का.आ. का.आ. का.आ. का.आ. 909909909909(अ)(अ)(अ)(अ)....————के न्(cid:16)ीय सरकार, उर्वरक (नियंत्रण) आदेश, 1985 के खंड 3 के उपखंड (1) के अनुसरण में और भारत सरकार के कृ षि मंत्रालय (कृ षि और सहकारिता विभाग) की अधिसूचना संख्या का.आ. 2663(अ), तारीख 31अक्तू बर, 2012 (जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है) को उन बातों के सिवाय अधि?ांत करते @ए, जिन्हें ऐसे अधि?मण से पहले किया गया है या करने का लोप किया गया है, इससे उपाबC अनुसूची के स्तम्भ (4) में विनिFर्दष्ट कीमत को, स्तंभ (3) में विनिFर्दष्ट आकार के प्रति थैले के लिए, इस अधिसूचना को जारी करने की तारीख से,ऐसी अधिकतम कीमत के रूप में नियत करती है, जिस पर उक्त अनुसूची के स्तम्भ (2) में की तत्स्थानी प्रविष्टिमें विनिFर्दष्ट उर्वरकों का, चाय, काफी या रबर बागानों के उगाने वालों या खेतिहरों को डीलर, विनिर्माता आयातक या पूल हैंडलिंग अभिकरण द्वारा वि?य किया जाएगा :--

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] स्पस्पस्पस्पष्टीष्टीष्टीष्टीकरण 2 :करण 2 :करण 2 :करण 2 :--------जहां किसी उर्वरक का वि?य, 25 किलोUाम से अनधिक मात्राओं में किया जाता है, वहां डीलर उर्वरक के छोटे थैलों पर अनुसूची के स्तम्भ (3) में विनिFर्दष्ट कीमत के अतिरिक्त निम्नलिखित राशि प्रभारित कर सके गा, अर्थात् :--

(क) 2 किलोUाम की पैcकं ग पर 1.50 fपए प्रति पैcकं ग;

(ख) 5 किलोUाम की पैcकं गपर 2.25 fपए प्रति पैcकं ग;

(ग) 10 किलोUाम की पैcकं ग पर 3.50 fपए प्रति पैcकं ग; और

(घ) 25 किलोUाम की पैcकं ग पर 5.00 fपए प्रति पैcकं ग।

(2) 50 किलोUाम के थैले, यदि कोई हो, का वि?य डीलर, विनिर्माता, आयातक और पूल हैंडलिंग अभिकरण द्वारा उक्त अधिसूचना की अनुसूची में नियत कीमत पर किया जाएगा, जिसमें ऊपर स्पष्टीकरण 1 में विनिFर्दष्ट कर सम्मिलित नहZ हैं ।

(3) इस अिधसूचना के प्रवृत्त होने के पश्चात् उक्त अधिसूचना की अनुसूची में निर्धारित कीमत पर प्राप्त उर्वरक के वि?य न किए गए स्टॉक को विनिर्माता और पूल हैंडलिंग अभिकर्ता, चाहे वे सरकारी,प्राइवेट या सहकारी सैक्टर में हों (जिसके अंतर्गत राज्य कृ षि उद्योग िनगम, शीर्षस्थ सहकारी विपणन संघ और अन्य संस्थागत अभिकरण भी हैं) से भिन्न किसी थोक या खुदरा jयौहारी द्वारा उक्त अिधसूचना के अधीन नियत अधिकतम कीमत से अनधिक कीमत पर वि?य नहZ किया जाएगा।

ORDER

New Delhi, the 1st March, 2018

S.O. 909(E).—In pursuance of sub-clause (1) of clause 3 of the Fertilizer (Control) Order, 1985 and in supersession of the notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation) number S.O. 2663 (E) dated the 31st October, 2012 (hereinafter referred to as the said notification), except as respects things done or omitted to be done before such supersession, the Central Government hereby fixes, with effect from the date of issue of this notification, the prices specified in column (4) of the Schedule annexed hereto as the maximum price per bag of size specification in column (3) at which the fertilisers specified in the corresponding entries in column (2) of the said Schedule shall be sold by a dealer, manufacturer, importer or a pool handling agency to the growers of tea, coffee or rubber plantations or to the cultivators:-

SCHEDULE

Explanation I.- The maximum price fixed above shall be exclusive of the central excise duty, Central Tax, Integrated Tax, Union Territory Tax or Countervailing Duty, the state tax and other local taxes wherever levied, whether at the retail sales point or at an intermediate stages.

Explanation II : Where the sale of any fertiliser is made in quantities not exceeding 25 kilograms, the dealer may charge the following amount on small fertiliser bags in addition to the price specified in the Schedule namely:-

(a) On packing of 2 kg. Rs. 1.50 per packing;

(b) On packing of 5 kg Rs. 2.25 per packing;

(c) On packing of 10 kg. Rs. 3.50 per packing; and

(d) On packing of 25 kg. Rs. 5.00 per packing.

(2) The 50 kg. bag, if any, shall be sold by a dealer, manufacturer, importer and a pool handling agency at the price fixed in the Schedule to the said notification which shall be exclusive of taxes specified in Explanation I above.

(3) After the coming into force of this notification, the unsold stocks of fetiliser procured at the price fixed in the Schedule to the said notification, by any wholesale or retail dealer other than the manufacturer and pool handling agent, whether in the Government, private or cooperative sector (including the State Agro-Industries Corporations, Apex Cooperative Marketing Federations and other institutional agencies), shall be sold at the price not exceeding the maximum price fixed under the said notification.
