काकाकाका0000आआआआ0 0 0 0 1123112311231123((((अअअअ))))....————अिधसूचना का निम्नलिखित प्रा(cid:16)प, िजसे के न्(cid:21)ीय सरकार, पर्यावरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पठित उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते )ए, जारी करने का प्रस्ताव करती है, पर्यावरण (संरक्षण) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) की अपेक्षानुसार, जनसाधारण की जानकारी के िलए, प्रकाशित किया जाता है; िजनके उससे प्रभावित होने की संभावना है, और यह सूिचत किया जाता है कि उक्त प्रारूप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना को अंत1र्वष्ट करने वाले भारत के राजपत्र की प्रतियां जनसाधारण को उपलब्ध करा दी जाती हैं, साठ दिन की अविध की समाप्ति पर या उसके पश्चात् िवचार किया जाएगा ;

ऐसा कोई <क्ति, जो प्रारूप अिधसूचना में अंत1र्वष्ट प्रस्तावों के संबंध में कोई आपत्ति या सुझाव देने का इAछु क है, वह इस प्रकार विनिCर्दष्ट अविध के भीतर, के न्(cid:21)ीय सरकार द्वारा िवचार किए जाने के िलए, अपनी आपत्ति या सुझाव सिचव, पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय, इंदिरा पर्यावरण भवन, जोर बाग रोड, अलीगंज, नई दिल्ली-110003 को या ई-मेल [email protected] पर िलिखत रूप में भेज सकता है ।

अमराबाद बाघ रिजर्व (ए.टी.आर) तेलंगाना में दक्षिणी-पूर्वी घाट की एक शाखा नल्लमालिस में स्थित है और यह 2611.09 वर्ग किलोमीटर क्षेत्र में फै ला )आ है। यह भौगोिलक रूप से 16.006207 और 16.713067 उत्तरी अक्षांश और 78.415603 और 79.46740 पूर्वी देशांतर के बीच स्थित है। यह अभयारGय दHन पठार की विशिष्ट, भौितक और जैिवक सुविधाओं का प्रतीक है।

उत्तरी भाग है, कृ ष्णा नदी के उत्तर में महबूब नगर और नालगोंडा जिलें में स्थित है। बाघ रिजर्व के अंतर्गत दो (2) संभाग आतें है, अर्थात् अचम्पेट वन्यजीव प्रबंधन संभाग और नागाजु र्न सागर वन्यजीव प्रबंधन संभाग।

और,और,और,और, अमराबाद बाघ रिजर्व िवशेषत: कई लुप्तप्राय वनस्पतियों और इससें संबंिधत जीवजन्तुओं के िलए एक समृQ जैव-िविवधता स्थल है। इस अभयारGय का भू-आकृ तिविRान के मोजेक से अलंकृ त किया गया है, कृ ष्णा नदी में धाराएं बहती है और यहां वनस्पति और जीवजंतु की प्रजातियों की िविवधता है। अिधकांश क्षेत्र में पहाड़ी के साथ पठार, चSानें, घाटियां और गहरी घाटियां है, जो बांस और घास के िवकास के साथ उष्णकटिबंधीय मिJित शुष्क पर्णपाती वनों को आJय प्रदान करते है;

और,और,और,और, अमराबाद बाघ रिजर्व में कु छ वनस्पति और जीवजंतु की िविवधता का वास है क्योंकि यह दHन पठार में स्थित है। जू-भौगोिलक वर्गीकरण के अनुसार, यह क्षेत्र इंडो–मलायन क्षेत्र के अंतर्गत भारतीय जीवजंतु जैसे नीलगाय (बोसेलैफस ट्रेगोमेमेलस) काला िहरण (अनटीलोपे के रवीकपरा) और चौसिंगा मृग (टेट्रासरस (cid:16)ा(िcid:18)कोरिन), आदि के अंतर्गत आता हैं। इस क्षेत्र में स्तनधारियां की 80 से अिधक प्रजातियां, 303 पक्षियों की प्रजातियां, 54 सरीसृपों की प्रजातियां, 20 उभयचरों की प्रजातियां, 55 मछलियों की प्रजातियों, 101 तितलियों की प्रजातियां, 57 कीटों की प्रजातियों, 45 कोलेआंपटेरन की प्रजातियां, 35 ओडोनाटा की प्रजातियां पाई जाती हैं। मुख्य जीवजंतु में बाघ (पेंथेरा टिगरिस), तेंदुआ (पैंथेरा पार्डस), भेिडया (कै िनस लुपस), िसयार (के िनस अयरेउस), सांभर (रूस यूनीक्लोर), चीतल (एक्सिस एक्सिस), चिंकारा (गजेल्ला बेन्ने'ीइ), िपसूरी (मोसचुस स्प), बनैला सूअर (सस स्*ोफ़ा) और साही शािमल है । कृ ष्णा नदी में मग्गर, ओटर और कछु ए की आबादी है। दुर्लभ प्रजाति में िपसूरी (ट्ररागुलीदेइ जाित) शािमल है। इसके अलावा इनवेटेब्रेट जीवजंतु की एक विस्तृत सरणी है;

और,और,और,और, अमराबाद बाघ रिजर्व एंडरो]ाफिस, नाल्लामलायना, इरीओटा, इनालुस_गटोइ आदि का वास है अनुमान कि यहां 29 घासों की प्रजातियां और 353 औषधीय पौधों की प्रजातियां नल्लमाला में 109 परिवारों के साथ 743 टेक्सा है ँ।

दक्षिणी शुष्क मिJित पर्णपाती वन सागौन धारक वनों के साथ अति<ाप्त है जहां भूवैRानिक संरचना मूल है और मिSी काले कपास के अनुकू ल है। सागौन विभिन्न प्रकार के अनुरूप में विद्यमान हैं, िवशेष रूप से बलुई मिSी के नदी के किनारे और सहायक स्थलों के छोटें पैचों में स्थानीयकृ त है। मुख्य िवशेषता वृक्ष टेक्टोना ,ाडिस, ट-र्मनलिया टोमेंटोसा, ट-र्मनलिया बेल्लेरिका, लेगरस्ट्रोइमिया परवि/लोरा, क्लोरोक्ज़िलोन स्वीइटेनीया, बोसवेल्लीया सेर्राटा, सोयमीदा फे बरीफगा, माधुका इंिडका, बुचानेनीया लतीफोिलया, स्टेरकु ली अयरेंस, एनोगेसस लेटीफोिलया, कै िडया कै लीसीना और ब्यूटा 4ांदोसा; है;

और,और,और,और, अमराबाद बाघ रिजर्व के चारों ओर के क्षेत्र को, पर्यावरण की दृष्टि से पारिस्थितिकी संवेदी जोन के रूप में सुरक्षित और संरक्षित करना करना आवश्यक है ;

