सं.सं.सं.सं. बीईई/एस और एल/टीएफएल/63/2017बीईई/एस और एल/टीएफएल/63/2017बीईई/एस और एल/टीएफएल/63/2017बीईई/एस और एल/टीएफएल/63/2017----18181818....———— ऊर्जा संरक्षण अधिनियम, 2001 (2001का 52) की धारा 58 की उपधारा (1) के अधीन यथाअपेक्षित ऊर्जा दक्षता ब्यूरो (%ूबलर फलोरेंस के लेबलों पर उनके संप्रदर्शन की विशिष्टियां और रीित) िविनयम, 2017 का प्ररूप नियम विनियम ऐसे सभी 1यक्तियों से जिनके उससे प्रभावित होने की संभावना थी, उस तारीख से पैंतालीस दिन की अवधि के भीतर जिसको उक्त अधिसूचना में अंत7र्वष्ट राजपत्र की प्रतियां जनता को उपलब्ध कर दी गई थ<;

उक्त राजपत्र की प्रतियां 5 अक्तूबर, 2017 को जनता को उपलब्ध करा दी गई थ<;

उक्त पूव=क्त अवधि के भीतर उक्त प्ररूप विनियम के संबंध में जनता से प्राप्त आक्षेप या सुझाव प्राप्त नह< Bए हैं;

अत: अब, उक्त अधिनियम की धारा 58 की उपधारा (2) के खंड (1) और उक्त धारा 13 की उपधारा (2) के खंड (ढ़) के साथ पठित उक्त धारा 14 के खंड (घ) द्वारा प्रदत्त शक्त्यिों का प्रयोग करते Bए और ऊर्जा दक्षता ब्यूरो (%ूबलर Lलोरेसेंट के लेबलों पर उनके संप्रदर्शन की विशिष्टियां और रीति) विनियम, 2009 को उन बातों के सिवाए अधिPांत करते Bए जिन्हें अधिPमण से पहले किया गया है या करने का लोप किया गया है, के न्Sीय सरकार के पूर्व अनुमोदन से एतTारा निम्निलिखत िविनयम बनाती है, अर्थात् :-

1. संक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभ.- (1) इन विनियमों का संक्षिप्त नाम ऊर्जा दक्षता (टुबुलर Lलोरेंस लैम्पों के लेबलों पर उनके संप्रदर्शन की विशिष्टियां और रीति) विनियम, 2018 है ।

(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएंपरिभाषाएंपरिभाषाएंपरिभाषाएं.- (1) इन विनियमों जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,

(क) "अिधिनयम " से ऊर्जा संरक्षण अधिनियम, 2001 (2001 का 52) अभिप्रेत है ;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ख) "ब्यूरों" से अधिनियम की धारा (3) की उपधारा (1) के अधीन स्थापित ऊर्जा दक्षता ब्यूरो अभिप्रेत है ;

(ग) "प्ररूप" से इन विनियमों से संलb प्ररूप अभिप्रेत है ;

(घ) "लेबल" से टुबुलर Lलोरेंस लैम्प पर लिखा गया, मुSित, चिन्हांकित, स्टाम्पित या उस पर चिपकाया गया या उपद7र्शत चित्रित विषय वस्तु अभिप्रेत है ;

(ङ) "लेबल अविध" से अधिनियम की धारा 14 के खंड (क) के अधीन के न्Sीय सरकार द्वारा अधिसूचित ऊर्जा खपत मानक के अधीन द्युतिमान (ल्यूमिनस) दक्षता की विधिमान्य अवधि अभिप्रेत है ;

परंतु यदि यदि ल्यूमिनस अवधि की विधिमान्यता अवधि की समाप्ति को अधिसूचित नह< किया जाता है तो उसे तब तक विधिमान्य समझा जाएगा जब तक के न्Sीय सरकार द्वारा उसके नए मूल्य अधिसूचित न कर दिए जाएं ।

(च) "माडल या माडलों के वर्ग" से किसी विशिष्ट ब्रांड के उत्पाद या उत्पादों के gेणी अभिप्रेत है जिसके परीक्षण रिपोर्ट का एकल सेट लागू होता है और जहां उत्पादों में से प्रत्येक उत्पाद का मौलिक स्वiप ल्यूमिनस दक्षता, स्टार रेjटंग स्तर और सम्पादन स्वरूप समान होता है ;

(छ) "अनुkापित lक्ति" से ऐसा lक्ति या अभिकरण अभिप्रेत है जिसे विनियम 7 के अधीन लेबल िचपकाने की अनुkा दी गई है ;

(ज) "अनुसूची" से इन विनियमों से संलb अनुसूची अभिप्रेत है ;

(झ) "स्टार रेjटंग या स्टार लेवल'' से अधिनियम के अधीन के न्Sीय सरकार द्वारा अधिसूचित ऊर्जा खपत मानक पर आधारित टुबुलर Lलोरेंस लैम्प के लेबल पर संप्रद7र्शत ऊर्जा दक्षता का nेड अभिप्रेत है ;

(ञ) टुबुलर Lलोरेंस लैम्प पर लगाए किसी लेबल के संबंध में ''lापारी या विPे ता'' से ऐसा lक्ति अभिप्रेत है जो ऐसी टुबुलर Lलोरेंस लैम्प का विPय या वितरण करता है और इसके अन्तर्गत ऐसा दुकानदार, lापारी, विनिर्माता और अनुkापित lकित भी है जिसे ऐसा टुबुलर Lलोरेंस लैम्प पर लेबल लगाने की अनुkा दी गई है ;

(ट) "टुबुलर Lलोरेंस लैम्प" से अधिनियम के अधीन के न्Sीय सरकार द्वारा अधिसूचित कोई साधित्र अभिप्रेत है ;

