का.आ. 1019(अ).—विदेश व्यापार नीति (एफटीपी) 2015-20 के पैरा 1.02 के साथ पठित यथा संशोधित विदेश व्यापार(विकास एवं विनियमन) अधिनियम 1992 की धारा 5 और धारा 14क के तहत प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्‌द्वारा 18 अक्टूबर 2017 की अधिसूचना सं० 35/2015-20 के द्वारा यथा अधिसूचित विदेश व्यापार नीति 2015-20 के पैरा 2.17 में तत्काल प्रभाव से संशोधन करती है। इसके परिणामस्वरुप, विदेश व्यापार नीति 2015-20 का परिशिष्ट-I भी संशोधित किया जाता है।

2. विदेश व्यापार नीति 2015-20 के पैरा 2.17 को निम्नानुसार प्रतिस्थापित किया जाता हैः- (पैरा शीर्षक और उपशीर्षक में प्रयुक्त मोटे अक्षरों को छोड़कर किए गए परिवर्तन मोटे अक्षरों में हैं)

''2.17 कोरिया लोक जनतांत्रिक गणराज्य (डीपीआरके) से/को किए जाने वाले प्रत्यक्ष अथवा अप्रत्यक्ष आयात और निर्यात पर निषेध''

''निर्यात पर निषेधः-

(क) ''कोरिया लोक जनतांत्रिक गणराज्य (डीपीआरके) को निम्नलिखित मदों की प्रत्यक्ष अथवा अप्रत्यक्ष आपूर्ति, बिक्री, अंतरण अथवा निर्यात निषिद्ध किया जाता हैः-

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) कोई युद्ध टैंक, बख्तरबंद युद्ध वाहन, बड़़ी क्षमता की आर्टिलरी प्रणालियां, लडाकू विमान, आक्रमणकारी हेलीकाप्टर, युद्धपोत, मिसाइलें अथवा मिसाइल प्रणालियां जिन्हें संयुक्त राष्ट्र संघ के परंपरागत हथियारों अथवा स्पेयर पार्टस सहित संबंधित सामग्री संबंधी रजिस्टर के प्रयोजन हेतु परिभाषित किया गया है;

(ii) सभी हथियार और संबंधित सामग्री जिसमें छोटे हथियार और हल्के हथियार और उनकी संबंधित सामग्री शामिल है;

(iii) संयुक्त राष्ट्र सुरक्षा परिषद (यूएनएससी) और अंतरराष्ट्रीय परमाणु ऊर्जा अभिकरण (आईएईए) दस्तावेजों में यथा उल्लिखित सभी मदें, सामग्री, उपस्कर, वस्तुएं और प्रौद्योगिकी नामत : :-

1) एस/2006/853*;

2) एस/2006/853/सीओआरआर. 1;

3) एस/2009/364 का भाग (ख);

4) संकल्प 2094 (2013) का अनुलग्नक III;

5) एस/2016/1069;

6) आईएनएफसीआईआरसी/254/संशोधन 12/भाग-1 (आईएईए दस्तावेज) का अनुलग्नक क;

7) आईएनएफसीआईआरसी/254/संशोधन 9/भाग-2 (आईएईए दस्तावेज) का अनुलग्नक ;

8) एस/2014/253;

9) एस/2016/308;

10) संकल्प 2321(2016) का अनुलग्नक III; और

11) केन्द्र सरकार द्वारा यथा निर्धारित अन्य मदें, सामग्री, उपस्कर, माल और प्रौद्योगिकी जो कोरिया लोक जनतांत्रिक गणराज्य के परमाणु से जुडे़, बैलिस्टिक मिसाइल या सामूहिक विनाश के अन्य हथियारों से संबंधित कार्यक्रमों में योगदान देते हों;

(iv) संकल्प 2094(2013) के अनुलग्नक IV, संकल्प 2270 (2016) के अनुलग्नक IV और संकल्प 2321 (2016) के अनुलग्नक IV में विनिर्दिष्ट मदों सहित विलासिता संबंधी माल परंतु जो इन मदों तक सीमित नहीं हैं।

(v) खाद्य या दवा को छोडकर केन्द्र सरकार द्वारा यथा निर्धारित मदें जो कोरिया लोक जनतांत्रिक गणराज्य के अपने सशस्त्र बलों की प्रचालन संबंधी क्षमताओं के विकास में प्रत्यक्ष रुप से योगदान दे सके। यह उपाय संकल्प 2270 (2016) के पैरा 8(क) और (ख) में निर्धारित छूटों के अधीन है;

