अतः, अब, के (cid:7008)(cid:7076)ीय सरकार, पया(cid:6981र्)रण (संर(cid:6979)ण) ननयम, 1986 के ननयम 5 के उपननयम (3) के सा प(cid:7407)ठत पया(cid:6981र्)रण (संर(cid:6979)ण) अनधननयम, 1986 (1986 का 29) क(cid:7409) धारा 3 क(cid:7409) उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) (cid:7367)ारा (cid:7079)द(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए, रा(िcid:7021)ान रा(cid:6996)य म(cid:7286) स(cid:7343)नगर् (cid:7008)र्यीि अभयार(cid:7003)य क(cid:7409) सीमा के चार(cid:7298) ओर 250 मीटर से 5 (cid:7408)कलोमीटर तक के र्न(cid:7021)ता(cid:7407)रत (cid:6979)े(cid:7074) को स(cid:7343)नग र्(cid:7008)र्यीि अभयार(cid:7003)य पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन (नसिे इसम(cid:7286) इसके प(cid:7019)चात् पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन कहा गया है) के (cid:7272)प म(cid:7286) अनधसूनचत करती है, नसिके (cid:7011)यौरे नन(cid:7388)ानुसार है, अा(cid:6981)त् :--
1. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का र्न(cid:7021)तार और उसक(cid:7409) सीमाएं--(1) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन स(cid:7343)नग र्(cid:7008)र्यीि अभयार(cid:7003)य क(cid:7409) सीमा के चार(cid:7298) ओर 250 मीटर से 5 (cid:7408)कलोमीटर तक नभ(cid:7382)-नभ(cid:7382) र्न(cid:7021)तार के सा 28.7र् ग(cid:6981) (cid:7408)कलोमीटर (cid:6979)े(cid:7074) पर ै ला (cid:7263)आ है और उ(cid:7334) ोिन का सीमार् ण(cid:6981)न उपाबंध-I पर (cid:7408)दया गया है ।
(2) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन रा(िcid:7021)ान के उदयपुर नलिे क(cid:7409) नगर्रा तहसील के 9 (cid:7061)ाम(cid:7298) तक ै ला (cid:7263)आ है |
(3) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का माननच(cid:7074) इसके अ(cid:6979)ां और देा(cid:7008)तर के सा उपाबंध II के (cid:7271)प म(cid:7286) संल(cid:7336) है ।
(4) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के ननद(cid:7287)ांक उपाबंध III म(cid:7286) (cid:7408)दए गए ह(cid:7289) और (cid:7079)मुख (cid:7410)बदु(cid:7312) के ननद(cid:7287)ांक के सा-सा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर आनेर् ाले (cid:7061)ाम(cid:7298) क(cid:7409) सूची उपाबंध IV के (cid:7271)प म(cid:7286) संल(cid:7336) है ।
2. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आंचनलक महायोनिा – (1) रा(cid:6996)य सरकार, पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए रापि(cid:7074) म(cid:7286) अंनतम अनधसूचना के (cid:7079)कान क(cid:7409) तारीख से दोर् ष(cid:6981) क(cid:7409) र्अनध के भीतर, (cid:7021)ानीय (cid:7390)न(cid:7334)य(cid:7298) के पराम(cid:6981) से और इस अनधसूचना म(cid:7286) (cid:7408)दए गए अनुबंध(cid:7298) पालन करके आंचनलक महायोनिा तैयार करेगी ।
(2) उ(cid:7334) योनिा रा(cid:6996)य सरकार म(cid:7286) स(cid:6979)म (cid:7079)ानधकारी (cid:7367)ारा अनुमो(cid:7408)दत क(cid:7409) ािएगी ।
(3) रा(cid:6996)य सरकार (cid:7367)ारा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आचंनलक महायोनिा ऐसी रीनत म(cid:7286), तैयार क(cid:7409) ािएगी ोि इस अनधसूचना म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट है ता सुसंगत क(cid:7286) (cid:7076)ीय और रा(cid:6996)य र्ननधय(cid:7298) के और क(cid:7286) (cid:7076)ीय सरकार (cid:7367)ारा ािरी माग(cid:6981)ननद(cid:7287)(cid:7298), य(cid:7408)द कोई ह(cid:7298), के भी अनु(cid:7271)प है ।
(4) आंचनलक महायोनिा, पया(cid:6981र्)रणीय और पा(cid:7407)रन(cid:7021)नतक र्नचार(cid:7298) को समाकनलत करने संब(cid:7373) रा(cid:6996)य के सभी र्नभाग(cid:7298) के पराम(cid:6981) से तैयार क(cid:7409) ािएगी, अा(cid:6981)त्:--
(i) पया(cid:6981र्)रण ;
(ii) र्न ;
(iii) नगर र्नकास ;
(iv) पय(cid:6981)टन ;
(v) नगरपानलका ;
(vi) रा(िcid:7021र्) ;
(vii) कृ नष ;
(viii) रा(cid:6996)य (cid:7079)दूषण ननयं(cid:7074)ण बोड(cid:6981);
(ix) (cid:7410)सचाई; और
(x) लोक ननमा(cid:6981)ण र्नभाग।
[भाग II—खण्ड 3(ii)] भारत का राजपत्रा : असाधरण 3(5) आंचनलक महायोनिा अनुमो(cid:7408)दत र्न(cid:7378)मान भू-उपयोग, र्असंरचना और (cid:7408)(cid:7059)याकलाप(cid:7298) पर कोई ननब(cid:7304)धन तब तक अनधरोनपत नह(cid:7277) करेगी बि तक (cid:7408)क इस अनधसूचना म(cid:7286) इस (cid:7079)कार र्ननन(cid:7416)द(cid:7020)ट न (cid:7408)कया गया हो और आचंनलक महायोनिा सभी र्असंरचना और (cid:7408)(cid:7059)याकलाप(cid:7298) म(cid:7286) और अनधक द(cid:6979)ता और पा(cid:7407)रन(cid:7021)नतक अनुकू लता का र्संध(cid:6981)न करेगी ।
(6) आंचनलक महायोनिा म(cid:7286) अना(cid:6994)छा(cid:7408)दत (cid:6979)े(cid:7074)(cid:7298) के ीिण(cid:7299)(cid:7373)ार, र्न(cid:7378)मान लि ननकाय(cid:7298) के संर(cid:6979)ण, र्आाह (cid:6979)े(cid:7074)(cid:7298) के (cid:7079)बंधन, लि- संभर(cid:7298) के (cid:7079)बंधन, भूतल लि के (cid:7079)बंधन, मृदा और नमी संर(cid:6979)ण, (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409) र्आ(cid:7019)यकता(cid:7312) ता पा(cid:7407)रन(cid:7021)नतक और पया(cid:6981र्)रण से संबंनधत ऐसे अ(cid:7008)य पहलु(cid:7312), ननि पर (cid:7007)यान देना र्आ(cid:7019)यक है, के नलए उपबंध ह(cid:7298)गे ।
(7) आंचनलक महायोनिा सभी र्न(cid:7378)मान पूाि (cid:7021)ल(cid:7298), (cid:7061)ाम(cid:7298) और नगरीय बन(cid:7021)तय(cid:7298), र्न(cid:7298) के (cid:7079)कार और (cid:7408)क(cid:7021)म(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), ऊपािऊ भूनम, ह(cid:7407)रत (cid:6979)े(cid:7074) ैिसे उ(cid:7378)ान और उसी (cid:7079)कार के (cid:7021)ान, उ(cid:7378)ान कृ नष (cid:6979)े(cid:7074), लोउ(cid:7378)ान, झील(cid:7298) और अ(cid:7008)य लि ननकाय(cid:7298) का अ(cid:7012)यकं न करेगी ।
(8) आंचनलक महायोनिा (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409)र् ीिकोपा(िcid:6981)न को सुननन(cid:7019)चत करने के नलए, पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) र्नकास को पा(cid:7407)रन(cid:7021)नतक अनुकू ल र्नकास के नलए र्नननयनमत करेगी ।
3. रा(cid:6996)य सरकार (cid:7367)ारा (cid:7408)कए ािनेर् ाले उपाय-- रा(cid:6996)य सरकार इस अनधसूचना के उपबंध(cid:7298) को (cid:7079)र्भाी करने के नलए नन(cid:7388)नलनखत उपाय करेगी, अा(cid:6981)त् :--
