ए नं. ³⁹⁵⁰.—ब(cid:167)ककारी कं पनी अिधिनयम (उप(cid:248)म(cid:332) का अज(cid:170)न एवं अंतरण), 1980 (1980 का 40) क(cid:236) धारा 12 क(cid:236) उपधारा (2) के साथ पिठत धारा 19 (cid:300)ारा (cid:255)द(cid:176) शि(cid:265)य(cid:332) का (cid:255)योग करते ह(cid:242)ए ओ(cid:229)रय(cid:198)टल ब(cid:167)क ऑफ़ कॉमस(cid:170) का उपधारा (2) के साथ पिठत धारा 19 (cid:300)ारा (cid:255)द(cid:176) शि(cid:265)य(cid:332) का (cid:255)योग करते ह(cid:242)ए ओ(cid:229)रय(cid:198)टल ब(cid:167)क ऑफ़ कॉमस(cid:170) का ब(cid:167)क ऑफ़ कॉमस(cid:170) (अिधकारी) सेवा िविनयम, 1982 को संशोिधत करने के िलए िन(cid:204)निलिखत िविनयम बनाता है, नामतः- 1. (1) यह िविनयम ओ(cid:229)रय(cid:198)टल ब(cid:167)क ऑफ़ कॉमस(cid:170) (अिधकारी) सेवा (संशोधन) िविनयम, 2017 कहे जाएंगे ।

(2) जब तक इन िविनयम(cid:332) म(cid:164) अ(cid:198)यथा उ(cid:208)लेख न हो, ये नव(cid:204)बर, 2007 क(cid:236) पहली तारीख से (cid:255)भावी माने जाएंगे ।

2. ओ(cid:229)रय(cid:198)टल ब(cid:167)क ऑफ़ कॉमस(cid:170) (अिधकारी) सेवा िविनयम, 1982 म(cid:164) (िजसे आगे उ(cid:265) िविनयम कहा गया है) के िविनयम 3 म(cid:164), -

(i) ख(cid:193)ड (च) के िलए िन(cid:204)निलिखत ख(cid:193)ड (cid:214)थानाप(cid:198)न िकए जाएंग(cid:164), यथा:-

'(च) "प(cid:229)रवार" का ता(cid:194)पय(cid:170) है अिधकारी क(cid:236) प(cid:194)नी / पित, पूण(cid:170)तः िनभ(cid:170)र अिववािहत ब(cid:184)चे (सौतेले एवं िविधक (cid:322)प से गोद िलए गए ब(cid:184)चे सिहत) , चालीस (cid:255)ितशत अथवा अिधक के िद(cid:211)यांग भाई अथवा बिहन और सामा(cid:198)यतः साथ रहने वाले एवं अिधकारी पर पूण(cid:170)त् आि(cid:174)त माता-िपता'.

(cid:214)प(cid:310)ीकरण.- इस ख(cid:193)ड के (cid:255)योजन के िलए ब(cid:184)चे अथवा माता-िपता अथवा िद(cid:211)यांग भाई अथवा बिहन उस ि(cid:214)थित म(cid:164) अिधकारी पर आि(cid:174)त माने जाएंगे जबिक ऐसे ब(cid:184)चे, माता-िपता, भाई अथवा बिहन क(cid:236) मािसक आय (cid:321).3500/- से अिधक न हो ।

बशत(cid:165), माता अथवा िपता क(cid:236) मािसक आय (cid:321).3500/- से अिधक अथवा माता-िपता क(cid:236) कु ल मािसक आय (cid:321).3500/- से अिधक हो तो माता एवं िपता दोन(cid:332) अिधकारी पर पूण(cid:170)तः आि(cid:174)त नह(cid:233) माने जाएंगे ।'

3. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 4 म(cid:7286),-

(i) उप-र्नननयम (4क) को हटा (cid:7408)दया ािएगा।;

(ii) उप-र्नननयम (4क) को हटाने के बाद नन(cid:7388) उप-र्नननयम को अंत:(cid:7021)ानपत (cid:7408)कया ािएगा, नामतः :-

(cid:7021)प(cid:7397)ीकरण- (cid:7079)(cid:7004)येक अनधकारी ोि 31 अ(cid:7334)ू बर, 2007 को (cid:7079)र्भाीर् ेतनमान से ानसत है, को (cid:7021)टे-िदर-(cid:7021)टे िआधार पर 1 र्नंबर, 2007 को इस उप-र्नननयम म(cid:7286) (cid:7390र्)न(cid:7021)तर् ेतनमान म(cid:7286) ननयतन (cid:7408)कया ािएगा अा(cid:6981)त् संबंनधतर् ेतनमान म(cid:7286) (cid:7079)म (cid:7021)टे िसे तदनु(cid:7272)पी (cid:7021)टे(िcid:7298) पर ता र्ेतर्नृन(cid:7373)र् ा(cid:7414)ष(cid:6981)क नतन पर सामा(cid:7008)य (cid:7272)प से देय होगी, बि तक (cid:7408)क अ(cid:7008)या उ(cid:7016)लेख न हो।

(6) उप-र्नननयम (1), (2), (3), (4) र्एं (5) क(cid:7409) (cid:7408)कसी भी बात का यह अ(cid:6981) न लगाया ािएगा (cid:7408)क ब(cid:7289)क के नलए सर्दै इन सभी (cid:7088)ेनणय(cid:7298) म(cid:7286) अनधका(cid:7407)रय(cid:7298) को रखना अपेन(cid:6979)त है। ".

4. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 5 म(cid:7286) , -

(क) उप-र्नननयम (1) के नलए, नन(cid:7388)नलनखत उप-र्नननयम को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, नामतः : -

"(1) र्नननयम 4 के उप-र्नननयम (5) के (cid:7079र्)ाधान(cid:7298) के अनुसार, 1 र्नंबर, 2007 को र्एं इसके बाद सेर् ेतर्नृन(cid:7373) को नन(cid:7388) त(cid:7300) के अधीन ािरी (cid:7408)कया ािएगा, नामतः : -

(क) र्नननयम 4 के उप-र्नननयम (5) म(cid:7286) (cid:7390र्)न(cid:7021)तर् ेतनमान(cid:7298) म(cid:7286) नन(cid:7416)द(cid:6981)(cid:7397)र् ेतर्नृन(cid:7373) स(cid:6979)म (cid:7079)ानधकारी क(cid:7409) (cid:7021र्)ीकृ नत के अधीन र्ा(cid:7414)ष(cid:6981)क आधार पर देय होगी ता नसि माह म(cid:7286) देय होगी उसक(cid:7409) पहली तारीख को ािरी क(cid:7409) ािएगी;

(ख) कनन(cid:7399) (cid:7079)बंधन (cid:7088)ेणीर् ेतनमान I म(cid:7286) ऐसे अनधकारी ोि उ(cid:7340)तरर् ेतनमान के अनधकतम पर प(cid:7263)ंचने पर म(cid:7007)यम (cid:7079)बंधन (cid:7088)ेणीर् ेतनमान II के र् ेतनमान म(cid:7286) प(cid:7263)ंच चुके ह(cid:7289), अपने र्सेाकाल के (cid:7079)(cid:7004)येक पूण(cid:6981) तीनर् ष(cid:7300) के नलए चार गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) करने के पा(cid:7074) ह(cid:7298)गे ननिम(cid:7286) से पहली दो (cid:7079)(cid:7004)येक (cid:7271).800/- क(cid:7409) ता आगामी दो (cid:7079)(cid:7004)येक (cid:7271).900/- क(cid:7409) ह(cid:7298)गी:

बत(cid:7287), ऐसे अनधकारी न(िcid:7008)ह(cid:7298)ने 1 र्नंबर, 2007 को दूसरी गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) करने के बाद तीनर् ष(cid:6981) या अनधक पूरे कर नलए ह(cid:7298) 1 र्नंबर, 2007 को तीसरी गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) कर(cid:7286)गे ता दूसरी गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) करने के छह र्ष(cid:6981) पूरे कर लेने के बाद 01 र्नंबर, 2008 को र्अा इसके बाद अ(cid:7008)य गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) कर(cid:7286)गे ;

(ग) म(cid:7007)यम (cid:7079)बंधन (cid:7088)ेणीर् ेतनमान II म(cid:7286) ऐसे अनधकारी ोि उ(cid:7340)तरर् ेतनमान के अनधकतम पर प(cid:7263)ंचने पर म(cid:7007)यम (cid:7079)बंधन (cid:7088)ेणीर् ेतनमान III के र् ेतनमान म(cid:7286) प(cid:7263)ंच चुके ह(cid:7289), अपने र्सेाकाल के (cid:7079)(cid:7004)येक पूण(cid:6981) तीनर् ष(cid:7300) के नलए (cid:7079)(cid:7004)येक (cid:7271). 900/- के तीन गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) करने के पा(cid:7074) ह(cid:7298)गे:

बत(cid:7287) ऐसे अनधकारी न(िcid:7008)ह(cid:7298)ने 1 र्नंबर, 2007 को पहली गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) करने के बाद तीनर् ष(cid:6981) पूरे कर नलए ह(cid:7289), को 1 र्नंबर, 2007 से (cid:7079)र्भाी आगामीर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) कर(cid:7286)गे ता पहली गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) करने के छहर् ष(cid:6981) पूण(cid:6981) होने पर 1 र्नंबर, 2008 को र्अा इसके बाद उ(cid:7275)र्रत(cid:7278) गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) कर(cid:7286)गे:

बत(cid:7287), यह भी (cid:7408)क मु(cid:6990)यतः म(cid:7007)यम (cid:7079)बंधन (cid:7088)ेणी III म(cid:7286) ननयु(cid:7334) र्अा पदो(cid:7382)त अनधकारी र्सेाकाल के (cid:7079)(cid:7004)येक पूण(cid:6981) तीनर् ष(cid:7300) के नलए (cid:7079)(cid:7004)येक (cid:7271). 900/- क(cid:7409) चार गनतरोधर् ेतर्नृन(cid:7373) के नलए पा(cid:7074) ह(cid:7298)गे र्अा:

बत(cid:7287), यह भी (cid:7408)क ऐसे सभी अनधकारी न(िcid:7008)ह(cid:7298)ने पहले ही दो गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) कर ली ह(cid:7289) ता 1 र्नंबर, 2007 को दूसरी गनतरोध र्ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) करने के बाद तीन र्ष(cid:6981) से अनधक र्सेा पूण(cid:6981) कर ली हो, 01 र्नंबर, 2007 को तीसरी गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) कर(cid:7286)गे ता दूसरी गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) कर लेने के छहर् ष(cid:6981) के बाद 1 र्नंबर, 2008 को र्अा इसके बाद चौी गनतरोधर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) कर(cid:7286)गे

पर(cid:7008)तु अगले उ(cid:7340)तरर् ेतनमान म(cid:7286) ऐसीर् ेतर्नृन(cid:7373)(यां)/ र्अरोधर् ेतर्नृन(cid:7373)(यां) उस अनधकारी को नह(cid:7277) दी ािएंगी, नसिने पदो(cid:7382)नत का (cid:7079)(cid:7021)र्ता नमलने पर उसे अ(cid:7021र्)ीकार कर (cid:7408)दया हो।

(cid:7021)प(cid:7397)ीकरण.- इस उप-र्नननयम के अंतग(cid:6981)त इस (cid:7079)कार क(cid:7409)र् ेतर्नृन(cid:7373) ािरी (cid:7408)कए ािने का अ(cid:6981) अनधकारी क(cid:7409) पदो(cid:7382)नत नह(cid:7277) है ता ये अनधकारी अपने मूल पद के अनु(cid:7272)प सुर्नधाएं, प(cid:7407)रलन(cid:7011)धयां, कत(cid:6981)(cid:7390)(cid:7298) र्एं न(िcid:7013)मेदा(cid:7407)रय(cid:7298) कार् हन करते रह(cid:7286)गे।.

(ख) उप-र्नननयम (2) म(cid:7286),-

(i)(cid:7021)प(cid:7397)ीकरण म(cid:7286) , ख(cid:7003)ड (ड.) के बाद ता (cid:7407)ट(cid:7009)पणी से पहले नन(cid:7388) ख(cid:7003)ड को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, नामतः :-

"(च) 1 र्नंबर, 2007 को ता उसके बाद से अ(cid:7008)य बात(cid:7298) के समान रहने पर (cid:7390र्)ासानयक यो(cid:6991)यता र्ेतन क(cid:7409) रान नन(cid:7388)ानुसार संोनधत क(cid:7409) ािती है:-

बत(cid:7287), य(cid:7408)द (cid:7408)कसी अनधकारी नसिने उ(cid:7340)तम र्ेतनमान म(cid:7286) प(cid:7263)ँचने के बाद भारतीय ब(cid:7289)कर सं(cid:7021)ान के ूिननयर एसोनसएट र्अा भारतीय ब(cid:7289)कर सं(cid:7021)ान के (cid:7079)मानणत एसोनसएट (कोई एक र्अा दोन(cid:7298) भाग) क(cid:7409) अह(cid:6981)ता (cid:7079)ा(cid:7385) क(cid:7409) हो, उ(cid:7008)ह(cid:7286) यह अह(cid:6981)ता (cid:7079)ा(cid:7385) करने क(cid:7409) नतन से (cid:7390र्)ासानयक यो(cid:6991)यता र्ेतन क(cid:7409) (cid:7079)म (cid:7408)क(cid:7019)त का भुगतान (cid:7408)कया ािएगा और उसके बाद के (cid:7390र्)ासानयक यो(cid:6991)यता र्ेतन क(cid:7409) (cid:7408)क(cid:7019)त(cid:7298) का नन(cid:7021)तारण (cid:7390र्)ासानयक यो(cid:6991)यतार् ेतन क(cid:7409) पहली (cid:7408)क(cid:7019)त के भुगतान क(cid:7409) नतन के अनु(cid:7272)प ही (cid:7408)कया ािएगा।

इसके अर्लाा य(cid:7408)द (cid:7408)कसी अनधकारी ने उपरो(cid:7334) म(cid:7286) से कोई भी अह(cid:6981)ता पहले ही (cid:7079)ा(cid:7385) कर ली है और इसके र्ए िम(cid:7286) उसे (cid:7408)कसी (cid:7079)कार क(cid:7409) र्ेतनर्-ृन(cid:7373) र्अा (cid:7390र्)ासानयक यो(cid:6991)यता र्ेतन (cid:7079)ा(cid:7385) नह(cid:7277) (cid:7263)आ है, ऐसे मामले म(cid:7286) उसे (cid:7390र्)ासानयक यो(cid:6991)यता र्ेतन का भुगतान 1 र्नंबर, 2007 र्अा ऐसी अह(cid:6981)ता (cid:7079)ा(cid:7385) करने क(cid:7409) नतन म(cid:7286) से ोि भी बाद म(cid:7286) हो, से (cid:7408)कया ािएगा।

(ii) (cid:7407)ट(cid:7009)पणी म(cid:7286), खंड (v),के (cid:7021)ान पर नन(cid:7388)नलनखत खंड (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या:-

