के नलये बी.के .पी.एल. क(cid:7409) मुगलसराय और कानपुर के बीच खंड न(cid:7410)(cid:7010)टग हेतु (cid:6979)े(cid:7074)-एच ((cid:7079)(cid:7021)ानपत पाइपलाइन चैने ि433.654 से 440.085 तक नलिा – इलाहाबाद) म(cid:7286) पे(cid:7069)ोनलयम प(cid:7407)र्रहन के नलए इंनडयन ऑयल कॉप(cid:7299)रेन नलनमटेड (cid:7367)ारा पाइपलाइन नबछाने के (cid:7079)योनि के नलए उपयोग के अनधकार के अ(िcid:6981)न के अपने आय क(cid:7409) घोषणा क(cid:7409) ी;

और उ(cid:7334) रापि(cid:7074) अनधसूचना क(cid:7409) (cid:7079)नतयां निता को तारीख 20 र्ररी 2015 तक उपल(cid:7011)ध करा दी गई ी ;

और स(cid:6979)म (cid:7079)ानधकारी ने उ(cid:7334) अनधननयम क(cid:7409) धारा 6 क(cid:7409) उपधारा (1) के अधीन के (cid:7008)(cid:7076)ीय सरकार को (cid:7407)रपोट(cid:6981) दे दी है ;

और के (cid:7008)(cid:7076)ीय सरकार ने, उ(cid:7334) (cid:7407)रपोट(cid:6981) पर र्नचार करने के प(cid:7391)ात और यह समाधान हो ािने पर (cid:7408)क उ(cid:7334) भूनम पाइपलाइन नबछाने के नलए अपेन(cid:6979)त है, उसम(cid:7286) उपयोग के अनधकार का अ(िcid:6981)न करने का र्ननन(cid:7391)य (cid:7408)कया है ;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, के (cid:7008)(cid:7076)ीय सरकार उ(cid:7334) अनधननयम क(cid:7409) धारा 6 क(cid:7409) उपधारा (1) (cid:7367)ारा (cid:7079)(cid:7006)(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए यह घोषणा करती है (cid:7408)क इस अनधसूचना से संल(cid:7336) अनुसूची म(cid:7286) र्ननन(cid:7416)द(cid:7397) भूनम म(cid:7286) पाइपलाइन नबछाने के नलए उपयोग के अनधकार का अ(िcid:6981)न (cid:7408)कया ािए ;

और के (cid:7008)(cid:7076)ीय सरकार उ(cid:7334) अनधननयम क(cid:7409) धारा 6 क(cid:7409) उपधारा (4) (cid:7367)ारा (cid:7079)द(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए, यह ननद(cid:7287) देती है (cid:7408)क उ(cid:7334) भूनम म(cid:7286) उपयोग का अनधकार इस घोषणा के (cid:7079)कान क(cid:7409) तारीख से के (cid:7008)(cid:7076)ीय सरकार म(cid:7286) नननहत होने के बािए, सभी र्न(cid:7016)लंगम(cid:7298) से मु(cid:7334) होकर इंनडयन ऑयल कॉप(cid:7299)रेन नलनमटेड म(cid:7286) नननहत होगी।

पे(cid:7069)ोनलयम और खनन िपाइपलाइन अनधननयम, 1962 क(cid:7409) धारा 10 के अधीन (cid:7408)कसी भी (cid:6979)नतपू(cid:7414)त के नलए इंनडयन ऑयल कॉप(cid:7299)रेन नलनमटेड पूण(cid:6981)तया उ(cid:7275)रदायी होगी और पाइपलाइन से स(cid:7013)बन(cid:7008)धत (cid:7408)कसी भी मामले पर के (cid:7008)(cid:7076)ीय सरकार के र्न(cid:7271)(cid:7373) कोईर् ाद र्दाा या कानूनी काय(cid:6981र्)ाही नह(cid:7277) हो सके गी |

MINISTRY OF PETROLEUM AND NATURAL GAS NOTIFICATION New Delhi, the 4th July, 2017 S.O. 2166(E).—Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas S.O. No. 240(E) dated the 22nd January, 2015, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (herein after referred to as the said Act), published in the Gazette of India dated the 27th January 2015; the Central Government declared its intention toभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 3 acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for the "Shifting of Barauni-Kanpur pipeline between Mughalsarai and Kanpur for DFCCIL of Indian Railway in Part-H (from Existing P/L Ch 433.654TO 440.085 KM in District-Allahabad) by Indian Oil Corporation Limited for the transportation of petroleum products;

And whereas copies of the said Gazette notification were made available to the public up to 20th February 2015;

And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report to the Central Government;

And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances.

Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
