यह मामला तटीय रो-रो पोत(cid:7298) के मा(cid:7007)यम से मोटर र्ाहन(cid:7298) के (cid:7079)ह(cid:7021)तन के नलए (cid:7407)रयायती घाटु(cid:7016)क दर(cid:7298) के अनुमोदन के संबंध म(cid:7286) चे(cid:7008)नई प(cid:7275)न (cid:7008)यास (सीएचपीटी) से (cid:7079)ा(cid:7009)त (cid:7079)(cid:7021)र्ता से संबंनधत है।

2. चे(cid:7008)नई प(cid:7275)न (cid:7008)यास (सीएचपीटी) ने अपने 18 र्ररी, 2016 के प(cid:7074) के मा(cid:7007)यम से अ(cid:7008)य बात(cid:7298) के सा-सा, संसूनचत (cid:7408)कया (cid:7408)क अपने (cid:7008)यासी मंडल के अनुमोदन के आधार पर रो-रो पोत(cid:7298) के मा(cid:7007)यम से (cid:7079)हन(cid:7021)तत मोटर र्ाहन(cid:7298) के नलए अपने 410 GI/2017

3.1. सीएचपीटी ने यह भी बताया ा (cid:7408)क 31 माच(cid:6981), 2016 तक सीएचपीटी (cid:7367)ारा (cid:7408)कये ािनेर् ाले सामा(cid:7008)य संोधन (cid:7079)(cid:7021)र्ता म(cid:7286) मोटर र्ाहन(cid:7298) सनहत सभी घाटु(cid:7016)क (cid:7079)ु(cid:7016)क मद(cid:7298) को ननि पर र्त(cid:6981)मान म(cid:7286) यामू(cid:7016)य आधार पर (cid:7079)ु(cid:7016)क ननधा(cid:6981)(cid:7407)रत है, को (cid:7079)ानधकरण काय(cid:6981)कारी (cid:7408)दाननद(cid:7287) 2015 के खंड 2.10 के अनुसारर् नि/(cid:7079)मा(cid:7074)ा/नग आधार पर संोधन (cid:7408)कया ाियेगा और रा(िcid:7021र्)/लागत र्र्नरण के आधार पर अनधकतम (cid:7079)ु(cid:7016)क का (cid:7079)(cid:7021)र्ता भी (cid:7408)कया ाियेगा और यह भी (cid:7408)क र्संध(cid:6981)नीय (cid:7079)ु(cid:7016)क के नलए (cid:7018)यापार क(cid:7409) (cid:7079)नत(cid:7408)(cid:7059)या पर भी र्नचार (cid:7408)कया ाियेगा।

3.2. यह देखते (cid:7263)ए (cid:7408)क मोटर कार(cid:7298) पर (cid:7079)नत यूननट घाटु(cid:7016)क उगाही 1 र्ररी, 2016 से 31 माच(cid:6981), 2016 तक दो महीने क(cid:7409) र्अनध के नलए ी और चू ं(cid:7408)क परी(cid:6979)ण र्अनध 18 र्ररी, 2016 से कु छ ही (cid:7408)दन बाद समा(cid:7009)त हो ािनी ी और चू ं(cid:7408)क सीएचपीटी ने पुन(cid:7397) क(cid:7409) ी (cid:7408)क सीएचपीटी 31 माच(cid:6981), 2016 तक दायर (cid:7408)कये ािनेर् ाले सामा(cid:7008)य संोधन (cid:7079)(cid:7021)र्ता म(cid:7286),र् ह मोटर र्ाहन(cid:7298) सनहत सभी घाटु(cid:7016)क (cid:7079)ु(cid:7016)क मद(cid:7298) को ननि पर र्त(cid:6981)मान म(cid:7286) यामू(cid:7016)य आधार पर (cid:7079)ु(cid:7016)क ननधा(cid:6981)(cid:7407)रत है, को र्नि/(cid:7079)मा(cid:7074)ा/नग आधार पर संोधन करेगा इसनलए यह ननण(cid:6981)य नलया गया ा (cid:7408)क उस समय (cid:7079)ा(cid:7009)त सीएचपीटी के प(cid:7074) पर कोई कार(cid:6981र्)ाई न क(cid:7409) ािए।

3.3. त(cid:7004)प(cid:7019)चात्, सीएचपीटी ने अपने 09 मई, 2016 के प(cid:7074) म(cid:7286) बताया (cid:7408)क (cid:7008)यासी मंडल के अनुमोदन से, सभी तटीय रो-रो पोत(cid:7298) के मा(cid:7007)यम से (cid:7079)हन(cid:7021)तत मोटरर् ाहन(cid:7298) क(cid:7409) '(cid:7079)नत इकाई आधार' पर र्नेष (cid:7407)रयायती घाटु(cid:7016)क दर को 1 र्ररी, 2016 से 31 माच(cid:6981), 2016 क(cid:7409) दो महीने क(cid:7409) परी(cid:6979)ण र्अनध का 01.04.2016 से 31.03.2017 तक एकर् ष(cid:6981) के नलए, कु छ संोधन(cid:7298) के सा (cid:7408)कया गया है।

3.4. 2 महीने (01.02.2016 से 30.03.2016) क(cid:7409) परी(cid:6979)ण र्अनध के दौरान अगाही (cid:7408)कया गया र्नेष (cid:7407)रयायत घाटु(cid:7016)क और 31.03.2016 से इतर अा(cid:6981)त् 01.04.2016 से 31.03.2017 तक लगाया गया र्नेष (cid:7407)रयायती घाटु(cid:7016)क क(cid:7409) तुलना(cid:7004)मक न(cid:7021)नत नीचे दी ािती है:

3.5. काय(cid:6981)कारी (cid:7408)दाननद(cid:7287) के खंड 5.7.1 के अनुसार बि (cid:7408)कसी प(cid:7275)न र्नेष र्अा (cid:7408)कसी अ(cid:7008)य महाप(cid:7275)न के दरमान(cid:7298) म(cid:7286) (cid:7408)कसी र्सेा/काग(cid:7299) के अलए र्नन(cid:7020)ट (cid:7079)ु(cid:7016)क उपल(cid:7011)ध नह(cid:7277) होता, तब प(cid:7275)न कनत नए काग(cid:7299)/र्सेा के (cid:7079)ु(cid:7016)क क(cid:7409) अनधसूचना के नलए (cid:7079)(cid:7021)र्ता दायर कर सकता है। इसके अनत(cid:7407)र(cid:6989)त, काय(cid:6981)कारी (cid:7408)दाननद(cid:7287)(cid:7298) के खंड 5.7.3 और 5.7.4 के अनुसार, (cid:7079)(cid:7021)र्ता (cid:7079)(cid:7021)तुत करने के सा, प(cid:7275)न, सा ही सा संबंनधत (cid:7079)यो(cid:6989)ता(cid:7312) के सा पराम(cid:6981) से तदभ(cid:6981) आधार पर तब तक (cid:7079)(cid:7021)तार्नत दर क(cid:7409) उगाही कर सकते ह(cid:7289) बि तक दर अंनतम (cid:7272)प से अनधसूनचत नह(cid:7277) कर दी ािती।

3.6. य(cid:7378)नप, सीएचपीटी ने मोटर र्ाहन(cid:7298) पर (cid:7079)नत यूननट घाटु(cid:7016)क उगाही करनी आरंभ कर दी, परंतु इस (cid:7079)ानधकरण के अनुमोदन (cid:7079)ा(cid:7009)त करने का (cid:7079)(cid:7021)र्ता सा नह(cid:7277) आया है। यहां तक (cid:7408)क उ(cid:7008)ह(cid:7298)ने अपने 9 मई, 2016 के प(cid:7074) म(cid:7286), सीएचपीटी ने बस यही सूनचत (cid:7408)कया ा (cid:7408)क (cid:7008)यासी मंडल (cid:7367)ारा 31.03.2016 से इतर अा(cid:6981)त् 01.04.2016 को 31.03.2017 तक र्नेष (cid:7407)रयायती घाटु(cid:7016)क क(cid:7409) उगाही करने का ननण(cid:6981)य नलया है।

