1. संन(cid:6979)(cid:7385) नाम और (cid:7079)ारंभ :

1.1 . ये र्नननयम भारतीय बीमा र्नननयामक और र्नकास (cid:7079)ानधकरण (बीमा र्नपणन म(cid:6981) का रन(िcid:7021)(cid:7069)ीकरण) (पहला संोधन) र्नननयम, 2016 कहलाएँगे ।

1.2. ये र्नननयम सरकारी रापि(cid:7074) म(cid:7286) इनके (cid:7079)कान क(cid:7409) तारीख को (cid:7079र्)ृ(cid:7275) ह(cid:7298)गे।

2. भारतीय बीमा र्नननयामक और र्नकास (cid:7079)ानधकरण (बीमा र्नपणन म(cid:6981) का रन(िcid:7021)(cid:7069)ीकरण) र्नननयम, 2015 म(cid:7286) (क) र्नननयम 3(क) और र्नननयम 11.1 म(cid:7286) "के बीमा उ(cid:7004)पाद(cid:7298).." (cid:7011)द(cid:7298) के पहले "के अनधकतम" (cid:7011)द अंत:(cid:7021)ानपत (cid:7408)कये ािएँगे

(घ) बीमा र्नपणन म(cid:6981) (आईएमए) नन(cid:7388)नलनखत के अधीन बीमा उ(cid:7004)पाद(cid:7298) के दूर(cid:7021) र्नपणन के संबंध म(cid:7286) समय- समय पर (cid:7079)ानधकरण (cid:7367)ारा ािरी (cid:7408)कये गये (cid:7408)दाननद(cid:7287)(cid:7298)/ र्नननयम(cid:7298)/ प(cid:7407)रप(cid:7074)(cid:7298) का पालन करेगाः दूर(cid:7021) र्नपणन

i. बीमा र्नपणन म(cid:6981) (आईएमए) (cid:7367)ारा दूर-र्नपणनकता(cid:6981)((cid:7312)) को ननयु(cid:7334) (cid:7408)कये नबना (cid:7408)कया ािएगा।

ii. (cid:7079)ानधकरण से र्पू(cid:6981) अनुमोदन (cid:7079)ा(cid:7385) करने के बाद (cid:7408)कया ािएगा।

iii. के र्ल बीमा र्न(cid:7059)े ता(cid:7312) (आईएसपी) के मा(cid:7007)यम से (cid:7408)कया ािएगा।

iv. के र्ल उ(cid:7008)ह(cid:7277) बीमाकता(cid:6981)((cid:7312)) क(cid:7409) ओर से (cid:7408)कया ािएगा ननिके सा अनुसूची V के भाग I म(cid:7286) र्ननन(cid:7416)द(cid:7397) (cid:7272)प म(cid:7286) बीमा (cid:7390र्)साय काय(cid:6981)कलाप करने के नलए बीमा र्नपणन म(cid:6981) (cid:7367)ारा करार (cid:7408)कये गये ह(cid:7298)।

(ग) र्नननयम 4.1 म(cid:7286) नन(cid:7388)नलनखत खंड िअंत:(cid:7021)ानपत (cid:7408)कया ािएगाः

()ि यहर् (cid:7334)(cid:7390) देते (cid:7263)ए एकर् चनप(cid:7074) (cid:7079)(cid:7021)तुत करेगा (cid:7408)क बीमा (cid:7390र्)साय क(cid:7409) अपे(cid:6979)ा / अ(cid:7061)ता उ(cid:7004)पादन के नलए दूर र्नपणनकता(cid:6981)((cid:7312)) को ननयु(cid:7334) नह(cid:7277) (cid:7408)कया ािएगा।

(घ) र्नननयम 5.2 (vi) को नन(cid:7388)नलनखत से (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगाः

"(cid:6989)या र्आेदक के नाम म(cid:7286) (cid:7011)द "बीमा र्नपणन" र्अा "आईएमए"

है।

(ङ) र्नननयम 14.2 म(cid:7286) नन(cid:7388)नलनखत खंड अंत: (cid:7021)ानपत (cid:7408)कया ािएगाः

(क) यहर् (cid:7334)(cid:7390) देते (cid:7263)ए एकर् चनप(cid:7074) (cid:7079)(cid:7021)तुत करेगा (cid:7408)क बीमा (cid:7390र्)साय क(cid:7409) अपे(cid:6979)ा / अ(cid:7061)ता उ(cid:7004)पादन के नलए दूर र्नपणनकता(cid:6981) ननयु(cid:7334) नह(cid:7277) (cid:7408)कया ािएगा/ नह(cid:7277) (cid:7408)कये ािएँगे।

