of any chemicals or colors on body parts of animals;

(e) sealing teats of the udder using any material such as adhesive tapes to prevent the calf from suckling;

(f) any person forcefully drenching any fluids or liquids, other than by a veterinarian for the purpose of treatment;

(g) forcing animals to perform any unnatural acts, such as dancing;

(h) putting any ornaments or decorative materials on animals;

(i) use of any type of muzzle to prevent animals from suckling or eating food.

14. Protection of animals from injury or unnecessary pain or suffering.—(1) No person shall cause or permit any injury or unnecessary pain or suffering to an animal in a market.

(2) It shall be the duty of the person in charge of an animal in a market to ensure that the animal is not, or is not likely to be, caused injury or unnecessary pain or suffering by reason of—

(a) the animal being exposed to the weather;

(b) inadequate ventilation being available for the animal;

(c) the animal being hit or prodded by any instrument or other thing; nose ropes or nose pegs or bits are pulled, yanked and jerked, causing immeasurable pain and suffering or any other cause;

(d) being tethered on a short rope for an unreasonable period;

(e) thirst or starvation.

15. Handling and tying of animals.—(1) No person shall handle an animal in a market by—

(a) lifting it off the ground , other than poultry for weighing propose;

(b) dragging it along the ground;

(d) head, neck, ears, horns, legs, feet, tail, fleece or wing.

(2) No person shall—

(a) tie up or muzzle any calf;

(b) tether an animal by both forelegs and hindlegs in such a way that it will prevent the animal from taking a step forward or backward to ease the discomfort of standing at one place for long hours;

(c) tie an animal by head or neck from both the sides which will prevent the animal from moving its head and neck in any direction or attending the self needs such as driving away flies or licking body parts;

(d) tie more than one animal using one single rope;

(e) use abrasive or sharp materials to tether or tie the animals that may cause injuries;

(f) tie any poultry by neck, leg or wing or carry poultry upside down.

16. Control of animals.—(1) No person shall use excessive force to control any animal in a market, including but not limited to breaking of tail, hitting with stick, goad or other instrument, rubbing chilly or any other substance in the eyes, nose rings.

(2) No person shall drive or lead any animal over any ground or floor, the nature or condition of which is likely to cause the animal to slip or fall.

17. Penning and caging of animals.—(1) It shall be the duty of Member Secretary of the Animal Market Committee to ensure that no animal is kept in a pen, cage or other enclosures, which is unsuitable for the size and species of that animal.

(2) It shall be the duty of Member Secretary of the Animal Market Committee to ensure that—

(a) any pen in which any calves or pigs are kept is of sufficient size to enable all the calves or pigs kept in it to lie down, stand up, and turn around and make normal postural adjustments at the same time;

(b) any cage or enclosure in which any poultry are kept—

(i) is of such a design as to enable the poultry to stand, lie down, spread wings and turn around and make normal postural adjustment in their natural position;

(ii) has a door which is of sufficient size to enable the poultry to be placed in, and removed from, the cage or enclosure without being caused any injury or unnecessary pain or suffering.

(3) It shall be the duty of Member Secretary of the Animal Market Committee to ensure that, within the market,—

(a) when animals are penned,—

(i) those of one species are kept in separate pens from animals of another species;

(ii) they are distributed within the pens, having regard to differences in age and size, so as to avoid unnecessary pain or suffering to them;

(iii) any fractious animal is kept in a separate pen, cage or enclosure from other animals;

(iv) they are not kept in pens, cages or enclosures which are overcrowded;

(b) adequate provision is made to prevent animals from—

(i) escaping from the market;

(ii) coming into contact with any aggressive or fractious animals in the market;

(i) bulls may be kept together in the same undivided pen if they are all secured by the head or neck; or

(ii) bulls which have been reared together may be kept together in the same undivided pen (without being secured by the head or neck);

(d) a boar over the age of six months is not kept in the same undivided pen as any other animal; and (e) animals and young animals are not kept in the same undivided pen as any other animals, except where they originate from the same group of animals and are of a mutually acceptable disposition.

18. Feeding and watering of animals.—(1) It shall be the duty of the person in charge of an animal to ensure that the animal in a market is provided with an adequate quantity of wholesome water as often as is necessary to prevent it suffering from thirst.

(2) The Animal Market Committee shall ensure that animal feed is sold at a market at a specified price.

