संसंसंसं.... 6/44/20176/44/20176/44/20176/44/2017----डीजीएडीडीजीएडीडीजीएडीडीजीएडी....————समय-समय पर यथा संशोिधत सीमा शुल्क टैरिफ अिधिनयम, 1975 (जिसे एत(cid:28)प(cid:30)ात अिधिनयम भी कहा गया है) और समय-समय पर यथा संशोधित तत्संबंधी सीमा शुल्क टैरिफ (पाटित वस्तुओं की पहचान, उन पर पाटनरोधी शुल्क का आकलन और सं,हण तथा क्षति निर्धारण) नियमावली, 1995 (जिसे एत(cid:28)प(cid:30)ात नियमावली भी कहा गया है) को ध्यान में रखते 5ए नि6दष्ट प्राधिकारी ने पाटन रोधी जांच के संबंध में दिनांक 17 जनवरी, 2018 की अधिसूचना सं. 6/44/2017- डीजीएडी (के स सं. ओ I -47/2017) के तहत जांच प्रारंभ करने की अधिसूचना जारी की है ।

2. पृष्ठ सं. 2 के पैरा सं. 5 में विचाराधीन उत्पाद की परिभाषा में एचएस कोड उपलब्ध न होने के कारण यथा आवश्यक तत्संबंधी आंिशक संशोधन करते 5ए, जिसे इस प्रकार पढ़ा गया है :

उपरोक्त अधिसूचना को अब इस प्रकार पढ़ा जाएगा :

"वतर्मान मामले में विचाराधीन उत्पाद )पीयूसी (में सन और/ या डस्ट कं ट्रोल फिल्म शािमल है, यह एक प्रकार की िवशेषपालीिथलीन/ पालिएस्टर फिल्म है । सन और/ या डस्ट कं ट्रोल फिल्म एक प्रकार की सेल्फ एधेिसव प्लेट, शीट, फिल्म, फोइल, टेप, स्ट्रिप और प्लास्टिक के अन्य Nलेट शेप होते हैं चाहे रोल्स में हों अथवा नहQ । िवचाराधीन उत्पाद को Rापार और बाजार शब्दावली में विभिन्न नामों से जाना जाता है, जैसे सन फिल्म्स, सन और/ या डस्ट कं ट्रोल फिल्म, विडो फिल्म, सोलर फिल्म, 1443 GI/2018 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] सोलर कं ट्रोल फिल्म्स, सोलर विडो फिल्म आदि। िवचाराधीन उत्पाद के दायरे में प्लेन या मेटलाइज्ड पालीिथलीन/ पालीएस्टर फिल्म्स शािमल नहQ है । सन और/ अथवा डस्ट कं ट्रोल फिल्म को सीमा शुल्क टैरिफ अधिनियम में उप शीर्ष 39206929 में अध्याय 39 के तहत वर्गीकृ त किया गया है । तथापि, सीमा शुल्क वर्गीकरण के वल संके तात्मक है और यह इस जांच के क्षेत्र पर किसी भी तरीके से बाध्यकारी नहQ है ।"

CORRIGENDUM NOTIFICATION

New Delhi, the 12th March, 2018

Subject : Anti-Dumping investigation concerning imports of Sun/Dust control film originating in or exported

from China PR, Chinese Taipei, Hong Kong and Korea RP - Reg Corrigendum Notification.

No. 6/44/2017-DGAD.—Having regard to the Customs Tariff Act 1975, as amended from time to time (hereinafter also referred to as the Act) and the Customs Tariff (Identification, Assessment and Collection of Anti- dumping Duty on Dumped Articles and for Determination of Injury) Rules 1995, as amended from time to time (hereinafter also referred to as the Rules) thereof, the Designated Authority has issued the initiation notification, vide notification No. 6/44/2017-DGAD (Case No. OI-47/2017) dated 17th January, 2018 in respect of the subject anti- dumping investigation.

2. In partial modification thereof, necessitated because of HS code missing in the definition of Product under Consideration in para no. 5, page no. 2 which reads as :-

"The product under consideration in the present case is Sun and/or dust control film is a kind of specialty polyethylene/polyester film. Sun and/or dust control film in the form of Self Adhesive plate, sheet, film, foil, tape, strip and other flat shapes of plastics whether or not in rolls. The product under consideration is known by different names in the trade and market parlance, such as Sun films, Sun and/or dust control film, Window Film, Solar films, Solar Control Films, Solar Window Films etc. The scope of the product under consideration excludes plain or metallized polyethylene/polyester films."

The said notification shall now read as:
