सा.का.नि. 728(अ).—आवश्यक वस्तु अधिनियम, 1955 (1955 का 10) की धारा 3 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए के न्(cid:7076)ीय सरकार मोटर स् िपरिट और हाई स्पीड डीजल (आपूर्ति, वितरण का विनियम और कदाचारों की रोकथाम) आदेश, 2005 में और संशोधन करने के लिए एत(cid:7375)ारा निम् नलिखित आदेश करती है, अर्थात्:—
1. (1) इस आदेश को मोटर स्पिरिट और हाई स्पीड डीजल (आपूर्ति, वितरण का विनियम और कदाचारों की रोकथाम) संशोधन आदेश, 2017 कहा जाए।
(2) यह आदेश राजपत्र में इसके प्रकाशन की तारीख से लागू होगा।
2. मोटर स्पिरिट और हाई स्पीड डीजल (आपूर्ति, वितरण का विनियम और कदाचारों की रोकथाम) आदेश, 2005 में खंड 6ए के स्थान पर, निम्नलिखित खंड रखा जाएगा, अर्थात:—
''6ए (1) के न्(cid:7076)ीय सरकार भारतीय मानक ब् यूरो द्वारा विनि(cid:7416)र्दष्ट मानकों और विनि(cid:7416)र्दष्ट मि(cid:7088)ण सीमाओं के अनुसरण में सभी उपभोक्ताओं को हाई स्पीड डीजल में मि(cid:7088)ण के लिए जैव डीजल (बी-100) का सीधा वि(cid:7059)य करने की अनुज्ञा प्रदान कर सकती है ।
(2) जैव डीजल (बी-100) का वि(cid:7059)य करने वाले प्रत्येक वि(cid:7059)य के न्(cid:7076) स्वामी को भारतीय मानक ब् यूरो द्वारा विनि(cid:7416)र्दष्ट मानकों और वाहनों के विनिर्माताओं द्वारा विनि(cid:7416)र्दष्ट अनुज्ञेय सीमाओं की सूचना उपभोक्ताओं द्वारा उनके वाहनों में जैव डीजल (बी-100) का मि(cid:7088)ण करने के लिए, कारबार के स्थान पर प्रमुख रूप से प्रदर्शित करना होगा।
स्पष्टीकरण : इस खंड के प्रयोजन के लिए ''तेल कं पनी'' से इंडियन ऑयल काप(cid:7299)रेशन लिमिटेड, हिन्दुस्तान पेट्रोलियम काप(cid:7299)रेशन लिमिटेड, भारत पेट्रोलियम काप(cid:7299)रेशन लिमिटेड, कोई भी निजी जैव डीजल विनिर्माताओं, ऐसी तेल कं पनियों के प्राधिकृ त व्यवहारियों और के न्(cid:7076) सरकार द्वारा प्राधिकृ त सार्वजनिक क्षेत्र की तेल विपणन कं पनियों के संयुक्त उद्यम अभिप्रेत है'' 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] नोट : मूल आदेश भारत के राजपत्र, असाधारण भाग-II, खण्ड-3, उप खण्ड (i) में अधिसूचना संख्यांक सा.का.नि. 729(अ) तारीख 19 दिसंबर, 2005 द्वारा प्रकाशित किया गया था और तत् पश्चात् अधिसूचना संख्यांक सा.का.नि. 18(अ), तारीख 12 जनवरी, 2007, अधिसूचना संख्यांक सा.का.नि. 1(अ), तारीख 1 जनवरी, 2009, अधिसूचना संख्यांक 352(अ) तारीख 6 मई, 2014 और अधिसूचना संख्यांक सा.का.नि. 621(अ), तारीख

NOTIFICATION
New Delhi, the 29th June, 2017
G.S.R. 728(E).—In exercise of the powers conferred by section 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following Order further to amend the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Order, 2005, namely:—
1. (1) This Order may be called the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Amendment Order, 2017.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. In the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Order, 2005, for clause 6A, the following clause shall be substituted, namely :—
"6A(1) The Central Government may permit the direct sale of bio-diesel (B-100) for blending with high speed diesel to all consumers, in accordance with the specified blending limits and the standards specified by the Bureau of Indian Standards.
(2) The owner of every outlet selling bio-diesel (B-100) shall prominently display at the place of business the permissible limits specified by the manufacturers of vehicles and the standards specified by the Bureau of Indian Standards for blending of bio-diesel (B-100) for use of consumers in their vehicles.
Explanation.—For the purposes of this clause, "oil company" means the Indian Oil Corporation Limited, the Hindustan Petroleum Corporation Limited, the Bharat Petroleum Corporation Limited, any private bio-diesel manufacturers, the authorized dealer of such oil companies and joint ventures of public sector oil marketing companies authorised by the Central Government."