(2) उन शब्दों और पदों के , जो इसमें प्रयुक्त हैं और परिभाषित नह< है oकं तु अधिनियम में परिभाषित हैं, वही अर्थ होंगे जो Pमशः उनके अधिनियम में हैं ।

3. 3. 3. 3. लेबल पर संप्रद(cid:30)र्शत की जाने वाली विशिष्टियांलेबल पर संप्रद(cid:30)र्शत की जाने वाली विशिष्टियांलेबल पर संप्रद(cid:30)र्शत की जाने वाली विशिष्टियांलेबल पर संप्रद(cid:30)र्शत की जाने वाली विशिष्टियां....---- (1) प्रत्येक टुबुलर Lलोरेंस लैम्प में, उसके लेबल पर निम्नलिखित विशिष्टियां संप्रद7र्शत होंगी, अर्थात् :-

(क) ऊर्जा दक्षता ब्यूरो का लोगो ;

(ख) विनिर्माता या आयातकर्ता या ब्रांड का नाम ;

(ग) टुबुलर Lलोरेंस लैम्प का आकार और रंग तापमान ;

(घ) lापार नाम और संख्या ;

(ड.) मॉडल और विनिर्माण या आयात का वर्ष ;

(च) विशिष्ट gेणी कोड ;

(छ) वाट में विद्युत शक्ति की खपत ;

(ज) टुबुलर Lलोरेंस लैम्प का स्टार लेवल;

(झ) 1 एम डब्लयू में ल्युमनस दक्षता ;

(ञ) लेबल अविध ;

(2) लेबल का डिजायन, रंग, आकार और विशिष्टियां इन विनियमों से संलb अनुसूची में यथाविनिvर्दष्ट होंगी ।

4. लेबल के संप्रदर्शन के लिए समयसीमालेबल के संप्रदर्शन के लिए समयसीमालेबल के संप्रदर्शन के लिए समयसीमालेबल के संप्रदर्शन के लिए समयसीमा---- (1) प्रत्येक टुबुलर Lलोरेंस लैम्प पर विनियम 3 में विनिvर्दष्ट सभी विशिष्टियों वाले लेबल को, इन विनियमों के प्रवृत्त होने की तारीख से छह मास की अवधि के भीतर संप्रद7र्शत किया जाएगा ।

(2) के न्Sीय सरकार द्वारा अधिसूचित पुनरीक्षित ऊर्जा खपत मानकों के प्रारम्भ की तारीख से ही प्रत्येक अनुkापित lक्ति या lापारी या विPे ता यह सुनिwित करेगा कि –

(क) विPय के लिए रखे गए टुबुलर Lलोरेंस लैम्प के बाहरी आवरण पर पुनरीक्षित स्टार लैंप पर पुनरीक्षित ऊर्जा खपत मानकों को समसमाहित करते Bए पुनरीक्षित स्तर लेबल और पुनरीक्षित लेबल अवधि संप्रद7र्शत की जाएगी और ऐसे पुनरीक्षित ऊर्जा खपत मानकों के साथ टुबुलर Lलोरेंस लैम्प का विनिर्माण वर्ष भी समसमाहित हो और पूर्ववर्ती ऊर्जा खपत मानकों के साथ टुबुलर Lलोरेंस लैम्प तैयार नह< किया जाएगा ।

(ख) इन विनियमों के अधीन lौहारियों, खुदरा विPे ताओं और उपभोक्ताओं को जागiक बनाने, उन्हें शिक्षित करने के लिए प्रचार सहित सभी प्रारम्भिक उपाय, प्रारंभ होने की तारीख से छह मास पहले किए जाएंगे ।

5. लेबल के संप्रदर्शन की रीतिलेबल के संप्रदर्शन की रीतिलेबल के संप्रदर्शन की रीतिलेबल के संप्रदर्शन की रीति....---- (1) टुबुलर Lलोरेंस लैम्प पर एक लेबल लगा होगा जिसे विPय के स्थान पर लगाया जाएगा और ऐसे लेबल को निम्नलिखित रीित से टुबुलर Lलोरेंस लैम्प पर चिपकाया जाएगा, अर्थात् :-

(क) रंग योजना के साथ लेबल की फोटो 16 मिलीमीटर की उं चाई तक छोटा करके नली पर मुSित की जाएगी ;

(ख) प्रत्येक विनिर्माता और आयातकर्ता नली पर रंग का तापमान द7र्शत करेगा ;

(ग) टुबुलर Lलोरेंस लैम्प पर रेjटंग के अनुसार स्टार मा{क| ग की जाएगी, स्टार मा{क| ग के लिए स्टाम्प का आकार 14.5 िमलीमीटर ऊं चा x 8.5 मिलीमीटर चौड़ा होगा और एक पृथक स्तंभ में स्टाम्पित किया जाएगा ।

6. लेबल के संप्रदर्शन के लिए अनु'ालेबल के संप्रदर्शन के लिए अनु'ालेबल के संप्रदर्शन के लिए अनु'ालेबल के संप्रदर्शन के लिए अनु'ा- (1) ब्यूरो की पूर्व अनुkा के सिवाय टुबुलर Lलोरेंस लैम्प पर कोई स्टार लेबल नह< िचपकाया जाएगा ।

(2) उप विनियम (1) के अधीन ब्यूरो की अनुkा अभिप्राप्त करने के प्रयोजनों के लिए अनुkापित lक्ति प्रत्येक ब्रांड के लिए स्वयं को एक लाख iपए की लेबल प्रतिपू7र्त फीस के साथ, जो ऊर्जा दक्षता ब्यूरो, नई दिल्ली के पक्ष में आहरित मांगदेय ~ाLट द्वारा या संदाय के किसी अन्य स्वीकार्य इलैक्ट्रानिक रीति में संदेय होगी, पृथक iप से रजिस्ट्रीकृ त करवाएगा:

परंतु लघु उद्योग के लिए लेबल प्रतिभूति फीस प(cid:128)ीस हजार iपए होगी;

(3) उपविनियम (2) के अधीन रजिस्ट्रीकरण के लिए प्रत्येक आवेदन के साथ निम्नलिखित संलb होंगे

(क) प्रति माडल दो हजार iपए आवेदन फीस, जो ऊर्जा दक्षता ब्यूरो, नई दिल्ली के पक्ष में आहरित मांगदेय ~ाLट द्वारा या संदाय के किसी अन्य स्वीकार्य इलैक्ट्रानिक्स रीति द्वारा संदेय होगी ।

(ख) प्रiप 1 में विनिvर्दष्ट दस्तावेज ।

7. अनु'ा का दिया जाना और नवीकरण अनु'ा का दिया जाना और नवीकरण अनु'ा का दिया जाना और नवीकरण अनु'ा का दिया जाना और नवीकरण – (1) ब्यूरो, विनियम 6 के अधीन आवेदन प्राप्त होने और यह समाधान हो जाने पर कि इसमें सभी अपेक्षाओं का पालन किया गया है, ऐसी प्राप्ति की तारीख से एक मास की अवधि के भीतर, ऐसे निबन्धों और शत(cid:129) के अधीन रहते Bए, जो विनियम 8 में विनिvर्दष्ट किए जाएं, में टुबुलर Lलोरेंस लैम्प पर प्रiप 2 में या इलैक्ट्रानिक प्रiप में लेबल लगाने की अनुkा दे सके गा।

(2) ब्यूरो, प्रiप 3 में अनुkापित lक्ति का नाम और विशिष्टियां प्रविष्ट करेगा।

(3) उपविनियम (1) के अधीन इस प्रकार दी गई अनुkा ऐसी अवधि के लिए विधिमान्य होगी जिसके लिए के न्Sीय सरकार द्वारा यथा अधिसूचित ऊर्जा खपत मानक द्वारा विनिvर्दष्ट स्टार लेबल प्रवृत्त है।

(4) अनुkापित lक्ति अनुkा के नवीकरण के लिए छह पूर्व मास oकं तु उसके समाप्त होने के पूर्व तीन मास के अपwात् आवेदन करेगा और उसके साथ एक हजार iपए फीस संलb होगी जो ऊर्जा दक्षता ब्यूरो, नई दिल्ली के पक्ष में आहरित मांगदेय ~ाLट के रूप में या इलैक्ट्रानिक रीति से संदेय होगी।

(5) उपविनियम (4) के अधीन नवीकरण के लिए आवेदन प्राप्त होने पर, यह समाधान हो जाने के पwात् कि सभी अपेक्षाओं का पालन कर दिया गया है, ऐसी प्राप्ति की तारीख से एक मास की अवधि के भीतर प्रiप 2 में अनुkा का नवीकरण किया जाएगा।

(6) विधिमान्य अवधि की समाप्ति के पwात् नवीकरण के लिए किया गया कोई आवेदन नामंजूर कर दिया जाएगा और अनुkापित lक्ति अनुkा के िलए नए िसरे से आवेदन कर सके गा।

(7) ऐसा अनुkापित lक्ति, जो उस तारीख से जिससे पुनरीक्षित स्टार लेवल प्रवृत्त होते हैं, टुबुलर Lलोरेंस लैम्प के विद्यमान माडल पर लेबल लगाने की अनुkा जारी रखने की ईप्सा करता है, प्रiप 4 में एक घोषणा प्रस्तुत करेगा।

(8) पुनरीक्षित स्टार लेवल के समसमायिक टुबुलर Lलोरेंस लैम्प का नया मॉडल प्रारम्भ करने की योजना है तो अनुkापित lक्ति नए सिरे से लेबल लगाने की अनुkा की ईप्सा करेगा और ऐसी अनुkा के लिए आवेदन, पुनरीक्षित स्टार लेवल के प्रवृत्त होने के छह मास पूर्व किया जाएगा।

लेबल पर विशिष्टियों के संप्रदर्शन के निबन्धन और शत-.- प्रत्येक अनुkापित lक्ति, lापारी और विPे ता,- 8. लेबल पर विशिष्टियों के संप्रदर्शन के निबन्धन और शत- लेबल पर विशिष्टियों के संप्रदर्शन के निबन्धन और शत- लेबल पर विशिष्टियों के संप्रदर्शन के निबन्धन और शत-

(क) के न्Sीय सरकार द्वारा अधिसूचित टुबुलर Lलोरेंस लैम्प के लिए ऊर्जा खपत मानकों का पालन करेगा;

(ख) के वल ऐसे टुबुलर Lलोरेंस लैम्प के माडल पर लेबल लगाया जाएगा जिन्हें अनुkा दी गई है ;

(ग) टुबुलर Lलोरेंस लैम्प पर लेबल अनुkापित lक्ति के खच(cid:130) पर लगाया जाएगा;

(घ) यह सुनिशचित करेगा कि टुबुलर Lलोरेंस लैम्प के लेबल पर

संप्रद7र्शत स्टार लेवल को सभी समय पर बनाए रखा जाएगा ;

(ङ) विनियम 9 में यधा विनिvर्दष्ट लेबल फीस का संदाय करेगा;

