का.आ. का.आ. का.आ. का.आ. 1024102410241024(अ).(अ).(अ).(अ).————कें (cid:12)ीय सरकार, स्थायी सलाहकार समिति की सिफारिशों पर विचार करते (cid:30)ए, जूट पैके ज साम"ी (वस्तु पै%कं ग अनिवार्य प्रयोग) अधिनियम, 1987 (1987 का 10) धारा 3 की उपधारा (1) के अधीन ऐसी वस्तुओं अथवा वस्तुओं की 1ेणी अथवा उसका कु छ प्रतिशत आदेश में विनि5र्दष्ट किए गए अनुसार उन पटसन पैके जिंग साम"ी में आपू:र्त अथवा वितरण किए जाने के प्रयोजन से पैक किए जाने के लिए विनि5र्दष्ट करने के लिए सशक्त है;
और कें (cid:12)ीय सरकार ने उक्त अधिनियम की धारा 4 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:30)ए पटसन साम"ी में पैके जिंग के मानदंडों की सिफारिश करने के लिए का.आ. संख्यांक 255(अ), तारीख 27 जनवरी, 2016 द्वारा स्थायी सलाहकार समिति का गठन कर दिया है;
और कें (cid:12)ीय सरकार, स्थायी सलाहकार समिति द्वारा की गई सिफारिशों पर विचार करने के पश्चात् इस बात से संतुष्ट है कि पटसन पै%कं ग साम"ी में पैक किए जाने के लिए वस्तुओं अथवा वस्तुओं की 1ेणियों अथवा उसके कु छ प्रतिशत को विनि5र्दष्ट करना, कGचे पटसन और पटसन पैके जिंग साम"ी के उत्पादन और इनके उत्पादन में लगे (cid:30)ए Iयक्तियों के हित में अनिवार्य है;
अत: अब कें (cid:12)ीय सरकार, जूट पैके ज साम"ी (वस्तु पै%कं ग अनिवार्य प्रयोग) अधिनियम, 1987 की धारा 16 की उपधारा (1) के साथ पठित धारा 3 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोगकरते (cid:30)ए और भारत के राजपत्र,,,, असाधारण,,,, भाग II, , , , खंड 3, , , , उपखंड (ii), तारीख 14 जनवरी,,,, 2016 में प्रकाशित का.आ.

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] संख्यांक 126(अ) को उन बातों के सिवाय अधिPांत करते (cid:30)ए जिन्हें ऐसे अधिPमण से पूर्व किया गया है या करने का लोप किया गया है,,,, यह निदेश देती है कि नीचे दी गई अनुसूची के स्तंभ (2) में विनि5र्दष्ट वस्तुएं उक्त अनुसूची के स्तंभ (3) की तत्स्थानी प्रविष्टियों में यथाविनि5र्दष्ट ऐसे न्यूनतम प्रतिशत में आपू:र्त और वितरण के लिए इस अधिसूचना के राजपत्र के प्रकाशन की तारीख से 30 जून,,,, 2018 तक पटसन पै%कं ग साम"ी में पैक की जाएगी,,,, अर्थात्:-