अतःअतःअतःअतः,,,, अब, के न्(cid:21)ीय सरकार, पर्यावरण (संरक्षण) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पठित पर्यावरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की उपधारा (1) तथा धारा 3 की उपधारा (2) एवं उपधारा (3) के खंड (v) और खंड (xiv) द्वारा प्रदत्त शक्तियों का प्रयोग करते )ए तेलंगाना राज्य में अमराबाद बाघ रिजर्व की सीमा के चारों ओर 0 से 1 किलोमीटर तक विस्तारित क्षेत्र को अमराबाद बाघ रिजर्व पारिस्थितिकी संवेदी जोन (जिसे इसमें इसके पश्चात् पारिस्थितिकी संवेदी जोन कहा गया है) के रूप में अधिसूचित करती है, िजसका िववरण निम्नानुसार है, अर्थात् :--

1. पारिस्थितिकीपारिस्थितिकीपारिस्थितिकीपारिस्थितिकी संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन काकाकाका विस्तारविस्तारविस्तारविस्तार औरऔरऔरऔर उसकीउसकीउसकीउसकी सीमाएंसीमाएंसीमाएंसीमाएं--(1) पारिस्थितिकी संवेदी जोन का विस्तार अमराबाद बाघ रिजर्व के चारों ओर 0 किलोमीटर से 1 किलोमीटर तक विस्तारित है। आंh प्रदेश के नागाजु र्नसागर बाघ रिजर्व के समीपवर्ती दक्षिणी भाग का विस्तार शून्य है। पारिस्थितिकी संवेदी जोन अचम्पेट संभाग में अमराबाद बाघ रिजर्व केभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 3 मध्यवर्ती क्षेत्र की सीमा से आरंभ होता है और बाघ रिजर्व की सीमा के साथ 1 किलोमीटर की चौडाई के साथ नागाजु र्नसागर संभाग की ओर फै ला )आ है। पारिस्थितिकी संवेदी जोन का क्षेत्र 315 वर्ग किलोमीटर है।

(2) पारिस्थितिकी संवेदी जोन की सीमा के संरक्षित क्षेत्र का मानचित्र उपाबंधउपाबंधउपाबंधउपाबंध I में दिया गया है और ]ामों के स्थान की मानचित्र में प्रद1र्शत करके उपाबंधउपाबंधउपाबंधउपाबंध I ((((कककक) ) ) ) के रूप में संलj है। संरक्षित क्षेत्र और इसके पारिस्थितिकी संवेदी जोन की सीमा के निदkशांकों की सूची उपाबंधउपाबंधउपाबंधउपाबंध I ((((खखखख)))) और ((((गगगग)))) के (cid:16)प में संलj है ।

(3333) अमराबाद बाघ रिजर्व के पारिस्थितिकी संवेदी जोन 16.000197 से 16.717876 उत्तरी अक्षांश और 78.403642 से 78.24 पू से 79.473548 पूर्वी देशांतर के बीच स्थित है। पारिस्थितिकी संवेदी जोन की सीमा का वर्णन उपाबंधउपाबंधउपाबंधउपाबंध II के रूप में संलj हैं ।

(4) मुख्य बिंदुओं के भू-निदkशांकों के साथ पारिस्थितिकी संवेदी जोन के अंतर्गत आने वाले ]ामों की सूची उपाबंधउपाबंधउपाबंधउपाबंध III के रूप में संलj हैं ।

(1) राज्य सरकार, पारिस्थितिकी संवेदी जोन के प्रयोजन के िलए राजपत्र में अंितम अिधसूचना के प्रकाशन की तारीख से दो वर्ष की अविध के भीतर, स्थानीय <क्तियों के परामर्श से और इस अधिसूचना में दिए गए अनुबंधों का पालन करते )ए राज्य सरकार के सक्षम प्राधिकारी के अनुमोदनार्थ एक आंचिलक महायोजना तैयार करेगी।

(2) पारिस्थितिकी संवेदी जोन के लिए आचंलिक महायोजना इस अधिसूचना में विनिCर्दष्ट रीित से राज्य सरकार द्वारा प्रासंगिक कें (cid:21)ीय और राज्य विधियों तथा कें (cid:21)ीय सरकार द्वारा जारी मार्गनिदkशों, यदि कोई हों, के अनुरूप तैयार की जाएगी।

(3) आंचलिक महायोजना, पारिस्थितिकी और पर्यावरणीय संबंधी सरोकारों को उक्त योजना में समाकलित करने के लिए राज्य सरकार के निम्नलिखित विभागों के परामर्श से तैयार की जायेगी,:-- (i) पर्यावरण; (ii) वन और वन्यजीव; (iii) कृ िष और बागवानी ; (iv) राजस्व; (v) शहरी िवकास; (vi) पारि-पर्यटन सिहत पर्यटन; (vii) ]ामीण िवकास; (viii) सिंचाई और बाढ़ नियंत्रण;

(ix) नगरीय और ]ामीण िवकास;

(x) पंचायती राज; (xi) लोक िनर्माण विभाग।

(4) जब तक इस अिधसूचना में विनिCर्दष्ट न हो, आंचिलक महायोजना में वतर्मान में अनुमोदित भू-उपयोग, अवसंरचना और oियाकलापों पर कोई प्रतिबंध नह_ लगाया जाएगा तथा आचंिलक महायोजना में सभी अवसंरचनाओं और oियाकलापों को अधिक दक्ष और पर्यावरण अनुकू ल बनाने की <वस्था की जाएगी।

(5) आंचिलक महायोजना में अनाAछादित और अवoमित क्षेत्रों के जीणpQार, विद्यमान जल निकायों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदा और नमी के संरक्षण, स्थानीय जनता की4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] आवश्यकताओं तथा पारिस्थितिकी एवं पर्यावरण के ऐसे अन्य पहलुओं, िजन पर ध्यान देना आवश्यक है, की <वस्था की जाएगी ।

(6) आंचिलक महायोजना में सभी विद्यमान पूजा स्थलों, ]ामीण और शहरी बस्तियों, वनों की Jेणियों और किस्मों, कृ िष क्षेत्रों, ऊपजाऊ भूिम, उद्यानों एवं उद्यानों की तरह के हरित क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्य जल निकायों की सीमा का सहायक मानचित्रों के साथ निर्धारण किया जाएगा। इस योजना से संबंिधत सहायक मानचित्र में विद्यमान और प्रस्तावित भूमि के उपयोग की विशेषताओं का ब्यौरा दिया जाएगा।