3.7. इस (cid:7079)कार काय(cid:6981)कारी (cid:7408)दाननद(cid:7287) क(cid:7409) न(cid:7021)नत को (cid:7007)यान म(cid:7286) रखते (cid:7263)ए सीएचपीटी को हमारे 17 ूिन, 2016 के प(cid:7074) के (cid:7367)ारा अनुरोध (cid:7408)कया गया ा (cid:7408)कर् ह काय(cid:6981)कारी (cid:7408)दाननद(cid:7287)(cid:7298) के खंड 5.7.1 से 5.7.5 म(cid:7286) अंत(cid:7414र्)(cid:7020)ट अनुब(cid:7373)ता के अनुसार पूरा (cid:7079)(cid:7021)र्ता दायर करे।

4.1. (cid:7079)संर्ग, सीएचपीटी (cid:7367)ारा (cid:7079)ु(cid:7016)क नीनत, 2015 के अंतग(cid:6981)त दायर (cid:7079)(cid:7021)र्ता के आधार पर, इस (cid:7079)ानधकरण ने अपने 17 नसत(cid:7013)बर, 2016 के आदे सं(cid:6990)या टीएएमपी/22/2016-सीएचपीटी के (cid:7367)ारा चे(cid:7008)नई प(cid:7275)न (cid:7008)यास के सामा(cid:7008)य दरमान अनुमो(cid:7408)दत (cid:7408)कये ह(cid:7289)। यह आदे भारत के रापि(cid:7074) म(cid:7286) रापि(cid:7074) सं(cid:6990)या 371 के (cid:7272)प म(cid:7286) 10 अ(cid:6989)तूबर, 2016 को अनधसूनचत (cid:7408)कया गया ा। अनधसूचना और आदे क(cid:7409) संसूचना सीएचपीटी और संबंनधत (cid:7079)यो(cid:6989)ता(cid:7312)/(cid:7079)यो(cid:6989)ता संगठन(cid:7298) को हमारे 13 अ(cid:6989)तूबर, 2016 के प(cid:7074) के (cid:7367)ारा दे दी गई ी। संोनधत दरमान भारत के रापि(cid:7074) म(cid:7286) आदे क(cid:7409) अनधसूचना क(cid:7409) तारीख से 30 (cid:7408)दन क(cid:7409) समान(cid:7385) के प(cid:7019)चात् (cid:7079)र्भाी हो गए है (अा(cid:6981)त् 9 र्न(cid:7013)बर, 2016 से)।

4.2. उ(cid:6989)त आदे के (cid:7367)ारा, इस (cid:7079)ानधकरण (cid:7367)ारा मोटर र्ाहन(cid:7298) म(cid:7286) घाटु(cid:7016)क के नलए अनुसूची 3.1. के अंतग(cid:6981)त नन(cid:7013)न (cid:7079)कार अनुमो(cid:7408)दत (cid:7408)कये ह(cid:7289):

5.1. इस पृ(cid:7020)ट भूनम म(cid:7286), सीएचपीटी ने अपने 4 अ(cid:6989)तूबर, 2016 के प(cid:7074) म(cid:7286) नन(cid:7013)ननलनखत नर्नेदन (cid:7408)कये ह(cid:7289):

(i) तटीय रो-रो पोत(cid:7298) के मा(cid:7007)यम से (cid:7079)हन(cid:7021)तत (cid:7408)कये ािने र्ाले (cid:7407)रयायती घाटु(cid:7016)क (cid:7079)भार (cid:7079)(cid:7021)तार्नत दरमान(cid:7298) म(cid:7286) ननधा(cid:6981)(cid:7407)रत उगाही के र्र्नरण और यूननट के अनु(cid:7272)प आोनधत कर (cid:7408)दये गए ह(cid:7289)। आोनधत (cid:7407)रयायती (cid:7021)क(cid:7409)म का मंडल (cid:7367)ारा अपनी 19.08.2016 को (cid:7263)ई बैठक म(cid:7286) बीआर सं(cid:6990)या 63 के (cid:7367)ारा 01.07.2016 से 31.03.2017 तक क(cid:7409) र्अनध के नलए (cid:7079)ानधकरण काय(cid:6981)कारी (cid:7408)दाननद(cid:7287)(cid:7298) के खंड 5.7.3. के अनु(cid:7272)प, तद(cid:6981) आधार पर, (cid:7079)ानधकरण के अनुमोदन के अधीन इस (cid:7079)ानधकरण के सम(cid:6979) दायर सामा(cid:7008)य संोधन (cid:7079)(cid:7021)र्ता म(cid:7286) मोटरर् ाहन(cid:7298) के नलए अनधकतम सीमा हेतु अनुमोदन (cid:7408)कया है।

