फाफाफाफा.... संसंसंसं.1.1.1.1----100/100/100/100/एस पी पी एस पी पी एस पी पी एस पी पी ए ए ए ए आरआरआरआर----अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना/सीटीआर//सीटीआर//सीटीआर//सीटीआर/एफएसएसएआईएफएसएसएआईएफएसएसएआईएफएसएसएआई----2016201620162016.—कतिपय विनियमों का प्रारूप खाद्य सुरक्षा और मानक (संदूषक, आविष और अवशिष्ट) विनियम, 2011 का और संशोधन करने के िलए, जिसे भारत के राजपत्र, असाधारण, भाग III, खंड 4, में भारतीय खाद्य सुरक्षा और मानक प्राधिकरण की अिधसूचना 1-100/एस पी पी ए आर-अिधसूचना/सीटीआर/एफएसएसएआई-2016, तारीख 18 अप्रैल, 2017, खाद्य सुरक्षा और मानक अधिनियम, 2006 (2006 का 34) की धारा 92 की उपधारा (1) की अपेक्षानुसार उन सभी 9क्तियों की जानकारी के लिए प्रकाशित किया गया था, जिनके उससे प्रभावित होने की संभावना है, उस तारीख से जिसको उक्त अधिसूचना में अंत@वष्ट राजपत्र की प्रतियाँ जनता को उपलब्ध करा दी गई थी, तीस दिन की अविध की समाप्ति से पूर्व आक्षेप या सुझाव आमंत्रित किए गए थे;

और उक्त राजपत्र की प्रतियाँ, जनता को 25 अप्रैल , 2017 को उपलब्ध करा दी गई थG;

और भारतीय खाद्य सुरक्षा और मानक प्राधिकरण द्वारा उक्त प्रारूप विनियमों के संबंध में जनता से प्राप्त आक्षेपों या सुझावों पर विचार किया गया है;

अत:, अब, भारतीय खाद्य सुरक्षा और मानक अधिनियम, 2006 (2006 का 34) की धारा 20 और 21 के साथ पठित धारा 92 की उपधारा (2) के खंड (झ) द्वारा प्रदत्त शक्तियों का प्रयोग करते Nए खाद्य सुरक्षा और मानक प्राधिकरण (संदूषक, आविष और अवशिष्ट) विनियम, 2011 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात्

(2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे।

2. खाद्य सुरक्षा और मानक (संदूषक, अविष तथा अवशिष्ट) िवनयम, 2011, के िविनयम 2.3, के उप-िविनयम 2.3.1,-

(1) खंड (2) की सारणी में,-

क) एल्Uिन, डाइल्Uिन (एल्Uिन और डाइल्Uिन अके ले या संकु क्त रूप से लागू होती है और उन्हें डाइल्Uिन के Xप में अभिYयक्त किया जाता है) से संबंधित [म संख्या 1 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ख) ''क्लोरडेन (अवशेष को सिस प्लस और ट्रान्स क्लोरडेन के रूप में मापा जाएगा)" से संबंधित [म संख्या 3 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ग) "डी.डी.टी (डी.डी.टी., डी.डी.डी. और डी.डी.ई. पर अके ले या संयुक्त रूप से लागु होती है)" से संबंिधत [म संख्या 4 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

घ) "डी.डी.टी (एकल)" से संबंधित [म संख्या 5 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ङ) "डी.डी.डी (एकल)" से संबंधित [म संख्या 6 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

च) "डी.डी.ई (एकल)" से संबंधित [म संख्या 7 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

छ) "डाईिजनोन" से संबंधित [म संख्या 8 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ज) "एन्डोसल्फान (अवशिष्टों को एन्डोसल्फान ए और बी और एन्डोसल्फान-सल्फे ट के कु ल योग के Xप में 9क्त किया जाएगा)" से संबंधित [म संख्या 12 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

झ) "एन्डोसल्फान-ए" से संबंधित [म संख्या 13 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ञ) "एन्डोसल्फान-बी" से संबंधित [म संख्या 14 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ट) "एन्डोसल्फान-सल्फे ट" से संबंधित [म संख्या 15 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ठ) "फै निट्रोथियम" से संबंधित [म संख्या 16 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ड) "हेप्टाक्लोर (हेप्टाक्लोर और उसके अपोक्साईड की सम्मिलित अवशिष्ट को हेप्टाक्लोर के Xप में अवधारित और Yयक्त किया जाएगा)" से संबंधित [म संख्या 17 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ढ) "गामा (λ) आईसोमर (जिसे लिडेन के Xप में जाना जाता है)" से संबंधित [म संख्या 21 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

ण) "पैराथोन मैिथल" (पैराथोन मैथिल और इसके ऑक्सीजन एनालॉग की सम्मिलत अवशिष्टो को पैराथोन मैथिल के Xप में अवधारित और Yयक्त किया जाएगा)" से संबंधित [म संख्या 24 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