(7) आंचिलक महायोजना के अंतर्गत पारिस्थितिकी संवेदी जोन में िवकास को िविनयिमत किया जाएगा तथा इस अिधसूचना में विनिCर्दष्टानुसार निषिQ किए गए, िविनयिमत किए और बढ़ावा दिए गए oियाकलापों का पालन किया जाएगा तथा स्थानीय जनता की आजीिवका की सुरक्षा के किए पारिस्थितिकी-अनुकू ल िवकास सुनिrित तथा संव1र्धत किया जायेगा ।

(8) आंचिलक महायोजना क्षेत्रीय िवकास योजना की सह-कािलक होगी ।

(9) आंचिलक महायोजना, िनगरानी सिमित के िलए एक संदर्भ दस्तावेज होगी जिसमें इस अिधसूचना के उपबंधों से सम्बधित उसके कर्त<ों के निवर्हन का विवरण होगा ।

3. राज्यराज्यराज्यराज्य सरकारसरकारसरकारसरकार द्वाराद्वाराद्वाराद्वारा किएकिएकिएकिए जानेजानेजानेजाने वावावावालेलेलेले उपायउपायउपायउपाय————राज्य सरकार इस अिधसूचना के उपबंधों को प्रभावी बनाने के िलए निम्नलिखित उपाय करेगी, अर्थात्:--

(1) भूभूभूभू----उपयोगउपयोगउपयोगउपयोग....–––– (क) पारिस्थितिकी संवेदी जोन में वनों, बागवानी क्षेत्रों, कृ िष क्षेत्रों, आमोद-प्रमोद के प्रयोजन के िलए चिन्हित किए गए उद्यानों और खुले स्थानों का बड़े वाणिज्यिक या आवासीय परिसरों या औद्योगिक oियाकलापों के िलए उपयोग या संपरिवर्तन नह_ किया जाएगा:

(ख) परंतु पारिस्थितिकी संवेदी जोन के भीतर भाग (क) में विनिCर्दष्ट प्रयोजन से भिन्न प्रयोजन के लिए कृ षि और अन्य भूमि का संपरिवर्तन, मानीटरी सिमित की सिफारिश पर और यथा लागू क्षेत्रीय नगर योजना अधिनियम तथा के न्(cid:21)ीय/राज्य सरकार के अन्य नियमों तथा विनियमों के अधीन सक्षम प्राधिकारी के पूर्व अनुमोदन से, तथा इस अधिसूचना के उपबंधों द्वारा स्थानीय निवासियों की निम्नलिखित आवासीय जरूरतों को पूरा करने के िलए अनुRात किया जाएगा, जैसे कि:-

(i) विद्यमान सड़कों को चौड़ा करना, उन्हें सुदृढ करना और नई सड़कों का निर्माण;

(ii) बुिनयादी ढांचों और नागरिक सुविधाओं का निर्माण और नवीकरण;

(iii) प्रदूषण उत्पन्न न करने वाले लघु उद्योग;

(iv) ]ामीण उद्योगों सहित कु टीर उद्योग; सुविधा भGडार और गृह वास सहित स्थानीय सुविधाएं जो पारिस्थितिकी पर्यटन में सहायक हैं; और

(v) बढ़ावा दिए गए और पैरा-4 में व1र्णत oियाकलाप :

(ग) परंतु यह भी कि राज्य सरकार के प्रासंगिक नियमों तथा विनियमों एवं क्षेत्रीय शहरी नियोजन अधिनियम के अधीन सक्षम प्राधिकारी के पूर्व अनुमोदन के िबना तथा संविधान के अनुAछेद 244 के उपबंधों अथवा तत्समय प्रवृत्त िविध, िजसके अंतर्गत अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अधिकारों की मान्यता) अिधिनयम, 2006 (2007 का 2) भी है, के अनुपालन के िबना वाणिज्यिक या औद्योिगक िवकास oियाकलापों के िलए जनजातीय भूिम का प्रयोग अनुRात नह_ होगा:

(घ) परंतु यह भी कि पारिस्थितिकी संवेदी जोन के भीतर की भूमि के अभिलेखों में उत्पन्न किसी त्रुटि की, िनगरानी सिमित के िवचार प्राप्त करने के पrात्, राज्य सरकार द्वारा प्रत्येक मामले में एक बार शुQि की जाएगी और उक्त त्रुटि के शुQिकरण की सूचना कें (cid:21)ीय सरकार के पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय को दी जाएगी ।

(ड़) परंतु यह भी कि उपयु र्क्त त्रुटि के शुQिकरण में, इस उप-पैरा में यथा उपबंिधत के िसवाय, किसी भी दशा में भू-उपयोग का परिवर्तन सम्मिलित नह_ होगा ।

(च) अनुप्रयुक्त या अनुत्पादक कृ षि क्षेत्रों में पुन: वनीकरण के तथा पर्यावास और जैव- िविवधता की बहाली के प्रयास किए जाएंगे ।

(2) प्राकृ तिक जल (cid:25)ोतप्राकृ तिक जल (cid:25)ोतप्राकृ तिक जल (cid:25)ोतप्राकृ तिक जल (cid:25)ोत....—आंचंिलक महायोजना में सभी प्राकृ तिक जल zोतों/नदियों/जलमागp की पहचान की जाएगी और उसमें उनके संरक्षण और बहाली की योजना सम्मििलत की जाएगी ।

(3) पर्यटन/पारिस्थितिकी पर्यटनपर्यटन/पारिस्थितिकी पर्यटनपर्यटन/पारिस्थितिकी पर्यटनपर्यटन/पारिस्थितिकी पर्यटन....—(क) पारिस्थितिकी संवेदी जोन के भीतर सभी नए पारिस्थितिकी पर्यटन oियाकलाप या विद्यमान पर्यटन oियाकलापों का विस्तार पारिस्थितिकी संवेदी जोन संबंधी पर्यटन महायोजना के अनुसार होगा।

(ख) पारिस्थितिकी पर्यटन महायोजना पर्यटन विभाग द्वारा राज्य के पर्यावरण और वन विभाग के परामर्श से तैयार होगी।

(ग) पर्यटन महायोजना आंचलिक महायोजना का एक घटक होगी।

(घ) पारिस्थितिकी पर्यटन संबंधी oियाकलाप निम्नानुसार िविनयिमत होंगे,:-

(i) वन्यजीव अभयारGय की सीमा से 1 किलोमीटर के भीतर या पारिस्थितिकी संवेदी जोन की सीमा तक, इसमें जो भी निकट हो, किसी होटल या रिजार्ट का नया संन्निर्माण अनुRात नह_ किया जाएगा । तथापि, वन्यजीव अभयारGय की सीमा से 1 किलोमीटर की दूरी से परे पारिस्थितिकी संवेदी जोन की सीमा तक नए होटलों और रिजाट| की स्थापना पर्यटन महायोजना के अनुसार पारिस्थितिकी पर्यटन सुविधाओं के लिए पूर्व परिभाषित एवं अभीहित क्षेत्रों में अनुRात की जाएगी।