आयात पर निषेधः

(ख) उपर्युक्त उप-पैरा (क)(i), क(ii), क(iii) और क(v) में शामिल कोरिया लोक जनतांत्रिक गणराज्य से संबंधित मदें जिनका कोरिया जनतांत्रिक गणराज्य में उद्‌गम हो या न हो, का प्रत्यक्ष या अप्रत्यक्ष खरीद या आयात पर निषेध है।

क्षेत्रीय निषेध (निर्यात)ः

(ग) कोरिया लोक जनतांत्रिक गणराज्य को निम्नलिखित मदों की प्रत्यक्ष या अप्रत्यक्ष आपूर्ति, बिक्री, अंतरण या निर्यात पर निषेध हैः (i) समिति द्वारा प्रत्येक मामले के आधार पर अग्रिम में यथा अनुमोदित को छोड़कर नए हेलीकाप्टर और नये अथवा पुराने जलयान;

(ii) विमानन गैसोलीन सहित विमानन ईंधन, नाप्था प्रकार का जेट ईंधन, केरोसीन प्रकार का जेट ईंधन और केरोसीन प्रकार का रॉकेट ईंधन। यह उपाय संकल्प 2270 (2016) के पैराग्राफ 31 और संकल्प 2321 (2016) के पैराग्राफ 20 के प्रावधानों के अधीन है।

(iii) संघनन और प्रा—तिक गैस तरल;

(iv) परिष्—त पेट्रोलियम उत्पाद। यह उपाय संकल्प 2397 (2017) के पैरा 5 में निर्धारित सीमाओं, अपवादों और प्रक्रियाओं के अधीन है;

(v) कच्चा तेल। यह उपाय संकल्प 2397 (2017) के पैरा 4 में निर्धारित सीमाओं, छूटाें और प्रक्रियाओं के अधीन है;

(vi) सभी औद्योगिक मशीनरी [आईटीसी (एचएस) का अध्याय 84 और 85], परिवहन वाहन [आईटीसी (एचएस) का अध्याय 86 से 89 तक], और लोहा, इस्पात तथा अन्य धातु [आईटीसी (एचएस) के अध्याय 72 से 83 तक]। यह उपाय संकल्प 2397 (2017) के पैरा 7 में निर्धारित छूटों के अधीन है।

क्षेत्रीय निषेध (आयात)भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 3 (घ) कोरिया लोक जनतांत्रिक गणराज्य से निम्नलिखित मदों की प्रत्यक्ष या अप्रत्यक्ष खरीद या आयात प्रतिबंधित हैः

(i) कोयला, लोहा और लौह अयस्क। यह उपाय संकल्प 2371 (2017) के पैराग्राफ 8 में निर्धारित छूटों और प्रक्रियाओं के अधीन है;

(ii) सोना, टाइटेनियम अयस्क, वैनेडियम अयस्क और दुर्लभ मृदा-खनिज;

(iii) तांबा, निकल, चांदी और जस्ता;

(iv) मूर्तियां, जब तक कि समिति अग्रिम में मामला-दर-मामला आधार पर अनुमोदन न दे;

(v) समुद्री खाद्य पदार्थ, (मछली, क्रसटेशियंस, मोलस्क और सभी रुपों में अन्य जलीय अकशेरुकीय सहित)। यह उपाय संकल्प 2371 (2017) के पैराग्राफ 9 और संकल्प 2397 (2017) के पैराग्राफ 6 में निर्धारित छूटों, स्पष्टीकरणों और प्रक्रियाओं के अधीन है;

(vi) सीसा और सीसा अयस्क। यह उपाय संकल्प 2371 (2017) के पैराग्राफ 10 में निर्धारित छूट और प्रक्रियाओं के अधीन है;

(vii) वस्त्र (फैब्रिक्स और आंशिक रुप से या पूर्ण रुप से तैयार परिधान उत्पादों सहित लेकिन उन्हीं तक सीमित नहींं)।

यह उपाय संकल्प 2375 (2017) के पैराग्राफ 16 में निर्धारित छूट और प्रक्रियाओं के अधीन है;

