1 संन(cid:6979)(cid:7385) नाम और (cid:7079)ारंभ- इन र्नननयम(cid:7298) का संन(cid:6979)(cid:7385) नाम खा(cid:7378) सुर(cid:6979)ा और मानक (गैर-नन(cid:7416)द(cid:7397) खा(cid:7378) र्एं खा(cid:7378) सामन(cid:7061)य(cid:7298) के नलए अनुमोदन) र्नननयम, 2017 है।

2. प(cid:7407)रभाषाएं.(1) इन र्नननयम(cid:7298) म(cid:7286), बि तक (cid:7408)क संदभ(cid:6981) म(cid:7286) अ(cid:7008)या अपेन(cid:6979)त न होः-

(a) "अनधननयम" से खा(cid:7378) सुर(cid:6979)ा और मानक अनधननयम, 2006 (2006 का 34) अनभ(cid:7079)ेत है;

(b) "अनुमोदन" से (cid:7079)(cid:7004)य(cid:6979) या परो(cid:6979) (cid:7272)प से मार्न उपभोग के नलए आनयत ऐसी खा(cid:7006)र् (cid:7021)तु या खा(cid:7378) र्अर्य के र्नननमा(cid:6981)ण, र्नतरण, र्न(cid:7059)य या आयात क(cid:7409) अनुमनत अनभ(cid:7079)ेत है नसिे इस अनधननयम के अंतग(cid:6981)त बनाए गए (cid:7408)कसी अ(cid:7008)य र्नननयम के अधीन अनुमनत नही दी गई है;

(c) "खा(cid:7378) (cid:7079)ानधकरण" से इस अनधननयम क(cid:7409) धारा 4 के अंतग(cid:6981)त (cid:7021)ानपत भारतीय खा(cid:7378) सुर(cid:6979)ा और मानक (cid:7079)ानधकरण अनभ(cid:7079)ेत है।

(2) यहां इसम(cid:7286) (cid:7079)यु(cid:7334) और अप(cid:7407)रभानषत, परंतु अनधननयम म(cid:7286) या इसके अंतग(cid:6981)त बनाए गए ननयम(cid:7298) या र्नननयम(cid:7298) म(cid:7286) प(cid:7407)रभानषत (cid:7011)द और अनभ(cid:7390)न(cid:7334)य(cid:7298) का र्ही अ(cid:6981) होगा ोि अनधननयम, ननयम(cid:7298) या र्नननयम(cid:7298) म(cid:7286) उ(cid:7008)ह(cid:7286) (cid:7079)दान (cid:7408)कया गया है।

3. र्पू(cid:6981) अनुमोदन (cid:7079)दान (cid:7408)कए ािने क(cid:7409) (cid:7079)(cid:7408)(cid:7059)या- (1) खा(cid:7378)र् (cid:7021)तु(cid:7312) के र्नननमा(cid:6981)ता या आयातक, अपेन(cid:6979)त द(cid:7021)र्ताे(िcid:7298) और ु(cid:7016)क के सा, यान(cid:7021)नत (cid:7079)(cid:7272)प I, या (cid:7079)(cid:7272)प II, या (cid:7079)(cid:7272)प III, या (cid:7079)(cid:7272)प IV, या (cid:7079)(cid:7272)प V, या (cid:7079)(cid:7272)प VI खा(cid:7378) (cid:7079)ानधकरण को (cid:7079)(cid:7021)तुत कर(cid:7286)गे।

(2) खा(cid:7378) (cid:7079)ानधकरण र्आेदन क(cid:7409) ता यान(cid:7021)नत (cid:7079)(cid:7272)प I, या (cid:7079)(cid:7272)प II, या (cid:7079)(cid:7272)प III, या (cid:7079)(cid:7272)प IV, या (cid:7079)(cid:7272)प V, या (cid:7079)(cid:7272)प VI म(cid:7286) उन(cid:7016)लनखत सूचना(cid:7312) क(cid:7409) र्संी(cid:6979)ा करेगा।