(ii) पारिस्थितिकी संवेदी जोन के अन्दर सभी नए पर्यटन oिया-कलाप या विद्यमान पर्यटन oियाकलापों का विस्तार के न्(cid:21)ीय सरकार, पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय द्वारा जारी मार्गदर्शी सिQांतों तथा पारिस्थितिकी पर्यटन पर बल देते )ए राष्ट्रीय बाघ संरक्षण प्राधिकरण द्वारा जारी पारिस्थितिकी पर्यटन मार्गदर्शी सबंधी सिQांतों के अनुसार होगा।

(iii) आंचिलक महायोजना का अनुमोदन किए जाने तक, पर्यटन के विकास तथा विद्यमान पर्यटन oियाकलापों के विस्तार को वास्तविक स्थल विनिCर्दष्ट संवीक्षा तथा निगरानी समिति की सिफारिश के आधार पर संबंिधत विनियामक प्राधिकरणों द्वारा अनुRात किया जाएगा और पारिस्थितिकी संवेदी जोन में किसी नये होटल/रिजार्ट या वाणिज्यिक प्रतिष्ठान का संन्निर्माण अनुRात नह_ होगा।

(4) प्राकृ तिकप्राकृ तिकप्राकृ तिकप्राकृ तिक िवरासतिवरासतिवरासतिवरासत....————पारिस्थितिकी संवेदी जोन में ब)मूल्य प्राकृ तिक िवरासत के सभी स्थलों जैसे कि सभी जीन पूल रिजर्व क्षेत्र, शैल संरचना, जल प्रपात, झरने, दरk, उपवन, गुफाएं, स्थल, वनपथ, रोहण मार्ग, उत्प्रपात आदि की पहचान की जाएगी तथा उनकी सुरक्षा एवं संरक्षण के लिए विरासत संरक्षण योजना बनायी जाएगी जो आंचिलक महायोजना का भाग होगी ।

(5) मानव नि र्मत विरासत स्थमानव नि र्मत विरासत स्थमानव नि र्मत विरासत स्थमानव नि र्मत विरासत स्थलललल....————पारिस्थितिकी संवेदी जोन में भवनों, संरचनाओं, कृ त्रिम क्षेत्रों, ऐितहािसक, कलात्मक और सांस्कृ तिक महत्व के क्षेत्रों की पहचान की जाएगी और उनके संरक्षण के लिए विरासत संरक्षण योजना बनायी जाएगी जो आंचिलक महायोजना का भाग होगी।

(6) ध्वध्वध्वध्वनि प्रदूषणनि प्रदूषणनि प्रदूषणनि प्रदूषण– तेलंगाना राज्य सरकार का पर्यावरण िवभाग या राज्य प्रदूषण नियंत्रण बोर्ड, पर्यावरण (संरक्षण) अिधिनयम, 1986 के अधीन बने ध्वनि प्रदूषण (िविनयमन और नियंत्रण) िनयम, 2000 के उपबंधों के अनुसार पारिस्थितकी संवेदी जोन में ध्वनि प्रदूषण के नियंत्रण संबंधी विनियमों को लागू करेगा ।

(7) वायुवायुवायुवायु प्रदूषणप्रदूषणप्रदूषणप्रदूषण - पारिस्थिितकी संवेदी जोन में, वायु प्रदूषण का िनवारण एवं नियंत्रण, वायु (प्रदूषण िनवारण और नियंत्रण) अिधिनयम, 1981 (1981 का 14) के उपबंधो और उसके अधीन बनाए गए नियमों के अनुसार किया जाएगा ।

(8) बहि(cid:25)ावबहि(cid:25)ावबहि(cid:25)ावबहि(cid:25)ाव काकाकाका निस्सारणनिस्सारणनिस्सारणनिस्सारण - पारिस्थितिकी संवेदी जोन में उपचारित बहिzावों का निस्सारण, पर्यावरण (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए नियमों के अन्तर्गत शािमल किए गए पर्यावरणीय प्रदूषण के निस्सारण संबंधी साधारण मानकों या राज्य सरकार द्वारा नियत मानकों के अनुसार किया जाएगा।

(9) ठोसठोसठोसठोस अपशिष्ट अपशिष्ट अपशिष्ट अपशिष्ट ---- ठोस अपशिष्टों का िनपटान और प्रबंधन निम्नलिखित रूप में होगा-

(क) पारिस्थितिकी संवेदी जोन में ठोस अपशिष्ट का िनपटान भारत सरकार के पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय की अधिसूचना सं. का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाशित ठोस अपशिष्ट प्रबंधन िनयम, 2016 के उपबंधों के अनुसार किया जाएगा। गैर-जैिवक पदाथp का िनपटान पारिस्थितिकी संवेदी जोन से बाहर चिन्हित किए गए स्थान पर पर्यावरण-अनुकू ल रीित से किया जाएगा;

(ख) पारिस्थितिकी संवदी जोन के भीतर मान्य प्रौद्योगिकियों (ईएसएम) का प्रयोग करते )ए विद्यमान नियमों और विनियमों के अनुरूप ठोस अपिशष्ट का सुरक्षित और पर्यावरण अनुकू ल प्रंबंधन अनुRात किया जायेगा।

(10) जैव चिकिजैव चिकिजैव चिकिजैव चिकित्सात्सात्सात्सा अपशिष्टअपशिष्टअपशिष्टअपशिष्ट- (क) जैव चिकित्सा अपशिष्ट का निपटान निम्न प्रकार से किया जाएगा:-

(क) पारिस्थितिकी संवेदी जोन में जैव चिकित्सा अपशिष्ट का िनपटान भारत सरकार के पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय की समय –समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 343 (अ), तारीख 28 मार्च, 2016 के तहत प्रकाशित जैव चिकित्सा अपशिष्ट प्रबंधन िनयम, 2016 के उपबंधों के अनुसार किया जाएगा ।

(ख) पारिस्थितिकी संवदी जोन के भीतर मान्य प्रौद्योगिकियों (ईएसएम) का प्रयोग करते )ए विद्यमान नियमों और विनियमों के अनुरूप जैव-चिकित्सा अपिशष्ट का सुरक्षित और पर्यावरण अनुकू ल ठोस प्रंबंधन अनुRात किया जायेगा।

प्लास्टिक अपशिष्ट प्रबंधन: ---- पारिस्थितिकी संवेदी जोन में प्लास्टिक अपशिष्ट का प्रबंधन, भारत सरकार के पर्यावरण, (11) प्लास्टिक अपशिष्ट प्रबंधन: प्लास्टिक अपशिष्ट प्रबंधन: प्लास्टिक अपशिष्ट प्रबंधन:

वन और जलवायु परिवर्तन मंत्रालय की समय –समय पर यथा संशोिधत अधिसूचना सं.सा.का.नि 340(अ), तारीख 18 मार्च, 2016 के तहत प्रकाशित प्लास्टिक अपशिष्ट प्रबंधन िनयम, 2016 के उपबंधो के अनुसार किया जाएगा।

निर्माण और विध्वंस अपशिष्ट प्रबंधन: ---- पारिस्थितिकी संवेदी जोन में निर्माण और विध्वंस अपशिष्ट का प्रबंधन, भारत (12) निर्माण और विध्वंस अपशिष्ट प्रबंधन: निर्माण और विध्वंस अपशिष्ट प्रबंधन: निर्माण और विध्वंस अपशिष्ट प्रबंधन:

सरकार के पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय की समय –समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 317(अ), तारीख 29 मार्च, 2016 के तहत प्रकाशित संनिर्माण और विध्वंस अपशिष्ट प्रबंधन नियम, 2016 के उपबंधों के अनुसार किया जाएगा।

(13) ईईईई––––अपशिष्टअपशिष्टअपशिष्टअपशिष्ट::::---- पारिस्थितिकी संवेदी जोन में ई–अपशिष्ट का प्रबंधन, भारत सरकार पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय द्वारा प्रकाशित ई–अपशिष्ट प्रबंधन िनयम, 2016 समय –समय पर यथा संशोिधत के उपबंधों के अनुसार किया जाएगा।

(14) वाहनवाहनवाहनवाहन----यातायातयातायातयातायातयातायात: : : : ---- वाहन-यातायत का संचलन आवास-अनुकू ल तरीके से िविनयिमत किया जाएगा और इस संबंध में आंचलिक महायोजना में विशेष उपबंध शािमल किए जाएंगे तथा आंचिलक महायोजना के तैयार होने और राज्य सरकार केभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 7 सक्षम प्राधिकारी द्वारा अनुमोदित किए जाने तक, िनगरानी सिमित प्रासंगिक अधिनियमों और उनके तहत बनाए गए नियमों एवं विनियमों के अनुसार वाहनों की आवाजाही के अनुपालन की िनगरानी करेगी।

(15) वाहन वाहन वाहन वाहन जिनतजिनतजिनतजिनत प्रदूषणप्रदूषणप्रदूषणप्रदूषण::::---- वाहन प्रदूषण की रोकथाम और नियंत्रण लागू विधियों के अनुसार किया जाएगा। स्वAछतर (cid:135)धन जैसे कि सीएनजी, एलपीजी आदि के प्रयोग के प्रयास किए जाएंगे ।

(16) औद्योगिक ईकाइयांऔद्योगिक ईकाइयांऔद्योगिक ईकाइयांऔद्योगिक ईकाइयां: : : : ---- (i) सरकारी राजपत्र में इस अिधसूचना के प्रकाशन की तारीख को या उसके बाद पारिस्थितिकी संवेदी जोन के भीतर किसी भी नए प्रदूषणकारी उद्योग की स्थापना अनुRात नह_ की जायेगी।

(ii) जब तक इस अधिसूचना में विनिCर्दष्ट न हो, पारिस्थितिकी संवेदी जोन में कें (cid:21)ीय प्रदूषण नियंत्रण बोर्ड द्वारा फरवरी, 2016 में जारी दिशानिदkशों में किए गए उद्योगों के वर्गीकरण के अनुसार के वल गैर प्रदूषणकारी उद्योगों की स्थापना अनुRात की जायेगी। इसके अतिरिक्त, गैर-प्रदूषणकारी कु टीर उद्योगों को बढ़ावा दिया जायेगा।

(17) पहाड़ीपहाड़ीपहाड़ीपहाड़ी ढलानोंढलानोंढलानोंढलानों काकाकाका संरक्षणसंरक्षणसंरक्षणसंरक्षण: : : : ---- पहाड़ी ढलानों का संरक्षण निम्नानुसार किया जायेगा:

(क) आंचलिक महायोजना में पहाड़ी ढलानों के उन क्षेत्रों को दर्शाया जाएगा जिनमें किसी भी संनिर्माण की अनुमित नह_ होगी ।

(ख) िजन विद्यमान खड़ी पहाड़ी ढलानों या ढलानों में अत्यधिक भू-क्षरण होता है, उनमें कोई भी संनिर्माण अनुRात नह_ किया जायेगा ।

कें (cid:21)ीय सरकार, पर्यावरण (संरक्षण) अधिनियम, 1986 (1986 का 29) की धारा 3 की उपधारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते )ए, पारिस्थितिक संवेदी जोन की प्रभावी निगरानी के लिए जिला स्तर पर एक िनगरानी सिमित गठित करती है, जो निम्नलिखित से िमलकर बनेगी:--

(1) िनगरानी सिमित इस अिधसूचना के उपबंधों के अनुपालन की िनगरानी करेगी।

(2) निगरानी समिति का कार्यकाल तीन वर्ष या राज्य सरकार द्वारा नई समिति का पुन: गठन किए जाने तक होगा और बाद में िनगरानी सिमित राज्य सरकार द्वारा गठित की जाएगी।

(3) िनगरानी सिमित उन oियाकलापों को अनुRात नह_ करेगी जो भारत सरकार के तत्कालीन पर्यावरण और वन मंत्रालय की अधिसूचनाओं अर्थात् पर्यावरण प्रभाव मूल्यांकन अिधसूचना, 2006 सं.का.आ.1533 (अ), तारीख 14 िसतंबर, 2006 और तटीय िविनयम जोन, 2011 सं.का.आ 19 (अ), तारीख 6 जनवरी, 2011 तथा इनमें किए गए परिवर्ती संशोधनों की अनुसूची के अंतर्गत आते हैं और जो पारिस्थितिकी संवेदी जोन की सीमा में भी आते हैं जिनमें इस अधिसूचना के पैरा-4 में दी गई सारणी में यथाविनिCर्दष्ट प्रतिषिQ oियाकलाप भी शािमल हैं। के वल (cid:136)ेत Jेणी के उद्योगों को ही के न्(cid:21)ीय प्रदूषण नियंत्रण बोर्ड द्वारा ''उद्योगों के वर्गीकरण, 2016'' के लिए जारी मार्गदर्शी सिQांतों में विनिCर्दष्ट माना जाएगा।

(4) वे oियाकलाप, जो भारत सरकार के तत्कालीन पर्यावरण और वन मंत्रालय की अिधसूचना सं. का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 और का.आ. 19 (अ), तारीख 6 जनवरी, 2011 की अनुसूची के अंतर्गत नह_ आते हैं और जो पारिस्थितिकी संवेदी जोन की सीमा में आते हैं, उनकी, इस अिधसूचना के पैरा-4 में दी गई सारणी में यथा विनिCर्दष्ट प्रतिषिQ oियाकलापों के िसवाय, वास्तविक स्थल–विशिष्ट दशाओं के आधार पर निगरानी समिति द्वारा संवीक्षा की जाएगी और उन्हें संबंिधत विनियामक प्राधिकरणों को भेजा जाएगा।

(5) िनगरानी सिमित का सदस्य-सिचव या संबंिधत आयुक्त कलेक्टर अिधसूचना के उपबंधों का उल्लंघन करने वाले किसी <क्ति के वि(cid:16)Q पर्यावरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अंतर्गत शिकायत दर्ज करने के िलए सक्षम होगा ।

(6) िनगरानी सिमित प्रत्येक मामले में आवश्यकताओं के आधार पर संबंधित विभागों के प्रतिनिधियों या विशेषRों, औद्योगिक संघों के प्रतिनिधियों या संबंिधत पक्षों को अपने िवचार-विमर्श में सहायता के िलए आमंत्रित कर सके गी ।

(7) िनगरानी सिमित प्रत्येक वर्ष 31 मार्च की स्थिति के अनुसार अपनी वा1र्षक कार्रवाई रिपोर्ट राज्य के पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय में मुख्य वन्यजीव वार्डन को, उपाबंधउपाबंधउपाबंधउपाबंध IVIVIVIV में दिए गए प्रपत्र के अनुसार, उस वर्ष की 30 जून तक प्रस्तुत करेगी ।

(8) के न्(cid:21)ीय सरकार का पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय िनगरानी सिमित को उसके कृ त्यों के प्रभावी निर्वहन के िलए ऐसे िनदेश दे सके गा जो वह उिचत समझे ।

7.7.7.7. इस अधिसूचना के उपबंधों को प्रभावी बनाने के लिए कें (cid:21)ीय सरकार और राज्य सरकार, अतिरिक्त उपाय, यदि कोई हों, विनिCर्दष्ट कर सकें गी ।

उत्तरउत्तरउत्तरउत्तर ((((खखखख सेसेसेसे ङ):- इसके बाद पारिस्थितिकी संवेदी जोन सीमा रेखा कम्पाटर्मेंट सं. 427, 415, 414. की उत्तरी सीमाओं से '1' किलोमीटर की चौड़ाई के साथ आडे ितरछे ढंग से स्टेशन 'बी' से उत्तर-पूर्व दिशा की ओर जाती है। इसके बाद सीमा रेखा कम्पाटर्मेंट सं. 66. के दक्षिण- पrिम कोण से 1 किलोमीटर की चौड़ाई के साथ राजीव गांधी वन्यजीव अभयारGय की उत्तरी सीमा के साथ जाती है। इसके बाद सीमा रेखा कम्पाटर्मेंट सं. 66, 68 की पrिम सीमाओं से 1 किलोमीटर की चौड़ाई के साथ उत्तरी दिशा की ओर जाती है और द_दी के नदी तट से िमलती है। इसके बाद सीमा रेखा कम्पाटर्मेंट सं 68, 70, 71, 73, 74, 483, 485, 486 की उत्तरी सीमाओं से 1 किलोमीटर की चौड़ाई के साथ आडे ितरछे ढंग में पूर्वी दिशा की ओर जाती है और मानिचत्र पर दर्शाये गये स्टेशन 'सी' से िमलती है। स्टेशन 'सी' की जीपीएस रिडिंग 16.49868 उ, 78.96141 पू. है। इसके बाद इस पारिस्थितिकी संवेदी जोन की सीमा कम्पाटर्मेंट सं. 131, 132, 133, 134, 152, 153, 156 और 158 की पrिमी सीमा के साथ आडे ितरछे ढंग में उत्तर-पrिम की ओर स्टेशन 'सी' से स्टेशन 'डी' प)ंचती है। स्टेशन 'डी' की जीपीएस रिडिंग 16.56170 उ, 78.86522 पू है। स्टेशन 'डी' से पारिस्थितिकी संवेदी जोन की सीमा कम्पाटर्मेंट सं 158, 157, 155, 150, 149, 148, 147, 145, 144, 139, 140, 143, 142, 141. के साथ 1 किलोमीटर की दूरी से पूर्व की ओर जाती है । इसके बाद सीमा रेखा उत्तर पrिमी दिशा में जाकर, पूर्वी दिशा की ओर मुडकर कम्पाटर्मेंट सं. 84 से जाती है और कम्पाटर्मेंट सं. 86 और 87 की सीमा के साथ पrिम की ओर मुडकर और स्टेशनभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 15 'इ' पर प)ंचती है। स्टेशन 'इ' की जीपीएस रिडिंग 16.6372 उ, 79.09694 पू है और फिर पूर्व की ओर मुडकर और कम्पाटर्मेंट सं 84, 81. के साथ जाती है। इसके बाद रेखा कम्पाटर्मेंट सं 76 के साथ उत्तर की ओर जाकर कम्पाटर्मेंट सं 76 के चारों ओर जाती है और स्टेशन 'एफ' पर प)ंचती है । स्टेशन 'एफ' की जीपीएस रिडिंग 16.65518 उ, 79.21902 पू है और फिर दक्षिण की ओर मुडकर कम्पाटर्मेंट सं. 77 की सीमा के साथ पूर्व की ओर जाती है। इसके बाद सीमा रेखा कम्पाटर्मेंट सं 78, की सीमा के साथ जाकर, उत्तर की ओर मुडकर कम्पाटर्मेंट सं 72, 73, 67 की उत्तरी सीमा के साथ पूर्व की ओर जाती है। इसके बाद सीमा रेखा पूर्व की ओर जाकर और हिलया नदी को पार करके स्टेशन 'जी' पर प)ंचती है। स्टेशन 'जी' की जीपीएस रिडिंग 16.71829 उ 79.42869 पू है।

पूर्वपूर्वपूर्वपूर्व ((((जीजीजीजी सेसेसेसे एचएचएचएच)))) :- पारिस्थितिकी संवेदी जोन की सीमा रेखा इसके बाद कम्पाटर्मेंट सं 59, 60, 61 और 62 के साथ हिलया नदी के तट से 1 किलोमीटर की दूरी में दक्षिणी दिशा की ओर जाकर कृ ष्णा नदी के बाएं तट पर प)ंचती है जो स्टेशन 'एफ' है। स्टेशन 'एच' की जीपीएस रिडिंग 16.62432 उ 79.47473 पू है। पारिस्थितिकी संवेदी जोन की सीमा रेखा स्टेशन 'पी' से हिलया नदी से 100 मीटर की दूरी पर जाती है। स्टेशन. 'पी' की जीपीएस रिडिंग 16.63645 उ, 79.43406 पू है और फिर दक्षिण की ओर जाती है जो स्टेशन 'क्यू' है। स्टेशन 'क्यू' की जीपीएस रिडिंग 16.59614 उ, 79.42430 पू है और कम्पाटर्मेंट सं 69 के दक्षिण-पूर्वी किनारे की ओर पूर्व मे मुडकर स्टेशन 'आर' प)ंचती है स्टेशन 'आर' की जीपीएस रिडिंग 16.59191 उ, 79.38362 पू है। इसके बाद रेखा कम्पाटर्मेंट सं. 69 एवं 68 की पूर्वी सीमा के साथ उत्तर पrिम की ओर जाती है और स्टेशन 'एस' प)ंचती है। स्टेशन 'एस'की जीपीएस रिडिंग 16.63619 उ, 79.36404 पू है और फिर पूर्व की ओर मुडकर कम्पाटर्मेंट सं 64 की सीमाओं के साथ जाती है और स्टेशन 'पी' प)ंचती है जो आरंभ बिंदु है।

