काकाकाका....आआआआ. . . . 899899899899((((अअअअ))))....———— जबकि के न्(cid:12) सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का.आ. 2948(अ), दिनांकित 15 िसतंबर, 2016 के द्वारा पंजाब राज्य में राष्ट्रीय राजमार्ग सं. 15 [नई राष्ट्रीय राजमार्ग सं. 54] के मौजूदा किमी 445.250 [िडजाइन किमी 112.575] से मौजूदा किमी 287.615 [डिजाइन किमी 287.215] तक अमृतसर – तरन तारन – हरिके – फरीदकोट - भ<टंडा खंड तक को मुख्य अिभयंता [राष्ट्रीय राजमार्ग], लोक निर्माण विभाग, पंजाब सरकार (जो इसके बाद ''प्राधिकरण'' के रूप में उल्लिखित है) के माध्यम से पंजाब राज्य सरकार को सुपुर्द कर दिया है ।

और जबकि, कें (cid:12)ीय सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 9 द्वारा प्रदत्त शक्तियों का प्रयोग करते Mए राष्ट्रीय राजमागO के खंडों, स्थायी पुलों, बाइपासों और सुरंगों के प्रयोग के लिए फीस संTहण हेतु सा.का.िन. 838(अ), दिनांकित 05 दिसंबर, 2008 के तहत राष्ट्रीय राजमार्ग फीस (दरों का अवधारण एवं संTहण) नियमावली, 2008 तैयार की है तथा सा.का.िन. 950(अ), दिनांकित 03 दिसंबर, 2010, सा.का.िन. 15(अ), दिनांकित 12 जनवरी, 2011, सा.का.िन. 756(अ), दिनांकित 12 अक्टूबर, 2011, सा.का.िन. 778(अ), दिनांकित 16 दिसंबर, 2013, सा.का.िन. 26(अ), दिनांकित 16 जनवरी, 2014, सा.का.िन. 831(अ), दिनांकित 21 नवंबर, 2014, सा.का.िन. 02(अ), दिनांकित 29 दिसंबर, 2014, सा.का.िन. 220(अ), दिनांकित 23 मार्च, 2015, सा.का.िन. 585(अ), दिनांकित 8 जून, 2016, सा.का.िन. 1114(अ), दिनांकित 2 दिसंबर, 2016, और सा.का.िन. 248(अ), दिनांकित 14 मार्च, 2017 के तहत संशोधित की है ।

अत: अब, राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संTहण) िनयम, 2008 के िनयम 3 के साथ पठित और समय- समय पर संशोिधत (जो इसके आगे ''िनयम'' के रूप में उल्लििखत है) राष्ट्रीय राजमार्ग अिधिनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते Mए, के न्(cid:12)ीय सरकार, एतदद्वारा राष्ट्रीय राजमार्ग सं. 15 [नई राष्ट्रीय राजमार्ग सं. 54] के 1183 GI/2018

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] मौजूदा किमी 445.250 [डिजाइन किमी 112.575] से मौजूदा किमी 287.615 [डिजाइन किमी 287.215] तक अमृतसर – तरन तारन – हरिके – फरीदकोट - भ<टंडा खंड के प्रयोग के लिए निम्निलिखत तािलका 1 के कॉलम (2) में विनिXर्दष्ट वाहनों के प्रकार पर फीस (इसके आगे 'आधार दर' के रूप में उल्लििखत है) चार लेन खंडों के उपयोग हेतु 108.268 किमी [0.364 किमी की समतुल्य लंबाई सहित 3.64 किमी की संरचना (60 मीटर से अधिक की लंबाई वाले) को छोड़कर] और 64.127 किमी [1.881 किमी की समतुल्य लंबाई सहित 18.81 किमी की संरचना (60 मीटर से अधिक की लंबाई वाले) को छोड़कर] की डिजाइन लंबाई वाले बाइपास के िलए आधार दर के 150% पर िनवल सड़क खंड लंबाई के िलए तािलका 1 के कॉलम (2) में विनिXर्दष्ट आधार दर से उदगृहीत करती है तथा प्राधिकरण को उसके अधिकारियों अथवा किसी ठेके दार के माध्यम से उक्त फीस के संTहण के िलए प्राधिकृ त करती है, अर्थात्:-

2. उपयु र्क्त के अतिरिक्त, टोल प्लाजा के लिए विनिXर्दष्ट बाइपास की लंबाई के लिए निम्नलिखित टोल प्लाजा (प्लाजाओं) पर 10 करोड़ d. अथवा अिधक लागत वाले बाइपास (बाइपासों) के उपयोग हेतु आधार दर के डेढ़ गुना पर निम्निलिखत फीस भी देय और संदेय होगी :-

3. उपयु र्क्त के अतिरिक्त, निम्नलिखित टोल प्लाजा (प्लाजाओं) पर 60 मीटर से अधिक लंबाई वाली निम्निलिखत अवसंरचनाओं के उपयोग के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को परिवeर्तत करके निम्नलिखित फीस भी देय और संदेय होगी:-

****60 मीटर से अधिक लंबाई वाली अवसंरचनाओं का ब्यौरा निम्नानुसार है:-

4. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किमी की दूरी के भीतर निवास करने वाले iयक्ति के िलए मािसक पास की दर वर्ष 2017-18 के िलए 245.00 d. (दो सौ पैतालीस dपए मात्र) है और यह राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संTहण) नियम, 2008 के उपबंधों के अनुसार प्रत्येक वर्ष संशोधन के अध्यधीन है ।

5. राजमार्ग खंड पर बMल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्

6. फीस प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए फीस उस mेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशतn कि ऐसे वाणिज्यिक वाहनों के प्रयोग के िलए कोई सeर्वस रोड या वैकल्पिक सड़क उपलब्ध न हों ।

7. संबंधित mेणी के वाहनों के लिए विनिXर्दष्ट अनुoेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी iयक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संTहण एजेंसी को ऐसी mेणी के वाहनों के लिए अनुप्रयोज्य फीस के समतुल्य दस गुणा फीस का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहp होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहp जाता ।

8. सभी परिभाषाएं, यांत्रिक वाहनों की mेणी, इनके अनुoेय भार, छू ट प्राप्त वाहनों की mेणी, सeर्वस रोड, वैकल्पिक सड़क इत्यादि पूवqक्त नियमों में विनिXर्दष्ट परिभाषाओं के अनुरूप होंगी ।

9. फीस की दरें उक्त नियमों के नियम 12 के अनुसरण में प्रयोक्ताओं के सूचनार्थ प्रदeर्शत करनी होंगी ।

10. यांत्रिक वाहनों से फीस की वास्तविक राशि उपयु र्क्त तािलका-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी फीस की आधार दर के आधार पर प्रभारित होगी और छू टों की गणना प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंTेजी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा ।

11. परियोजना की प्राक्किलत पू ंजीगत लागत तालिका 5 में दी गई है । पू ंजीगत लागत परिवर्तन के अध्यधीन है क्योंकि भूिम अधिTहण, जनोपयोगी सुविधाओं के अंतरण, पेड़ों को काटने आदि कार्यकलापों को अभी पूरा किया जाना है । अंितम पू ंजीगत लागत को पृथक रूप से अधिसूचित किया जाएगा । प्राप्त होने वाली प्रयोक्ता फीस के माध्यम से वसूल की गई पू ंजीगत लागत का प्राधिकरण द्वारा रिकॉर्ड रखा जाएगा तथा पू ंजीगत लागत की वसूली के पश्चात् उदTाu फीस घटाकर दरों के 40% तक कर दी जाएगी और उक्त नियमों के अनुसरण में वाeर्षक रूप से संशोधित की जाएगी ।

NOTIFICATION

New Delhi, the 28th February, 2018

S.O. 899(E).— whereas, by notification of the Government of India in the erstwhile Ministry of Road Transport and Highways, number S. O. 2948 [E] dated 15th September, 2016, issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the Amritsar-Tarn Taran - Harike - Faridkot - Bathinda section of National Highway No. 15 (New National Highway No. 54) from existing km. 445.250 (Design km 112.575 ) to existing km 287.615 (Design km 287.215) in State of Punjab to the State Government of Punjab acting through the Chief Engineer [National Highways], Public Works Department, Government of Punjab (hereinafter referred to as the "Authority");

And whereas the Central Government, in exercise of the power conferred by Section-9 of National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008,vide G.S.R 838 (E), dated the 5th December, 2008, and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011, G.S.R 778 (E) dated 16th December, 2013, G.S.R 26(E) dated 16th January, 2014, G.S.R 831(E) dated 21st November, 2014, G.S.R 02(E) dated 29th December, 2014, G.S.R 220(E) dated 23rd March, 2015, G.S.R 585(E) dated 8th June, 2016, G.S.R 1114(E) dated 2nd December, 2016 and G.S.R 248(E) dated 14th March, 2017, for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels;

Now, therefore, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956 (48 of 1956) read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the "said Rules"), the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for net road section length of 108.268 km. [excluding 0.364 km of structures (having length more than 60m) with equivalent length of 3.64 km] for use of the four lane sections (hereinafter referred to as "base rate") and at 150% of the base rate for the bypasses having design length of 64.127 km [Excluding 1.881 km of structure (having length more than 60m) with equivalent length of 18.81km] on the type of Vehicle specified in column (2) of the Table 1 below for the use of the Amritsar-Tarn Taran - Harike - Faridkot - Bathinda section of National Highway No. 15 (New National Highway No. 54) from existing km. 445.250 (Design km 112.575) to existing km 287.615 (Design km 287.215) and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely and authorizes the Authority to collect, either through its official or through a contractor, the said fee, namely:-

1. The fee levied and collected hereunder shall be due and payable at the following toll plaza for the distance specified under such Toll Plaza.

2. In addition to above, the following fee shall also be due and payable for the use of the following bypass(es) costing Rs. 10 crore or more at the following Toll Plaza (s) at one and half times the base rate for the length of Bypass(es) specified for such Toll Plaza :-

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the at the following Toll Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10.

The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 245.00 (Rupees Two Hundred Forty Five only) for the year 2017-18 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

10. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.

11. The estimated capital cost of the project is given in Table 5. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost; the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