(3) खा(cid:7378) (cid:7079)ानधकरण र्आेदक को अनत(cid:7407)र(cid:7334) सम(cid:6981)क द(cid:7021)र्ताे,ि आंके या (cid:7021)प(cid:7397)ीकरण, य(cid:7408)द र्आ(cid:7019)यक हो, (cid:7079)(cid:7021)तुत करने के नलए ननद(cid:7287) दे सकता है।

(4) खा(cid:7378) (cid:7079)ानधकरण, खा(cid:7378)र् (cid:7021)तु(cid:7312) के सुर(cid:6979)ा आकलन के आधार पर, (cid:7079)(cid:7272)प VII के अनुसार, अनुमोदन (cid:7079)दान कर सकता है र्अा र्आेदन को अ(cid:7021र्)ीकार कर सकता है।

(5) हिां अनुमोदन (cid:7079)दान (cid:7408)कया ािएगा, खा(cid:7378) (cid:7390)ापार (cid:7079)चालक रासायननक, पोषक, सू(cid:7023)मैिर्नक(cid:7409)य, भारी धातु, नाीक(cid:7409)टनाक के र्अेष(cid:7298) और (cid:7079)ाकृ नतक (cid:7272)प नमलने र्ाले र्नषा(cid:7334) त(cid:7004र्)(cid:7298) से संबंनधत उ(cid:7004)पादन मानदंड(cid:7298) का र्न(cid:7395)ेषण (cid:7079)माणप(cid:7074) (cid:7079)(cid:7021)तुत करेगा।

(6) खा(cid:7378) (cid:7390)ापार (cid:7079)चालक अपने र्आेदन के अ(cid:7021र्)ीकार (cid:7408)कए ािने के (cid:7408)कसी भी ननण(cid:6981)य के र्न(cid:7272)(cid:7373) अ(cid:7007)य(cid:6979), खा(cid:7378) (cid:7079)ानधकरण के सम(cid:6979) अपील दायर कर सके गा।

(7) एक खा(cid:7378) (cid:7390)ापार (cid:7079)चालक, ोि अ(cid:7007)य(cid:6979), खा(cid:7378) (cid:7079)ानधकरण के ननण(cid:6981)य (cid:7367)ारा (cid:7390)नत हो, खा(cid:7378) (cid:7079)ानधकरण क(cid:7409) बैठक म(cid:7286) र्नचार हेतु समी(cid:6979)ा यानचका दायर कर सकता है।

(8) खा(cid:7378) (cid:7079)ानधकरण, नलनखत (cid:7272)प से द(िcid:6981) (cid:7408)कए गए कारण(cid:7298) से, (cid:7408)कसी खा(cid:7378) (cid:7079)चालक को (cid:7079)दान (cid:7408)कए गए (cid:7408)कसी भी अनुमोदन का (cid:7079)नतसंहरण या ननलंबन कर सकता है।

(9) खा(cid:7378) (cid:7079)ानधकरण र्आेदन दायर करने क(cid:7409) ु(cid:7016)क रान क(cid:7409) समय-समय पर समी(cid:6979)ा कर सकता है।

(10) य(cid:7408)द खा(cid:7378) (cid:7390)ापार (cid:7079)चालक के पास यह र्न(cid:7393)ास करने के नलए कारण हो (cid:7408)क नसि खा(cid:7378) र्(cid:7021)तु के नलए अनुमोदन (cid:7079)दान (cid:7408)कया गया है, उसम(cid:7286) (cid:7021र्)ा(cid:7021)(cid:7005)य के नलए कोई ोिनखम है, तोर् ह त(cid:7004)काल ऐसी खा(cid:7378)र् (cid:7021)तु(cid:7312) के आयात, र्नननमा(cid:6981)ण, र्न(cid:7059)य, या र्नतरण को ननलंनबत करेगा और खा(cid:7378) सुर(cid:6979)ा और मानक (खा(cid:7378) (cid:7079)(cid:7004)याहरण) र्नननयम, 2016 के उपबंध(cid:7298) के अनुसार खा(cid:7378) (cid:7079)ानधकरण को सूचना देते (cid:7263)ए इसका (cid:7079)(cid:7004)याहरण करने के नलए दिम उठाएगा।

