I .—केन्द्रीय विद्युत विनियामक आयोग, विद्युत अधिनियम, 2003 (2003 का 36) की धारा 178 की उप-धारा (1) के खण्ड (छ) के साथ पठित धारा 79 के अधीन प्रदत्त शक्तियों तथा इस निमित्त सामथ्र्यकारी सभी अन्य शक्तियों का प्रयोग करते हुए, केन्द्रीय विद्युत विनियामक आयोग (फीस का संदाय) विनियम, 2012 (जिसे इसके पश्चात् 'मूल विनियम' कहा गया है) का संशोधन करने के लिए, निम्नलिखित विनियम बनाता है, अर्थात्ः- 1. —(1) इन विनियमों का संक्षिप्त नाम केन्द्रीय विद्युत विनियामक आयोग (फीस का संदाय) (प्रथम संशोधन) विनियम, 2017 है।
(2) ये विनियम भारत के राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे।

(क) विनियम 2 के खण्ड (1) के उप-खण्ड (ठ) के स्थान पर, निम्नलिखित रखा जाएगाः
"(ड) ''पुनरीक्षण याचिका'' अनुज्ञप्तिधारी संकर्म नियम, 2006 के नियम 3 के उप-नियम (3) के अधीन यथा-उपबंधित जिला मजिस्ट्रेट या पुलिस आयुक्त या प्राधिकृत अधिकारी द्वारा दिए गए आदेश के विरुद्ध किसी भी व्यक्ति द्वारा फाइल की गई याचिका अभिप्रेत है।''
3.
"(ङ) पुनरीक्षण याचिका ः रुपये 25,000/- प्रति याचिका'' "(3) केद्रीय पारेषण उपयोगिता (सीटीयू) द्वारा अपने विनियामक कार्यों के निर्वहन में किए गए किसी भी आवेदन के लिए कोई आवेदन शुल्क संदेय नहीं होगा''

New Delhi, the 14th June, 2017
No. L-I/01/2017-CERC.—In exercise of powers conferred under clause (g) of sub-section (1) of Section 79 read with Section 178 of the Electricity Act, 2003 (36 of 2003), and all other powers enabling it in this behalf, the Central Electricity Regulatory Commission hereby makes the following regulations to amend the Central Electricity Regulatory Commission (Payment of Fees) Regulations, 2012 (hereinafter referred to as "the Principal Regulations"), namely:—
1. Short title and commencement.—(1) These regulations may be called the Central Electricity Regulatory Commission (Payment of Fees) (First Amendment) Regulations, 2017.
(2) These regulations shall come into force with effect from the date of their publication in the Official Gazette.
2. Amendment of Regulation 2 of Principal Regulations:
(a) Following sub-clause shall be added after sub-clause (l) of clause (1) of Regulation 2
"(m) "Revision Petition" means the petition filed by any person against an order made by a District Magistrate or a Commissioner of Police or an authorised officer as provided under sub-rule (3) of Rule 3 of the Works of Licensees Rules, 2006."
3. Amendment of Regulation 6 of Principal Regulations:
(a) Following sub-clause shall be added after sub-clause (d) of clause (1) of Regulation 6
"(e) Revision Petition : ` 25,000/- per petition"
(b) Following clause shall be added after clause (2)
"(3) No application fee shall be payable by the Central Transmission Utility (CTU) for any application made in discharge of its regulatory functions."
