सासासासा0000काकाकाका0000िनिनिनिन0.0.0.0. 201(201(201(201(अअअअ))))————के न्(cid:13)ीय मोटर यान अिधिनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) की अपेक्षानुसार के न्(cid:13)ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए, भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की, भारत के राजपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में प्रकािशत, अिधसूचना सा.का.िन. संख्यांक 1114(अ), तारीख 29 अगस्त, 2017 द्वारा प्रारूप नियम प्रकाशित किए गए थे, उन सभी 4क्तियों से, िजनके उनसे प्रभावित होने की संभावना थी, उस तारीख से, िजसको उक्त अिधसूचना से युक्त राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थी, तीस दिन की अविध के अवसान से पूर्व आक्षेप और सुझाव आमंत्रित किए गए थे ;
और राजपत्र की प्रतियां जिसमें उक्त अिधसूचना प्रकाशित की गई थी, जनता को 29 अगस्त, 2017 को उपलब्ध करा दी गई थी ;
और उक्त प्रारूप नियमों की बाबत जनता से प्राप्त आक्षेपों और सुझावों पर के न्(cid:13)ीय सरकार द्वारा िवचार कर िलया गया है ;
अतः, अब, के न्(cid:13)ीय सरकार, के न्(cid:13)ीय मोटर यान अिधिनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते ?ए, के न्(cid:13)ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए निम्नलिखित िनयम बनाती है, अर्थात् :--

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. संक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभ-----(1) इन नियमों का संक्षिप्त नाम के न्(cid:13)ीय मोटर यान (दूसरा संशोधन) िनयम, 2018 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. के न्(cid:13)ीय मोटर यान िनयम, 1989 के िनयम 115क के उपिनयम (8) के पश्चात् निम्निलिखत उपिनयम अंत:स्थापित किया जाएगा, अर्थात् :-
"9. प्रत्येक कृ षि ट्रैक्टर, सन्निर्माण उपस्कर यान और कम्बाइन हावSस्टर का विनिर्माण इस प्रकार किया जाएगा कि वह उनके द्वारा उत्सTजत गैसीय प्रदूषकों के निम्नलिखित मानकों का, जब निम्नलिखित Uूटी साइकिल मानकों का अनुपालन करे, अर्थात् :--
(क) परिवर्तनशील-गित इंजनों के लिए 8-मोड परीक्षण चW या तदनुरूपी अनियंत्रित मोडल चW तथा गैर-सड़क चलायमान चW (एनआरटीपी) ।
(ख) स्थिर -गित इंजनों के लिए 5-मोड परीक्षण चW या तदनुरूपी अनियंत्रित मोडल चW ।
(ग) उत्सर्जन (जी/के डब्ल्यूएच) को नीचे दी गई सारणी 1 और सारणी 2 में वTणत परीक्षण प्रयोज्यता के अनुसार गैर-सड़क सुरक्षा चW (एनआरएससी) और गैर-सड़क चलायमान चW (एनआरटीसी) परीक्षण चW के द्वारा मापा जाएगा और एनआरटीसी परीक्षण चW के लिए संयुक्त भारित उत्सर्जन की गणना कोल्ड स्टॉर्ट परिणाम के 10 प्रतिशत और हॉट स्टॉर्ट परिणाम के 90 प्रतिशत भार द्वारा की जाएगी । उक्त सारणियों में दी गई भारित संयुक्त परिणाम सीमाओं को पूरा करेंगे ।

(ख) 'जन विनिर्माता, गुणhास कारकों की गणना के लिए सेवा संचयन अनुसूची का उपयोग करने के लिए एक विकल्प के रूप में निम्निलिखत सुपुर्द किए गए गुणक गुणhास कारकों (डीएफ) का चयन कर सकते हैं ।

