का.आ. 507(अ).— भारत सरकार ने पेट्रोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का अर्जन) अधिनियम, 1962 (1962 का 50) (जिसे इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की धारा 3 की उप-धारा (1) के अधीन जारी भारत सरकार के पेट्रोलियम और प्रा—तिक गैस मंत्रालय की अधिसूचना का.आ. 434 तारीख 4 फरवरी 2005, द्वारा उन अधिसूचनाओं से संलग्न अनुसूचियों में विनिर्दिष्ट भूमियों में देश के विभिन्न भागों में अवस्थित उपभोक्ताओं तक प्रा—तिक गैस के परिवहन के लिए मैसर्स रिलायंस गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड (पूर्ववत गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर कंपनी लिमिटेड) द्वारा का किनाडा-हैदराबाद-ऊरण-अहमदाबाद गैस पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी;

और, यतः, भारत सरकार ने उक्त अधिनियम की धारा 6 की उप-धारा (1) के अन्तर्गत सम्ब़़द्ध सक्षम प्राधिकारी द्वारा प्रस्तुत रिपोर्ट पर विचार करने के पश्चात्‌ और संतुष्ट हो जाने पर कि उक्त भूमि पाइप लाइन बिछाने हेतु चाहियें, उसमें उपयोग के अधिकार का अर्जन किये जाने का निर्णय लिया था;

और यतः, उक्त अधिनियम की धारा 6 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार ने उक्त पाइप लाइन बिछाने के प्रयोजन के लिए, भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना का.आ. 2064 तारीख 3 जून, 2005; द्वारा उन अधिसूचनाओं से संलग्न अनुसूचियों में विनिर्दिष्ट भूमियाें में उपयोग का अधिकार का अर्जन किया था;

और, यतः, उक्तअधिनियम की धारा 6 की उप-धारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार ने उक्त भूूमि में उपयोग का अधिकार क्रमशः अधिसूचनाओं के प्रकाशन की तारीख से, भारत सरकार में निहित होने के बजाए, सभी बाधाओं से मुक्त मैसर्स रिलायंस गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड में निहित किया था;

और, यतः, मैसर्स रिलायंस गैस पाइपलाइन्स लिमिटेड (आर.जी.पी.एल), जो कि दहेज-नागोथनेईथेन पाइपलाइन बिछा रही है, ने इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में उपयोग का अधिकार, जो उपरोक्तानुसार मैसर्स रिलायंस गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड में निहितहै, को मैसर्स रिलायंस गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड (पूर्ववत गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर कंपनी लिमिटेड) के साथ बांटने की इच्छा जताइ है;

और, यतः, मैसर्स आर.जी.पी.एल की दहेज-नागोथनेतरलईथेन पाइपलाइन बिछाने के प्रयोजन के लिए, मैसर्स रिलायंस गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड ने उक्त भूमि में उपयोग के अधिकार को मैसर्स रिलायंस गैस पाइपलाइन्स लिमिटेड के साथ बांटने के लिए अपनी सहमति दे दी है;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः, अब, उक्त अधिनियम की धारा 6 की उप-धारा (4) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार यह निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार, जो मैसर्स रिलायंस गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड में निहित किया गया था, इस घोषणा के प्रकाशन की तारीख से सभी विल्लंगमं से मुक्त, मैसर्स रिलायंस गैस पाइपलाइन्स लिमिटेड, में भी निहित होगा।

MINISTRY OF PETROLEUM AND NATURAL GAS

NOTIFICATION New Delhi, the 13th February, 2017.

S.O. 507(E).— Whereas by notifications of Government of India in Ministry of Petroleum and Natural Gas number S.O.434 dated 4th February, 2005 issued under sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act), Government of India declared its intention to acquire Rights of Users in lands, specified in the schedules appended to those notifications, for the purpose of laying Kakinada – Hyderabad – Uran – Ahemdabad Gas Pipeline By M/s Relaince Gas Transportation Infrastructure Limited (earlier Gas Transportation and Infrastructure Company Limited) for Transpotation of natural gas to consumers in various parts of the country.

And whereas, Government of India, after considering the reports submitted by the Competent Authority under sub-section(1) of Section 6 of the Act and on being satisfied that the said lands were required for laying the pipeline, decided to acquire the Rights of Users therein;

And whereas, in exercise of the powers conferred by sub-section (1) of Section 6 of the Act, Government of India declared acquisition of the Rights of Users in lands, specified in the schedules appended to those notifications, for laying the said pipeline, vide notifications of Government of India in Ministry of Petroleum and Natural Gas number S.O. 2064 dated 3rd June, 2005;

And whereas, in exercise of powers conferred by sub-section (4) of Section 6 of the Act, Government of India declared vesting the Rights of Users in the said lands for laying the pipeline in M/s Relaince Gas Transportation Infrastructure Limited instead of Government of India, free from all encumbrances on the dates of publication of respective declarations;

And whereas, M/s Reliance Gas Pipelines Limited (RGPL), which is laying Dahej- Nagothane Ethane Pipeline, intends to share with M/s Relaince Gas Transportation Infrastructure Limited the Rights of Users in lands described in the schedule appended to this notification, which has been earlier vested in M/s Relaince Gas Transportation Infrastructure Limited (earlier Gas Transportation and Infrastructure Company Limited) as mentioned above;

And whereas, M/s Relaince Gas Transportation Infrastructure Limited has consented to the sharing of the Rights of Users in the said lands with M/s Reliance Gas Pipelines Limited for the purpose of laying Dahej- Nagothane Ethane Pipeline.

Now, therefore, in exercise of powers conferred under sub-section (4) of Section 6 of the Act, Government of India directs that the Rights of Users in the said lands, vested earlier in M/s Relaince Gas Transportation Infrastructure Limited, would also be vested in M/s Reliance Gas Pipelines Limited, free from all encumbrances from the date of publication of this declaration.