(ii) र्ननभ(cid:7008)न (cid:7088)ेनणय(cid:7298) के नलए (cid:7079)(cid:7021)तार्नत घाट ु(cid:7016)क (cid:7079)भार नन(cid:7013)र्नत् ह(cid:7289):

(iii) सीएचपीटी (cid:7367)ारा अपने प(cid:7074) के सा बोड(cid:6981) का संक(cid:7016)प और (cid:7018)यापार सूचना (cid:7079)(cid:7021)तुत क(cid:7409) गई है।

5.2. उपरो(cid:6989)त के म(cid:7374)ेनर, सीएचपीटी ने इस (cid:7079)ानधकरण से (cid:7079)ानधकरण काय(cid:6981)कारी (cid:7408)दाननद(cid:7287) 2015 के खंड 5.7.3 के अनु(cid:7272)प 01.07.2016 से (cid:7079)(cid:7021)तार्नत दरमान(cid:7298) के काया(cid:6981)(cid:7008र्)यन क(cid:7409) तारीख तक तद(cid:6981) आधार पर, उ(cid:6989)त (cid:7407)रयायती घाटु(cid:7016)क (cid:7079)भार(cid:7298) को अनुमो(cid:7408)दत करने का अनुरोध (cid:7408)कया है।

6. सीएचपीटी (cid:7367)ारा (cid:7408)कये गए नर्नेदन के संदभ(cid:6981) म(cid:7286) नन(cid:7013)ननलनखत न(cid:7021)नत उभर कर सामने आती है:

(i) सीएचपीटी के र्पू(cid:6981) संोनधत दरमान (र्न(cid:7013)बर, 2016 से र्पू(cid:6981)) रो-रो पोत(cid:7298) के मा(cid:7007)यम से मोटरर् ाहन(cid:7298) के (cid:7079)ह(cid:7021)तन के नलए नन(cid:7013)ननलनखत घाटु(cid:7016)क (cid:7079)भार ननधा(cid:6981)(cid:7407)रत े:

(ii) त(cid:7004)प(cid:7019)चात्, इस (cid:7079)ानधकरण ने, नसत(cid:7013)बर, 2016 म(cid:7286) सीएचपीटी के सामा(cid:7008)य संोधन (cid:7079)(cid:7021)र्ता का ननपटान करते समय, मोटरर् ाहन(cid:7298) के संबंध म(cid:7286) खंड 3.1 म(cid:7286) सीएचपीटी (cid:7367)ारा या (cid:7079)(cid:7021)तार्नत नन(cid:7013)ननलनखत घाटु(cid:7016)क (cid:7079)भार(cid:7298) क(cid:7409) उगाही का अनुमो(cid:7408)दत (cid:7408)कया:

उ(cid:6989)त आदे भारत के रापि(cid:7074) म(cid:7286) 10 अ(cid:6989)तूबर, 2016 को अनधसूनचत (cid:7263)आ और संोनधत दरमान भारत के रापि(cid:7074) म(cid:7286) आदे क(cid:7409) अनधसूचना क(cid:7409) तारीख से 30 (cid:7408)दन क(cid:7409) समान(cid:7385) के प(cid:7019)चात् (cid:7079)र्भाी हो गए है (अा(cid:6981)त् 9 र्न(cid:7013)बर, 2016 से)।