(3) It shall be the duty of the owner (or his duly authorised agent) of an animal which is kept in a market from one day to the next to ensure that the animal is provided with an adequate quantity of wholesome food wholesome water—

(a) before 9 p.m. on the day on which the animal arrives at the market or, if it arrives at the market after 9 p.m., immediately on its arrival there; and

(b) thereafter at least once in each complete period of six hours (calculated from 9 p.m. on the day of its arrival at the market) during which the animal is kept in the market.

19. Provision of lighting and bedding.—(1) It shall be the duty of Member Secretary of the Animal Market Committee and other person for the time being in charge of an animal in a market to ensure that adequate lighting is available to enable animals kept in the market to be inspected and to be fed and watered.

(2) It shall be the duty of Member Secretary of the Animal Market Committee and other person for the time being in charge of an animal in a market to ensure that an adequate supply of suitable bedding is provided for animals.

20. Covered accommodation.— It shall be the duty of Member Secretary of the Animal Market Committee to provide covered accommodation in the market for animals.

21. Restrictions on sale of cattle.— The Member Secretary of the Animal Market Committee shall ensure that- (a) no person shall bring to a market a young animal;

(b) no person shall bring a cattle to a market unless upon arrival he has furnished a written declaration signed by the owner of the cattle or his duly authorised agent—

(i) stating the name and address of the owner of the cattle, with a copy of the photo identification proof ;

(ii) giving details of the identification of the cattle ;

(iii) stating that the cattle has not been brought to market for sale for slaughter;

(c) every declaration furnished to the Animal Market Committee shall be retained by it for a period of six months from the date on which it is furnished to them and the Animal Market Committee shall, on demand made by an Inspector at any reasonable time during that period, produce such declaration and allow a copy of it or an extract from it to be taken;

(d) where an animal has been sold and before its removal from the market, the Animal Market Committee shall—

(i) obtain the expenses incurred for each animal, as approved by the District Animal Market Monitoring Committee, so as to provide the basic facilities for animals and people;

(ii) take an undertaking that the animals are bought for agriculture purposes and not for slaughter;

(iii) keep a record of name and address of the purchaser and procure his identity proof;

(iv) verify that the purchaser is an agriculturist by seeing any revenue document;

(v) ensure that the purchaser of the animal gives a declaration that he shall not sell the animal up to six months from the date of purchase and in case of death of the animal, he shall get post mortem done from a Government veterinary hospital and shall abide by the rules relating to transport of animals made under this Act or any other law for the time being in force;

(vi) retain such record for a period of six months from the date of sale;

(vii) produce such record before an Inspector on demand being made by him at any reasonable time during that period and allow a copy of it or an extract from it to be taken;

(e) the purchaser of the cattle shall –

(i) not sell the animal for slaughter purpose;

(ii) follow the State cattle protection or preservation laws;

(iii) not sacrifice the animal for any religious purpose;

(iv) not sell the cattle to a person outside the State without the permission as per the State cattle protection or preservation laws;

(f) where a cattle has been sold and before its removal from the market, the proof of sale shall be issued in five copies, out of which first copy shall be handed over to purchaser, second copy to seller, third copy to tehsil office of the residence of purchaser, fourth copy to the Chief Veterinary Officer in the district of purchaser and last copy to be kept intact in the record by the Animal Market Committee.

22. Additional duties of Animal Market Committee.— It shall be the duty of the Animal Market Committee to ensure that—

(a) all passageways in the market and all pens in which animals are kept—

(i) are constructed and maintained in a manner which is not likely to cause injury or unnecessary pain or suffering to animals;

(ii) are free from any sharp edges or projections with which animals may come into contact;

(b) a market have an adequate supply of wholesome water available for animals;

(c) a market have adequate facilities in the form of troughs, buckets, drinking bowls or other drinking devices available for watering animals; and

(d) the covered accommodation in the market in which animals are kept shall be adequately ventilated.

23. Accommodation for unfit animals.— It shall be the duty of the Animal Market Committee to ensure that—

(a) suitable pens are available in which any unfit animals may be separated from other animals; and (b) any such pen in which an unfit animal is being kept is clearly marked so as to show that it is being used for this purpose and that entry into the pen is prohibited unless under the authority of an inspector.

24. Detention and treatment of unfit animals.—(1) Where a veterinary inspector has reasonable grounds for believing that any animal in a market is unfit, he may move it, or cause it to be moved, to a pen provided in the market for the accommodation of unfit animals or to any other suitable place in the market and require the Animal Market Committee to detain the animal there pending its examination by a veterinary inspector.

(2) Where a veterinary inspector is of the opinion that any animal in a market is unfit, he may treat it, or cause it to be treated, and take, or cause to be taken, any other steps that he considers necessary to protect it from unnecessary pain or suffering, and he may for any such purpose require the Animal Market Committee to detain the animal in a pen for as long as he considers necessary for the purpose of further treatment or otherwise protecting it from unnecessary pain or suffering.

(3) Where an animal is being detained under this rule, no person shall move it from its place of detention except with the approval of a veterinary inspector and in accordance with any conditions subject to which the approval is given.

(4) The Animal Market Committee shall—

(i) render such assistance to a veterinary inspector as he may require for the purpose of facilitating the exercise of his powers under these rules;

(ii) give to a veterinary inspector such information as it possesses as to the ownership of any animal in respect of which any such power is exercised.

(5) Expenses incurred by a veterinary inspector in treating, or causing to be treated, an unfit animal in exercise of the powers conferred on him by these rules shall be borne by the owner of the animal.

25. Marking of animals.—The veterinary inspector may mark, or cause to be marked, any animal including by ear tags but hot branding, cold branding and other injurious marking shall be prohibited.

26. Ramps.—Where, at any time after the coming into force of these rules, any premises are constructed for use as a market, it shall be the duty of the Animal Market Committee for that market to ensure that facilities are provided in the market for the purpose of loading and unloading cattle, sheep, goats, horses, ponies, donkeys, camels and pigs into and out of vehicles and that those facilities consist of fixed ramps or other facilities which are of a height and design suitable and as specified for that purpose; and it shall be the duty of the Animal Market Committee to ensure that any fixed ramp or other facilities which are so provided are fitted with side railings (or some other means of protection) designed and constructed so as to prevent such animals from falling off them.

4. मुदिमा लंनबत रहने के दौरान पु क(cid:7409) देखरेख और रखने क(cid:7409) लागत- (1) रा(cid:6996)य बोड(cid:6981) इन ननयम(cid:7298) के (cid:7079)ारंभ क(cid:7409) तारीख से तीस मास के भीतर और उसके प(cid:7019)चात् (cid:7079)(cid:7004)येकर् ष(cid:6981) 1 अ(cid:7079)ैल को ऐसे पु क(cid:7409), ोि रा(cid:6996)य म(cid:7286) सामा(cid:7008)यत: अनभगृहीत (cid:7408)कए ािते ह(cid:7289), (cid:7079)(cid:7004)येक (cid:7079)ािनत के नलए (cid:7079)नत(cid:7408)दन प(cid:7407)र्रहन, भरणपोषण और उपचार क(cid:7409) लागत र्ननन(cid:7416)द(cid:7020)ट करेगी ।

(3) उस दा म(cid:7286) बि र्नचाराधीन पु रा(cid:6996)य बोड(cid:6981) (cid:7367)ारा र्ननन(cid:7416)द(cid:7020)ट दर सूची पर नह(cid:7277) है, नलिा मन(िcid:7021)(cid:7069)ेट या (cid:7079)ेनसड(cid:7286)सी नगर म(cid:7286) पुनलस आयु(cid:6989)त पु(cid:7312) के प(cid:7407)र्रहन, उपचार और भरणपोषण क(cid:7409) लागत उस एसपीसीए या (cid:7410)परिापोल (cid:7367)ारा, नसिम(cid:7286) पु को रखा गया है, दी गई सूचना के आधार पर ननयत करेगा ।

5. बंधप(cid:7074) का नन(cid:7020)पादन- (1) मन(िcid:7021)(cid:7069)ेट पु को (cid:7408)कसी (cid:7271)(cid:6991)र्णाास, (cid:7410)परिापोल, एसपीसीए, पु क(cid:7016)याण संगठन, या गोाला को अनभर(cid:6979)ा स(cid:7301)पते समयर् ह रकम र्अधा(cid:7407)रत करेगा ोि अनधका(cid:7407)रतार् ाले पु नच(cid:7408)क(cid:7004)सा अनधकारी (cid:7367)ारा दी गई सूचना के आधार पर पु के प(cid:7407)र्रहन, भरणपोषण और उपचार के नलए उपगत या उपगत क(cid:7409) ािने के नलए (cid:7079)(cid:7004)यानत सम(cid:7021)त युन(cid:6989)तयु(cid:6989)त लागत का (cid:7079)नतसंदाय करने के नलए पया(cid:6981)(cid:7009)त हो और अनभयु(cid:6989)त ता (cid:7021र्)ामी को र्अधा(cid:7407)रत मू(cid:7016)य का बंधप(cid:7074) (cid:7079)नतभु(cid:7312) सनहत तीन (cid:7408)दन के भीतर नन(cid:7020)पा(cid:7408)दत करने का ननदे देगा और य(cid:7408)द अनभयु(cid:6989)त ता (cid:7021र्)ामी बंधप(cid:7074) नन(cid:7020)पा(cid:7408)दत नह(cid:7277) करते ह(cid:7289) तो पु, पु क(cid:7016)याण संगठन, (cid:7271)(cid:6991)र्णाास या (cid:7410)परिापोल को समप(cid:7265)त हो ािएगा ।

(2) पु क(cid:7409) अनभर(cid:6979)ा रखनेर् ाला (cid:7271)(cid:6991)र्णाास, (cid:7410)परिापोल, एसपीसीए, पु क(cid:7016)याण संगठन या गोाला पान(cid:6979)क आधार पर बंधप(cid:7074) से पु क(cid:7409) अनभर(cid:6979)ा (cid:7079)ा(cid:7009)त करने क(cid:7409) तारीख से उसके अंनतम (cid:7018)ययन क(cid:7409) तारीख तक पु क(cid:7409) देखरेख म(cid:7286) उपगतर् ा(cid:7021)तर्नक युन(cid:6989)तयु(cid:6989)त लागत का आहरण कर सके गा ।

(3) मन(िcid:7021)(cid:7069)ेट अनभयु(cid:6989)त और (cid:7021र्)ामी से (cid:7079)ारंनभक बंधप(cid:7074) का अ(cid:7021)सी (cid:7079)नतत पु क(cid:7409) देखरेख क(cid:7409) लागत म(cid:7286) खच(cid:6981) हो ािने पर (cid:7079)नतभु(cid:7312) सनहत अनत(cid:7407)र(cid:6989)त बंधप(cid:7074) नन(cid:7020)पा(cid:7408)दत करने क(cid:7409) मांग करेगा ।

(8) य(cid:7408)द (cid:7021र्)ामी और अनभयु(cid:6989)त के पास बंधप(cid:7074) देने के साधन नह(cid:7277) ह(cid:7289) तो मन(िcid:7021)(cid:7069)ेट (cid:7021)ानीय (cid:7079)ानधकरण को अंत(cid:7414)लत लागत का न(िcid:7013)मा लेने और उसे भूरा(िcid:7021र्) के बकाया के (cid:7272)प म(cid:7286)र् सूल करने का ननदे देगा ।

6. प(cid:7407)र(cid:7004)य(cid:6989)त पु- (1) उस दा म(cid:7286) हिां अ(cid:7008र्)ेषक अनधकारी यह (cid:7407)रपोट(cid:6981) ाइल करता है (cid:7408)क (cid:7079)म दृ(cid:7020)टया अनधननयम के अधीन अपराध पाया गया है (cid:7412)कतुर् ह अनभयु(cid:6989)त या पु के (cid:7021र्)ामी का र्अधारण करने म(cid:7286) असम(cid:6981) है तो मन(िcid:7021)(cid:7069)ेट (cid:7021)ानीय (cid:7079)ानधकरण को अंर्त(cid:7414)लत लागत का न(िcid:7013)मा लेने का ननदे देगा और यह समझा ािएगा (cid:7408)क (cid:7021र्)ामी ने पु के (cid:7021र्)ानम(cid:7004र्) का (cid:7004)याग कर (cid:7408)दया है ।

(2) (cid:7021र्)ानम(cid:7004र्) का (cid:7004)याग अ(cid:6980)ात अपराधी या (cid:7021र्)ामी के र्न(cid:7271)(cid:7373) (cid:7408)क(cid:7008)ह(cid:7277) दांनडक आरोप(cid:7298) को (cid:7079)भार्नत नह(cid:7277) करेगा ।

7. (cid:7021र्)ैन(cid:6994)छक (cid:7004)याग- इस ननयम क(cid:7409) (cid:7408)कसी बात का अ(cid:6981) (cid:7021र्)ामी (cid:7367)ारा (cid:7408)कसी पु को बंधप(cid:7074) के नन(cid:7020)पादन के बदले एसपीसीए, पु क(cid:7016)याण संगठन, (cid:7271)(cid:6991)र्णाास या (cid:7410)परिापोल को (cid:7021र्)ैन(cid:6994)छक और (cid:7021)ायी (cid:7004)याग करने से रोकना नह(cid:7277) होगा (cid:7412)कतु (cid:7021र्)ैन(cid:6994)छक और (cid:7021)ायी (cid:7004)याग, अनभयु(cid:6989)त या (cid:7021र्)ामी के र्न(cid:7271)(cid:7373) (cid:7412)कही दांनडक आरोप(cid:7298) को (cid:7079)भार्नत नह(cid:7277) करेगा ।

8. मुदिम(cid:7286) के ननपटारे पर पु क(cid:7409) (cid:7079)ान(cid:7021)नत- (1) य(cid:7408)द अनभयु(cid:6989)त को दोषनस(cid:7373) (cid:7408)कया ािता है यार् ह दोषी होने का अनर्भाक् करता है तो मन(िcid:7021)(cid:7069)ेट उसे पु(cid:7312) के (cid:7021र्)ानम(cid:7004र्) से र्ंनचत कर देगा और अनभगृहीत पु को पहले से ही अनभर(cid:6979)ा रखने र्ाले (cid:7271)(cid:6991)र्णाास, (cid:7410)परिापोल, एसपीसीए, पु क(cid:7016)याण संगठन, या गोाला को उनचत द(cid:7004)तक (cid:7061)हण या अ(cid:7008)य (cid:7079)कार से (cid:7018)ययन के नलए समप(cid:7265)त कर देगा ।

(2) य(cid:7408)द अनभयु(cid:6989)त को सभी आरोप(cid:7298) से दोषमु(cid:6989)त पाया ािता है तो अनभगृहीत पु अनभयु(cid:6989)त या (cid:7021र्)ामी को लौटा (cid:7408)दया ािएगा, य(cid:7408)दर् ह (cid:7008)यायालय के समाधान(cid:7079)द (cid:7272)प म(cid:7286) यह (cid:7079)द(cid:7414)त कर सकता है (cid:7408)कर् ह पु क(cid:7409) पया(cid:6981)(cid:7009)त देखरेख कर सकता है और करेगा ता नन(cid:7020)पा(cid:7408)दत (cid:7408)कसी बंधप(cid:7074) का अ(cid:7079)यु(cid:6989)त भाग उस (cid:7018)यन(cid:6989)त को लौटा (cid:7408)दया ािएगा, नसिने बंधप(cid:7074) नन(cid:7020)पा(cid:7408)दत (cid:7408)कया ा (cid:7412)कतु ऐसे बंधप(cid:7074) के पहले से ही (cid:7079)यु(cid:6989)त (cid:7408)कसी भाग क(cid:7409)र् सूली नह(cid:7277) क(cid:7409) ाि सके गी ।

9. द(cid:7004)तक (cid:7061)हण या अ(cid:7008)य (cid:7079)कार से (cid:7018)ययन क(cid:7409) (cid:7079)(cid:7408)(cid:7059)या- (1) मुदिमे के दौरान या मुदिम(cid:7286) के प(cid:7019)चात् पु क(cid:7409) अनभर(cid:6979)ा रखनेर् ाला (cid:7271)(cid:6991)र्णाास, (cid:7410)परिापोल, एसपीसीए, पु क(cid:7016)याण संगठन या गोाला अनधननयम क(cid:7409) धारा 13 के अनुसार उसक(cid:7409) अनभर(cid:6979)ा म(cid:7286) के पु को सह िमृ(cid:7004)यु दे सके गा ।

(2) हिां पु को दोषनसन(cid:7373), प(cid:7407)र(cid:7004)याग या (cid:7021र्)ैन(cid:6994)छक (cid:7004)याग के प(cid:7019)चात् (cid:7271)(cid:6991)र्णाास, (cid:7410)परिापोल, एसपीसीए, पु क(cid:7016)याण संगठन, या गोाला को समप(cid:7265)त कर (cid:7408)दया गया हैर् हां पु को द(cid:7004)तक (cid:7061)हण के नलए रख (cid:7408)दया ािएगा ।