(च) ब्यूरो को लेबलीकृ त उपस्कर के उत्पादन के ब्यौरे और वित्तीय वर्ष के प्रत्येक तिमाही के लिए देय लेबल लगाने के लिए प्रो(cid:131)भूत फीस अंत्त7र्वष्ट करके एक विवरण देगा ;

(छ) ब्यूरो को प्रत्येक वर्ष की 30 अप्रैल तक उसके लेबल लगे उत्पादों के विPय के लिए नियुक्त प्राधिकृ त वितरकों, lौहारी, खुदरा विPे ताओं, विPे ताओं की अद्यतन सूची देगा;

(ज) ऐसे अन्य निबन्धनो और शत(cid:129) का पालन करेगा जो विनvर्दष्ट किए जाए जिसके अंतर्गत वे भी हैं जो मानक और लेबल लगाने संबंधी ब्यूरो प्रचालन मैनुअल में अंत7र्वष्ट है ।

9. लेबल फीसलेबल फीसलेबल फीसलेबल फीस .-(1) प्रत्येक अनुkापित lक्ति, ब्यूरो को टुबुलर Lलोरेंस लैम्प पर लगाए गए प्रत्येक लेबल के लिए पांच पैसा लेबल फीस का संदाय करेगा ।

(2) उप-नियम (1) के अधीन विनिvर्दष्ट लेबल फीस, प्रत्येक वित्तीय वर्ष की समाप्ति की तारीख से एक मास के भीतर वा7र्षक iप से संदत्त की जाएगी ।

(3) यदि अनुkाप्राप्त lक्ति, इस प्रकार विनिvर्दष्ट अवधि के भीतर लेबल फीस का संदाय करने में असफल रहता है तो ब्यूरो, िविनयम 6 के उपविनियम (2) के खंड (ख) के अधीन दी गई लेबल सुरक्षा फीस से ऐसी शोध्य रकम को उस पर प्रतिवर्ष दस प्रतिशत ब्याज के साथ वसूल कर सके गा और यदि प्रस्तुत किए जाने की अंतिम तारीख से एक वर्ष के भीतर संपूर्ण लेबल फीस की वसूली नह< होती है तो ब्यूरो अनुkापित lक्ति को दिया गया लेबल रद्द कर सके गा और समाचारपत्रों में उसका नाम lतिPमी के रूप में प्रकाशित करवा सके गा ।

10.10.10.10. लेबल प्रतिभूति फीस का प्रतिदायलेबल प्रतिभूति फीस का प्रतिदायलेबल प्रतिभूति फीस का प्रतिदायलेबल प्रतिभूति फीस का प्रतिदाय.- िविनयम 9 के उप-विनियम (2) और उपविनियम (3) के उपबंधों के अधीन रहते Bए अनुkापित lक्ति टुबुलर Lलोरेंस लैम्प का विनिर्माण समाप्त हेने पर लेबल सुरक्षा फीस के प्रतिदाय का हकदार होगा ।

11.11.11.11. ब्यूरो द्वारा सत्याब्यूरो द्वारा सत्याब्यूरो द्वारा सत्याब्यूरो द्वारा सत्यापनपनपनपन.-(1) ब्यूरो या उसका अभिहित अभिकरण स्वप्रेरणा से या उसके द्वारा प्राप्त शिकायत पर यह सुनिwित करने के लिए सत्यापन कर सके गा कि टुबुलर Lलोरेंस लैम्प उसके लेबल पर संप्रद7र्शत स्टार लेवल के और अन्य विशिष्टियों के अनुiप है या नह< और उसमें अनुkा के अन्य निबन्धों और शत(cid:129) का पालन किया गया है या नह< ।

(2) सत्यापन के प्रयोजनों के लिए ब्यूरो या उसका अभिहित अभिकरण विनिर्माण सुविधा के न्S, भाडागार या खुदरा बाजार से जैसा वह ठीक समझे, यादृष्छिक iप में नमूने ले सके गा,

(3) जहां उपिनयम (1) के अधीन कोई िशकायत प्राप्त होने पर ब्यूरो, टुबुलर Lलोरेंस लैम्प का परीक्षण के लिए राष्ट्रीय प्रत्यायन बोर्ड द्वारा सम्यक् iप से प्रत्यायित किसी स्वतंत्र प्रयोगशाला में और अंशाकन प्रयोगशालाओं में चुनौती पूर्ण परीक्षा की अपेक्षा करता है वहां.-

(क) ब्यूरो अनुkापित lक्ति को ऐसी परीक्षा कराए जाने के लिए सूचना देगा और शिकायतकर्ता को, ऐसे समय के भीतर, जो ब्यूरो द्वारा अवधारित किया जाए, ब्यूरो के पास परीक्षण, परिवहन से संबंधित ऐसे lय अन्य अनुषंगिक lय जमा करने को कहा जाएगा;

(ख) यदि चुनौतीपूर्ण प्रPिया के अधीन लिए गए नमूने असफल हो जातें हैं तो अनुkाप्राप्त lक्ति नमूने के परिवहन की लागत और अन्य परीक्षण प्रभारों के मद्दे सभी lयों की ब्यूरो को प्रतिपू7र्त करेगा और ब्यूरो पूव=क्त रकम शिकायतकर्ता को पूव=क्त lयों का प्रतिदाय करेगा ; और

(ग) जहां उपस्करों की चुनौतीपूर्ण परीक्षा की गई है वहां शिकायतकर्ता द्वारा जमा किए गए lयों का समपहरण हो जाएगा ।

