का.आ. 2208(अ).—केन्द्रीय सरकार को यह प्रतीत होता है कि, इससे उपाबद्ध अनुसूची में उल्लिखित परिक्षेत्र की भूमि में कोयला अभिप्राप्त किए जाने की संभाव्यता है;

और रेखांक संख्या आरवीयूएन/पीसीबी/सीबीए/4/1, तारीख 23 मई, 2017 का जिसमें उक्त अनुसूची में वर्णित भूमि क्षेत्र के ब्यौरे का निरीक्षण, मुख्य महाप्रबंधक ( खोज प्रभाग), सेंट्रल माइन प्लानिंग एण्ड डिजाइन इन्स्टीटयूट लिमिटेड, गोंदवाना पैलेस, कांके रोड, रांची-834031,झारखंड के कार्यालय में या अपर मुख्य अभियंता (ईंधन)/उप मुख्य अभियंता- ईंधन/उप मुख्य अभियंता -कोयला, राजस्थान राज्य विद्युत उत्पादन निगम लिमिटेड, रजिस्ट्रीकृत कार्यालय और मुख्यालय, विद्युत भवन, जनपथ, ज्योति नगर, जयपुर (राजस्थान) -302005 के कार्यालय में या कोयला नियंत्रक, 1, काउंसिल हाऊस स्ट्रीट, कोलकाता - 700001 के कार्यालय में या जिला कलेक्टरों, जिला सुरजपुर और जिला सरगुजा (छत्तीसगढ़) के कार्यालयों में किया जा सकता है;

अतः अब, केन्द्रीय सरकार, कोयला धारक क्षेत्र (अर्जन और विकास) अधिनियम, 1957 (1957 का 20) (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 4 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पूर्वोक्त अनुसूची में वर्णित भूमि में कोयले का पूर्वेक्षण करने के अपने आशय की सूचना देती है;

उपरोक्त अनुसूची में वर्णित भूमि में हितबद्‌ध कोई व्यक्ति :-

(i) संपूर्ण भूमि या उसके किसी भाग या ऐसी भूमि में या उसके ऊपर किसी अधिकार के अर्जन का आक्षेप कर सकेगा ; या (ii) उक्त अधिनियम की धारा 4 की उप-धारा (3) के अधीन की गई किसी कार्रवाई से हुई क्षति या सम्भावित क्षति के लिए अधिनियम की धारा 6 के अधीन किसी नुकसानी के लिये प्रतिकर का दावा कर सकेगाः या

(iii) उक्त अधिनियम की धारा 13 की उप-धारा (1) के अधीन समाप्त हो गई पूर्वेक्षण अनुज्ञप्तियों के संबंध में या उक्त अधिनियम की धारा 13 की उप-धारा (4) के अधीन समाप्त हो गये खनन पट्‌टे के लिये प्रतिकर का दावा कर सकेगा और उक्त अधिनियम की धारा 13 की उप-धारा (1) के खंड (i) से खंड (iv) में विनिर्दिष्ट मदों के संंबंध में उपगत व्यय को उपदर्शित करने के लिये उक्त भूमि से संबंधित सभी मानचित्रों, चार्टो और अन्य दस्तावेजों को,

इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से नब्बे दिन की अवधि के भीतर, अपर मुख्य अभियंता - ईंधन या उप मुख्य अभियंता - ईंधन या उप मुख्य अभियंता -कोयला, राजस्थान राज्य विद्युत उत्पादन निगम लिमिटेड, रजिस्ट्रीकृत कार्यालय और मुख्यालय, विद्युत भवन, जनपथ, ज्योति नगर, जयपुर (राजस्थान) -302005 को सौंपेगा ।

ज-क : रेखा, बिन्दु 'ज' ग्राम जनार्दनपुर से आरंभ होती है और ग्राम साल्ही के मध्य में बिन्दु 'क' पर मिलती है ।

क-ख रेखा, बिन्दु 'क' से आरंभ होती है और ग्राम हरिहरपुर ग्राम के मध्य से होती हुई घाटबर्रा ग्राम के पश्चिमी सीमा के निकट बिंदु 'ख' पर मिलती है ।