(viii) खाद्य और —षि उत्पाद [आईटीसी (एचएस) का अध्याय 12,08,07], मशीनरी [आईटीसी (एचएस) का अध्याय 84], विद्युत उपकरण [आईटीसी (एचएस) का अध्याय 85], मैग्नेसाइट और मेग्नेसिया सहित मिट्टी और पत्थर [आईटीसी (एचएस) का अध्याय 25], लकड़ी [आईटीसी (एचएस) का अध्याय 44] और जलयान [आईटीसी (एचएस) का अध्याय 89]। ये उपाय संकल्प 2397 (2017) के पैराग्राफ 6 में निर्धारित प्रक्रियाओं के अधीन है।

व्याख्याः-

क) यूएनएससी का अर्थ संयुक्त राष्ट्र सुरक्षा परिषद है;

ख) आईएईए का अर्थ अंतराष्ट्रीय परमाणु ऊर्जा अभिकरण हैः ग) समिति का अर्थ संकल्प 1718 (2016) के पैराग्राफ 12 के अनुसार गठित यूएनएससी की समिति हैः और

घ) संकल्प, जैसा भी मामला हो, का अर्थ कोरिया लोक जनतांत्रिक गणराज्य पर संयुक्त राष्ट्र चार्टर के अध्याय VII के तहत यूएनएससी संकल्प, अर्थात्‌; 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2231 (2016), 2356 (2017), 2371 (2017) और 2375 (2017) और 2397 (2017) है।

3. अधिसूचना का प्रभावः-

इस अधिसूचना का उद्देश्य कोरिया लोक जनतांत्रिक गणराज्य पर संयुक्त राष्ट्र के चार्टर के अध्याय VII के तहत यूएनएससी संकल्प अर्थात, 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2094 (2013), 2270 (2016), 2231 (2016), 2356 (2017), 2371 (2017), 2375 (2017) और 2397 (2017) के कारण कोरिया लोक जनतांत्रिक गणराज्य से/को आयात और निर्यात के संबंध में विदेश व्यापार नीति 2015-20 के पैरा 2.17 को अद्‌यतन बनाना है।

NOTIFICATION

New Delhi, the 7th March, 2018

Subject : Amendment in Para 2.17 of the Foreign Trade Policy 2015-20 on "Prohibition on direct or

indirect import and export from/to DPRK (Democratic People's Republic of Korea) in terms

of UNSC resolutions concerning DPRK.

S.O. 1019(E).—In exercise of the powers conferred by Section 5 and Section 14A of the Foreign Trade (Development and Regulation) Act, 1992, as amended, read with Para 1.02 of the Foreign Trade Policy (FTP) 2015-20, the Central Government hereby makes amendment to the Paragraph 2.17 of FTP 2015-20 as4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] notified vide Notification No. 35/2015-20 dated 18th October 2017, with immediate effect. Consequently, the Appendix I of FTP 2015-20 also stands amended.

2. Paragraph 2.17 of the FTP 2015-20 stands substituted as under: (changes made are in bold letters, except bold letters used in Para heading and sub-headings).

"2.17 Prohibition on direct or indirect import and export from/to Democratic People's Republic of

Korea (DPRK)

"Prohibition on export:

(A) The direct or indirect supply, sale, transfer or export of the following items to Democratic People's Republic of Korea (DPRK) is prohibited:-

(i) any battle tanks, armoured combat vehicles, large calibre artillery systems, combat aircraft, attack helicopters, warships, missiles or missile systems as defined for the purpose of the United Nations Register on Conventional Arms, or related materiel including spare parts;

(ii) all arms and related materiel, including small arms and light weapons and their related materiel;

(iii) all items, materials, equipment, goods and technology as set out in the United Nations Security Council (UNSC) and International Atomic Energy Agency (IAEA) documents, namely, 1. S/2006/853*;

2. S/2006/853/Corr.1;

3. Part B of S/2009/364;

4. Annex III of Resolution 2094 (2013);

5. S/2016/1069;

6. Annex A to INFCIRC/254/Rev.12/Part1 (IAEA document);

7. Annex to INFCIRC/254/Rev.9/Part2 (IAEA document);

8. S/2014/253;

9. S/2016/308;

10. Annex III of Resolution 2321 (2016); and

11. other items, materials, equipment, goods and technology, as determined by the Central Government, which could contribute to DPRK's nuclear related, ballistic missile-related or other weapons of mass destruction related programmes;

(iv) luxury goods, including, but not limited to, the items specified in Annex IV of Resolution 2094 (2013), Annex IV of Resolution 2270 (2016) and Annex IV of Resolution 2321 (2016); (v) items as determined by the Central Government, except food or medicine, that could directly contribute to the development of the Democratic People's Republic of Korea's operational capabilities of its armed forces. This measure is subject to the exemptions set out in paragraph 8 (a) and (b) of Resolution 2270 (2016);

Prohibition on import

(B) The direct or indirect procurement or import from DPRK, of items, whether or not originating in DPRK, covered in sub-paragraphs (A)(i), (A)(ii), (A)(iii) and (A)(v) above is prohibited.

Sectoral prohibitions (export)

(C) The direct or indirect supply, sale, transfer or export of the following items to DPRK is prohibited:

(i) new helicopters and new or used vessels, except as approved in advance by the Committee on a case-by-case basis;

(ii) aviation fuel, including aviation gasoline, naptha-type jet fuel, kerosene-type jet fuel, and kerosene-type rocket fuel. This measure is subject to the provisions of paragraph 31 of Resolution 2270 (2016) and paragraph 20 of Resolution of 2321 (2016);

(iii) condensates and natural gas liquids;

(iv) refined petroleum products. This measure is subject to the limits, exceptions and procedures set out in paragraph 5 of Resolution 2397 (2017);

(v) crude oil. This measure is subject to the limits, exemptions and procedures set out in paragraph 4 of Resolution 2397 (2017);

(vi) all industrial machinery [Chapter 84 and 85 of ITC(HS)], transportation vehicles

[Chapter 86 to 89 of ITC(HS)], and iron, steel, and other metals [Chapter 72 to 83 of

ITC(HS)]. This measure is subject to the exemptions set out in paragraph 7 of Resolution

2397 (2017);

Sectoral prohibitions (import)

(D) The direct or indirect procurement or import from DPRK, of the following items is prohibited:

(i) coal, iron and iron ore. This measure is subject to the exemptions and procedures set out in paragraph 8 of Resolution 2371 (2017);

(ii) gold, titanium ore, vanadium ore, and rare earth minerals;

(iii) copper, nickel, silver and zinc;

(iv) statues, unless the Committee approves on a case-by-case basis in advance;

(v) seafood (including fish, crustaceans, mollusks, and other aquatic invertebrates in all forms). This measure is subject to the exemptions, clarifications and procedures set out in paragraph 9 of Resolution 2371 (2017) and paragraph 6 of Resolution 2397 (2017);

(vi) lead and lead ore. This measure is subject to the exemptions and procedures set out in paragraph 10 of Resolution 2371 (2017);

(vii) textiles (including but not limited to fabrics and partially or fully completed apparel products). This measure is subject to the exemptions and procedures set out in paragraph 16 of Resolution 2375 (2017);

(viii) food and agricultural products [Chapters 12, 08, 07 of ITC(HS)], machinery [Chapter

84 of ITC(HS)], electrical equipment [Chapter 85 of ITC(HS)], earth and stone including

magnesite and magnesia [Chapter 25 of ITC(HS)], wood [Chapter 44 of ITC(HS)], and

vessels [Chapter 89 of ITC(HS)]. These measures are subject to the procedures set out in

paragraph 6 of Resolution 2397(2017).

Explanation.-

a) UNSC means the United Nations Security Council;

b) IAEA means the International Atomic Energy Agency;

c) Committee means the Committee of the UNSC set up in terms of paragraph 12 of Resolution 1718 (2006);

d) Resolution, as the case may be, means the UNSC Resolutions under Chapter VII of the Charter of the United Nations on Democratic People's Republic of Korea, namely, 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2231 (2016), 2356 (2017), 2371 (2017), 2375 (2017) and 2397(2017)".

3. Effect of the Notification

This Notification seeks to update the Para 2.17 of the Foreign Trade Policy 2015-20, on imports and exports to Democratic People's Republic of Korea (DPRK), to account for UNSC Resolutions under Chapter VII of the Charter of the United Nations on Democratic People's Republic of Korea, namely, 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2231 (2016), 2356 (2017), 2371 (2017), 2375 (2017) and 2397(2017).