(iii) यहां यह उ(cid:7016)लेख करना समीचीन होगा (cid:7408)क 4 अग(cid:7021)त, 2014 के आदे सं(cid:6990)या टीएएमपी/11/2013-सीएचपीटी (cid:7367)ारा अनुमो(cid:7408)दत र्पू(cid:6981)-संोनधत दरमान(cid:7298) म(cid:7286) (cid:7079)ु(cid:7016)क क(cid:7409) र्ैधता र्अनध 31 माच(cid:6981), 2016 तक ननधा(cid:6981)(cid:7407)रत है।

त(cid:7004)प(cid:7019)चात्, सीएचपीटी के अनुरोध पर, इस (cid:7079)ानधकरण ने सीएचपीटी के दरमान(cid:7298) क(cid:7409)र् ैधता र्अनध 30 नसत(cid:7013)बर, 2016 तक बा दी ी। इसके अनत(cid:7407)र(cid:6989)त, नसत(cid:7013)बर, 2016 का र्नीनतम सामा(cid:7008)य संोधन आदे पा(cid:7407)रत करते समय दरमान(cid:7298) क(cid:7409) र्ैधता 30 नसत(cid:7013)बर, 2016 के प(cid:7019)चात् संोनधत दरमान(cid:7298) के काया(cid:6981)(cid:7008र्)यन क(cid:7409) तारीख तक अा(cid:6981)त् 08 र्न(cid:7013)बर, 2016 तक बा दी ी।

(iv) सीएचपीटी का अब यह (cid:7079)(cid:7021)र्ता मोटर र्ाहन(cid:7298) के नलए नन(cid:7013)ननलनखत घाटु(cid:7016)क (cid:7079)भार 01 ुिलाई, 2016 से 08 र्न(cid:7013)बर, 2016 तक क(cid:7409) र्अनध के नलए उगाही कर सकने के नलए है:

(v) य(cid:7378)नप, रो-रो पोत(cid:7298) के मा(cid:7007)यम से मोटर र्ाहन(cid:7298) के (cid:7079)ह(cid:7021)तन के नलए, घाटु(cid:7016)क (cid:7079)भार(cid:7298) सनहत, संोधन-र्पू(cid:6981) दरमान(cid:7298) क(cid:7409) र्अनध का र्न(cid:7021)तार कर (cid:7408)दया गया है, दरमान(cid:7298) म(cid:7286) ननधा(cid:6981)(cid:7407)रत दर(cid:7286) अनधकतम (cid:7021)तर(cid:7298) क(cid:7409) ह(cid:7289), इसी (cid:7079)कार, छू ट(cid:7286) और (cid:7407)रयायत(cid:7286) नन(cid:7013)नतम (cid:7021)तर क(cid:7409) ह(cid:7289)। सीएचपीटी के पास यह लचकता ी (cid:7408)कर् ह कम दर (cid:7079)भा(cid:7407)रत करे और/ र्अा ऊं ची छू ट(cid:7286) और (cid:7407)रयायत(cid:7286) दे।

(vi) इस (cid:7079)कार, 01 ुिलाई, 2016 से 08 र्न(cid:7013)बर, 2016 क(cid:7409) र्अनध के नलए, बि र्पू(cid:6981) संोनधत दर(cid:7286) लागू (cid:7277), (cid:7061)ा(cid:7405) यामू(cid:7016)य दर(cid:7286) 4 अग(cid:7021)त, 2014 के आदे सं(cid:6990)या टीएएमपी/11/2013- सीएचपीटी (cid:7367)ारा अनुमो(cid:7408)दत दरमान(cid:7298) के अनुसार रहे ह(cid:7298)गे, ैिसा (cid:7408)क ऊपर बताया गया है। ले(cid:7408)कन, प(cid:7275)न का अब का (cid:7079)(cid:7021)र्ता यामू(cid:7016)य दर(cid:7298) के सान पर मोटरर् ाहन(cid:7298) के नलए (cid:7079)नत यूननट घाटु(cid:7016)क दर(cid:7298) क(cid:7409) उगाही करने से संबंनधत है। यह उ(cid:7016)लेखनीय है (cid:7408)क कनत (cid:7079)नत यूननट दर(cid:7286) नसतंबर 2016 म(cid:7286) अनुमो(cid:7408)दत (cid:7079)नत यूननट दर(cid:7298) से कम पायी गई ह(cid:7289)।

This case relates to the proposal received from the Chennai Port Trust (CHPT) for approval of concessional wharfage rates for automobiles handled through Coastal Ro-Ro vessels.