(1) भू-उपयोग - पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286)र् न(cid:7298), उ(cid:7378)ान-कृ नष (cid:6979)े(cid:7074)(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योनि(cid:7298) के नलए नचन(cid:7008)हत (cid:7408)कए गए पाक(cid:7300) और खुले (cid:7021)ान(cid:7298) कार् ानणन(cid:6996)यक और औ(cid:7378)ोनगक संब(cid:7373) र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए उपयोग या संप(cid:7407)र्रत(cid:6981)न नह(cid:7277) होगा:
परंतु पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर कृ नष भूनम का संप(cid:7407)र्रत(cid:6981)न, मानीटरी सनमनत क(cid:7409) नसा(cid:7407)र पर और रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन से, (cid:7021)ानीय नर्नानसय(cid:7298) क(cid:7409) र्आासीय (िcid:7272)रत(cid:7298) को पूरा करने के नलए और पैरा 4 क(cid:7409) सारणी के (cid:7021)तंभ (2) म(cid:7286) (cid:7059)म सं0 15, 22, 28, 30 और 33 के सामने सूचीब(cid:7373) (cid:7408)(cid:7059)याकलाप(cid:7298) को पूरा करने के नलए अनु(cid:6980)ात ह(cid:7298)गे, अा(cid:6981)त् :-
(i) र्न(cid:7378)मान सक(cid:7298) को चौा और सुदृ करना और नई सक(cid:7298) का सन(cid:7382)मा(cid:6981)ण;
(ii) (cid:7079)दूषण उ(cid:7004)प(cid:7382) न करनेर् ाले लघु उ(cid:7378)ोग;
(iii) पा(cid:7407)रन(cid:7021)नतक अनुकू ल पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप ;
(iv)र् षा(cid:6981) लि संचय; और
(v) कु टीर उ(cid:7378)ोग, नसिके अंतग(cid:6981)त (cid:7061)ामीण उ(cid:7378)ोग भी ह(cid:7289):
परंतु यह और (cid:7408)क निाितीय भूनम का उपयोग रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन और संर्नधान के अनु(cid:6994)छेद 244 या त(cid:7004)समय (cid:7079र्)ृ(cid:7275) र्ननध के उपबंध(cid:7298) के अनुपालन के नबना, नसिके अंतग(cid:6981)त अनुसूनचत निािनत और अ(cid:7008)य परंपरागतर् न नर्नासी र्(न अनधकार(cid:7298) क(cid:7409) मा(cid:7008)यता) अनधननयम, 2006 (2007 का 2) भी है,र् ानणन(cid:6996)यक या उ(cid:7378)ोग र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए अनु(cid:6980)ात नह(cid:7277) होगा :
परंतु यह और भी (cid:7408)क पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर भू-अनभलेख(cid:7298) म(cid:7286) (cid:7079)कट होनेर् ाली कोई (cid:7074)ु(cid:7407)ट, मानीटरी सनमनत के र्नचार (cid:7079)ा(cid:7385) करने के प(cid:7391)ात् रा(cid:6996)य सरकार (cid:7367)ारा (cid:7079)(cid:7004)येक मामले म(cid:7286) एक बार संोनधत क(cid:7409) ािएगी और उ(cid:7334) (cid:7074)ु(cid:7407)ट के संोधन क(cid:7409) सूचना के (cid:7008)(cid:7076)ीय सरकार के पया(cid:6981र्)रण,र् न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय को देनी होगी ।
परंतु यह और भी (cid:7408)क उपयु (cid:6981)(cid:7334) (cid:7074)ु(cid:7407)ट का संोधन म(cid:7286) इस उप पैरा के अधीन या उपबंनधत के नर्साय (cid:7408)कसी भी दा म(cid:7286) भू-उपयोग का प(cid:7407)र्रत(cid:6981)न सन(cid:7013)मनलत नह(cid:7277) होगा ।
परंतु यह और भी (cid:7408)क ह(cid:7407)रत (cid:6979)े(cid:7074) म(cid:7286) ैिसे र्न (cid:6979)े(cid:7074) और कृ नष (cid:6979)े(cid:7074) म(cid:7286) कोई पा(cid:7407)रणानमक कटौती नह(cid:7277) होगी और अन(cid:7079)यु(cid:6989)त या अनु(cid:7004)पादक कृ नष (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) पुन:र् नीकरण करने के (cid:7079)यास (cid:7408)कए ािएंगे ।
(2) (cid:7079)ाकृ नतक लि (cid:7090)ोत - आचंनलक महायोनिा म(cid:7286) सभी (cid:7079)ाकृ नतक के र्आाह (cid:6979)े(cid:7074)(cid:7298) क(cid:7409) पहचान क(cid:7409) ािएगी और उनके संर(cid:6979)ण और र्नीकरण के नलए योनिा सन(cid:7013)मनलत होगी और रा(cid:6996)य सरकार (cid:7367)ारा ऐसे (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) या उनके ननकट ऐसे र्नकास (cid:7408)(cid:7059)याकलाप ोि ऐसे (cid:6979)े(cid:7074)(cid:7298) के नलए हाननकर ह(cid:7289) (cid:7079)नतनष(cid:7373) करने के नलए ऐसी रीनत से माग(cid:6981)ननद(cid:7287) तैयार (cid:7408)कए ािएंगे ।
(3) पय(cid:6981)टन – (क) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप पय(cid:6981)टन महायोनिा के अनुसार ह(cid:7298)गे ोि आंचनलक महायोनिा के भाग (cid:7272)प म(cid:7286) होगी ।

(ग) पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप नन(cid:7013)ननलनखत के अधीन र्नननयनमत ह(cid:7298)गे, अा(cid:6981)त् :-
(i) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर सभी नए पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) या र्न(cid:7378)मान पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) का र्न(cid:7021)तार क(cid:7286) (cid:7076)ीय सरकार के पया(cid:6981र्)रण,र् न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय के माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत(cid:7298) के (cid:7367)ारा ता रा(cid:7020)(cid:7069)ीय (cid:7018)या(cid:7062) संर(cid:6979)ण (cid:7079)ानधकरण, (cid:7367)ारा ािरी पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन (समय-समय पर या संोनधत) माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत(cid:7298) के अनुसार होगा और पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन, पा(cid:7407)रन(cid:7021)नतक न(cid:6979)ा और पा(cid:7407)रन(cid:7021)नतक र्नकास को मह(cid:7004र्) देते (cid:7263)ए पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन क(cid:7409)र् हन (cid:6979)मता के अ(cid:7007)ययन पर आधा(cid:7407)रत होगा;

NOTIFICATION
New Delhi, the 13th February, 2017
S.O.435(E)— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide
notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 2807(E), dated the 13th October, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on the 2nd November 2015;
AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
[भाग II—खण्ड 3(ii)] भारत का राजपत्रा : असाधरण 13(vii) Agriculture; (viii) State Pollution Control Board; (ix) Irrigation; and (x) Public Works Department, for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6)The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7)The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8)The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.
3.Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 15, 22, 28, 30 and 33 in column (2) of the Table in paragraph 4, namely:- (i) widening and strengthening of existing roads and construction of new roads; (ii) small scale industries not causing pollution; (iii) eco-friendly tourism activities; (iv) rainwater harvesting; and (v) cottage industries including village artisans, etc.
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Eco-tourism.- (a) The activity relating to Eco-tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the Government of Rajasthan.
(c) The activity of Eco-tourism shall be regulated as under, namely:-
(i) all new Eco-tourism activities or expansion of existing eco-tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco- sensitive Zone;
14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)](ii) No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometre or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan.
(iii) commercial Eco-tourism establishments shall be regulated strictly in accordance with ''the guidelines for taking non forestry activities in Wild life habitats" issued vide F.No.610/2011 WL, dated the 15th March, 2011 by the Ministry of Environment and Forests (WL Division), New Delhi and National Tiger Conservation Authority guidelines (if applicable).
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder. If required, standards may be made more stringent for protection of environment.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil or noise pollution within the Eco-sensitive Zone shall be permitted.
(c) No new explosive go down shall be established within the Eco-sensitive Zone.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-

(b) Beyond one kilometer up to the extent of Eco-sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities and construction and augmentation of civic amenities shall be regulated as per the Zonal Master Plan. |
| 11. | Felling of trees. | (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. (c) In case of Reserve Forests and Protected Forests, the Working Plan prescriptions shall be followed. |

5. Monitoring Committee:- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) District Collector, Udaipur - Chairman;
(b) one representative of Non-Governmental Organisation working in the field of environment to be nominated by the Government of Rajasthan for a term of three year – Member;
(c) one expert in the area of ecology and environment to be nominated by the Government of Rajasthan for a term of three year – Member;
(d) District level officer of the Public Work Department –Member;
(e) District level officer of the Mining Departments – Member;
(f) District level officer of the Irrigation Departments – Member;
(g) District level officer of the Tourism Departments – Member;
(h) District level officer of the Police Departments – Member;
(i) District level officer of the Municipal Council Departments – Member;
(j) District level officer of the Industry Departments – Member;
(k) District level officer of the UIT Departments – Member;
(l) Regional Officer (RO) of the State Pollution Control Board – Member;
(m) SDO, Udaipur -Member;
(n) Deputy Conservator of forest – Member-Secretary.
6. Terms of reference.- (1) The tenure of the Monitoring Committee shall be of three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India, Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India, Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State as per pro-forma appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal.

- 35 ' N to 24 39’ N Latitudes and 73 °37’ E to 73° 40’E Longitudes in District Udaipur, Rajasthan and is spread across 5.19 square kilometer; AND WHEREAS, Sanctuary has a varied habitat having diversified fauna and flora and supports 26 species of mammals, 115 species of birds, 33 species of reptiles and 7 amphibian species; AND WHEREAS, the Sanctuary harbours Leopard, Striped Hyaena, Indian Fox, Jungle Cat, Toddy cat, Small Indian Civet, Jackal, Flying fox, Sambar, Spotted Deer, etc.; AND WHEREAS, the sanctuary has Tropical Dry Deciduous Forests as per Champion and Seth Classification and the major plant species are Anogeissus pendula, Lannea grandis, Acacia catechu, Mitragyna parviflora, Boswellia serrata, Anogeissus latifolia, Acacia leucophloea etc.; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Sajjangarh Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone. NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986), read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent ranging from 250 meters to 5 kilometers around the boundary of Sajjangarh Wildlife Sanctuary in the State of Rajasthan as the Sajjangarh Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area of 28.7 square kilometers with an extent varying from 250 meters to 5 kilometers around the boundary of Sajjangarh Wildlife Sanctuary and the boundary description of the said Zone is given in Annexure I. (2) The Eco-sensitive Zone is spread across 9 villages falling in Girva Tehsil, Udaipur District of Rajasthan. (3) The map of the Eco-sensitive Zone along with latitude and longitude is appended as Annexure II. (4) The co-ordinates of Eco-sensitive Zone are given at Annexure-III and the list of villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure IV. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) the said Plan shall be approved by the Competent Authority in the State Government. (3) the Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