संशोधित प्रWिया के अनुसार होगी ।
(viii) उत्पादन पुष्टि के िलए,-
(क) 200 तक ('जन ^ेणी के अनुसार) वाTषक उत्पादन या आयात वाले कृ षि ट्रैक्टर, सन्निर्माण उपस्कर और कं बाइन हावSस्टर के िलए यह ^ेणी या मॉडल के अनुसार दो वषm में एक बार किया जाएगा ।
(ख) 200 ('जन ^ेणी के अनुसार) से अधिक वाTषक उत्पादन या आयात वाले कृ षि ट्रैक्टर, संनिर्माण उपस्कर और कं बाइन हावSस्टर के लिए यह ^ेणी या मॉडल के अनुसार एक वर्ष में एक बार किया जाएगा ।
(ix) उत्पादन की पुष्टि के लिए नमूना-आकार एक दिन के औसत उत्पादन के अध्यधीन न्यूनतम 10 और अिधकतम 100 का होगा :
परंतु ऐसी इंजन ^ेणी के लिए, जिसका एक वर्ष में उत्पादन 200 से कम है, नमूना आकार 1 हो सके गा ।
(x) किस्म अनुमोदन और उत्पादन पुष्टि परीक्षण के लिए 'धन Wमश: अनुलग्नक IV–T और IV-V में यथा-विनिrदष्ट संदTभत 'धन अथवा वाणिज्यिक 'धन होगा ।
(xi) इस नियम में विनिrदष्ट वाहन जो इंजन से सुसtित हैं जो 'जन उत्सर्जन को कम करने के लिए एक अभिकर्मक के उपयोग पर निर्भर करते हैं, एआइएस:137 में अधिकथित और समय-समय पर यथा- संशोधित प्रWिया के अनुसार एनओएक्स नियंत्रण उपायों का सही संचालन सुनिश्चित करेंगे ।
(xii) एससीआर से सुसज्जित 'जनों के लिए गैर-सड़क स्थिर चW (एनआरएससी) और गैर-सड़क चलायमान चW (एनआरटीसी) पर अमोनिया का उत्सर्जन 56 के डब्ल्यू से कम के शक्ति ^ेणी वाले 'जन के लिए 25 पीपीएम मध्य मान तथा 56 के डब्ल्यू से अधिक के शक्ति ^ेणी वाले 'जन के िलए 10 पीपीएम मध्य मान से अधिक नहf होगा ।
(xiii) डीजल 'जन एनओएक्स को कम करने वाले पदार्थ एयूएस:32 (जलीय यूरिया घोल) आइएसओ:22241 के भाग 1 और भाग 2 के अनुसार होंगे ।
(xiv) इस नियम में विनिrदष्ट और 1 अप्रैल, 2026 के पश्चात विनिTमत वाहनों की एआइएस:137 में अिधकिथत और समय-समय पर यथा-संशोधित प्रWिया के अनुसार प्रयोगरत वाहनों की उनमें प्रतिष्ठापित आंतरिक दहन इंजनों की गैसीय प्रदूषकों के उत्सर्जन के लिए मानीटरी की जाएगी ।
(xv) ऐसे 'जन या वाहन जिनमें 'जन लगे ?ए हैं में एआइएस:137 में अधिकथित अपेक्षाओं और समय- समय पर यथा-संशोधित प्रWिया के अनुसार अपेक्षाओं को पूरा करने वाला अनुरूपता लेबल लगाया जाएगा ।
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(i)] 5(xvi) इस नियम के अधीन विनिrदष्ट यानों के लिए एआइएस-137 में अधिकथित और समय-समय पर यथा-संशोधित प्रWिया के अनुसार नियंत्रण क्षेत्र के भीतर उत्सर्जन नमूना Wमश: भारत स्टेज (सीईवी/टीआरईएम) IV और भारत स्टेज (सीईवी/टीआरईएम) V के िलए सारणी 1 और सारणी 2 में विनिrदष्ट उत्सर्जन की सीमा दोगुने से अधिक नहf होगा ।
पंरतु कि भारत स्टेज (सीईवी/टीआरईएम) IV और भारत स्टेज (सीईवी/टीआरईएम) V को लागू किए जाने की तिथि से पूर्व विनिTमत वाहनों को इस उप-नियम के संबंधित कार्यान्वयन की तिथि के पश्चात छह महीने तक रजिस्टर किया जाएगा" ।

NOTIFICATION
New Delhi, the 05th March, 2018
G.S.R. 201(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R.1114 (E), dated the 29thAugust, 2017, in the Gazette of India, Extraordinary, Part II, Section (3), Sub- section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 29thAugust, 2017;
And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: -
1. Short title and commencement. -(1) These rules may be called the Central Motor Vehicles (Second Amendment) Rules, 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicle Rules, 1989,in rule 115A,after sub-rule (8), the following sub-rule shall be inserted, namely: –
" (9) Every agricultural tractor, construction equipment vehicle and combine harvester shall be so manufactured that it complies with the following standards of gaseous pollutants emitted by them when tested on following duty cycle, namely :-
(a) for variable-speed engines, the 8-mode test cycle or the corresponding ramped modal cycle and the transient cycle Non Road Transient Cycle (NRTC);
(b) for constant-speed engines, the 5-mode test cycle or the corresponding ramped modal cycle;
(c) emissions (g/kWh) shall be measured over applicable emission limit for Non Road Safety Cycle (NRSC) and Non Road Transient Cycle (NRTC) test cycle as per test applicability mentioned in Table 1 and Table 2given below and for NRTC test cycle, composite weighted emissions shall be computed by weighing the cold6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] start results 10 per cent. and the hot start results 90 per cent. weighted composite results shall meet the limits given in said- tables