(4) जहां, उपविनियम (1) के अधीन प्राप्त किसी शिकायत पर, यदि अनुkापित lक्ति, ऐसे समय के भीतर उपिविनयम (3) में निvर्दष्ट ऐसे lय जमा करने में असफल रहता है तो ब्यूरो उप विनियम (3) में निvर्दष्ट टुबुलर Lलोरेंस लैम्प की चुनौतीपूर्ण परीक्षा द्वारा सत्यापन जारी रखेगा और विनियम 6 के अधीन प्राप्त आवेदन के प्रगमन में, ऐसे lय जमा किए जाने तक प्रास्थगन रखेगा।

(5) परीक्षा के लिए उपयोग किया गया टुबुलर Lलोरेंस लैम्प का नमूना स्वप्रेरणा से परीक्षा के दौरान की गई परीक्षा या चुनौतीपूर्ण परीक्षा में असफल हो जाता है वहां ब्यूरो अनुkापित lक्ति को एक और अवसर प्रदान करेगा और ब्यूरो अनुkापित lक्ति की लागत पर परीक्षा और अशांकन के लिए राष्ट्रीय प्रत्याययन बोर्ड द्वारा सम्यक् iप से प्रत्यायित किसी स्वतंत्र परीक्षा प्रयोगशाला में टुबुलर Lलोरेंस लैम्प के पहले परीक्षण नमूनों की दुगनी मात्रा सहित दूसरा परीक्षण करवाएगा।

(6) जहां दूसरी परीक्षा असफल हो जाती है वहां ब्यूरो –

(क) प्ररूप 5 में अनुkापित lक्ति को, सभी राज्य अभिहीत अभिकरणों को सूचना के अधीन यह निदेश देगा कि अनुkापित lक्ति, दो मास की अवधि के भीतर,-

(i) टुबुलर Lलोरेंस लैम्प के ऊपर चिपकाए गए लेबल पर संप्रद7र्शत स्टार लेवल को सही करे या परीक्षा के दौरान पाई गई त्रुटियों और कमियों को दूर करे;

(ii) ब्यूरो के निदेशों का पालन करने के लिए बाजार से पूरा स्टाक वापस ले ; और

(iii) विkापन सामnी पर संप्रद7र्शत विशिष्टियों में परिवर्तन करे;

(ख) किसी राष्ट्रीय या प्रादेशिक दैनिक समाचरपत्र में और किसी इलैक्ट्रानिक साधनों में या किसी अन्य रीति में, जो वह ठीक समझे, दो मास के भीतर अनुkापित lक्ति का नाम, ब्रांड का नाम, माडल का नाम या माडल संख्या, लोगो और अन्य विनिद(cid:130)श प्रकाशित करेगा;

(ग) राज्य अभिहित अभिकरण को अनुkापित lक्ति के विi(cid:136) अधिनियम की धारा 27 के अधीन की गई कार्यवाहियों का न्यायनिर्णयन आरम्भ करने के लिए सूचित करेगा।

(7) अनुkापित lक्ति, उपविनियम (6) में निvर्दष्ट दो मास की अवधि पूरी होने के दस दिन के भीतर,

(क) ब्यूरो को, निदेशो के अनुपालन में की गई कार्रवाई के संबंध में प्रiप -6 में अनुपालन रिपोर्ट भेजेगा, और (ख) यदि खंड (क) में निvर्दष्ट अनुपालन रिपोर्ट प्राप्त नह< होती है या

विनिvर्दष्ट अवधि के भीतर किसी निदेश का पालन किए बिना प्राप्त होती है, तो उसे जारी निदेशों का अऩनुपालन समझा जाएगा और ब्यूरो द्वारा उस प्रभाव का आदेश पारित किया जाएगा।

(8) ब्यूरो, सभी आवश्यक दस्तावेजों के साथ, खंड (क) में निvर्दष्ट अनुपालन रिपोर्ट और उप विनियम (7) के खंड (ख) में पारित आदेश की प्रति धारा 17 के अधीन कार्रवाई करने और उपविनियम (7) के खंड (ख) के अधीन पारित आदेशों के प्रवर्तन के प्रयोजन के लिए सभी अभिहित राज्य अभिकरणों को भेजेगा।

(9) जहां अनुkापित lक्ति, उपविनियम (6) के अधीन ब्यूरो द्वारा जारी निदेशों का पालन करने में असफल रहता है वहां ब्यूरो सभी अभिहित राज्य अभिकरणों के सूचना के अधीन-

(क) विनियम 7 के उपविनियम (1) के अधीन अनुkापित lक्ति को दी गई अनुमति वापस लेगा;

(ख) के न्Sीय सरकार को के न्Sीय सरकार द्वारा अधिसूचित ऊर्जा खपत मानकों के अनुरूप अनुkापित lक्ति द्वारा असफलता के समर्थन में परीक्षा रिपोर्ट के न्Sीय सरकार द्वारा अधिनियम की धारा 12 के खंड (ग) के अधीन विचारण और कार्रवाई करने हेतु उपविनियम (7) के खंड (क) में निvर्दष्ट ब्यूरो के निदेशों को संलb करके रिपोर्ट भेजेगा;

(ग) दो मास के भीतर किसी राष्ट्रीय या प्रादेशिक समाचार पत्र में और इलैक्ट्रानिक या किसी अन्य ऐसी रीति में जो वह ठीक समझे, अनुkापित lक्ति का नाम, ब्रांड का नाम, माडल का नाम या माडल संख्या, लोगो और अन्य विनिद(cid:130)श प्रकाशित करेगा;

(घ) अधिनियम की धारा 27 के अधीन अkापित lक्ति और कारबार के विi(cid:136) अतिरिक्त न्यायनिर्णयन कार्यवाहियां आरम्भ करने के लिए संबंधित अभिहित राज्य प्राधिकारी को सूचित करेगा।

(ख) विनियम 9 के अधीन विनिvर्दष्ट लेबल फीस का संदाय करने में असफल रहता है;

(ग) विनियम 11 के अधीन जारी निदेशों का पालन करने में असफल रहता है।

(i) लेबल की निम्नलिखित विमीय परिकल्पना, अर्थात्:-

(क) 30 जून, 2018 तक विधिमान्य (ख) 1 जुलाई, 2018 से 30 जून, 2020 तक विधिमान्यभारत का राजपत्रा : असाधरण [भाग III—खण्ड 4] 7 (i) बाहरी आवरण/नली पर नियत किए जाने वाले लेबल की विमा टिप्पणटिप्पणटिप्पणटिप्पण : लेबल की विमा बाहरी अंतरण के आकार के अनुसार अपेक्षाकृ त कम की जा सके गी, परन्तु लेबल का आकार अनुपात समान रहेगा ।

(ii) टुबुलर Lलोरेंस लैम्प पर स्टांपित किए जाने वाले लेबल की विमा टिप्पणटिप्पणटिप्पणटिप्पण : लेबल की विमा टुबुलर Lलोरेंस लैम्प के lास के अनुसार अपेक्षाकृ त कम की जा सके गी, परन्तु लेबल का आकार अनुपात समान रहेगा

(i) लेबल के लिए निम्नलिखित रंग स्कीम होगी, अर्थात् :-

गहरा नीलागहरा नीलागहरा नीलागहरा नीला – ग: 97, ड: 95, म: 6, ट: 1

1. िविनयम 7 के उपबंधों के अनुसरण में, ब्यूरों, इस पत्र के उपाबंध में प्रद7र्शत अनुमोदन के ब्यौरे के अनुसार स्टांपित करने और मुSण अथवा लेबल चिपकाने की अनुkा देता है ।

2. यह अनुkा निम्नलिखित के अध्यधीन रहते Bए होगी –

(क) टुबुलर Lलोरेंस लैम्प के लेबल पर द7र्शत स्टार लेबल और इन विनियमों में उपबंधित निबंधनों और शत(cid:129);

(ख) लेबल के वल ऐसे टुबुलर Lलोरेंस लैम्पों, जिसके लिए अनुkा प्रदान की जा चुकी है, पर ही स्टांपित होगा;

(ग) टुबुलर Lलोरेंस लैम्प, अनुkाधारक की लागत पर ही मुSित या चिपकाया जाएगा;

(घ) टुबुलर Lलोरेंस लैम्पों पर द7र्शत स्टार लेबल का अनुkाधारक द्वारा हर समय रख-रखाव किया जाएगा;

(ङ) अनुkाधारक द्वारा पांच पैसा प्रति लेबल के हिसाब से लेबल फीस का संदाय;

(च) (i) अनुkाधारक द्वारा लेबलित उपस्कर के उत्पादन के ब्यौरे अन्त7र्वष्ट करने वाला कथन ब्यूरों को प्रस्तुत करना और वित्तीय वर्ष की प्रत्येक तिमाही को समाप्ति के आगामी माह के भीतर प्रत्येक तिमाही के लिए बकाया उपा7र्जत लेबलिंग फीस प्रस्तुत करना;

(ii) आटोमेटेड प्रणाली के माध्यम से ब्यूरो को प्रस्तुत समान ब्यौरे;

(छ) टुबुलर Lलोरेंस लैम्प के ऐसे अन्य ब्यौरे, जैसे और जब ब्यूरो द्वारा, चाहे जिसके लिए अनुkा प्रदान की गई है, अनुkाधारक उपलब्ध कराएगा।

3. यह अनुkा................से......................तक विधिमान्य होगी और इन विनियमों के उपबंधों के अनुसरण में नवीकृ त की जा सके गी ।

4. अनुkाधारक, ब्यूरो के पूर्व अनुमोदन के सिवाय अनुkा की विधिमान्य अवधि के दौरान बाजार से टुबुलर Lलोरेंस लैम्प वापस नह< ले सके गा ।

5. ब्यूरो द्वारा उपस्कर के लिए समनुदेशित यूनिक लेबल सीरीज कोड़....................... है और अनुमोदित परिकल्पना के अनुसार लेबल पर होना चािहए ।

6. जहां पुनरीक्षण पर के न्Sीय सरकार द्वारा स्टार लेबल प्लान उपांतरित किया जाता है,टुबुलर Lलोरेंस लैम्प का स्टार लेबल निम्नलिखित विकल्पों के अधीन उपांतरित माना जाएगा, अर्थात् :-

(क) यदि पुनरीक्षित स्टार लेबल के साथ समकालिक मॉडल लांच किया जाता है ऐसी अनुkा के लिए आवेदन ब्यूरो को उस तारीख, जिससे नया स्टार लेबल प्रवृत्तन में आता है, छह मास के भीतर किया जाएगा ।

(ख) जहां विद्यमान मॉडल उपांतरित स्टार स्तर को प्रभाव देने के लिए जारी है, ब्यूरो को के वल प्ररूप 4 में घोषणा प्रस्तुत की जाएगी ।

2. उपरोक्त उपस्कर [lष्ठि या फर्म का पूरा नाम] द्वारा विनि7र्मत या आयात किया जाता है और [कारखाने का नाम और पता] पर विनि7र्मत किया जाता है या [आयातकर्ता का नाम और पता] से आयात किया जाता है ।

8. आपको इस पत्र के जारी होने की तारीख से दो मास के भीतर उपरोक्त सुधारात्मक कार्यवाही पूर्ण करने का और...............तक दो मास की समाप्ति के पwात् दस दिवस की अवधि के भीतर प्ररूप 6 में अनुपालन रिपोर्ट भेजने का निदेश दिया जाता है। उक्त तारीख तक अनुपालन रिपोर्ट प्राप्त नह< होने की दशा में ब्यूरो इन विनियमों के अधीन कार्यवाही करेगा।