(11) खा(cid:7378) सुर(cid:6979)ा अनधकारी और अनभनहत अनधकारी इन र्नननयम(cid:7298) के अंतग(cid:6981)त खा(cid:7378) (cid:7079)ानधकरण (cid:7367)ारा अनुमो(cid:7408)दत खा(cid:7378)र् (cid:7021)तु क(cid:7409) सुर(cid:6979)ा के संबंध म(cid:7286) (cid:7079)ा(cid:7385) (cid:7408)कसी भी नकायत को त(cid:7004)काल खा(cid:7378) (cid:7079)ानधकरण को सूनचत करेगा।

4. र्नननमा(cid:6981)ण, भंडारण, र्न(cid:7059)य, र्नतरण, आयात इ(cid:7004)या(cid:7408)द के नलए र्पू(cid:6981) अनुमोदन- (1) कोई भी (cid:7390)न(cid:7334) खा(cid:7378) (cid:7079)ानधकरण के र्पू(cid:6981) अनुमोदन के नबना नन(cid:7388)नलनखत खा(cid:7378)र् (cid:7021)तु(cid:7312) या खा(cid:7378) र्अर्य(cid:7298) का र्नननमा(cid:6981)ण, भंडारण, र्न(cid:7059)य, र्नतरण या आयात नह(cid:7277) करेगा:-

(a) दे म(cid:7286) मार्न उपभोग का कोई इनतहास नही रखनेर् ाले र्नीन खा(cid:7378) पदा(cid:6981) या खा(cid:7378) पदा(cid:6981) रखने र्ाले र्नीन र्अर्य;

(b) दे म(cid:7286) मार्न उपभोग का इनतहास रखने र्ाले परंतु इस अनधननयम के अंतग(cid:6981)त बनाए गए (cid:7408)कसी अ(cid:7008)य र्नननयम(cid:7298) म(cid:7286) र्ननन(cid:7416)द(cid:7397) नह(cid:7277) (cid:7408)कए गए खा(cid:7378) र्अर्य;

(c) नए यो(cid:6996)य पदा(cid:6981) और (cid:7079)सं(cid:7021)करण साधन;

(d) र्नीन (cid:7079)ौ(cid:7378)ोनगक(cid:7409) का उपयोग करके र्ननन(cid:7414)मत या (cid:7079)सं(cid:7021)क(cid:7407)रत खा(cid:7378) पदा(cid:6981)।

(2) इन र्नननयम(cid:7298) के (cid:7079र्)ाधान इस अनधननयम के अतंग(cid:6981)त बनाए गए (cid:7408)क(cid:7008)ह(cid:7277) ननयम(cid:7298) र्अा र्नननयम(cid:7298) के अनत(cid:7407)र(cid:7334) ह(cid:7289) और (cid:7008)यूनीकरण म(cid:7286) नह(cid:7277) है।

5. खा(cid:7378) (cid:7390)ापार (cid:7079)चालक, (cid:7079)(cid:7272)प VII के अनुसार अनुमोदन (cid:7079)दान करने के बाद, खा(cid:7378) सुर(cid:6979)ा और मानक (खा(cid:7378) (cid:7390)ापार(cid:7298) क(cid:7409) लाइस(cid:7286)(cid:7410)सग और पंीिकरण) र्नननयम, 2011 म(cid:7286) र्ननन(cid:7416)द(cid:7397) (cid:7079)(cid:7408)(cid:7059)या के अनुसार लाइस(cid:7286)स के नलए र्आेदन करेगा।

7. साम(cid:7061)ी या उ(cid:7004)पाद का काया(cid:6981)(cid:7004)मक उपयोग:

(क) मार्न उपभोग हेतु ल(cid:7023)य समूह म(cid:7286) (cid:7079)(cid:7021)तार्नत उ(cid:7004)पाद के काया(cid:6981)(cid:7004)मक (cid:7079)योग को नन(cid:7416)द(cid:7397) कर(cid:7286);

(ख) (cid:7079)योग क(cid:7409) गई मा(cid:7074)ा हेतु डेटा के औनच(cid:7004)य आ(cid:7408)द के सा उपरो(cid:7334) के नलए द(cid:7021)र्ताेीि (cid:7079)माण सनहत संन(cid:6979)(cid:7385) र्र्नरण उपल(cid:7011)ध कर्राएं।

8. नए उ(cid:7004)पाद का आानतत उपयोग उपल(cid:7011)ध कर्राएं

(क) उपभो(cid:7334)ा(cid:7312) या खा(cid:7378) ननमा(cid:6981)ता(cid:7312) को र्नन(cid:7397) लाभ, य(cid:7408)द (cid:7079)(cid:7021)तार्नत खा(cid:7378) उ(cid:7004)पाद / साम(cid:7061)ी क(cid:7409) अनुमनत हो;

(ख) सम(cid:7414)त द(cid:7021)र्ताेीि (cid:7079)माण(cid:7298) के सा औनच(cid:7004)य सनहत उपभो(cid:7334)ा(cid:7312) और ननमा(cid:6981)ता(cid:7312) को (cid:7079)(cid:7021)तार्नत खा(cid:7378) उ(cid:7004)पाद के र्नन(cid:7397) लाभ/हाननयां;

(ग) ननमा(cid:6981)ता को कोई अ(cid:7008)य कनत उपयोग और प(cid:7407)रणामी लाभ र्अा हाननयां भी उपल(cid:7011)ध कर्रायी ाि सकती है।

9. तृतीय प(cid:6979) रा(cid:7398)ीय (cid:7079)योगाला (cid:7079)(cid:7004)यायन बोड(cid:6981) या अंतरा(cid:6981)(cid:7398)ीय (cid:7079)योगाला (cid:7079)(cid:7004)यायन काप(cid:7299)रेन मा(cid:7008)यता (cid:7079)ा(cid:7385) (cid:7079)योगाला(cid:7312) से र्न(cid:7395)ेषण का (cid:7079)माणप(cid:7074) उपल(cid:7011)ध कर्राना होगा ोि (cid:7408)क र्आेदक (cid:7367)ारा र्दाा (cid:7408)कए गए र्नेष र्र्नरण साम(cid:7061)ी या उ(cid:7004)पाद(cid:7298) के अनुकू लन का (cid:7079)द(cid:6981)न करता है। ऐसे र्न(cid:7395)ेषण का (cid:7079)माणप(cid:7074) म(cid:7286) रासायननक मापदंड(cid:7298), पोषण (cid:7021)तर, उ(cid:7020)मीय मान, धातु संदूषक ( पीबी, सीडी, एएस, सीआर, सीयू, एसएन, एचीि, एनआई), (cid:7079)ाकृ नतक (cid:7272)प से पाए ािनेर् ाले र्नषैल पदा(cid:6981), एलेटोन(cid:6989)सनस, क(cid:7409)टनाक र्अेष, टीपीसी,र् ाईर्एंएम, ई-कोली, कोली (cid:7079)(cid:7272)प ानमल होने चानहए और रोगनिकर् ीि(cid:7298) र्एं अ(cid:7008)य रासायननक पैरामीटस(cid:6981) आ(cid:7408)द से मु(cid:7334) होने चानहए। र्न(cid:7395)ेषण (संसूचन क(cid:7409) सीमा, (cid:7079)मा(cid:7074)ीकरण क(cid:7409) सीमा पर ािनकारी, र्सेदनीलता, दोहरान, र्नन(cid:7397)ता र्एं अ(cid:7008)य परी(cid:6979)ण र्ननध) के नलए ैिसी र्आ(cid:7019)यकता हो, मा(cid:7008)यकृ त परी(cid:6979)ण र्ननधयां को सदभ(cid:7300) के सा उपल(cid:7011)ध कर्राया ािएगा।