2. The Chennai Port Trust (CHPT) vide its letter dated 18 February, 2016 had, interalia, communicated that based on the approval of its Board of Trustees, instead of levying the advalorem wharfage rates prescribed in its Scale of Rates towards automobiles handled through Ro-Ro vessels, has decided to adopt the per unit wharfage levy of automobiles relevant for the M/s. Kamarajar Port Limited (KPL) on trial basis for a period of two months from 01 February, 2016 to 31 March, 2016, and that it has issued a Circular to this effect.

3.1. The CHPT had also stated that in the general revision proposal to be filed by CHPT by 31 March, 2016, all the wharfage tariff items including automobiles presently prescribed on ad valorem basis will be revised into weight/volume/nos. basis in line with clause 2.10 of TAMP Working Guidelines, 2015 and a ceiling tariff will be proposed based on the revenue/cost details and also taking into consideration the response of the trade for the promotional tariff.

3.2. Given that the per unit wharfage levy on automobiles was on a trial basis for a period of two months from 01 February, 2016 to 31 March, 2016 and since the trial period was to get over in a few days from 18 February, 2016 and also since the CHPT had confirmed that in the general revision proposal to be filed by CHPT by 31 March, 2016, it would revise all the wharfage tariff items including automobiles which is presently prescribed on ad valorem basis, into weight/volume/nos. basis, it was decided to not take any action on the communication received from CHPT at that point of time.

3.3. Subsequently, the CHPT vide its letter dated 09 May, 2016 stated that with the approval of its Board of Trustees, the special concessional wharfage for handling of automobiles through all coastal Ro Ro vessels on 'per unit basis' implemented on trial basis for a period of 2 months from 01.02.2016 to 31.03.2016 has been extended for a further period of one year from 01.04.2016 to 31.03.2017, with some changes.

3.4. A comparative position of the special concessional wharfage levied during the trial period of 2 months (01.02.2016 to 30.03.2016) and special concessional wharfage levied beyond 31.03.2016 i.e. 01.04.2016 to 31.03.2017 is given below:

3.5. As per Clause 5.7.1 of the Working Guidelines, whenever a specific tariff for a service/cargo is not available in the SOR of the particular port or any other major port, then the port may file the proposal for notification of tariff for the said new cargo/service. Further, as per Clause 5.7.3 and 5.7.4 of the Working Guidelines, with the submission of proposal, the port can simultaneously levy the proposed rate on an ad hoc basis in consultation with the concerned users, till the rate is finally notified.

3.6. Though the CHPT has started levying the per unit wharfage levy on automobiles, it had not come up with a proposal seeking approval of this Authority. Even in its letter dated 9 May, 2016, the CHPT had just intimated the decision taken by its Board of Trustees to levy the Special concessional wharfage levied beyond 31.03.2016 i.e. 01.04.2016 to 31.03.2017.

3.7. Thus, in view of the Working Guidelines position, the CHPT was requested vide our letter dated 17 June, 2016 to file a complete proposal in line with the stipulation contained in Clauses 5.7.1 to 5.7.5 of the Working Guidelines.

4.1. Incidentally, based on the proposal filed by the CHPT under the Tariff Policy 2015, this Authority has approved the general Scale of Rates (SOR) of Chennai Port Trust (CHPT) vide its Order No. TAMP/22/2016- CHPT dated 17 September, 2016. This Order was notified in the Gazette of India on 10 October, 2016 vide G.No. 371. The Notification and Order has been communicated to the CHPT and to the concerned users/user organisations vide our letter dated 13 October, 2016. The revised SOR has come into effect after expiry of 30 days from the date of notification of the Order in the Gazette of India (i.e. from 9 November, 2016.