"(v) य(cid:7408)द (cid:7408)कसी अनधकारी ने 27 अ(cid:7079)ैल 2010 तक खंड (iv) मेर् (cid:7414)ण(cid:6981)त उपरो(cid:7334) म(cid:7286) से कोई भी अह(cid:6981)ता (cid:7079)ा(cid:7385) कर ली है और इसके र्ए िम(cid:7286) उसे (cid:7408)कसी (cid:7079)कार क(cid:7409)र् ेतनर्-ृन(cid:7373) र्अा (cid:7390र्)ासानयक यो(cid:6991)यतार् ेतन (cid:7079)ा(cid:7385) नह(cid:7277) (cid:7263)आ है, ऐसे मामले म(cid:7286) उसे (cid:7390र्)ासानयक यो(cid:6991)यतार् ेतन का भुगतान 1 र्नंबर 2007 से र्अा ऐसी अह(cid:6981)ता (cid:7079)ा(cid:7385) करने क(cid:7409) नतन, म(cid:7286) से ोि भी बाद म(cid:7286) हो, से (cid:7408)कया ािएगा।"

(ग) उप र्नननयम (3) म(cid:7286),-

(i) खंड (घ) के बाद र्एं (cid:7407)ट(cid:7009)पणी से पहले, नन(cid:7388)नलनखत खंड को इसम(cid:7286) (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या

"(ङ) 1 र्नंबर, 2007 को और उसके बाद से, अ(cid:7008)य बात(cid:7298) के समान होने पर, ननयत र्ैयन(cid:7334)क र्ेतन के सा मकान (cid:7408)कराया भ(cid:7275)ा नन(cid:7388)नलनखत दर के अनुसार होगा और पूरे र्सेाकाल के नलए यह न(cid:7021)र रहेगा : -

(ii) (cid:7407)ट(cid:7009)पणी म(cid:7286), खंड (i) और (ii), के (cid:7021)ान पर नन(cid:7388)नलनखत खंड को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या:-

"(i) सारणी के खंड (ख), (ग), (घ) र्अा (ङ) के तहत सारणी के कॉलम (ग) म(cid:7286)र् (cid:7414)ण(cid:6981)त ननयतर् ैयन(cid:7334)क भ(cid:7275)ा र्अा ननयतर् ैयन(cid:7334)कर् ेतन का भुगतान उन अनधका(cid:7407)रय(cid:7298) को (cid:7408)कया ािएगा न(िcid:7008)ह(cid:7286) ब(cid:7289)क (cid:7367)ारा र्आास उपल(cid:7011)ध कराया गया है।

(ii) मकान (cid:7408)कराया भ(cid:7275)े हेतु पा(cid:7074) अनधका(cid:7407)रय(cid:7298) के नलए ननयत र्ैयन(cid:7334)क भ(cid:7275)ा र्अा ननयत र्ैयन(cid:7334)क र्ेतन, खंड (ङ) के तहत सारणी के कॉलम (क) और (ख) म(cid:7286) नन(cid:7416)द(cid:6981)(cid:7397) रान ता र्नननयम 4 के उप-र्नननयम (2), (3), (4) र्अा (5) म(cid:7286) या नन(cid:7416)द(cid:6981)(cid:7397) संबन(cid:7008)धत र्ेतनमान क(cid:7409) अंनतमर् ेतर्नृन(cid:7373) (cid:7079)ा(cid:7385) (cid:7408)कए ािने पर संबन(cid:7008)धत अनधकारी कम(cid:6981)चारी (cid:7367)ारा (cid:7079)ा(cid:7385) (cid:7408)कए ाि रहे मकान (cid:7408)कराया भ(cid:7275)े क(cid:7409) कु ल समे(cid:7408)कत रान होगी।

(iii) (cid:7407)ट(cid:7009)पणी के बाद आनेर् ाले खंड (ङ) को अब से उप-खंड (v) के (cid:7272)प म(cid:7286) अं(cid:7408)कत (cid:7408)कया ािएगा और खंड (v) क(cid:7409) गिह नन(cid:7388)नलनखत खंड (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या:-

"(v) ऐसा अनधकारी नसिने उपरो(cid:7334) खंड (क) के अनुसार अन(cid:7061)मर् ेतनर् ृन(cid:7373) (cid:7079)ा(cid:7385) क(cid:7409) है, अपनेर् ेतनमान के अनधकतम (cid:7021)तर तक प(cid:7263)ँचने के एकर् ष(cid:6981) बाद उपरो(cid:7334) खंड (ख), (ग), (घ) या (ङ) के अनुसार ननयतर् ैयन(cid:7334)क भ(cid:7275)े/ ननयतर् ैयन(cid:7334)कर् ेतन क(cid:7409) रान (cid:7079)ा(cid:7385) करेगा।" 5. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 21 म(cid:7286) : -

(i) उप-र्नननयम (3) म(cid:7286), (cid:7407)ट(cid:7009)पणी को हटा (cid:7408)दया ािएगा;

(ii) उप-र्नननयम (4) म(cid:7286), (cid:7407)ट(cid:7009)पणी को हटा (cid:7408)दया ािएगा;

(iii) उप-र्नननयम (4) के बाद, नन(cid:7388)नलनखत उप-र्नननयम र्एं (cid:7407)ट(cid:7009)पणी ानमल (cid:7408)कए ािएंगे, या:-

(cid:7021)प(cid:7397)ीकरण- इस उप-र्नननयम के उ(cid:7374)े(cid:7019)य हेतु-

(क) महंगाई भ(cid:7275)े के (cid:7079)योनि हेतु र्"ेतन" से ता(cid:7004)पय(cid:6981) र्अ(cid:7271)(cid:7373)र् ेतर्नृन(cid:7373)य(cid:7298) सनहत मूलर् ेतन होगा।

(ख) र्नननयम 5 के उप-र्नननयम (2) के (cid:7021)प(cid:7397)ीकरण (ग), (घ), (ङ) र्एं (च) म(cid:7286) या र्(cid:7414)ण(cid:6981)त (cid:7390र्)ासानयक यो(cid:6991)यता भ(cid:7275)ा र्अा (cid:7390र्)ासानयक यो(cid:6991)यतार् ेतन क(cid:7409) गणना, महंगाई भ(cid:7275)े के नलए क(cid:7409) ािएगी।

6. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 22 म(cid:7286), उप-र्नननयम(cid:7298) (1) र्एं (2) के (cid:7021)ान पर, नन(cid:7388)नलनखत उप-र्नननयम(cid:7298) को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा या:-

"(1) 1 र्नंबर, 2002 को और उसके बाद से ,

(क) हिां (cid:7408)कसी अनधकारी को ब(cid:7289)क (cid:7367)ारा र्आासीय सुर्नधा (cid:7079)दान क(cid:7409) गयी है, तो उसे (cid:7079)द(cid:7275)र् ेतनमान के (cid:7079)म चरण, के मूलर् ेतन के 1.75% के समतु(cid:7016)य रान र्अा र्आास का मानक (cid:7408)कराया, ोि भी कम हो उससेर् सूला ािएगा।

(ख) हिां (cid:7408)कसी अनधकारी कम(cid:6981)चारी को ब(cid:7289)क (cid:7367)ारा र्आासीय सुर्नधा (cid:7079)दान नह(cid:7277) क(cid:7409) गयी है, तोर् ह नन(cid:7388)नलनखत सारणी म(cid:7286) नन(cid:7416)द(cid:6981)(cid:7397) दर(cid:7298) पर मकान (cid:7408)कराया भ(cid:7275)े के नलए पा(cid:7074) होगा, या:-

बत(cid:7287) य(cid:7408)द कोई अनधकारी (cid:7408)कराये क(cid:7409) रसीद (cid:7079)(cid:7021)तुत करता है, तो उसे (cid:7079)द(cid:7275) र्ेतनमान के (cid:7079)म चरण के र्ेतन के 1.75% के अर्लाा र्आासीय सुर्नधा हेतु उसके (cid:7367)ारा (cid:7079)द(cid:7275) र्ा(cid:7021)तर्नक (cid:7408)कराये के नलए उसे मकान (cid:7408)कराया भ(cid:7275)ा देय होगा, नसिक(cid:7409) अनधकतम सीमा उपरो(cid:7334) सारणी के कॉलम (2) म(cid:7286) नन(cid:7416)द(cid:6981)(cid:7397) मकान (cid:7408)कराया भ(cid:7275)े के 150% तक होगी।

(2) 1 र्नंबर, 2007 को और उसके बाद से, -

(क) हिां (cid:7408)कसी अनधकारी को ब(cid:7289)क (cid:7367)ारा र्आासीय सुर्नधा (cid:7079)दान क(cid:7409) गयी है,र् हँ उसे (cid:7079)द(cid:7275)र् ेतनमान के (cid:7079)म चरण के मूल र्ेतन के 1.20% के समतु(cid:7016)य रान र्अा र्आास का मानक (cid:7408)कराया, ोि भी कम हो, उससेर् सूला ािएगा।

(ख) हिां (cid:7408)कसी अनधकारी को ब(cid:7289)क (cid:7367)ारा कोई र्आासीय सुर्नधा (cid:7079)दान नह(cid:7277) क(cid:7409) गयी है, उस न(cid:7021)नत म(cid:7286)र् ह नन(cid:7388)नलनखत सारणी म(cid:7286) नन(cid:7416)द(cid:6981)(cid:7397) दर(cid:7298) के अनुसार मकान (cid:7408)कराया भ(cid:7275)े के नलए पा(cid:7074) होगा, या;-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

परंतु य(cid:7408)द कोई अनधकारी (cid:7408)कराया रसीद (cid:7079)(cid:7021)तुत करता है, तो उसे देय मकान (cid:7408)कराया भ(cid:7275)े का भुगतान उसके (cid:7367)ारा र्आास हेतु भुगतान (cid:7408)कए गएर् ा(cid:7021)तर्नक (cid:7408)कराये के (cid:7272)प म(cid:7286) (cid:7408)कया ािएगा ोि (cid:7408)कर् ेतनमान के पहले चरण के र् ेतन के 1.20% से अनधक होगा ोि उपयु (cid:6981)(cid:7334) कॉलम(2) म(cid:7286)र् (cid:7414)ण(cid:6981)त उपरो(cid:7334) दर(cid:7298) के अनुसार उसके मकान (cid:7408)कराया भ(cid:7275)े का अनधकतम 150% देय होगा।

(cid:7407)ट(cid:7009)पणी - मकान (cid:7408)कराया भ(cid:7275)े के नलए अनधका(cid:7407)रय(cid:7298) के र्दाे, ोि उनके (cid:7021र्)ानम(cid:7004र्)र् ाले र्आास क(cid:7409) लागत से स(cid:7013)ब(cid:7373) है, को भी अब से मकान (cid:7408)कराया भ(cid:7275)े के 150 % तक सीनमत रखा ािएगा। ";

7. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 23 म(cid:7286),-

(i) उप-र्नननयमन (1) म(cid:7286), अंक, अ(cid:6979)र, र्एं (cid:7011)द "र्नंबर, 2002 का पहला (cid:7408)दन" के नलए, "र्नंबर, 2007 का पहला (cid:7408)दन" अंक(cid:7298), अ(cid:6979)र(cid:7298) और (cid:7011)द(cid:7298) को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा;

(ii) उप-र्नननयम (2) म(cid:7286), अंक, अ(cid:6979)र र्एं (cid:7011)द "र्नंबर, 2002 का पहला (cid:7408)दन" के नलए, "र्नंबर, 2007 का पहला (cid:7408)दन" अंक(cid:7298), अ(cid:6979)र(cid:7298) और (cid:7011)द(cid:7298) को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा;

(iii) उप-र्नननयम (3), (4) र्एं (5) के नलए, नन(cid:7388)नलनखत उप-र्नननयम(cid:7298) को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या :-

"(3) 1 र्नंबर, 2007 को ता उसके बाद से, य(cid:7408)द कोई अनधकारी समूह ए र्एं बी म(cid:7286) आनेर् ाले प(cid:7407)रयोनिा (cid:6979)े(cid:7074) के (cid:7272)प म(cid:7286) नन(cid:7416)द(cid:6981)(cid:7397) (cid:6979)े(cid:7074) म(cid:7286) काय(cid:6981) कर रहा है, तोर् ह समूह ए या समूह बी के (cid:7272)प म(cid:7286)र् ग(cid:7278)कृ त (cid:6979)े(cid:7074) के अनुसार (cid:7271). 290 (cid:7079)नत माह र्अा (cid:7271).

225 (cid:7079)नत माह क(cid:7409) दर से प(cid:7407)रयोनिा (cid:6979)े(cid:7074) (cid:7079)नतपूरक भ(cid:7275)े के नलए पा(cid:7074) होगा।

(4) 1 र्नंबर, 2007 को ता उसके बाद से, य(cid:7408)द कोई अनधकारी ै(cid:6979)नणक र्ष(cid:6981) के बीच म(cid:7286) एक (cid:7021)ान से दूसरे (cid:7021)ान पर (cid:7021)ानांत(cid:7407)रत होता है ता उसके एक या एक से अनधक ब(cid:7340)े र्पू(cid:6981र्)त(cid:7278) (cid:7021)ान के र्न(cid:7378)ालय या महार्न(cid:7378)ालय म(cid:7286) पाई कर रहे ह(cid:7289) तो र्ह नए (cid:7021)ान पर (cid:7407)रपोट(cid:6981) करने क(cid:7409) नतन से ै(cid:6979)नणकर् ष(cid:6981) क(cid:7409) समान(cid:7385) तक अपने सभी ब(cid:7340)(cid:7298) के नलए (cid:7271).700 (cid:7079)नत माह ै(cid:6979)नणक र्ष(cid:6981) के म(cid:7007)य (cid:7021)ानांतरण भ(cid:7275)े के नलए पा(cid:7074) होगा, परंतु य(cid:7408)द उसके सभी ब(cid:7340)े र्पू(cid:6981र्)त(cid:7278) (cid:7021)ान पर अ(cid:7007)ययन करना बंद कर द(cid:7286) तो उस दा म(cid:7286) ऐसा भ(cid:7275)ा समा(cid:7385) हो ाियेगा।

(5) 1 मई, 2010 को ता उसके बाद से, य(cid:7408)द कोई अनधकारी को ब(cid:7289)क के बाहर र्सेा करने के नलए (cid:7079)नतननयु(cid:7334) (cid:7408)कया ािता है तो,र् ह उस पद से ुिी प(cid:7407)रलन(cid:7011)धयँ (cid:7079)ा(cid:7385) करने का र्नक(cid:7016)प चुन सकता है, नसि पर उसे (cid:7079)नतननयु(cid:7334) (cid:7408)कया गया है, र्अार् ह अपनेर् ेतन के अनत(cid:7407)र(cid:7334),र् ेतन के 7.75 (cid:7079)नतत क(cid:7409) दर से अनधकतम (cid:7271). 2300 (cid:7079)नत माह (cid:7079)नतननयुन(cid:7334) भ(cid:7275)ा र्एं ऐसे अ(cid:7008)य भ(cid:7275)े ोि (cid:7408)कर् ह उस (cid:7021)ान पर ब(cid:7289)क क(cid:7409) र्सेा म(cid:7286) पद(cid:7021) होने पर लेता, ले सकता है:

परंतु य(cid:7408)दर् ह ऐसे (cid:7079)नत(cid:7399)ान म(cid:7286) (cid:7079)नतननयु(cid:7334) (cid:7263)आ है ोि उसी (cid:7021)ान पर है हिँ परर् ह (cid:7079)नतननयुन(cid:7334) के ठीक पहले पद(cid:7021)ानपत ा, तोर् ह अपनेर् ेतन के 4 (cid:7079)नतत के बराबर (cid:7079)नतननयुन(cid:7334) भ(cid:7275)ा (cid:7079)ा(cid:7385) करेगा ोि अनधकतम (cid:7271).1200 (cid:7079)नत माह होगा:

परंतु यह भी (cid:7408)क ब(cid:7289)क के (cid:7079)न(cid:6979)ण सं(cid:7021)ान म(cid:7286) संकाय सद(cid:7021)य के (cid:7272)प म(cid:7286) (cid:7079)नतननयुन(cid:7334) पर कोई अनधकारी अपनेर् ेतन के 4 (cid:7079)नतत क(cid:7409) दर से अनधकतम (cid:7271).1200 (cid:7079)नत माह (cid:7079)नतननयुन(cid:7334) भ(cid:7275)ा (cid:7079)ा(cid:7385) करने का पा(cid:7074) होगा।"

(iv) उप-र्नननयम (8) के नलए, नन(cid:7388)नलनखत उप-र्नननयम (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या :-

"(8) 1 र्नंबर, 2007 को ता उसके बाद से, य(cid:7408)द एक (cid:7408)दन के दौरान काय(cid:6981)-समय को दो घंटे के (cid:7008)यूनतम अंतराल म(cid:7286) र्नभानति (cid:7408)कया ािता है तो अनधकारी (cid:7271).165 (cid:7079)नत माह क(cid:7409) दर से र्नभानति (cid:7357)ूटी भ(cid:7275)े के नलए पा(cid:7074) होगा।";

(v) उप-र्नननयम (10) म(cid:7286),-

(क) अंक, अ(cid:6979)र, र्एं (cid:7011)द "र्नंबर, 2002 का पहला (cid:7408)दन" के नलए, "र्नंबर, 2007 का पहला (cid:7408)दन" अंक(cid:7298), अ(cid:6979)र(cid:7298) और (cid:7011)द(cid:7298) को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा;

(ख) सारणी के नलए, नन(cid:7388)नलनखत सारणी को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या:-

8. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 24 के उप-र्नननयम (1) म(cid:7286), खंड (क) के नलए नन(cid:7388)नलनखत खंड (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या:-

"(क) नच(cid:7408)क(cid:7004)सा (cid:7390)य. - 01 र्नंबर, 2007 को ता उसके बाद से, कोई अनधकारी नीचे दी गयी सारणी म(cid:7286) यार्ननन(cid:7416)द(cid:6981)(cid:7397) र्दााकृ त रान के नलए (cid:7408)दए गए र्र्नरण (cid:7367)ारा सम(cid:7414)(cid:6981)त इस (cid:7079)कार के (cid:7390)य को करने से संबन(cid:7008)धत अनधकारी के (cid:7021र्)यं के (cid:7079)माणप(cid:7074) के आधार पर (cid:7021र्)यं ता प(cid:7407)र्रार के नलए नच(cid:7408)क(cid:7004)सा (cid:7390)य(cid:7298) क(cid:7409) (cid:7079)नतपू(cid:7414)त(cid:6981) हेतु पा(cid:7074) होगा, या:-

(cid:7407)ट(cid:7009)पणी.- (i) (cid:7408)कसी अनधकारी को अ(cid:7079)यु(cid:7334) नच(cid:7408)क(cid:7004)सा सहायता रान को संनचत करने क(cid:7409) अनुमनत दी ाि सकती है, परंतुर् ह (cid:7408)कसी भी समय ऊपर उन(cid:7016)लनखत अनधकतम रान के तीन गुना से अनधक नह(cid:7277) होगी र्अा;

(ii) र् ष(cid:6981) 2007 के नलए, नच(cid:7408)क(cid:7004)सा सहायता योनिा के अंतग(cid:6981)त नच(cid:7408)क(cid:7004)सा (cid:7390)य क(cid:7409) (cid:7079)नतपू(cid:7414)त(cid:6981) दो महीने अा(cid:6981)त, र्नंबर 2007 और (cid:7408)दसंबर 2007 के नलए यानुपात बाई ािएगी।

(ख) अ(cid:7021)पतालीकरण (cid:7390)यः

(i) अ(cid:7021)पताल म(cid:7286) भत(cid:7278) होनेर् ाले सभी मामल(cid:7298) के संबंध म(cid:7286) अनधकारी के मामले म(cid:7286) 100 (cid:7079)नतत र्एं उसके प(cid:7407)र्रार के सद(cid:7021)य(cid:7298) के मामले म(cid:7286) 75 (cid:7079)नतत तक अ(cid:7021)पतालीकरण के (cid:7079)भार(cid:7298) क(cid:7409) (cid:7079)नतपू(cid:7414)त(cid:6981) क(cid:7409) ािएगी।

(ii) 01 मई, 2010 को या उसके बाद से, इस र्नननयम के अंतग(cid:6981)त अ(cid:7021)पताल म(cid:7286) भत(cid:7278) क(cid:7409) (cid:7079)नतपू(cid:7414)त(cid:6981), कामगार कम(cid:6981)चा(cid:7407)रय(cid:7298) के नलए (cid:7408)दनांक 27 अ(cid:7079)ैल, 2010 के न(cid:7367)प(cid:6979)ीय समझौते के अंतग(cid:6981)त ननधा(cid:6981)(cid:7407)रत अ(cid:7021)पतालीकरण योनिा के ननयम(cid:7298) और त(cid:7300) के अनुसार, नीचे दी गई सारणी म(cid:7286) नन(cid:7416)द(cid:6981)(cid:7397) सीमा(cid:7312) के अ(cid:7007)यधीन होगी, अा(cid:6981)त्:

9. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 25 म(cid:7286), उप-र्नननयम (2) के नलए, नन(cid:7388)नलनखत उप-ननयम (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या –

"(2) उप-र्नननयम (1) म(cid:7286) (cid:7408)कसी बात के होते (cid:7263)ये भी, 1 र्नंबर, 2007 को और उसके बाद से अनधकारी (cid:7367)ारा उस र्ेतनमान, नसिम(cid:7286) उसे रखा गया है, के (cid:7079)म चरण के मूलर् ेतन के 1.20 (cid:7079)नतत के समतु(cid:7016)य रान या र्आास के नलए मानक (cid:7408)कराया,ोि भी कम हो, भुगतान ािने पर ब(cid:7289)क (cid:7408)कसी अनधकारी को र्आासीय सुर्नधा उपल(cid:7011)ध कराने के नलए (cid:7021र्)तं(cid:7074) होगा:

परंतु, हिां अनधकारी को ऐसे र्आास पर न(cid:7278)चर उपल(cid:7011)ध कराया गया हो,र् हँ ब(cid:7289)क (cid:7367)ारा उससे उसर् ेतन के र् ेतनमान, नसिम(cid:7286) उसे रखा गया है, के (cid:7079)म चरण के , मूलर् ेतन के 0.25 (cid:7079)नतत के समतु(cid:7016)य अनत(cid:7407)र(cid:7334) रान भीर् सूली ािएगी:

परंतु यह भी (cid:7408)क, हिां ब(cid:7289)क (cid:7367)ारा ऐसी र्आासीय सुर्नधा उपल(cid:7011)ध कराई ािती है तो नबलिी, पानी, गैस और साई (cid:7390र्)(cid:7021)ा के नलए (cid:7079)भार अनधकारी (cid:7367)ारार् हन (cid:7408)कए ािएंगे;"

10. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 36 म(cid:7286), उप-र्नननयम (2) के बाद, नन(cid:7388)नलनखत उप-ननयम को ोिा ािएगा, या –

"(3) 1 मई, 2010 से 12 महीने क(cid:7409) सम(cid:7061) र्अनध के भीतर, नह(cid:7021)टेरे(cid:6989)टोमी के मामले म(cid:7286) अनधकतम 45 (cid:7408)दन(cid:7298) तक र्अका भी (cid:7408)दया ाि सके गा।"

11. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 41 म(cid:7286), उप-र्नननयम (4) म(cid:7286), खंड (क) के नलए, नन(cid:7388)नलनखत खंड को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािएगा, या :-

'(क) र्नराम भ(cid:7275)ा – 1 मई, 2010 को और उसके बाद से, नीचे दी गई सारणी के कॉलम (1) म(cid:7286) ननधा(cid:6981)(cid:7407)रत (cid:7088)ेनणय(cid:7298) या र्ेतनमान(cid:7298) म(cid:7286) अनधकारी कॉलम (2) म(cid:7286) ननधा(cid:6981)(cid:7407)रत क(cid:7409) गई दर(cid:7298) पर (cid:7079)नत (cid:7408)दन र्नराम भ(cid:7275)ा का हदिार होगा, या:-

परंतुर् ेतनमान IV और उससे ऊपर के अनधका(cid:7407)रय(cid:7298) के मामले म(cid:7286), चार महानगर(cid:7298) अा(cid:6981)त (cid:7408)द(cid:7016)ली, मु(cid:7013)बई, कोलकाता और चे(cid:7382)ई म(cid:7286) काया(cid:6981)लय से बाहर (cid:7408)कसी काय(cid:6981) हेतु देय दैननक र्नराम भ(cid:7275)ा (cid:7271).1200 होगा औरर् ेतनमान I या II या III के अनधका(cid:7407)रय(cid:7298) के नलए दैननक र्नराम भ(cid:7275)ा (cid:7271). 1000 होगा।

परंतु यह भी (cid:7408)क हिां अनुपन(cid:7021)नत क(cid:7409) कु ल र्अनध आठ घंटे से कम ले(cid:7408)कन चार घंटे से अनधक है, र्नराम भ(cid:7275)ा उपरो(cid:7334) दर(cid:7298) से आधी दर(cid:7298) पर देय होगा।

(cid:7021)प(cid:7397)ीकरण- र्नराम भ(cid:7275)े क(cid:7409) गणना के (cid:7079)योनि के नलए '(cid:7079)नत (cid:7408)दन' का ता(cid:7004)पय(cid:6981) चौबीस घंटे या उसके बाद के (cid:7408)कसी भाग क(cid:7409) (cid:7079)(cid:7004)येक र्अनध से होगा, र्हाई या(cid:7074)ा क(cid:7409) न(cid:7021)नत म(cid:7286) नसिक(cid:7409) गणना (cid:7079)(cid:7021)ान के नलए (cid:7407)रपो(cid:7419)ट(cid:7304)ग समय और अ(cid:7008)य मामल(cid:7298) म(cid:7286) (cid:7079)(cid:7021)ान के ननधा(cid:6981)(cid:7407)रत समय से आगमन के र् ा(cid:7021)तर्नक समय तक क(cid:7409) ािएगी और हिां अनुपन(cid:7021)नत क(cid:7409) कु ल र्अनध चौबीस घंटे से कम है,र् हँ "(cid:7079)नत (cid:7408)दन" से ता(cid:7004)पय(cid:6981) कम से कम आठ घंटे क(cid:7409) र्अनध अनभ(cid:7079)ेत होगी ।

12. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 42 म(cid:7286), उप-र्नननयम (3) के बाद, नन(cid:7388)नलनखत उप-र्नननयम को ोिा ािएगा, या -

"(4) 1 मई, 2010 को या उसके बाद से, (cid:7021)ानांतरण पर अनधकारी पै(cid:7412)कं ग, (cid:7021)ानीय प(cid:7407)र्रहन, सामान का बीमा, आ(cid:7408)द से संबन(cid:7008)धत खच(cid:7300) के नलए नन(cid:7388)नलनखत सारणी म(cid:7286) या र्ननन(cid:7416)द(cid:6981)(cid:7397) एकमु(cid:7019)त रान (cid:7079)ा(cid:7385) करने का पा(cid:7074) होगा, अा(cid:6981)त :-

13. उ(cid:7334) र्नननयम(cid:7298) के र्नननयम 44 म(cid:7286), उप-र्नननयम (3) म(cid:7286), नन(cid:7388) परंतुक ोिा ािएगा, या:-

NOTIFICATION

Gurugram, the 24th January, 2018

No.3 950.—In exercise of the powers conferred by section 19, read with sub-section (2) of section 12 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1980 (40 of 1980), the Board of Directors of the Oriental Bank of Commerce in consultation with the Reserve Bank of India and with the previous sanction of the Central Government, hereby makes the following regulations further to amend the Oriental Bank of Commerce (Officers') Service Regulations, 1982, namely:—

1. (1) These regulations may be called the Oriental Bank of Commerce (Officers') Service (Amendment) Regulations, 2017.

(2) They shall be deemed to have come into force with effect from the 1st day of November, 2007, except as otherwise provided in these regulations.

2. In the Oriental Bank of Commerce (Officers') Service Regulations, 1982 (hereinafter referred to as the said regulations), in regulation 3,-

(i) for clause (f), the following clause shall be substituted, namely:-

'(f) "family" means the spouse of the officer, wholly dependent unmarried children (including step children and legally adopted children), physically challenged brother or sister with forty per cent, or more disability and parents ordinarily residing with and wholly dependent on the officer'.

Explanation.- For the purposes of this clause a child or parent or physically challenged brother or sister shall be deemed to be dependent on the officer if the monthly income of such child, parent, brother or sister does not exceed Rs. 3,500 per month.

Provided that if the income of one of the parents exceeds Rs. 3,500 per month or the aggregate income of both the parents exceeds Rs. 3,500 per month, both the parents shall not be considered as wholly dependent on the officer.'

(ii) Clause (o) shall be omitted.

3. In regulation 4 of the said regulations,-

(i) sub-regulation (4A) shall be omitted;

(ii) after sub-regulation (4A) as so omitted, the following sub-regulations shall be inserted, namely:-

"(5) With effect from the 1st November, 2007, the scales of pay specified against each grade shall be as under :

(a) Top Executive Grade

Scale VII = Rs. 46800 – 1300/4 – 52000

Scale VI = Rs. 42000 - 1200/4 – 46800

(b) Senior Management Grade

Scale V = Rs. 36200 – 1000/2 – 38200 – 1100/2 - 40400

Scale III = Rs. 25700 - 800/5-– 29700 - 900/2 - 31500

Scale I = Rs. 14500-600/7- 18700-700/2- 20100- 800/7-25700.

Explanation.-Every officer who is governed by the scales of pay in force as on the 31st October, 2007 shall be fitted in the scale of pay set out in this sub-regulation as on 1st November, 2007 on stage to stage basis, i.e. on corresponding stages from first stage onwards in the respective scales and the increments shall fall on the anniversary date as usual except where provided otherwise.

(6) Nothing in sub-regulations (1), (2), (3), (4) and (5) shall be construed as requiring the Bank to have at all times, officers serving in all these grades.".

4. In regulation 5 of the said regulations, -

(a) for sub-regulation (1), the following sub-regulation, shall be substituted, namely: -

"(1) Subject to the provisions of sub-regulation (5) of regulation 4, on and from the 1st November, 2007, the increments shall be granted subject to the following, namely: -

(a) the increments specified in the scales of pay set out in sub-regulation (5) of regulation 4 shall, subject to the sanction of the Competent Authority, accrue on an annual basis and shall be granted on the first day of the month in which these fall due;

(b) officers in Junior Management Grade Scale I who have moved to scale of pay for Middle Management Grade Scale II after reaching maximum of the higher scale shall be eligible for four stagnation increments for every three completed years of service of which first two shall be Rs.800 each and next two Rs.900 each:

Provided that officers who have completed three years or more after receipt of the second stagnation increment as on 1st November, 2007 shall get the third stagnation increment on 1st November, 2007 and another stagnation increment on or after the 1st November, 2008 on their completion of six years after receipt of second stagnation increment;

(c) officers in Middle Management Grade Scale II who have moved to scale of pay for Middle Management Grade Scale III after reaching maximum of higher scale shall be eligible for three stagnation increments of Rs.900 each for every three completed years of service:

Provided that officers who have completed three years or more after receipt of the first stagnation increment as on the 1st November, 2007 shall get the next stagnation increment with effect from the 1st November, 2007 and a subsequent stagnation increment on or after the 1st November, 2008 on their completion of six years after receipt of the first stagnation increment:

Provided further the officers appointed to or promoted in substantive Middle Management Grade Scale III, shall be eligible for four stagnation increments of Rs.900 each for every three completed years of service or :

Provided also that the officers who have already received two stagnation increments and completed more than three years of service after receipt of second stagnation increment as on the 1st November, 2007 shall get the third stagnation increment on the 1st November, 2007 and the fourth stagnation increment, on or after the 1st November, 2008 on completion of six years after receipt of second stagnation increment.

Provided further that such increment/s in the next higher scale/stagnation increment/s shall not be allowed to an officer who refuses promotion when offered.

Explanation.- Grant of such increments in the next higher scale under this sub-regulation shall not amount to promotion and the privileges, perquisites, duties and responsibilities of the officers shall continue as of their substantive posts.

(b) in sub-regulation (2),-

(j) in the Explanation, after clause (e) and before the Note, the following clause shall be inserted, namely:-

"(f) on and from the 1st day of November, 2007, other things being equal, the quantum of Professional Qualification Pay shall stand revised as under:-

Provided that an Officer acquiring Junior Associate of Indian Institute of Bankers or Certified Associate of Indian Institute of Bankers (either or both parts) qualifications after reaching the maximum of the scale of pay, shall be granted from the date of acquiring such qualification the first installment of Professional Qualification Pay and the release of subsequent installments of Professional Qualification Pay shall be with reference to the date of release of first installment of Professional Qualification Pay:

Provided further that in a case where an officer, has already acquired any of the above qualifications and has not earned any increment or Professional Qualification Pay on account of acquiring such qualification, he may be granted the Professional Qualification Pay, with effect from the 1st November 2007 or the date of acquiring such qualification/s, whichever is later.";

(ii) in the Note, for clause (v), the following clause shall be substituted, namely:-

"(v) if an officer, as on the 27thApril 2010 has already acquired any of the said qualifications referred to in clause (iv) and has not earned any increment or Professional Qualification Pay on account of acquiring such qualification, he shall be granted the Professional Qualification Pay, with effect from the 1st day of November, 2007 or the date of acquiring such qualification, whichever is later.";

(c) in sub-regulation (3),-

(i) after clause (d) and before the Note, the following clause shall be inserted, namely:-

"(e) on and from the 1st November, 2007, other things being equal, Fixed Personal Pay together with House Rent Allowance shall be at the following rates and shall remain frozen for the entire period of service:-

(ii) in the Note, for clauses (i) and (ii), the following clauses shall be substituted, namely:-

"(i) Fixed Personal Allowance or Fixed Personal Pay as indicated under column (C) of the Table under clauses (b), (c), (d) or (e) shall be payable to those officers who are provided with bank's accommodation.

(ii) Fixed Personal Allowance or Fixed Personal Pay for officers eligible for House Rent Allowance shall be the aggregate amount specified under columns (A) and (B) of the Table under clause (e) and House Rent Allowance drawn by the concerned officer employees when the last increment of the relevant scale of pay as specified in sub-regulations (2), (3), (4) or (5) of regulation 4 is earned.";

(iii) clause (e) occurring after the Note shall be renumbered as sub-clause (v) thereof and for clause (v) as so numbered, the following clause be substituted, namely:-

"(v) An officer who has earned the advance increment as in clause (a) above shall draw the quantum of Fixed Personal Allowance/Fixed Personal Pay as mentioned in clauses (b), (c), (d) or (e) above, one year after reaching the maximum of the scale";

5. In regulation 21 of the said regulations, -

(i) in sub-regulation (3), the Note shall be omitted;

(ii) in sub-regulation (4), the Note shall be omitted;

(iii) after sub-regulation (4), the following sub-regulation and Note shall be inserted, namely:-

"(5) On and from the 1st day of November, 2007, dearness allowance shall be payable for every rise or fall of four points over 2836 points in the quarterly average of the All India Average Working Class Consumer Price Index (General) Base 1960=100 at 0.15% of Pay.

Explanation.- For the purposes of this sub-regulation,-

(a) "pay" for the purpose of Dearness Allowance shall mean basic pay including Stagnation Increments;

(b) Professional Qualification Allowance or Professional Qualification Pay as specified in Explanations (c), (d), (e) and (f) to sub-regulation (2) of regulation 5 shall rank for dearness allowance'.

6. In regulation 22 of the said regulations, for sub-regulations (1) and (2), the following sub-regulations shall be substituted, namely:-

"(1) on and from the 1st day of November, 2002,

(a) where an officer is provided with residential accommodation by the Bank, a sum equal to 1.75 per cent of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less, shall be recovered from him;

(b) where an officer is not provided any residential accommodation by the Bank, he shall be eligible for House Rent Allowance at the rates specified in the following table, namely:

Provided that if an officer produces a rent receipt, the House Rent Allowance payable to him shall be the actual rent paid by him for the residential accommodation in excess over 1.75 per cent of pay in the first stage of the scale of pay in which he is placed with a maximum of 150 per cent of the House Rent Allowance payable as per column (2) of the above Table.

(2) on and from the 1st day of November, 2007, -

(a) where an officer is provided with residential accommodation by the Bank, a sum equal to 1.20 per cent of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less, shall be recovered from him;

(b) where an officer is not provided any residential accommodation by the Bank, he shall be eligible for House Rent Allowance at the rates specified in the following table, namely: -20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

actual rent paid by him for the residential accommodation in excess over 1.20 per cent of Pay in the first stage of the Scale of Pay in which he is placed with a maximum of 150 per cent of the House Rent Allowance payable as per aforesaid rates mentioned in column (2) above.

Note.- The claims of officers for House Rent Allowance linked to the cost of their ownership accommodation shall also be restricted to 150 per cent of House Rent Allowance as hitherto.";

7. In regulation 23 of the said regulations,-

(vi) in sub-regulation (1), for the figures, letters and words "1st day of November 2002", the figures, letters and words "1st day of November 2007" shall be substituted;

(vii) in sub-regulation (2), for the figures, letters and words "1st day of November 2002, the figures, letters and words "1st day of November 2007" shall be substituted;

(viii) for sub-regulations (3), (4) and (5), the following sub-regulations shall be substituted, namely:-

"(3) On and from the 1st day of November, 2007, if an officer is serving in an area to be specified as Project Area falling in Group A or Group B, he shall be eligible for a Project Area Compensatory Allowance at the rate of Rs. 290 per month or Rs. 255 per month according to the classification of area as Group A or Group B.

(4) On and from the 1st day of November, 2007, if an officer is transferred from one place to another in the midst of an academic year and if he has one or more children studying in school or college, in the former place, he shall be eligible for a mid-academic year transfer allowance of Rs. 700 per month from the date he reports to the latter place upto the end of the academic year in respect of all the children, provided that such allowance shall cease if all the children cease studying at the former place.

(5) On and from the 1st day of May, 2010, if an officer is deputed to serve outside the Bank, he may opt to receive the emoluments attached to the post to which he is deputed, or he may in addition to his pay, draw a deputation allowance at the rate of 7.75 per cent of pay subject to a maximum Rs.2300 per month and such other allowances he would have drawn had he been posted in the Bank's service at that place:

Provided that where he is deputed to an organisation which is located at the same place where he was posted immediately prior to his deputation, he shall receive a deputation allowance equal to 4 per cent of his pay subject to a maximum Rs.1200 per month:

Provided further that an officer on deputation to the Training Establishment of the Bank as a faculty member shall be eligible for deputation allowance at the rate of 4 per cent of his pay subject to a maximum Rs.1200 per month.";

(ix) for sub-regulation (8), the following sub-regulation shall be substituted, namely:-

"(8) on and from the 1st day of November 2007, if the working hours during a day are split with minimum interval of two hours, an officer shall be eligible for a Split Duty Allowance at the rate of Rs.165 per month.";

(x) in sub-regulation (10),-

(a) for the figures, letters and words "1st day of November 2002", the figures, letters and words "1st day of November, 2007" shall be substituted;

(b) for the Table, the following Table shall be substituted, namely:-

8. In regulation 24 of the said regulations, in sub-regulation (1), for clause (a), the following clause shall be substituted, namely:-

"(a) Medical Expenses.- On and from the 1st day of November 2007, an officer shall be eligible for reimbursement of medical expenses for self and family on the strength of the officer's own certificate of having incurred such expenditure supported by a statement of accounts for the amounts claimed as specified in the table below, namely:-

Note.- (i) an officer may be allowed to accumulate unavailed medical aid so as not to exceed at any time three times the maximum amount provided above or;

(ii) for the year 2007, the reimbursement of medical expenses under the medical aid scheme shall be enhanced proportionately for two months, that is, November 2007 and December, 2007.

(b) Hospitalization Expenses:

(i) Hospitalisation charges shall be reimbursed to the extent of 100 per cent in the case of an officer and 75 per cent, in the case of his family members in respect of all cases which require hospitalization or;

(ii) On and from the 1st day of May, 2010, reimbursement of hospitalisation expenses under this regulation shall be in accordance with the terms and conditions of Hospitalisation Scheme as laid down under the Bipartite Settlement dated the 27thday of April, 2010 for workmen employees, subject to the limits as specified in the table below, namely:-

9. In regulation 25 of the said regulations, for sub-regulation (2), the following sub-regulation shall be substituted, namely:-

"(2) Notwithstanding anything contained in sub-regulation(1), it shall be open to the Bank to provide residential accommodation to an officer on payment by the officer, on and from the 1st day of November, 2007, a sum equal to 1.20 per cent, of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less:

Provided that where the officer is provided with furniture at such residence, a further sum equal to 0.25 per cent of basic pay in the first stage of the scale of pay in which he is placed shall be recovered by the Bank from him:

Provided further that, where such residential accommodation is provided by the bank, the charges for electricity, water, gas and conservancy shall be borne by the officer.".

11. In regulation 36 of the said regulations, after sub-regulation (2), the following sub-regulation shall be inserted, namely :-

"(3) With effect from the 1st day of May 2010, within the overall period of 12 months, leave may also be granted in case of hysterectomy upto a maximum of 45 days.".

11. In regulation 41 of the said regulations, in sub-regulation (4), for clause (a), the following clause shall be substituted, namely:-

'(a) Halting Allowance – On and from the 1st day of May, 2010, an officer in the Grades or Scales set out in column (1) of the Table below shall be entitled to `per diem' Halting Allowance at the corresponding rates set out in column (2) thereof, namely:-

Provided that in the case of officers in Scale IV and above, Halting Allowance payable per diem while on outstation work at the four metros, viz., Delhi, Mumbai, Kolkata and Chennai, shall be Rs.1200 and for officers in Scale I or II or III, the per diem Halting Allowance shall be Rs.1000:

Provided further that where the total period of absence is less than eight hours but more than four hours, Halting Allowance at half the above rates shall be payable.

Explanation.- For the purpose of computing Halting allowance "per diem" shall mean each period of twenty-four hours or any subsequent part thereof, reckoned from the reporting time for departure in the case of air travel and the scheduled time of departure in other cases, to the actual time of arrival and where the total period of absence is less than twenty-four hours, "per diem" shall mean a period of not less than eight hours.'.

12. In regulation 42 of the said regulations, after sub-regulation (3), the following sub-regulation shall be inserted, namely:-

"(4) On and from the first day of May 2010, an officer on transfer shall be eligible to draw a lump sum amount for expenses connected with packing, local transportation, insuring the baggage, etc., as specified in the Table below, namely:

13. In regulation 44 of the said regulations, in sub-regulation (3), the following proviso shall be inserted, namely:-

"Provided that with effect from the 1st May 2010, an officer in Junior Management Grade Scale I while availing Leave Travel Concession shall be entitled to travel by air in the lowest fare economy class in which case the reimbursement will be the actual fare or the fare applicable to AC First Class fare by train for the distance traveled, whichever is less and the same rules shall apply to an officer in Middle Management Grade Scale II and Middle Management Grade Scale III while availing Leave Travel Concession where the distance is less than 1000 kms.".

14. In regulation 45 of the said regulations, -

(iv) in sub-regulation (1), the following proviso shall be inserted, namely:-

"Provided that there shall be no Provident Fund to Officers joining the services of the Banks on or after the 1st day of April, 2010.";

(v) in sub-regulation (3), after clause (b) and before the Note, the following clause shall be inserted, namely:-

"(c) Officers who are covered under the Contributory Provident Fund Scheme who do not opt for Pension Scheme shall continue under the Contributory Provident Fund Scheme.";

(vi) after sub-regulation(3), the following sub-regulation shall be inserted, namely:-

"(4) The officers joining the services of the Bank on or after the 1st day of April 2010 shall be covered by a Defined Contributory Pension Scheme, where the officer shall contribute ten per cent, of pay plus Dearness Allowance and the Bank shall make the similar amount of contribution in accordance with the provisions of the Contributory Pension Scheme in accordance with New Pension Scheme notified by the Central Government vide notification of the Government of India, F. No. 5/7/2003-ECB & PR dated the 22nd December, 2003, as amended from time to time." 15. For the Schedule to the said regulations, the following Schedule shall be substituted, namely,:-

"Schedule to Oriental Bank of Commerce (Officers') Service Regulations, 1982

(See sub-regulation (2) of regulation 23)

With effect from the 1st day of November, 2007, an officer shall be eligible for the Special Area Allowance till such time they are withdrawn or modified either wholly or partially, as specified in the Table below, namely:-

EXPLANATORY MEMORANDUM

The Regulations which have been given retrospective effect are as per the agreed terms and conditions of the Joint Notes signed between the Indian Banks' Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level officers' associations of the Banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