पटसन थैलों के लिए संपूर्ण अपेक्षा के लिए मांग पत्र एकल अध्यपेक्षा में किया जाएगा और यदि पटसन मिलें अध्यपेक्षा के अनुसार पटसन के थैले प्रदान करने में समर्थ नह] है, तब खाद्य और लोक वितरण विभाग पैके जिंग साम"ी का 10 प्रतिशत तक क्षीणीकरण अनु^ात कर सके गा ।
2. पटसन पैके जिंग साम"ी की आपू:र्त की किसी कमी या लोप की दशा में अथवा कोई अन्य आकस्मिकता या अत्यावश्यकता की दशा में, वस्त्र मंत्रालय संब' उपयोगकर्ता मंत्रालय के साथ परामर्श करके , उपरोक्त अनुसूची के स्तंभ (3) में विनि5र्दष्ट प्रतिशत के अधिकतम 30 प्रतिशत तक पैके जिंग साम"ी के और क्षीणीकरण को अनु^ात कर सके गा ।
3. पटसन पैके जिंग साम"ी के आवश्यक उपयोग से निम्नलिखित मामलों में छू ट प्रदान की जा सके गी, अर्थात् :-
(क) निर्यात के लिए पैक की गई चीनी जो खाद्य और लोक वितरण विभाग द्वारा किए गए निर्धारण और सिफारिशों के आधार पर निर्यात नह] की जा सकी थी;
(ख) विटामिन से पुष्ट चीनी;
(ग) निर्यात की जाने वाली वस्तुओं की पै%कं ग ;
(घ) खाद्यान्नों के लिए 10 कि."ा. और उससे कम और चीनी के लिए 25 कि."ा. और उससे कम के छोटे उपभोक्ता पैके ज;
(ड.) 100 कि."ा. से अधिक थोक पै%कं ग;और
(च) 10 कि. "ा. से अधिक मात्रा के उपभोक्ता एचडीपीई/पीपी पैके ट और राष्ट्रीय खा़द्य सुरक्षा अधिनियम, 2013 (2013 का 20) के अधीन िवतरण के िलए 25 कि."ा. तक खाद्यान्नों की पै%कं ग, परंतु खाद्यान्नों की पै%कं ग के लिए भारत सरकार द्वारा उपबंधित सहायिकी या प्रतिपू:र्त के अधीन नि:र्मत पटसन थैलों की तुलना में ऐसे थैले लागत प्रतिस्पर्धी हो ।

ORDER
New Delhi, the 9th March, 2018
S.O. 1024(E).—Whereas, the Central Government under sub-section (1) of section 3 of the Jute Packaging Materials (Compulsory Use in Packing Commodities) Act, 1987 (10 of 1987) (hereinafter referred to as the said Act) is empowered to specify the commodities or class of commodities or such percentage thereof to be packed for the purpose of its supply or distribution in such jute packaging material as may be specified in the order, considering the recommendations of the Standing Advisory Committee;
And, whereas, the Central Government, in exercise of powers conferred under sub-section (1) of section 4 of the said Act, has constituted the Standing Advisory Committee vide number S.O. 255(E), dated the 27th January, 2016, to recommend the norms of packaging in jute material;
And, whereas, the Central Government, after considering the recommendations made to it by the Standing Advisory Committee, is satisfied that it is necessary in the interest of production of raw jute and jute packaging material, and of persons engaged in the production thereof, to specify the commodity or class of commodities and percentage thereof to be packed in jute packaging material.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with sub- section (1) of section 16 of the Jute Packaging Materials (Compulsory Use in Packaging Commodities) Act, 1987 and in supersession of order number S.O. 126(E), published in the Gazette of India, Extraordinary, Part II, section 3, Sub-section (ii), dated the 14th January, 2016, except as respect to things done or omitted to be done before such supersession, the Central Government hereby directs that the commodities specified in column (2) of the Schedule below, shall be packed in jute packaging material for supply or distribution, in such minimum percentage as specified in corresponding entries in column (3) of the said Schedule, with effect from the date of publication of this notification in the Official Gazette, up to 30th June, 2018, namely:-

* The indent for the whole requirement shall be placed for jute bags in a single requisition and in case jute mills are not able to provide jute bags as per requisition, then the Department of Food and Public Distribution may allow dilution of the packaging material upto ten per cent.
2. In case of any shortage or disruption in supply of jute packaging material or in case of any other contingency or exigency, the Ministry of Textiles may, in consultation with the user Ministries concerned, allow further dilution of packaging material up to a maximum of thirty per cent of the percentage specified in column (3) of the Schedule above.
3. Exemption from compulsory use of jute packaging material may be allowed in the following cases, namely:-
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]a) sugar packed for export but which could not be exported on the basis of an assessment and recommendation by Department of Food and Public Distribution;
b) sugar fortified with vitamins;
c) packaging for export of the commodities;
d) small consumer packages of ten kilograms and below for foodgrains and twenty-five kilograms and below for sugar;
e) bulk packaging of more than one hundred kilograms; and
f) consumer HDPE/PP packages of quantity of above ten kilograms and upto twenty-five kilograms for packing of foodgrains for distribution under the National Food Security Act, 2013 (20 of 2013) provided such bags are cost competitive as compared to jute bags factoring in the subsidy or reimbursement provided by the Government of India for packing of foodgrains.