पारिस्थितिकी संवेदी जोन की रेखा स्टेशन 'डब्ल्यू' से आरंभ होती है। स्टेशन 'डब्ल्यू' की जीपीएस रिडिंग 16.64854 उ, 79.33655 पू है और फिर दक्षिण पrिमी की कम्पाटर्मेंट सीमा से 1 किलोमीटर की दूरी में कम्पाटर्मेंट सं 68, 69, 70 के समान्तर जाती है और स्टेशन 'एक्स' पर प)ंचती है। स्टेशन 'एक्स' की जीपीएस रिडिंग 16.64062 उ, 79.34465 पू है,पर इसके बाद कम्पाटर्मेंट 71 की पूर्वी सीमा के साथ उत्तर की ओर मुडती है और स्टेशन 'वाई' पर प)ंचती है । स्टेशन 'वाई' की जीपीएस रिडिंग 16.63083 उ, 79.33206 पू है और फिर कम्पाटर्मेंट सं 72, 73 की सीमा के साथ उत्तर पूर्व की ओर मुडकर और स्टेशन 'जेड' पर प)ंचती है । स्टेशन 'जेड' की जीपीएस रिडिंग 16.63710 उ, 79.32887 पू है पर इसके बाद यह रेखा कम्पाटर्मेंट सं 68 की ओर दक्षिण पूर्व में मुडती है और आरंभ बिंदु 'डब्ल्यू' पर प)ंचती है

S.O. 1123(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

Draft Notification

WHEREAS, the Amrabad Tiger Reserve (A.T.R) is situated in the Nallamalais – an offshoot of Southern – Eastern Ghats in Telangana and is spread over an area of 2611.09 square kilometres. It is geographically located between 16.006207 and 16.713067 North Latitudes and 78.415603 and 79.46740 East Longitudes. This sanctuary epitomizes typical, physical and biological features of Deccan plateau.

AND WHEREAS, the Amrabad Tiger Reserve is the northern part of erstwhile Rajiv Gandhi Wildlife Sanctuary and Nagarjunasagar Srisailam Tiger Reserve, north of River Krishna located in Mahabub Nagar and Nalgonda Districts. The Tiger Reserve falls in two (2) Divisions namely, Achampet Wildlife Management Division and Nagajunasagar Wildlife Management Division.

AND WHEREAS, the Amrabad Tiger Reserve is an abode for rich bio-diversity, especially for many endangered flora and its associated fauna. This sanctuary is decorated with mosaic of geo-morphological diversity, streams draining into River Krishna and a variety of floral and faunal species. Most of the area is hilly with plateaus, ridges, gorges and deep valleys which support tropical mixed dry deciduous forests with an under growth of bamboo and grass;

AND WHEREAS, the Amrabad Tiger Reserve harbors some of the wide variety of flora and fauna because of its location in Deccan plateau. As per zoo-geographic classification, this area comes under Indo-Malayan region native to the true Indian fauna like the Nilgai (Boselaphus tragocamelus), Black buck (Antilope cervicapra) and four horned antelope (Tetracerus quadricornis), etc. Over 80 species of mammals, 303 species of birds, 54 species of reptiles, 20 species of amphibians, 55 fish species of, 101 species of Butterflies, 57 species of Moths, 45 species of coleopterans, 35 species of odonata are found in the area. The main fauna include Tiger (Panthera tigris), Panther (Panthera pardus) Wolf (Canis lupus), Jackal (Canis aureus), Sambar (Rusa unicolor), Chital (Axis axis), Chinkara (Gazella bennettii), Mouse Deer (Moschus sp.), Wild boar (Sus scrofa) and Porcupine. The river Krishna has Mugger, Otters and Turtle populations. Rare species include Mouse Deer (Tragulidae species). Apart from these there is a wide array of invertebrate fauna;

AND WHEREAS, the Tiger Reserve also harbours endemic species like Andrographis nallamalayana, Eriola enalushingtonii, etc. It has been estimated that there are 743 taxa spread over 109 families occurring in Nallamala along with 29 species of grasses and 353 species of Medicinal plants. Southern dry mixed deciduous forest overlap with the teak bearing forests where the geological formation is basic and the soil is loamy to black cotton. Teak is present in varying proportion particularly localized to loamy riverbanks and in small patches in favorable sites. The main characteristic trees are Tectona grandis, Terminalia tomentosa, Terminalia bellerica, Lagerstroemia parviflora,18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

Chloroxylon swietenia, Boswellia serrata, Soymida febrifuga, Madhuca indica, Buchanania latifolia, Sterculi aurens,

Anogeissus latifolia, Kydia calycina and Butea frandosa;

AND WHEREAS, it is necessary to conserve and protect the area around the protected area of Amrabad Tiger Reserve as Eco Sensitive Zone from ecological and environmental point of view;

NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from 0 to 1 kilometre around the boundary of Amrabad Tiger Reserve in the State of Telangana as the Amrabad Tiger Reserve Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies from 0 to 1 kilometre around the Amrabad Tiger Reserve. Zero extent is towards the Southern side adjoining Nagarjunasagar Tiger Reserve of Andhra Pradesh. The Eco-sensitive zone starts from boundary of the buffer zone of Amrabad Tiger Reserve in Achampet Division and extends towards Nagarjunasagar Division with a width of 1 Km along the boundary of the Tiger Reserve. The area of the Eco-Sensitive Zone is 315 square kilometers.

(2) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure I and map displaying the location of villages is appended as Annexure I (A). The list of geo co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure I (B) and (C) respectively.

(3) The Eco- Sensitive Zone of Amrabad Tiger Reserve is situated between 16.000197 to 16.717876 North latitudes and 78.403642 to 78.24 E to 79.473548 East longitudes. The boundary description of the Eco Sensitive Zone is appended at Annexure II.