(च) अनुसूची-III (1) (सामा(cid:7008)य) को नन(cid:7388)नलनखत (cid:7272)प म(cid:7286) (cid:7079)नत(cid:7021)ानपत (cid:7408)कया

ािएगा

(छ) अनुसूची IV भाग III (2) को नन(cid:7388)ानुसार (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािता है

"(cid:6979)े(cid:7074)" को एक ऐसे नलिे के (cid:7272)प म(cid:7286) प(cid:7407)रभानषत (cid:7408)कया गया है नसिके नलए बीमा र्नपणन म(cid:6981) का रन(िcid:7021)(cid:7069)ीकरणर् ैध हो। तानप, य(cid:7408)द र्आेदक (cid:7367)ारा अनुरोध (cid:7408)कया ािता है तो (cid:7408)कसी रा(cid:6996)य के राधिानी नगर म(cid:7286) पंीिकृ त बीमा र्नपणन म(cid:6981) (आईएमए) के मामले म(cid:7286) ऐसे नगर क(cid:7409) नगरपानलका / नगर ननगम के अंतग(cid:6981)त प(cid:7407)रभानषत (cid:6979)े(cid:7074) प(cid:7407)रचालन के (cid:6979)े(cid:7074) के (cid:7272)प म(cid:7286) माना ािएगा।

NOTIFICATION

Hyderabad, the 17th January, 2017

Insurance Regulatory and Development Authority of India (Registration of Insurance Marketing Firm) (First

Amendment) Regulations, 2016

F. No. IRDAI/Reg/1/138/2017.—In exercise of the powers conferred by Section 114A of the Insurance Act, 1938 (4 of 1938), as amended from time to time, read with sections 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999) and sections 42D and 42E of Insurance Act, 1938, as amended from time to time, the Authority in consultation with the Insurance Advisory Committee, hereby makes the following amendments to Insurance Regulatory and Development Authority of India (Registration of Insurance Marketing Firm), Regulations 2015, namely:

1. Short title and commencement:

1.1 These regulations may be called Insurance Regulatory and Development Authority of India (Registration of Insurance Marketing Firm) (First Amendment) Regulations, 2016

1.2 They shall come into force on the date of their publication in the Official Gazette.

2. In the Insurance Regulatory and Development Authority of India (Registration of Insurance Marketing Firm) Regulations, 2015

(A) Insert the words "maximum of" after the words "… Insurance Products of" in Reg. 3(a) and Reg.11.1 (B) In regulation (3) following clause d shall be inserted:

(d) An IMF shall abide by the guidelines /regulations/circulars issued by

the Authority from time to time on Distance Marketing of Insurance Products subject to the

following: Distance Marketing shall be

i. undertaken by the IMF without engaging tele-marketer(s).

ii. undertaken after obtaining prior approval from the Authority.

iii. carried out only through ISPs.

iv. on behalf of those Insurer(s) with whom agreements are entered by IMF for carrying out

insurance business activity as specified in Part I of Schedule V.

(C) In regulation 4.1 the following clause h shall be inserted:

(h) Submit an undertaking stating that a tele marketer(s) shall not be engaged for solicitation/lead

generation of insurance business.

(D) Regulation 5.2 (vi) shall be substituted with the following:

"Whether the Applicant has in its name the words "Insurance Marketing" or "IMF"भारत का राजपत्रा : असाधरण [भाग III—खण्ड 4] 7 (E) In regulation 14.2 following clause shall be inserted:

(a) Submit an undertaking stating that a tele marketer(s) shall not be engaged for

solicitation/lead generation of insurance business.

(F) SCHEDULE-III (1) (General) is replaced as

"1. General:

The training for Principal Officer and ISP shall be conducted on-line by an approved institution,

and in the manner, as decided by the Authority from time to time".

(G) Schedule IV Part III (2) is replaced as

The "Area" is defined as a district for which the registration of the Insurance Marketing Firm is

valid. However, if requested by an applicant, in case of IMFs registered in capital city of any State,

the area defined under Municipality/ Municipal Corporation of such city shall be considered as

area of operation.

(H) Schedule V Part-II (e) is replaced as

"display at their place of work/office, details of their registration issued by the Authority such as,

date of issue of registration and its validity, and list of other financial products marketed along

with the certificates issued by respective regulators, grievance handling process, list of

ombudsman and such other relevant information as may be required under applicable

statute(s)."

(I) In schedule X(3) following sentence shall be inserted after the words "…insurance marketing firm in the business."

"The ratio of AOA:AOY shall be 1:1."

(J) The following words in the table are deleted in Form B, C and D and the revised forms are placed as Annexure 1, 2 and 3 respectively.
