का.आ. 2019(अ).—विनाशक कीट और नाशीजीव अधिनियम, 1914 (1914 का 2) की धारा 3 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्रीय सरकार वनस्पति संगरोध (भारत में आयात का विनियमन) आदेश, 2003 में पुन: संशोधन करने के लिए निम्नलिखित आदेश करती है, अर्थात्-
1. संक्षिप्त नाम और प्रारंभ- (1) इस आदेश को वनस्पति संगरोध (भारत में आयात का विनियमन) (पांचवां संशोधन) आदेश, 2017 कहा जाएगा।
(2) यह सरकारी राजपत्र में प्रकाशन की तारीख से प्रभावी होगा।
2. वनस्पति संगरोध (भारत में आयात का विनियमन) आदेश, 2003 के अध्याय-2 में, खंड-9 (1 और 3) से संबंधित वतर्मान प्रविष्टियां निम्नलिखित प्रविष्टियों से प्रतिस्थापित की जाएंगी, अर्थात:
' 9. इमारती लकड़ी और लकड़ी/बांस के उत्पादों का आयात :
(1) इमारती लकड़ी और लकड़ी/बांस उत्पाद का कोई भी पारेषण भारत में तब तक नहीं लाया जाएगा जब तक ऐसा पारेषण निम्नलिखित शर्तों को पूरा न करता हो, अर्थात:-
(i) अनुसूची-VI के अंतर्गत सूचीबद्ध इमारती लकड़ी और लकड़ी/बांस प्रजाति के अतिरिक्त ऐसे किसी पारेषण का भारत में आयात तब तक नहीं किया जाएगा जब तक वह खंड 3(7) के उपबंधों को पूरा न करता हो।
(ii) छाल सहित अथवा छाल रहित इमारती लकड़ी और लकड़ी/बांस के निर्यात से पूर्व उसका 48 जी/एम3 मिथाइल ब्रोमाइड से 21 सेंटीग्रेड या उससे अधिक या उसके समकक्ष तापमान पर प्रधूमन किया जाएगा या वनस्पति संरक्षण सलाहकार द्वारा विधिवत रूप से अनुमोदित कोई अन्य उपचार किया जाएगा और उस उपचार को निर्यातकर्ता देश में उसके पादप स्वच्छता प्रमाण पत्र में पृष्ठांकित किया जाएगा।

(iv) लकड़ी/बांस के बने उत्पादों जैसे विनिर्मित/तैयार/हस्तशिल्प/फर्नीचर/बढ़ईगिरी अथवा बढ़ईगिरी से बनाई गई वस्तुओं(खिड़कियां/दरवाजे/शटर्स/फोटो फ्रे म/पर्दे की राड/बक्से/छप्पर आदि) वाहन (चप्पू नाव, वाहन की छत, ट्रेलर आदि) बगीचे की वस्तुएं/घरेलू सामान/संगीत वाद्ययंत्र/खेलकू द का सामान/औजार/खिलौने/फू लदान/लकड़ी का रेशा/छाल रहित लकड़ी की सूखी शाखाएं/कोन/टोकरी आदि का विनिर्माण/दस्तकारी/तैयार करने की प्रक्रिया से पूर्व एनएपी पर 48 जी/एम3 मिथाइल ब्रोमाइड से 21 डिग्री सेंटीग्रेड या उससे अधिक तापमान पर प्रधूमन/उपचार किया जाएगा अथवा उसे 56 डिग्री सेंटीग्रेड तापमान पर 30 मिनट (लकड़ी के कोर तापमान) तक भट्टी में सुखाया जाएगा अथवा उसका उष्ण उपचार किया जाएगा अथवा 25 के ग्रे में अथवा उसके समकक्ष गामा किरणन किया जाएगा अथवा वनस्पति संरक्षण सलाहकार द्वारा विधिवत रूप से अनुमोदित कोई अन्य उपचार किया जाएगा और उस उपचार को निर्यातकर्ता देश में उसके पादप स्वच्छता प्रमाण पत्र में पृष्ठांकित किया जाएगा।
2. छाल रहित इमारती लकड़ी अथवा चीरी हुई/अकारयुक्त लकड़ी और लकड़ी/बांस से बने उत्पादों के कं टेनर में रखे कार्गो की जलपोत से कं टेनरों से उतराई के बाद संबंधित वनस्पति संगरोध के न्द्र के अधिकार क्षेत्र के अंतर्गत आने वाले कं टेनर फ्रे ट स्टेशन अथवा अंतर्देशीय कं टेनर डिपो के पत्तन पर किसी प्राधिकृ त वनस्पति संगरोध अधिकारी द्वारा उसका निरीक्षण किया जाएगा।
3. अनूसूची-VI में संशोधन- वनस्पति संगरोध (भारत में आयात का विनियमन) आदेश, 2003 की अनूसूची-VI में:
(i) विद्यमान प्रविष्टियों (iii) के पश्चात 'उपभोग हेतु सब्जियां' श्रेणी के लिए प्रविष्टि (iii) के सम्मुख कालम 3 में 'एस्पारागस आफिसिनलिस (एस्पारागस)' के संबंध में और कॉलम (4), (5) और (6) में उससे संबंधित प्रविष्टियों के संबंध में क्र.सं. 38 के सम्मुख क्रमश: निम्नलिखित प्रविष्टियां दर्ज की जाएं, नामत: -

(ii) मद (v) के पश्चात (उपभोग के लिए शुष्क मेवे (छिल्के वाले और बिना छिल्के ) श्रेणी के लिए प्रविष्टि (ii) के सम्मुख
कॉलम 3 में जुगलानस एसपीपी (अखरोट) के संबंध में, क्रम संख्या 184 के सम्मुख, और कॉलम (4), (5) और (6) उससे
संबंधित प्रविष्टियों के सम्मुख निम्नलिखित मद और प्रविष्टियां दर्ज की जाएं, नामतः-

(iii) क्रम संख्या 310 के ट्रिटिकम प्रजाति (गेहूँ) से संबंधित कॉलम सं. (3) में उल्लिखित प्रविष्टि को मद सं. (i) नम्बर दिया जाएगा और मद सं. (i) और उससे संबंधित प्रविष्टियों के बाद सं. (3), (4), (5) और (6) से संबंधित प्रविष्टियां क्रमश:

NOTIFICATION
New Delhi, the 21st June, 2017
S.O. 2019(E).—In exercise of the powers conferred by sub-section (1) of section 3 of the Destructive Insects and Pests Act, 1914 (2 of 1914), the Central Government hereby makes the following Order further to amend the Plant Quarantine (Regulation of Import into India) Order, 2003, namely:—
1. Short title and Commencement.—(1) This Order may be called the Plant Quarantine (Regulation of Import into India) (Fifth Amendment) Order, 2017.
II (ii) 5(2) It shall come into force on the date of its publication in the Official Gazette.
2. In Chapter II of Plant Quarantine (Regulation of Import into India) Order, 2003, the existing entries relating to clause 9(1 & 3) shall be replaced with the following entries, namely:-
'9. Import of Timber and Wood/Bamboo products:
(1) No consignment of timber and wood/bamboo products shall be brought into India unless such consignment fulfils the following conditions, namely:-
(i) No consignment of timber and wood/bamboo species other than those listed under Schedule-VI shall be imported into India unless the provisions of Clause 3(7) are fulfilled.
(ii) the timber and wood/bamboo with or without bark shall be fumigated prior to export with methyl bromide at 48 g/m3 for 24 hrs at 21oC or above or equivalent thereof or any other treatment duly approved by the Plant Protection Adviser and the treatment shall be endorsed on the Phytosanitary Certificate issued thereof at the country of export;

| (vi) Kyrgyzstan | Free from: (a) Erschoviellamusculana (Asian walnut moth) (b) Cydiapomonella (walnut worm) | Fumigation with Methyl Bromide at 48 g per cubic meter for 24 hrs at 210C and above or equivalent thereof. Or Fumigation with Aluminum Phosphide (ALP) |
| (c) Ophiognomonialeptostyla (walnut anthracnose) | at 9 g gm/ metric ton for minimum 5-7 days. The treatment shall be endorsed on Phytosanitary Certificate issued at the country of origin/re-export. |
(iii) Against serial no.310, relating to Triticum spp.(Wheat) in column (3), the entry shall be re-numbered as item (i) thereof and after item (i) as so re-numbered and the entries relating thereto in columns(3), (4), (5) and (6), the following item and entries shall respectively be inserted namely:-

(iv) Wood/Bamboo based products such as manufactured/ finished/ handicrafts/ furniture/ joinery and articles from carpentry (windows/doors/ shutters/photo frames/ curtain rods/boxes/ thatch etc)/ conveyances (row boats, vehicle decks, trailers etc)/ garden items/house hold articles/ musical instruments/ sporting equipments/ tools/toys/flower vase/ wood fiber/ woody dry branches without bark/ cones/baskets etc/., shall be fumigated/treated prior to manufacturing/crafting/ finishing process etc., with methyl bromide at 48 g/m C for 30 minutes (core temperature of wood) or Gamma irradiation at 25 kGray or equivalent thereof or any other treatment duly approved by the Plant Protection Adviser and the treatment shall be endorsed on the Phytosanitary Certificate issued thereof at the country of export; (2) The containerized cargo of timber or sawn/sized wood without bark and wood/bamboo based products shall be inspected by an authorized Plant Quarantine Officer after unloading of the containers from the ship at the port of Container Freight Station or Inland Container Depots under the jurisdiction of concerned Plant Quarantine Station.’ 3. Amendment of Schedule VI.- In the Schedule VI to the Plant Quarantine (Regulation of Import into India) Order, 2003- (i) Against Serial No. 38 relating to “Asparagus officinalis (Asparagus)” in column 3 against the entry (iii) for the category ‘vegetables for consumption’ after the existing entries (iii) and the entries relating thereto in columns (4), (5) and (6), the following item and entries shall respectively be inserted, namely: (ii) Against serial number 184, relating to Juglans spp. (Walnut), in column (3), against entry (ii) for the category ‘Dry fruits for consumption(shelled and unshelled)’ after item (v) and the entries relating thereto in columns (4), (5) and (6), the following item and entries shall respectively be inserted, namely ↩