(b) As an alternative to use a service accumulation schedule to determine deterioration factors, engine manufacturers may select to use the assigned multiplicative deterioration factors as per table 5 given below-

(vii) Conformity of Production (COP)frequency and selection procedure shall be as per procedure laid down in AIS: 137 and as amended time to time.
(viii) For Conformity of Production (COP),-
(a) for agricultural tractor, construction equipment and combine harvester with annual production or Import up to 200 nos (per engine family), it shall be once in two years per family or model.
(b) for agricultural tractor, construction equipment and combine harvester equipment with annual production or Import exceeding 200 nos (per engine family), it shall be once in every year per family or model.
(ix) For Conformity of Production (COP), the sampling size shall be one day's average production subject to a minimum of 10 and maximum of 100:
Provided that for engine family produced less than 200 in the yearly period sample size may be one.
(x) For Type approval and Conformity of Production (COP) test, fuel shall be Reference fuel or commercial fuel as specified in Annexure IV–T and Annexure IV-V respectively.
(xi) The vehicles specified in this rule fitted with engine, which rely on the use of a reagent in order to reduce emissions, shall ensure the correct operation of NOx control measures, as per procedure laid down in AIS:137 and as amended from time to time.
(xii) Emission of ammonia over the NRTC and NRSC for engines equipped with SCR shall not exceed a mean value of 25 ppm for engine power category less than or equal to 56 kW and 10 ppm for engine power category above 56 kW.
(xiii) The diesel engine Nox reduction agent AUS: 32 (Aqueous Urea Solution) shall conform to part 1 and part 2 of ISO: 22241.
(xiv) The vehicles specified under this rule and manufactured after the 1st April 2026 shall be monitored for gaseous pollutant emission from in-service internal combustion engines installed on vehicles, as per procedure laid down in AIS: 137 and as amended from time to time.
(xv) The engine or vehicle fitted with engines shall be affixed with a conformance label meeting the requirements as specified in AIS: 137 and as amended from time to time.
(xvi) For the vehicles specified under this rule, the emission sampled within the control area as per procedure laid down in AIS-137 and as amended from time to time, shall not exceed more than two times the limit values of the emission specified in Table 1 and Table 2 for stages IV and V, respectively:
Provided that the vehicles manufactured before the date of applicability of Bharat Stage (CEV/TREM) IV or Bharat Stage (CEV/TREM) V, respectively, shall be registered up to six months after the respective date of implementation of this rule.".

- टिप्पण—(i) ‘जन डायनोमीटर पर परीक्षण किया जाएगा । (ii) सकल शक्ति (पंखे के बिना) को मापने के लिए परीक्षण प्रWिया एआइएस:137 में और समय-समय पर यथा- संशोधित प्रWिया के अनुसार होगी । (iii) सकल शक्ति मापने के लिए सcता को किस्म अनुमोदन और उत्पादन की सुनिdितता हेतु नीचे दी गई सारणी 3 के अनुसार लागू किया जाएगा – सारणीसारणीसारणीसारणी 3333 (iv) दृश्यमान और गैसीय प्रदूषकों एवं छोटे कणों के उत्सर्जन को मापने के लिए परीक्षण प्रWिया एआइएस:137 में विनिर्धारित और समय-समय पर यथा-संशोधित प्रWिया के अनुसार होगी । (v) िनयम 115 के उप-िनयम (9) के अनुसार छह गतियों पर संपूर्ण भार पर ‘जन डायनोमीटर पर परीक्षण किए जाने पर दृश्यमान प्रदूषक (धुआं) के उत्सर्जन की सीमा िनयम 115 के उप-नियम (9) में दी गई सीमा से अधिक नहf होनी चाहिए । (vi) (क) ‘जन विनिर्माता, एआइएस:137 में विनिर्धारित और समय-समय पर यथा-संशोधित प्रWिया के अनुसार दूषण कारकों की गणना के लिए सारणी 4 में यथा-उल्लिखित एक ‘जन परीक्षण का विकल्प ले सकता है । सारणीसारणीसारणीसारणी 4444 ↩