(4) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure III.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is

specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by

the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the

ecological and environmental considerations into the said plan:

(i) Environment,

(ii) Forest and Wildlife,

(iii) Agriculture and Horticulture,

(iv) Revenue,

(v) Urban Development,

(vi) Tourism including eco-tourism,

(vii) Rural Development,

(viii) Irrigation and Flood Control,

(ix) Municipal and Urban Development,

(x) Panchayati Raj, and

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Landuse.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco- sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities.

(b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:

(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Construction and renovation of infrastructure and civic amenities;

(iii) Small scale industries not causing pollution;

(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) Promoted activities and given under para 4.

(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

(d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

(e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities.

(2) Natural Springs.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.

(3) Tourism/Eco-Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b)The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The activities of eco-tourism shall be regulated as under, namely:-

(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;

(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or Telangana State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-medical waste.- Bio medical waste management shall be as under:

(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.

(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.

(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.

(17) Protection of Hill Slopes: The protection of hill slopes shall be as under:

(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-

5. Monitoring Committee.- In exercise of the powers conferred by sub-section (3) of section 3 (1) of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes the first Monitoring Committee, for effective monitoring of the Eco Sensitive Zone, which shall comprise of, namely:-

(i) District Collector, Nagarkurnool District - Chairperson;

(ii) Field Director, Amrabad Tiger Reserve- Special Invitee;

(iii) One representative of non-Governmental Organisation (working in the field of environment including heritage conservation) to be nominated by the State Government- Member;

(iv) Regional Officer, Telangana State Pollution Board, Nagarkurnool- Member;

(v) Senior Town Planner /District Panchayat Officer, Nagarkurnool- Member;

(vi) Forest Divisional Officers, Achampet, Amrabad, WLM Nagarjunasagar- Members;

(vii) An expert in Ecology and environment to be nominated by the State Government-

Member;

(viii) An expert in Biodiversity to be nominated by the State Government- Member;

(ix) District Forest Officer, Nagarkurnool- Member secretary.

Terms of Reference.-

(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.

(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment, 2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E) dated 6th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for "classification of Industries, 2016".

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and S.O. 19 (E) dated 6th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.

(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per proforma appended at Annexure IV.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal.

West (A to B) :- The Eco-Sensitive Zone boundary line starts from station 'A' as shown on the map (Left Bank of River Krishna). The GPS reading of station 'A' is 16.07257 N, 78.45574 E. Thence the boundary line runs towards North – West direction in Zig – Zag manner with a width of '1' Kms from Western boundaries of Compartment Nos. 435, 433, 432, 430, 424, 425, 426, 427 and meets at station 'B' as shown on the map. The GPS reading of station 'B' is 16.22473 N, 78.42302 E.

North (B to E) :- Thence the Eco-Sensitive Zone boundary line runs North - East direction from Station 'B' in Zig – Zag manner with a width of '1' Km from Northern boundaries of Compartment Nos. 427, 415, 414. Thence the boundary line runs along northern boundary of Rajiv Gandhi Wildlife Sanctuary with a width of 1 Km up to South-West corner of Compartment No. 66. Thence the boundary line runs towards Northern direction with a width of 1 Km from western boundaries of Compartment Nos. 66, 68 and meets River bank of Dindi. Thence the boundary line runs towards Eastern direction in Zig-Zag manner with a width of 1 Km from northern boundaries of Compartment No. 68, 70, 71, 73, 74, 483, 485, 486 and meets at Station 'C' as shown on the map. The GPS reading of Station 'C' is 16.49868 N, 78.96141 E. Thence the Eco-Sensitive Zone boundary runs from Station 'C' towards northwest in a zigzag manner along the western boundary of Compartment No. 131, 132, 133, 134, 152, 153, 156 and 158 to reach station 'D'. The GPS readings of station 'D' is 16.56170 N, 78.86522 E. From station 'D' the Eco-Sensitive Zone boundary runs towards east at a distance of 1 Km along the Compartment No.: 158, 157, 155, 150, 149, 148, 147, 145, 144, 139, 140, 143, 142, 141. Thence the boundary line runs in a north-westerly direction, takes a turn in easterly direction and runs up to Compartment No. 84 and turns west along boundary of Compartment No. 86 and 87 and reaches Station 'E'. The GPS readings of station 'E' are 16.6372 N, 79.09694 E and turns towards east and runs along Compartment No. 84, 81. Thence the line runs towards north along Compartment No. 76 and after going around compartment No. 76 and reaches Station 'F'. The GPS readings of station 'F' are 16.65518 N, 79.21902 E and takes turn to south and then east to run along boundary of Compartment No. 77. The line then runs along boundary of Compartment No. 78, turns north and then east to run along northern boundary of Compartment No. 72, 73, 67. The line then runs towards east and crosses Halia River to reach Station 'G'. The GPS Readings of Station 'E' are 16.71829 N 79.42869 E.

East (G to H) :- The Eco-Sensitive Zone boundary line then runs towards southern direction at a distance of 1 Km from the banks of Halia River along Compartment No. 59, 60, 61 and 62 to reach the left bank of River Krishna which is Station 'F'. The GPS Readings of Station 'H' are 16.62432 N 79.47473 E. The Eco-Sensitive Zone boundary line also runs at a distance of 100 metres from Halia River from Station 'P'. The GPS readings of Station 'P' are 16.63645 N, 79.43406 E and runs down south which is station 'Q'. The GPS readings of Station 'Q' are 16.59614 N, 79.42430 E and turns east towards south-eastern corner of Compartment No. 69 to reach Station 'R'. The GPS readings of Station 'R' are 16.59191 N, 79.38362 E. The line then runs North West along the eastern boundary of Compartment No. 69 & 68 to reach Station 'S'. The GPS readings of Station 'S' are 16.63619 N, 79.36404 E and takes a turn towards east and travels along the boundaries of Compartment No. 64 and reaches Station 'P' which is the start point. The Eco-28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Sensitive Zone line starts at Station 'W'. The GPS Readings of station 'W' are 16.64854 N, 79.33655 E and runs parallel to Compartment No. 68, 69, 70 at a distance of 1 Km from the Compartment boundary travelling south west and reaches Station 'X'. The GPS readings of the station 'X' are 16.64062 N, 79.34465 E, then takes a turn towards north along the eastern boundary of Compartment No. 71 and reaches Station 'Y'. The GPS Readings of Station 'Y' are 16.63083 N, 79.33206 E and turns to north east along the boundary of Compartment No. 72, 73 and reaches Station 'Z'. The GPS Readings of the Station 'Z' are 16.63710 N, 79.32887 E. The line then turns south east towards Compartment No. 68 and reaches the start point 'W'.

South (H to A): -The boundary of Eco-Sensitive Zone then runs along River Krishna in south western and western direction which is also the state boundary between Telangana and Andhra Pradesh to reach station 'A' which is the starting point.
