का.आ.का.आ.का.आ.का.आ. 235(235(235(235(अअअअ).).).).———— भारत सरकार ने पे(cid:17)ोिलयम और खिनज पाइपलाइन (भूिम म(cid:27) उपयोग के अिधकार का अज न) अिधिनयम, 1962 (1962 का 50) (िजसे इसम(cid:27) इसके प!चात् उ$त अिधिनयम कहा गया है) क% धारा 3 क% उपधारा (1) के अधीन जारी भारत सरकार के पे(cid:17)ोिलयम और 'ाकृ ितक गैस मं+ालय क% अिधसूचना सं,या का.आ.3120 (अ) तारीख 03.10.2016 -ारा ; उस अिधसूचना से संल.न अनुसूची म(cid:27) िविन1द2ट भूिम म(cid:27) गेल (इि4डया) िलिमटेड -ारा िबहार रा6य म(cid:27) जगदीशपुर-हि(cid:6)दया पाइपलाइन (जे एच पी एल) & 8पर पाईप लाईन के मा9यम से 'ाकृ ितक गैस के प:रवहन के िलए पाइपलाइन िबछाने के 'योजन के िलए उपयोग के अिधकार का अज न करने के अपने आशय क% घोषणा क% थी;

और उ$त राजपि+त अिधसूचना क% 'ितयां जनता को उपलDध करा दी गई थी;

और सEम 'ािधकारी ने जनता से 'ाFत आEेपG को परीEण के उपरांत अ8वीकृ त कर (cid:4)दया है;

और सEम 'ािधकारी ने, उ$त अिधिनयम क% धारा 6 क% उपधारा (1) के अधीन भारत सरकार को अपनी :रपोट दे दी है;

और भारत सरकार ने, उ$त :रपोट पर िवचार करने के प!चात् और यह संतुH हो जाने पर (cid:4)क उ$त भूिम पाइपलाइन(cid:27) िबछाने के िलए अपेिEत है, उस म(cid:27) उपयोग के अिधकार का अज न करने का िविन!चय (cid:4)कया है;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अत: अब, भारत सरकार, उ$त अिधिनयम क% धारा 6 क% उपधारा (1) -ारा 'दJत शि$तयG का 'योग करते Kए, यह घोषणा करती है (cid:4)क इस अिधसूचना से संल.न अनुसूची म(cid:27) िविन1द2ट भूिम म(cid:27) पाइपलाइन(cid:27) िबछाने के िलए उपयोग के अिधकार का अज न (cid:4)कया जाता है;

और, भारत सरकार, उ$त अिधिनयम क% धारा 6 क% उपधारा (4) -ारा 'दJत शि$तयG का 'योग करते Kए, िनदLश देती है (cid:4)क पाइपलाइन(cid:27) िबछाने के िलए भूिम म(cid:27) उपयोग का अिधकार, इस घोषणा के 'काशन क% तारीख को, भारत सरकार म(cid:27) िनिहत होने के बजाए, पाइपलाइन(cid:27) िबछाने का '8ताव करने वाली गेल (इि4डया) िलिमटेड म(cid:27) िनिहत होगा और तदुप:र, भूिम म(cid:27) ऐसे उपयोग का अिधकार, इस 'कार अिधरोिपत िनबंधनG और शतN के अधीन रहते Kए, सभी िव(cid:6)लंगमG से मु$त, गेल (इि4डया) िलिमटेड म(cid:27) िनिहत होगा।

MINISTRY OF PETROLEUM AND NATURAL GAS

NOTIFICATION

New Delhi, the 19th January, 2017

S.O.235(E).—Whereas by notification of Government of India in Ministry of Petroleum and Natural Gas numbers S.O. 3120 (E) dated 03.10.2016 ; issued under sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of Users in Land ) Act, 1962 ( 50 of 1962 ) (hereinafter referred to as the said Act), Government of India declared its intention to acquire the Right of User in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for transportation of natural gas through Jagdishpur-Haldia pipeline (JHPL) & spur pipeline in the State of Bihar by GAIL (India) Limited;

And whereas copies of the said Gazette notification were made available to the public;

And whereas the objections received from the public to the laying of the pipeline have been considered and disallowed by the competent authority;

And whereas the Competent Authority has, under sub-section (1) of Section 6 of the said Act, submitted its report to Government of India;

And whereas Government of India after considering the said report and on being satisfied that the said land is required for laying the pipelines, has decided to acquire the Right of User therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act, Government of India hereby declares that the Right of User in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;

And, further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, Government of India hereby directs that the Right of User in the land for laying the pipeline shall, instead of vesting in Government of India, vest, on this date of the publication of the declaration, in the GAIL (India) Limited, free from all encumbrances.