ख-ग रेखा, बिन्दु 'ख' से आरंभ होती है और ग्राम फतेहपुर के मध्य भाग से होती हुई ग्राम तारा के पूर्वी सीमा के निकट बिन्दु 'ग' पर मिलती है।

ग-घ-ड.-च-छ-ज रेखा, बिन्दु 'ग' से आरंभ होती है और तारा ग्राम के पूर्वी सीमा के निकट बिन्दु 'घ' पर मिलती है, रेखा बिन्दु 'घ' से आरंभ होती है और तारा ग्राम के पूर्वोत्तर सीमा के निकट बिन्दु 'ड.' पर मिलती है, रेखा बिन्दु 'ड.' से आरंभ होती है एवं जनार्दनपुर ग्राम के दक्षिणी सीमा के निकट बिन्दु 'च' पर मिलती है, रेखा बिन्दु 'च' से आरंभ होती है एवं जनार्दनपुर ग्राम के दक्षिण पूर्वी सीमा के निकट बिन्दु 'छ' से मिलती है और रेखा बिन्दु 'छ' से आरंभ होती है और जनार्दनपुर ग्राम के मध्य में बिन्दु 'ज' से मिलती है ।

NOTIFICATION

New Delhi, the 12th July,2017

S.O. 2208(E).—Whereas, it appears to the Central Government that coal is likely to be obtained from the land in the locality described in the Schedule annexed hereto;

And, whereas, the plan bearing number RVUN/PCB/CBA/4/1, dated the 23rd May, 2017 containing details of the area of land described in the said Schedule may be inspected at the office of the Chief General Manager (Exploration Division), Central Mine Planning and Design Institute Limited, Gondwana Palace, Kanke Road, Ranchi-834 031, Jharkhand or at the office of the Additional Chief Engineer-Fuel/Deputy Chief Engineer-Fuel/Deputy Chief Engineer- Coal, Rajasthan Rajya Vidyut Utpadan Nigam Limited, Regd. Office and H.O. Vidyut Bhawan, Janpath, Jyoti Nagar, Jaipur (Rajasthan) – 302005 or at the office of Coal Controller, 1, Council House Street, Kolkata - 700001 or at the office of District Collectors, District Surajpur and Surguja (Chhattisgarh);

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957), (hereinafter referred to as the said Act), the Central Government hereby gives notice of its intention to prospect for coal in the land described in the said Schedule;

Any persons interested in the land described in the aforesaid Schedule may –

(i) object to the acquisition of the whole or any part of the land, or of any rights in over such land; or

(ii) claim compensation under section 6 of the said Act for any damaged caused or likely to be caused by any action taken under sub-section(3) of section 4 thereof; or

(iii) claim compensation under sub-section (1) of section 13 of the said Act in respect of prospecting license ceasing to have effect or under sub-section (4) of section 13 of the said Act for mining lease ceasing to have effect and deliver all maps, charts and other documents relating to the aforesaid land to show the expenditure incurred in respect of items specified in clauses (i) to (iv) of sub-section (1) of section 13 of the said Act,

to the officer of the Additional Chief Engineer-Fuel or Deputy Chief Engineer-Fuel or Deputy Chief Engineer-Coal, Rajasthan Rajya Vidyut Utpadan Nigam Limited, Regd. Office and Head Office Vidyut Bhawan, Janpath, Jyoti Nagar,Jaipur (Rajasthan) – 302005 within a period of ninety days from the date of publication of this notification.

Boundary description:

H-A : Line starts from point 'H' in Janardanpur village and meets at point 'A' in the middle of the Salhi village.

A-B: Line starts from point 'A' and passes through middle of the Hariharpur village and meets at point 'B' near the western boundary of Ghatbara village.

B-C: Line starts from point 'B' and passes through middle of the Fatehpur village and meets at point 'C' near the eastern boundary of Tara village.

C-D-E-F-G-H: Line starts from point 'C' and meets at point 'D' near the north eastern boundary of Tara village. And Line starts from point 'D' and meets at point 'E' near the north eastern boundary of Tara village. And line starts from point 'E' and meets at point 'F' near the southern boundary of Janardanpur village. And line starts from point 'F' and meets at point 'G' near the south eastern boundary of Janardanpur village. And line starts from at point 'G' and meets at point 'H' in the middle of Janardanpur village.