(3) ऐसा (cid:7018)यन(cid:6989)त, ोि इस अनधननयम या रा(cid:6996)य सरकार (cid:7367)ारा बनाए गए (cid:7408)कसी र्मेी प(cid:7407)रि(cid:6979)ण र्ननध के अधीन आरोनपत है, (cid:7271)(cid:6991)र्णाास, (cid:7410)परिापोल, एसपीसीए, पु क(cid:7016)याण संगठन, या गोाला से पु को द(cid:7004)तक (cid:7061)हण म(cid:7286) लेने से (cid:7079)नतनष(cid:7373) होगा ।

(4) (cid:7271)(cid:6991)र्णाास, (cid:7410)परिापोल, एसपीसीए, पु क(cid:7016)याण संगठन, या गोाला पु को द(cid:7004)तक (cid:7061)हण म(cid:7286) देने से पहले,-

(क) र्मेी क(cid:7409) दा म(cid:7286) प प(cid:7074) के (cid:7272)प म(cid:7286) यहर् चनबंध लेगा (cid:7408)क पु को द(cid:7004)तक (cid:7061)हण म(cid:7286) कृ नष (cid:7079)योनि(cid:7298) के नलए न (cid:7408)कर् ध के नलए नलया गया है और सुसंगत रा(िcid:7021र्) द(cid:7021)र्ताे िदेखकर यह स(cid:7004)यानपत करेगा (cid:7408)क पु का द(cid:7004)तक (cid:7061)हण म(cid:7286) लेनेर् ाले (cid:7018)यन(cid:6989)त एक कृ षक है ।

(ख) भार ढोनेर् ाले और ल(cid:7006)दू पु(cid:7312) क(cid:7409) दा म(cid:7286) प प(cid:7074) के (cid:7272)प म(cid:7286) यहर् चनबंध लेगा (cid:7408)क पु(cid:7312) को द(cid:7004)तक (cid:7061)हण म(cid:7286) भार ढोने और लादने के (cid:7079)योनि(cid:7298) के नलए न (cid:7408)कर् ध के नलए नलया गया है ।

(ग) कु (cid:7004)त(cid:7298) और नबन(cid:7016)लय(cid:7298) क(cid:7409) दा म(cid:7286) यह सुननन(cid:7019)चत करेगा (cid:7408)क द(cid:7004)तक (cid:7061)हण म(cid:7286) देने से पहले पु को अंडाय उ(cid:6994)छे(cid:7408)दत और नपु ंसक कर (cid:7408)दया गया है ।

(घ) पु को द(cid:7004)तक (cid:7061)हण म(cid:7286) लेनेर् ाले (cid:7018)यन(cid:6989)त का नाम और पते का अनभलेख रखेगा और पु को द(cid:7004)तक (cid:7061)हण म(cid:7286) लेनेर् ाले (cid:7018)यन(cid:6989)त का पहचान का सबूत और पते का सबूत उपा(cid:7009)त करेगा ।

(ड.) पु को द(cid:7004)तक (cid:7061)हण म(cid:7286) लेनेर् ाले (cid:7018)यन(cid:6989)त से प प(cid:7074) के (cid:7272)प म(cid:7286) यह घोषणा अनभ(cid:7079)ा(cid:7009)त करेगा (cid:7408)कर् ह पु का द(cid:7004)तक (cid:7061)हण क(cid:7409) तारीख से छह मास तक अ(cid:7008)य सं(cid:7059)ामण नह(cid:7277) करेगा और पु क(cid:7409) मृ(cid:7004)यु क(cid:7409) दा म(cid:7286) (cid:7408)कसी सरकारी पु नच(cid:7408)क(cid:7004)सा अ(cid:7021)पताल से उसक(cid:7409)र् परी(cid:6979)ा कर्राएगा और उसके प(cid:7407)र्रहन के नलए अनधननयम या त(cid:7004)समय (cid:7079र्)ृ(cid:7004)त (cid:7408)कसी अ(cid:7008)य र्ननध के अधीन र्नरनचत ननयम(cid:7298) का पालन करेगा और पु क(cid:7409) ननयनमत पु नच(cid:7408)क(cid:7004)सा ािंच कर्राएगा ।

(5) पु को द(cid:7004)तक (cid:7061)हण म(cid:7286) लेनेर् ाला (cid:7018)यन(cid:6989)त-

(क) द(cid:7004)तक गृहीत पु को नह(cid:7277) बेचेगा;

(ख) पु का प(cid:7407)र(cid:7004)याग नह(cid:7277) करेगा;

(ग) रा(cid:6996)य र्मेी संर(cid:6979)ण और प(cid:7407)रि(cid:6979)ण र्ननध का अनुसरण करेगा;

(घ) (cid:7408)कसी धा(cid:7414)मक (cid:7079)योनि के नलए पु क(cid:7409) बनल नह(cid:7277) देगा;

(ड.) रा(cid:6996)य र्मेी संर(cid:6979)ण और प(cid:7407)रि(cid:6979)ण र्ननध के अनुसार अनु(cid:6980)ा के नबना रा(cid:6996)य के बाहर (cid:7408)कसी (cid:7018)यन(cid:6989)त को र्मेी को नह(cid:7277) बेचेगा ।

G.S.R.35(E).—The following draft of certain rules, which the Central Government proposes to make in exercise of the powers conferred under section 38 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960), is hereby published, as required under subsection (1) of section 38 of the said Act, for the information of all the persons likely to be affected thereby; and notice is hereby given that the said rules shall be taken into consideration after the expiry of a period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public;

Objections or suggestions which may be received from any person with respect to the said draft rules before expiry of the period aforesaid will be considered by the Central Government;

DRAFT RULES

1. Short title, extent and commencement.— (1) These rules may be called the Prevention of Cruelty to Animals (Care and Maintenance of Case Property Animals) Rules, 2016.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. Definitions.— In these rules, unless the context otherwise requires, -

(a) "Act" means the Prevention of Cruelty to Animals Act, 1960 (59 of 1960);

(b) "Animal Welfare Organisation" means an organisation recognised by the Animal Welfare Board of India or an organisation recognised under any law made by a State;

(d) "Society for Prevention of Cruelty to Animals (SPCA)" means a SPCA recognised under the Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of Cruelty to Animals) Rules, 2001 made under the Act;

(e) "State Board" means the State Animal Welfare Board;

(f) "Vehicle" means any vehicle (including a trailer of any description and the detachable body of a vehicle) constructed or adapted for use on a road;

(g) words and expressions used in these rules and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act.

3. Custody of animals pending litigation.— When an animal has been seized under the provision of the Act or rules made thereunder, the magistrate may direct the animal to be housed at an infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala during the pendency of the litigation.

4. Cost of care and keeping of animal pending litigation.— (1) The State Board shall within three months from the date of commencement of these rules and thereafter on the 1st day of April every year, specify the cost of transport, maintenance and treatment per day for every species of animal that is commonly seized in the State.

(2) The District Magistrate or, in Presidency Towns, the Commissioner of Police shall use the rates specified by the State Board as the minimum specified rates for transport, maintenance and treatment of the seized animals under sub-section (4) of section 35 of the Act.

(3) In case the animal under consideration is not on the rate sheet specified by the State Board, the District Magistrate or, in Presidency Towns, the Police Commissioner shall fix the cost of transport, treatment and maintenance of animals based on the input provided by the SPCA, Animal Welfare Organisation, infirmary, Gaushala or Pinjarapole in which the animal is to be housed.

5. Execution of bond.— (1) The magistrate when handing over the custody of animal to an infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala shall determine an amount which is sufficient to repay all reasonable cost incurred and anticipated to be incurred for transport, maintenance and treatment of animal based on the input provided by the jurisdictional veterinary officer and shall direct the accused and the owner to execute a bond of the determined value with sureties within three days and if the accused and owner do not execute the bond, the animal shall be forfeited to Animal Welfare Organisation, infirmary, or Pinjarapole.

(2) The infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala having the custody of the animal may draw on from the bond on a fortnightly basis the actual reasonable cost incurred in caring for the animal from the date it received custody to the date of final disposal of the animal.

(3) The magistrate shall call for the accused and the owner to execute additional bond with sureties once the eighty-per cent of the initial bond has been exhausted as cost for caring for the animal.

(4) Where a vehicle has been involved in an offence, the magistrate shall direct that the vehicle be held as a security.

(5) In case of offence relating to transport of animals, the vehicle owner, consignor, consignee, transporter, agents and any other parties involved shall be jointly and severally liable for the cost of transport, treatment and care of animals.

(6) In cases where a body corporate owns the animal, the Chief Executive Officer, President or highest- ranking employee of the body corporate, the body corporate and the accused shall be jointly and severally liable for the cost of transport, treatment and care of animals.

(7) In cases where the Government owns the animal, the Head of the Department and the accused shall be jointly and severally liable for the cost of transport, treatment and care of animals.

(8) If the owner and the accused do not have the means to furnish the bond, the magistrate shall direct the local authority to undertake the costs involved and recover the same as arrears of land revenue.

6. Abandoned animal.— (1) In case where the investigating officer files a report that prima facie offence under the Act has been made out but he is unable to determine the accused or the owner of the animal then the magistrate shall direct the local authority to undertake the costs involved and it shall be deemed that the owner has relinquished the ownership of the animal.

(2) The relinquishment of ownership shall have no effect on any criminal charges against the unknown offender or the owner.

7. Voluntary relinquishment.— Nothing in these rules shall be construed to prevent the voluntary and permanent relinquishment of any animal by the owner to SPCA, Animal Welfare Organisation, infirmary or Pinjarapole in lieu of executing a bond but the voluntary and permanent relinquishment shall have no effect on any criminal charges against the accused or owner.

8. Status of animal upon disposal of litigation.— (1) If the accused is convicted, or pleads guilty, the magistrate shall deprive him of the ownership of animal and forfeit the seized animal to the infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala already having custody for proper adoption or other disposition.

(2) If the accused is found not guilty of all charges, the animal seized shall be returned to the accused or owner if he can demonstrate to the satisfaction of the court that he can and will provide sufficient care for the animal and the unused portion of any bond executed shall be returned to the person who executed the bond, but any already used portion of such bond may not be recovered.

9. Process of adoption or other disposition.— (1) The infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala having custody of the animal during the litigation or post litigation may euthanize the animal in its custody as per section 13 of the Act.

(2) Where the animal has been forfeited to the infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala either after conviction, abandonment or voluntary relinquishment, the animal shall be put up for adoption.

(3) A person who has been charged under the Act or any cattle preservation law made by the State Government shall be prohibited from adopting animals from the infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala.

(4) The infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala prior to giving the animal for adoption shall,—

(a) in case of cattle, take an undertaking in form of an affidavit that the animals are adopted for agriculture purposes and not for slaughter, and verify that the person adopting the animal is an agriculturist by seeing the relevant revenue document;

(b) in case of draught and pack animals, take an undertaking in the form of an affidavit that the animals are adopted for draught and pack purposes and not for slaughter;

(d) keep a record of name and address of the person adopting the animal and procure an identity proof and address proof of the person adopting the animal;

(e) obtain from the person adopting the animal a declaration in the form of an affidavit that he shall not alienate the animal up to six months from the date of adoption and in case of death of the animal, he shall get the post mortem done from a Government veterinary hospital and shall abide by the rules for transport framed under the Act or any other law for the time being in force and shall get regular veterinary checkup done for the animal.

(5) The person adopting the animal shall–

(a) not sell the animal adopted;

(b) not abandon the animal;

(d) not sacrifice the animal for any religious purpose;

(e) not sell the cattle to a person outside the State without permission as per the State cattle protection and preservation law.

(6) Where a cattle or a draught and pack animal has been adopted, before its removal from the premises of the infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala, the proof of adoption shall be issued in five copies, out of which first copy shall be handed over to person adopting the animal, second copy to infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala, third copy to tehsil office of the residence of person adopting the animal, fourth copy to the Chief Veterinary Officer, Office of District of person adopting the animal and last copy shall be sent to the court to be filed in the case file.

(7) The adoption of animal shall not create an irrevocable right to the person adopting the animal, and the infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala may from time to time inspect the animal and in case it finds that the person who has adopted the animal is not providing sufficient care or it has reasons to believe that an offence under the Act or any cattle preservation law is anticipated, then the infirmary, pinjrapole, SPCA, Animal Welfare Organisation or Gaushala shall take possession of the animal.

(8) The person adopting the animal shall only be the lawful guardian of the animal and shall not have any rights bestowed generally to an owner of the animal, but shall have the duty to take all responsible measures to ensure the well being of such animal and to prevent infliction upon such animal of unnecessary pain or suffering.