No. 12/PA Regulation/Dir (PA)/FSSAI-2016.—The following draft of the Food Safety and Standards (Approval for Non-Specified Food and Food Ingredients) Regulations, 2016, which the Food Safety and Standards Authority of India proposes to make with the previous approval of the Central Government, in exercise of the powers conferred by clause (v) of sub-section (2) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), is hereby published as required by sub-section (1) of section 92 of the said Act, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of the Gazette containing this notification is published are made available to the public;

The objections or suggestions, which may be received from any person with respect to the said draft regulations before the expiry of the period specified above, shall be considered by the Food Safety and Standards Authority of India.

Draft regulations

1 Short title and commencement.―These regulations may be called the 'Food Safety and Standards (Approval for Non-Specified Food and Food Ingredients) Regulations, 2017.'

2. Definitions.―(1) In these regulations, unless the context otherwise requires:-

(a) "Act" means the Food Safety and Standards Act, 2006 (34 of 2006);

(b) "Approval" means a permission to manufacture, distribute, sell or import any article of food or food ingredients, intended directly or indirectly for human consumption, that has not been permitted under any other regulation made under the Act;

(c) "Food Authority" means the Food Safety and Standards Authority of India established under section 4 of the Act.

(2) The words and expressions used herein and not defined, but defined in the Act or rules or regulations made thereunder, shall have the meaning as assigned to them in the Act, rules or regulations.

3. Procedure for grant of prior approval.―(1) The manufacturer or importer of articles of food shall submit an application in FORM I, or FORM II, or FORM III, or FORM IV, or FORM V, or FORM VI, as the case may be, along with requisite documents and fee to the Food Authority.

(2) The Food Authority shall scrutinize the application and other information stated in FORM I, or FORM II, or FORM III, or FORM IV, or FORM V, or FORM VI.

(3) The Food Authority may direct the applicant to submit additional supporting documents, data or clarifications, if required.

(4) The Food Authority may either grant approval or reject the application, as per FORM VII, on the basis of the safety assessment of the articles of food.

(5) Where the approval is granted, the food business operator shall submit certificate of analysis of the production parameters relating to chemical, nutritional, microbiological, heavy metals, pesticide residues and naturally occurring toxicants to the Food Authority.

(6) The food business operator may file an appeal before the Chairperson, Food Authority, against any decision of rejection of his application.

(7) A food business operator, who is aggrieved by the decision of the Chairperson, Food Authority, may file review petition to be placed for consideration in the meeting of the Food Authority.

(8) The Food Authority may, for reasons to be recorded in writing, revoke or suspend any approval granted to any food business operator.

(9) The Food Authority may review from time to time, the amount of fee for filing an application.

(10) If the food business operator has reason to believe that the food for which the approval has been granted involves any risk for health, he shall immediately suspend the import, manufacture, sale, or12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] distribution of such articles of food and take steps to recall the same under intimation to Food Authority in accordance with the provisions of the Food Safety and Standards (Food Recall) Regulation, 2016.

(11) The Food Safety Officers and Designated Officers shall immediately inform the Food Authority of any complaint received regarding safety of food approved by the Food Authority under these regulations.

4. Prior approval for manufacture, storage, sale, distribution, import, etc.―(1) No person shall manufacture, store, sell, distribute or import the following articles of food or food ingredients except with the prior approval of the Food Authority, namely:—

(a) novel food or food containing novel ingredients not having a history of human consumption in the country;

(b) food ingredients with a history of human consumption in the country but not specified in any other regulations made under the Act;

(c) new additives and processing aids;

(d) food manufactured or processed with the use of novel technology.

(2) The provisions of these regulations are in addition to and not in derogation of any rules or regulations made under the Act.

5. The food business operator shall apply for the license as per the procedure specified in the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011, after grant of approval as per FORM VII.

Persons applying for novel food or food containing novel Ingredients or processed with the use of novel

technology shall furnish the following information, namely:―

6. Indicate the recommended daily allowance levels (as specified by Indian Council of Medical Research) for vitamins, minerals and such other nutrients where recommended daily allowances are specified.

7. Functional use of ingredient or product:

(a) Specify the functional use of the proposed product in the target group for human consumption;

(b) A brief description with documentary evidence of the same may be provided along with justification of data etc. for the quantity used.

8. Provide intended use of the new product:

(a) Specific benefit to the consumers or food manufacturers, if the proposed food product/ingredient is allowed;

(b) Specific advantages/disadvantages of the proposed food product to consumers and manufacturers along with justification, supported with documentary evidence;

(c) Any other perceived use of the manufacture and resultant advantages or disadvantages may also be provided.

9. Certificate of analysis from third party National Accredited Board of Laboratories or International Laboratories Accreditation Cooperation recognised laboratories shall be provided which demonstrates the compliance of the ingredients or products to the specifications as claimed by the applicant. The certificate of analysis shall include chemical parameters, nutrient levels, calorific value, metals contaminants (Pb, Cd, As, Cr, Cu, Sn, Hg, Ni), naturally occurring toxic substances, aflatoxins, pesticide residues, TPC, Y&M, E-Coli, Coli Form and freedom from Pathogenic organisms, and other chemical parameters. The validated test method as needed for the analysis (with information on Limit of Detection, Limit of Quantification, sensitivity, repeatability, specificity and other test methods) shall be provided with references.

10. Proposed label in compliance with section 23 of the Act and Food Safety and Standards (Packaging and Labeling) Regulations, 2011 to be attached with the following heading :—

11. Method of manufacture: Please provide the process used for manufacture of the product in detail.

12. Real time or accelerated Shelf Life or Stability of product (shelf life studies) shall be provided.

13. Specific conditions of storage must be provided along with detailed directions for use and expected ill effect due to failure to store the product under optimal conditions.

14. History of consumption of product (attach supporting documents)

(a) Geographical area of use (with established history of safe use in at least two countries, regulated by the Food regimes prevalent in EU, USA, Canada, Australia, Japan and China;

(b) Average quantity of consumption;

(c) Positive effects;

(d) Negative or adverse effects.

15. Safety Information: (Documents on risk assessment or toxicity studies to be attached)

(a) The information shall be based on safety or risk assessment review from published studies and safety studies conducted on the ingredient and food product by the applicant:

(c) Information on human studies, if any;

(d) Toxicological studies;

(e) Results of Ame's tests to test mutagenecity, chromosomal aberration tests, studies for reproductive toxicity, prenatal developmental toxicity studies;

(f) Provide evidence to demonstrate that the proposed product or the ingredient will not adversely affect any specific population groups that is pregnant women, lactating mothers, children, elderly or any other vulnerable group;

(g) History of new ingredient/product in other countries (Documents to be attached);

(h) Allergenicity: Attach published or unpublished reports of allergenicity or other adverse effects in humans associated with the food consumption, Attach reports prepared by World Health Organisation or by other national or international agencies responsible for food safety or public health like Codex, United States Food and Drug Administration, European Union, Food Standards Australia New Zealand and other agencies;

(i) Information on dietary exposure, nutritional impact and potential impact on the consumer.

16. Regulatory Status: Mention the countries where the product or ingredient is permitted for direct or indirect human consumption as food. If so, provide the level and purpose of consumption by the consumers with the relevant regulations.

17. Copy of agreement of relationship of applicant and manufacturer and other entities involved in the food business of the proposed product, namely, marketer, importer, re-packer.

18. List of documents attached: The applicant shall attach an indexed list of documents in support of the application and identify these in relation to the information code herein.

21. All data documentary evidence provided by the applicant shall be from international peer reviewed journals, international bodies including World Health Organisation and Food and Agriculture Organisation. Only complete records or studies shall be provided.
