का.आ. 340(अ).—के (cid:7008)(cid:7076)ीय सरकार, रेल अनधननयम, 1989 (1989 का 24) (नसिे इसम(cid:7286) इसके प(cid:7019)चात उ(cid:6989)त अनधननयम कहा ािएगा) क(cid:7409) धारा 20 क क(cid:7409) उपधारा (1) (cid:7367)ारा (cid:7079)द(cid:7004)त न(cid:6989)तय(cid:7298) का (cid:7079)योग करते (cid:7263)ए यह समाधान हो ािने के प(cid:7019)चात् (cid:7408)क लोक (cid:7079)योनि के नलए, भू-भाग, नसिका संन(cid:6979)(cid:7009)त र्र्नरण उपबंध अनुसूची म(cid:7286) (cid:7408)दया गया है, नबहार रा(cid:6996)य के मढौरा नलिा के र्नेष रेल प(cid:7407)रयोनिा, अा(cid:6981)त मढौरा-डीलि लोकोमो(cid:7407)र्ट ै (cid:6989)(cid:7069)ी र्नननमा(cid:6981)ण कारखाने क(cid:7409) (cid:7021)ापना, के नन(cid:7020)पादन अनुर(cid:6979)ण, (cid:7079)बंधन और (cid:7079)चालन हेतु अपेन(cid:6979)त है, ऐसी भूनम का अ(िcid:6981)न करने के अपने आय क(cid:7409) घोषणा करती है।

उ(cid:6989)त भूनम म(cid:7286) नहतब(cid:7373) कोई (cid:7018)यन(cid:6989)त, रापि(cid:7074) म(cid:7286) इस अनधसूचना के (cid:7079)कान क(cid:7409) तारीख से तीस (cid:7408)दन के भीतर उ(cid:6989)त अनधननयम क(cid:7409) धारा 20 घ क(cid:7409) उप-धारा (1) के अधीन उपरो(cid:6989)त (cid:7079)योनि के नलए ऐसी भूनम है के अ(िcid:6981)न और उपयोग के संबंध म(cid:7286) आ(cid:6979)ेप कर सके गा।

इस (cid:7079)कार के (cid:7079)(cid:7004)येक आ(cid:6979)ेप स(cid:6979)म अनधकारी, अा(cid:6981)त् नलिा भूनम-अ(िcid:6981)न अनधकारी, मढौरा, नलिा सारण, नबहार, को नलनखत म(cid:7286) (cid:7408)कया ािएगा और उसम(cid:7286) उसके आधार उर्प(cid:7414)णत (cid:7408)कये ािएंगे और स(cid:6979)म अनधकारी, आ(cid:6979)ेपकता(cid:6981) का (cid:7018)यन(cid:6989)तगत (cid:7272)प से या र्ननध (cid:7018)र्यसायी के मा(cid:7007)यम से सुर्नाई का र्असर (cid:7079)दान करेगा और सभी ऐसे आ(cid:6979)ेप(cid:7298) क(cid:7409) सुर्नाई करने ता ऐसी और ँिच, य(cid:7408)द कोई हो, करने के प(cid:7019)चात य(cid:7408)द स(cid:6979)म अनधकारी र्आ(cid:7019)यक समझे तो आदे (cid:7367)ारा या तो आ(cid:6979)ेप(cid:7298) को अनु(cid:6980)ात या अननु(cid:6980)ात कर सके गा।

उ(cid:6989)त अनधननयम क(cid:7409) धारा 20 घ क(cid:7409) उपधारा (2) के अधीन स(cid:6979)म (cid:7079)ानधकारी (cid:7367)ारा (cid:7408)कया गया कोई आदे अंनतम होगा।

NOTIFICATION

New Delhi, the 2nd February, 2017

S.O. 340(E).—In exercise of the powers conferred by clause (1) of section 20A of Railway Act, 1989 (24 of 1989) (hereinafter referred to as the said act.) the Central Government, after being satisfied that for the public purpose, the land, the brief description of which is given in the schedule annexed hereto, is required for execution, maintenance, management and operation of Special Railway Project, namely, Marhowra-Setting up of Diesel Loco Manufacturing Factory, in the district of Marhowra, in the state of Bihar, hereby declares its intention to acquire such land.

Any person interested in the said land may, within thirty days from the date of publication of this notification in the Official Gazette, raise objection to the acquisition and use of such land for the aforesaid purpose under sub-section (1) of Section 20D of the said Act.

Every such objection shall be made to the competent authority, namely, District Land Acquisition Officer, Marhowra, District –Saran, Bihar, in writing and shall set out the grounds thereof, and the competent Authority shall give the objector an opportunity of being heard, either in person or by legal practitioner, and may after hearing all such objections and after making such further enquiry, if any, as the competent authority thinks necessary, by order, either allow or disallow the objections.

Any order made by the competent authority under sub-section (2) of Section 20D of the said act shall be final.

The land plans and other details of the land covered under this notification are available and can be inspected by the interested person at the aforesaid office of the competent authority.

SCHEDULE

Brief description of the land to be acquired, with or without structure, for Special Railway Project, namely Marhowra - Setting up of Diesel Locomotive Factory, in the State of Bihar.