NOTIFICATION

New Delhi, the 9th March, 2018

No. BEE/S&L/TFL/63/2017-18.— Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2017, were published vide notification number BEE/S&L/TFL/63/2017-18, dated the 5th October, 2017, as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the period of forty-five days from the date on which copies of Official Gazette containing the said notification were made available to the public;

And whereas copies of the said Official Gazette were made available to the public on the 5th October, 2017;

And whereas no objections or suggestions were received from public with respect to the said draft regulations within the aforesaid period;

Now, therefore, in exercise of the powers conferred by clause (d) of section 14 read with clause (i) of sub- section (2) of section 58 and clause (n) of sub-section (2) of section 13 of the said Act and in supersession of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2009, except as respects things done or omitted to be done before such supersession, the Bureau, with the previous approval of the Central Government, hereby makes the following regulations, namely:-

1. Short title and commencement. - (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. -(1) In these regulations, unless the context otherwise requires,-

(a) "Act" means the Energy Conservation Act, 2001(52 of 2001);

(b) "Bureau" means the Bureau of Energy Efficiency established under sub-section (1) of section 3 of the Act. (c) "Form" means forms appended to these regulations;

(d) "label" means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the tubular fluorescent lamp;

(e) "label period" means the validity period of the luminous efficacy under energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, the validity period of the luminous efficacy is not notified, it shall be deemed to be valid until new values for the same are notified by the Central Government.

(f) "models or family of models" means the product or range of products of one particular brand, to which a single set of test reports is applicable and where each of the products have the same physical characteristics, luminous efficacy, star rating level and performance characteristics;

(g) "permittee" means a person or agency to whom permission has been granted to affix label under regulation 7;

(h) "Schedule" means the Schedule annexed to these regulations;

(i) "star rating or star level" means the grade of energy efficiency displayed on the label of the tubular fluorescent lamp based on energy consumption standard notified by the Central Government under the Act; (j) "trader or seller" in relation to any labelled tubular fluorescent lamp means a person who sells or distributes such tubular fluorescent lamp and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such tubular fluorescent lamp;

(k) "tubular fluorescent lamps" means an appliance notified by the Central Government under the Act. (2) Words and expressions used herein and not defined, but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label. -(1) On every tubular fluorescent lamp, the following particulars shall be displayed on its label, namely:-

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand;

(c) size of tubular fluorescent lamp and colour temperature;

(d) trade name and number;

(e) model and year of manufacturing or import;

(f) unique series code;

(g) power consumption in Watts ;

(h) star level of the tubular fluorescent lamp;

(i) luminous efficacy in lm/W;

(j) label period;

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.- (1) A label containing all the particulars specified in regulation 3 shall be displayed on every tubular fluorescent lamp within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government, every permittee or trader or seller shall ensure that-

(a) outer casing of the tubular fluorescent lamp put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year of the tubular fluorescent lamp shall also be in synchronization with such revised energy consumption standards, and shall not produce the tubular fluorescent lamp with previous energy consumption standards;

(b) all preparatory steps including awareness of the dealers, retailers and consumers, publicity for their education shall be well planned six months in advance from the date of commencement, under these regulations.

5. Manner of display of label.- (1)There shall be a label on every tubular fluorescent lamp which shall display at the point of sale and such label shall be affixed on the tubular fluorescent lamp in the following manner, namely:-

(a) the label with colour programme after photographic reduction to 16 millimetre height shall be printed on the sleeve;

(b) every manufacturer and importer shall mark the colour temperature on the sleeve;

(c) the star marking as per the rating shall be stamped on the tubular fluorescent lamp, the size of the stamp for the star marking shall be 14.5 millimetre height x 8.5 millimetre width and the same shall be stamped in a separate column.

6. Permission for display of label.- (1) No star label shall be affixed on a tubular fluorescent lamp except with the prior permission of the Bureau.

(2) For the purposes of obtaining permission of the Bureau under sub-regulation (1), permittee shall make application as per Form I to register himself for every brand separately, accompanied by a label security fee of rupees one lakh, payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or by any other acceptable electronic mode of payment:

Provided that the label security fee for small scale industry shall be twenty-five thousand rupees;

(3) Every application for registration under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or by any other acceptable electronic mode of payment;

(b) documents specified in Form I.

7. Grant of permission and renewal. - (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may within a period of one month from the date of such receipt grant, subject to such terms and conditions as are specified in regulation 8, permission for affixing label on tubular fluorescent lamp in Form II or in electronic form.

(2) The Bureau shall enter the name and particulars of the permittee in Form III.

(3) The permission so granted under sub-regulation (1) shall be valid for a period for which the star level specified by the energy consumption standard as notified by the Central Government is in force.

(4) The permittee shall apply for renewal of permission before six months but not later than three months before its expiry and shall be accompanied by a fee of one thousand rupees payable in the form of demand draft or acceptable electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

(5) On receipt of the application for renewal under sub-regulation (4) the Bureau may, after being satisfied that all requirements are complied with, within a period of one month from the date of such receipt, renew permission in Form II.

(6) An application for renewal made after the expiry of validity period shall be rejected and the permittee may make a fresh application for permission.

(7) The permittee who seeks permission to continue to affix label on the existing model of the tubular fluorescent lamp from the date from which the revised star level comes into force shall submit a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of tubular fluorescent lamp is planned to be launched to synchronize with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall,-

(a) comply with the energy consumption standards for tubular fluorescent lamp notified by the Central Government;

(b) affix label only on such model of tubular fluorescent lamps for which permission has been granted;

(c) affix label on the tubular fluorescent lamps at the cost of the permittee;

(d) ensure that the star level displayed on the label of tubular fluorescent lamp shall be maintained at all time;

(e) pay the label fee as specified in regulation 9;

(f) furnish to the Bureau a Statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of closure of each quarter of the financial year;

(g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year;

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau's Operation Manual on Standard and Labelling.