4.2. Vide the said Order, this Authority has approved the following charges under Schedule 3.1 for Wharfage in respect of Automobiles:

5.1. In this backdrop, the CHPT vide its letter dated 04 October, 2016 has made following submissions:

(i) The concessional wharfage charges for automobiles handled through Coastal Ro-Ro vessels has been modified in line with the description and unit of levy prescribed in the proposed SOR. The modified concessional scheme has been approved by the Board in the meeting held on 19.08.2016 vide BR No. 63 for the period from 01.07.2016 to 31.03.2017, on ad-hoc basis, as per clause 5.7.3 of TAMP Working Guidelines, subject to approval of TAMP, for ceiling rates proposed for Automobiles (Motor Vehicles) in the general revision proposal filed with this Authority.

(ii) The proposed concessional wharfage charges for different categories are as given below: -

(iii). A copy of the Board Resolution and Trade Notice is furnished by the CHPT alongwith its letter.

5.2. In view of the above, the CHPT has requested this Authority to approve the above concessional wharfage rates on ad hoc basis from 01.07.2016 till the date of implementation of the proposed Scale of Rates as per clause 5.7.3 of TAMP Working Guidelines 2015.

6. With regard to the submissions made by CHPT, the following position emerges:

(i). The pre-revised Scale of Rates of CHPT (prior to November, 2016) prescribed the following wharfage charges for handling of Automobiles through RoRo vessels:

(ii) Thereafter, this Authority while disposing the general revision proposal of the CHPT in September 2016 has approved the levy of following Wharfage charges in Section 3.1 in respect of Automobiles, as proposed by CHPT:

The said Order has been notified in the Gazette of India on 10 October, 2016 and the revised SOR has come into effect after expiry of 30 days from the date of notification of the Order in the Gazette of India i.e. with effect from 09 November, 2016.

(iii) It is relevant here to mention that the pre-revised Scale of Rates approved vide Order No. TAMP/11/2013-CHPT dated 4 August, 2014, had prescribed a tariff validity period till 31 March, 2016. Subsequently, on request of CHPT, this Authority had extended the validity of the Scale of Rates of CHPT till 30 September, 2016. Further, while passing the latest10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] general revision Order of September, 2016, the validity of the Scale of Rates has been extended beyond 30 September, 2016 or till the date of implementation of the revised Scale of Rates i.e. 08 November, 2016.

(iv) The proposal of the CHPT now is to enable it levy the following concessional wharfage charges for automobiles for the period from 01 July, 2016 to 08 November, 2016:

(v) Though the pre revised SOR including the wharfage charges for handling Automobiles through RoRo vessels was extended, the rates prescribed in the Scale of Rates are ceiling levels; likewise, rebates and discounts are floor levels. The CHPT had the flexibility to charge lower rates and/ or allow higher rebates and discounts.

(vi). Thus, for the period from 01 July, 2016 to 08 November, 2016, when the pre-revised rates were in force, the applicable advalorem rates would be as per the SOR approved vide Order no TAMP/11/2013-CHPT dated 4 August 2014, as brought out earlier. However, the proposal of the port now is to enable it levy per unit wharfage rates for automobiles instead of the advalorem rates. It is noteworthy that the said per unit rates are seen to be lower than the per unit rates approved in the September 2016 Order.

(vii) Clause 2.10 of the Working Guidelines requires the Port Trust to do away with advalorem wharfage rate in the SOR and determine specific wharfage rate taking into consideration special case to be taken for handling such cargo or a market determined tariff. In compliance to the Working Guidelines, the CHPT has proposed per unit wharfage rates for the Motor Vehicles and has also proposed to levy lower per unit wharfage rates, till the new Scale of Rates comes into effect.

(viii) Given that the CHPT has proposed levy of lower per unit wharfage rates on automobiles for the period from 01 July, 2016 to 08 November, 2016, as compared to the per unit wharfage charges as approved in the September 2016 Order of CHPT, this Authority is inclined to accede to the proposal made by the CHPT.

7. In the result, and for the reasons given above, and based on a collective application of mind, this Authority approves levy of wharfage rates on per unit basis for the period from 01 July, 2016 to 08 November, 2016, as given below:
