फा. सं. स्टैंडड्र्स/03/अधिसूचना (एलएस)/एफएसएसएआई-2017.—खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) संशोधन विनियम, 2017 का प्रारूप खाद्य सुरक्षा और मानक अधिनियम, 2006 (2006 का 34) की धारा 92 की उपधारा (1) की अपेक्षानुसार भारतीय खाद्य सुरक्षा और मानक प्राधिकरण की अधिसूचना सं. फा. सं. स्टैंडड्र्स/03/अधिसूचना (एलएस)/ एफएसएसएआई-2017, तारीख 18 अप्रैल, 2017 द्वारा भारत के राजपत्र, असाधारण, भाग III, खंड 4 में प्रकाशित किया गया था जिसमें उन व्यक्तियों से जिनके उससे प्रभावित होने की संभावना थी, उस तारीख से जिसको उक्त अधिसूचना वाले राजपत्र की प्रतियां जनता को उपलब्ध करा दी गयीं थी, तीस दिनों की अवधि की समाप्ति के पूर्व आक्षेप और सुझाव आमंत्रित किए गए थे ;

और उक्त राजपत्र की प्रतियां जनता को 25 अप्रैल, 2017 को उपलब्ध करा दी गई थीं;

और भारतीय खाद्य सुरक्षा और मानक प्राधिकरण द्वारा उक्त प्रारूप विनियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया गया है;

अतः, अब, भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, उक्त अधिनियम की धारा 92 की उपधारा (2) के खंड (ङ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) विनियम, 2011 का और संशोधन करने के लिए निम्नलिखित विनियम बनाती है, अर्थात् :—

विनियम

1. संक्षित नाम और प्रारंभ.—(1) इन विनियमों का संक्षिप्त नाम खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) पांचवा संशोधन विनियम, 2017 है।

(2) ये राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रवृत होगें ।

(क) ''नमक, गर्म मसाले, मसाले और संबन्धित उत्पाद'' से संबन्धित विनियम 2.9 के उप-विनियम 2.9.30 में खंड 5 के बाद निम्नलिखित खंड अंत: स्थापित किया जाएगा, अर्थात्—

''6. लवण प्रतिस्थापी,—(1) लवण प्रतिस्थापियों का संघटन निम्नानुसार होगा:

(2) अल्प सोडियम और अत्यल्प सोडियम खाद्य वह खाद्य है जो सोडियम की विनिदिष्ट अधिकतम मात्रा के संबंध में क्रमिक उपबंधों के अनुसार हो:

(क) अल्प सोडियम वाला विशेष आहारीय खाद्य वह खाद्य है जिसका प्रसंस्करण सोडियम लवण डाले बिना किया गया हो और जिसमें सोडियम की मात्रा उपभोग के सामान्य उत्पाद में तुलनात्मक रूप से आधे से अधिक न हो और जिसमें सोडियम की मात्रा सामान्यत: प्रयुक्त अंत्य उत्पाद में 120 मिग्रा/100 ग्रा से अधिक न हो।

(ख) अत्यल्प सोडियम वाला विशेष आहारीय खाद्य वह खाद्य है जिसका प्रसंस्करण सोडियम लवण डाले बिना किया गया हो और जिसमें सोडियम की मात्रा उपभोग के सामान्य उत्पाद में तुलनात्मक रूप से आधे से अधिक न हो और जिसमें सोडियम की मात्रा सामान्यत: प्रयुक्त अंत्य उत्पाद में 40 मिग्रा/100 ग्रा से अधिक न हो।

(3) खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) विनियम, 2011 के उपविनियम 2.9.30 के खंड (6) के अनुरूप अल्प सोडियम वाले विशेष आहारीय खाद्य में लवण प्रतिस्थापी मिलाना अनुमत है और वह खाद्य सुरक्षा और मानक विनियमों में यथाउपबंधित अच्छी निर्माण रीतियों (जीएमपी) द्वारा परिसीमित किया जाए।

(4) अत्यल्प सोडियम वाला विशेष आहारीय खाद्य, खाद्य सुरक्षा और मानक (पैके जिग और लेबलिग) विनियम, 2011 के उपबंधों के अतिरिक्त लेबलिग के संबंध में निम्नलिखित विनिदिष्ट उपबंधों के अनुरूप हो, अर्थात्-

(क) लेबल पर इस विनियम के उप-विनियम 2.11.9 (2) (क) और 2.11.9 (2) (ख) के उपबंधों के अनुसार ''अल्प सोडियम'' अथवा ''अत्यल्प सोडियम'' लिखा हो;

(ख) लेबल पर सोडियम की मात्रा 5 मिग्रा प्रति 100 ग्राम के निकटतम गुणक में व्यक्त हो और इसके अतिरिक्त सामान्यत:

उपयोग किए जाने वाले विनिदिष्ट परोसे गए खाद्य मात्रा के अनुसार हो;

(ग) लेबल पर सामान्यत: प्रयुक्त 100 ग्राम खाद्य में कार्बोहाइड्रेट, प्रोटीन और वसा की औसत मात्रा और किलोकै लोरी (अथवा किलो जूल) मान घोषित हो;

(घ) लेबल पर खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) विनियम, 2011 के उप विनियम 2.9.30 के खण्ड (6) में वणित लवण प्रतिस्थापियों का योजन व्यक्त हो;

(ङ) पूर्णत: अथवा अंशत: पोटाशियम लवण से बना लवण प्रतिस्थापी मिलाने पर लेबल पर पोटाशियम की कु ल मात्रा सामान्यत: प्रयुक्त खाद्य के मिग्रा कै शन प्रति 100 ग्राम में घोषित की जाएगी;

(च) इसके अतिरिक्त, लवण की प्रति परोसे मात्रा सोडियम क्लोराइड (NaCl) की तुल्य मात्रा के रूप में और पैके ट में NaCl की कु ल मात्रा भी घोषित की जाएगी;

(छ) खाद्य के भंडारण के लिए कोई विशेष दशाएँ।"

NOTIFICATION

New Delhi, the 19th June , 2017

F. No. Stds/03/Notification (LS)/FSSAI-2017.—Whereas the draft of the Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2017, were published as required by sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of the Food Safety and Standards Authority of India number F. No. Stds/03/Notification (LS)/ FSSAI-2017, dated the 18th April, 2017, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas, the copies of the said Gazette were made available to the public on the 25th April, 2017;

And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India;

Now, therefore, in exercise of the powers conferred by clause (e) of sub- section (2) of section 92 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, namely:—

Regulations

1. Short title and commencement.—(1)These regulations may be called as the Food Safety and Standards (Food Products Standards and Food Additives) Fifth Amendment Regulations, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011,—

(a) in regulation 2.9 relating to "Salt, Spices, Condiments and related Products", in sub-regulation 2.9.30, after clause 5, the following clause shall be inserted, namely:—

"6. Salt Substitutes.—(1) The composition of salt substitutes shall be as follows:

(2) Salt substitutes may contain:

(a) Colloidal silica or calcium silicate: not more than one per cent. m/m of the salt substitute mixture, individually or in combination.

(b) Diluents: safe and suitable nutritive foods as normally consumed namely, sugars, cereal flour.

(3) The addition of iodine-containing compounds to salt substitutes shall be as per the Foods Safety and Standards Regulations, 2011.

(4) The sodium content of salt substitutes shall be not more than 120 mg/100 g of the salt substitute mixture.

(5) Salt substitutes shall conform to the following specific provisions for the labelling in addition to the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, namely:—

(a) a declaration on the label as "low sodium salt substitute" or "low sodium dietetic salt";

(b) a declaration on the label regarding the amount of cations (that is, sodium, potassium, calcium, magnesium, ammonium and choline/100 g (m/m) in the salt substitute mixture;

(b) in regulation 2.11 relating to "OTHER FOOD PRODUCTS AND INGREDIENTS", after sub-regulation 2.11.8, the following sub-regulation shall be inserted, namely:-

"2.11.9: Special dietary food with low sodium content:—(1) The special dietary food with low sodium content is a food whose special dietary value results from the reduction, restriction, or removal of sodium. It shall conform to the essential composition and standards namely standards applicable to such food excluding salt substitutes as such.

(2) Low sodium and Very low sodium food is a food conforming to the respective provisions regarding maximum sodium content specified, namely:—

(a) a special dietary food with low sodium content is a food which has been processed without the addition of sodium salts, and the sodium content of which is not more than one half of that of the comparable normal product as consumed, and the sodium content of which is not more than 120 mg/100 g of the final product as normally consumed;

(b) a special dietary food with very low sodium content is a food which has been processed without the addition of sodium salts, and the sodium content of which is not more than one half of that of the comparable normal product as consumed, and the sodium content of which is not more than 40 mg/100 g of the final product as normally consumed.

(3) The addition of salt substitutes conforming to clause (6) of sub-regulation 2.9.30 of the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 to a special dietary food with low sodium content is permitted and shall be limited by good manufacturing practice (GMP) as provided under Food Safety and Standards Regulations, 2011.

(4) The special dietary Food with low sodium content shall conform to the following specific provisions for the labelling in addition to the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, namely:-

(a) the label shall bear the description "low sodium" or "very low sodium" in accordance with the provisions of sub-regulations 2.11.9 (2) (a) and 2.11.9 (2)(b) of this regulation;

(b) the sodium content shall be declared on the label to the nearest multiple of 5 mg per 100 g and, in addition per a specified serving of the food as normally consumed;

c) the average carbohydrate, protein and fat content in 100 g of the product as normally consumed, and the kilocalorie (or kilojoule) value shall be declared on the label;

(d) the addition of the salt substitutes listed in clause (6) of sub-regulation 2.9.30 of the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 shall be declared on the label.

(e) when a salt substitute, composed entirely or partially of a potassium salt, has been added, the total amount of potassium, expressed as mg cation per 100 g of the food as normally consumed, shall be declared on the label.

(f) in addition, the salt equivalent in terms of sodium chloride (NaCl) content should also be declared per serving and the total amount of NaCl in the packet.

(g) any special conditions for the storage of the food."