9. Label Fee. - (1) Every permittee shall pay to the Bureau a label fee of five paisa for each label affixed on the tubular fluorescent lamp;

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure of each financial year;

(3) If a permittee fails to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security fee made under sub-regulation (2) of regulation 6 and if complete labelling fees are not recovered within one year of the last date of submission, Bureau may cancel the labels granted to the permittee and publish his name in the newspapers as a defaulter.

10. Refund of Label Security Fee. - Subject to the provisions to sub-regulations (2) and (3) of regulation 9, the permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture tubular fluorescent lamp.

11. Verification by the Bureau. - (1) The Bureau or its designated agency may, either suo motu or on a complaint received by it, carry out verification to ensure that the tubular fluorescent lamp conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purposes of verification, the Bureau or its designated agency may pick up samples at random from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the tubular fluorescent lamp in an independent laboratory duly accredited by the National Accreditation Board for testing and calibration laboratories and follow the below procedure, namely:-

(a) the Bureau shall issue a notice to the permittee for carrying out such testing and the complainant shall be called upon to deposit such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time as may be determined by the Bureau;

(b) if the sample drawn under challenge testing fails, the permittee shall reimburse all expenses towards the cost of sample, transportation of sample and the testing charges to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and

(c) where the equipment passes the challenge test, then the expenses deposited by the complainant shall stand forfeited.

(4) Where, upon a complaint received under sub-regulation (1), if the permittee fails to deposit such expenses referred to in sub-regulation (3) within such time, the Bureau shall continue the verification by challenge testing the tubular fluorescent lamp referred to in sub-regulation (3) and the processing of application received under regulation 6 be kept in abeyance till such expenses are deposited.

(5) Where samples of tubular fluorescent lamp used for testing fails, either in the suo motu testing or challenge testing, the Bureau shall afford the permittee another opportunity and the Bureau shall conduct a second test with twice the quantity of tubular fluorescent lamp used in the first test in an independent test laboratory duly accredited by the National Accreditation Board for testing and calibration laboratories at the cost of the permittee.

(6) Where the second test fails, the Bureau shall-

(a) direct the permitte in Form V, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label affixed on the outer casing of the tubular fluorescent lamp or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications for public infomation;

(c) intimate to the concerned State Designated Agency to take up the matter with the State Commission to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(7) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub-regulation (6) ,-

(a) send the compliance report in Form VI to the Bureau with respect to action taken in compliance with the direction; and

(b) in case compliance report referred to in clause (a) is not received or received without complying to any of the directions within the specified period, it shall be deemed to be non-compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(8) The Bureau shall send a copy of the compliance report referred to in clause (a) of sub-regulation (7) and order passed in clause (b) of sub-regulation (7) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of sub-regulation (7). (9) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (6), the Bureau under intimation to all State Designated Agencies shall-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standard notified by the Central Government, the directions of the Bureau referred to in clause (a) of sub-regulation (7) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications for public information;

(d) intimate to the concerned State Designated Agencies to take up the matter with the State Commission to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of Permission. - The Bureau may cancel the permission granted under regulation 7 if the permittee—

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(c) fails to comply with the directions issued under regulation 11.

2. This permission is subject to—

(a) the star level displayed on the label of the tubular fluorescent lamp and terms and conditions provided in these regulations;

(b) the label stamped only on such model of tubular fluorescent lamps for which permission has been granted;

(c) the label printed or affixed on the tubular fluorescent lamps at the cost of the permittee;

(g) such other details of tubular fluorescent lamp the permittee shall make available as and when sought by the Bureau of which the permission has been granted.

4. The permittee shall not withdraw the tubular fluorescent lamp from the market during the validity period of permission except with the prior approval of the Bureau.

6. Where the star level plan on review is modified by the Central Government, the star level of the tubular fluorescent lamp shall be deemed to be modified to the following options namely:-

The results of the test report indicated that the sampled tubular fluorescent lamp failed to meet the energy consumption standard, lumens, etc. and did not conform to the test details furnished by you in Form I annexed to the application submitted by you for seeking permission to affix label on the tubular fluorescent lamps manufactured/imported by you. The test results were sent to you vide the Bureau letter No........dated........in the name of your authorised contact person. You were also required to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

The sample for second check verification test was picked up ….dated the …. through our authorised Agency M/s. ............and transported to the National Accreditation Board for Testing and Calibration Laboratories accredited laboratory transported by our authorised agency, duly sealed by M/s............... and was given unique identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification agency as well as your representatives.

6. The test results of second check testing are enclosed which are dully checked and counter signed by the competent authorised personnel of the National Accreditation Board for Testing and Calibration Laboratories accredited laboratory. The test results confirm that they failed to meet the requisite parameters and standards given in S.O. number…dated ….and the terms and conditions of the permission given to you for display of particulars on label affixed to the tubular fluorescent lamps manufactured/imported and sold in the market.

The Bureau hereby directs you to correct the star level displayed on the label of the tubular fluorescent lamps or remove the defects and deficiencies found during testing; withdraw all the stocks from the market to comply with the directions of the Bureau; and change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within ten days after the expiry of two months i.e. by ...............In case no compliance report is received by the said date, the Bureau shall proceed to take action under these regulations.

9. The Bureau shall take further follow up action in accordance with the provisions of these regulations.