त) "फोरमथायन" (डायनोथूईट तथा इसके ऑक्सीजन अनुरूप के रूप में अवधारित और डाईमेथोएट के रूप में अभियक्त किया जायेगा सिवाय इसके कि सिट्रस फल के मामले में जंहा इसे फॉरमोथाईन के रूप में अवधारित किया जायेगा) से संबंधित [म संख्या 32 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

थ) "मोनो[ोटोफॉस" से संबंिधत, [म संख्या 33 के सामने स्तम्भ (3) और (4) की निम्नलिखित प्रविष्टियों का लोप किया जाएगा,अर्थात्;-

खाद्य सहन सीमा मि.fा./कि.fा.(पी.पी.एम्.) (3) (4)

"गाजर, शलजम, आलू और चुकं दर 0.05

प्याज और मटर 0.1

अन्य सब्जियां 0.2"

द) "एल्डीकार्ब (एल्डीकार्ब उसके सल्फोक्साईड और सल्फोन का योग जो एल्डीकार्ब के Xप में अभि Yयक्त हो)" से संबंधित [म संख्या 40 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

प) "फै न्थियोन (फै न्थियोन और इसके ऑक्सीजन एनालॉग तथा उनके सल्फोक्साईड तथा सल्फोन्स का योग जिन्हें फै न्थियोन के Xप में Yयक्त किया जाता है) से संबंधित [म संख्या 50 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

फ) [म संख्या 52 में स्तम्भ 2 के मद (क) की प्रविष्टियो "फबर्म या जीरम के उपयोग से परिणामी डाइमिथाइल डाइथाईलकाब्रोमेiस अवशिष्ट" के स्थान पर निम्निलिखत प्रविष्टि रखी जाएगी, अर्थात- "जीरम के उपयोग के परिणामस्वरूप डाइमिथाइल डाइथाईलकाब्रोमेiस के अवशेष"

ब) "िसमेजाईन" से संबंधित [म संख्या 55 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

भ) "कै प्टाफोल" से संबंधित [म संख्या 60 तथा स्तम्भ (3) और (4) में इससे संबंधित प्रविष्टियों का लोप किया जाएगा;

(II) खjड (2) और तदधीन होने वाली सारणी के पkात किन्तु स्पष्टीकरण से पूर्व, निम्नलिखित खjड अंतःस्थापित किया जाएगा, अर्थात्-

"(3) स्तम्भ 2 में उल्लेखित निम्निलखित कीटनाशक, कीटनाशी अधिनियम 1968(1968 का 46) के अनुसार पाबंदी हैं:-

टिप्पणटिप्पणटिप्पणटिप्पण : डीडीटी को छोड़कर, िजसके िलए 0.05 एमजी/किfा होगा, ऊपर उल्लिखित प्रतिबंधित कीटनाशकों की बाt एमआरएल 0.01 मि.fा. /किfा होगी।"

NOTIFICATION

New Delhi, the 19th March, 2018

F. No. 1-100/SPPAR-NOTIFICATION-CTR/FSSAI/2016.—Whereas the draft of certain regulations, further to amend the Food Safety and Standards (Contaminants, toxins and Residues) Regulations, 2011, was published as required under sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) vide notification of the Food Safety and Standards Authority of India number 1-100/SPPAR-Notification-CTR/FSSAI/2016, dated the 18th April, 2017 in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections or suggestions from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas the copies of the said Gazette were made available to the public on the 25th April, 2017;

And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food safety and Standards Authority of India;

Now, therefore, in exercise of the powers conferred by clause (i) of sub- section (2) of section 92 read with section 20 and 21 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Contaminants, toxins and Residues) Regulations, 2011, namely:-

1. Short title and Commencement.- (1) These regulations may be called the Food Safety and Standards (Contaminants, toxins and Residues) first Amendment Regulations, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Food Safety and Standards (Contaminants, toxins and Residues) Regulations, 2011, in regulation 2.3, in sub- regulation 2.3.1,-

(I) in clause (2), in the Table,-

(a) serial number 1 relating to Aldrin, dieldrin (the limits apply to aldrin and dieldrin singly or in any combination and are expressed as dieldrin) and the entries relating thereto in columns (3) and (4) shall be omitted;

(b) serial number 3 relating to "Chlordane (residue to be measured as cis plus trans chlordane)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(c) serial number 4 relating to "D.D.T. (The limits apply to D.D.T., D.D.D. and D.D.E. singly or in any combination)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(d) serial number 5 relating to "D.D.T. (singly)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(e) serial number 6 relating to "D.D.D. (singly)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(f) serial number 7 relating to "D.D.E. (singly)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(g) serial number 8 relating to "Diazinon" and the entries relating thereto in columns (3) and (4) shall be omitted;

(h) serial number 12 relating to "Endosulfan (residues are measured and reported as total of endosulfan A and B and endosulfan-sulphate)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(i) serial number 13 relating to "Endosulfan A" and the entries relating thereto in columns (3) and (4) shall be omitted;

(j) serial number 14 relating to "Endosulfan B" and the entries relating thereto in columns (3) and (4) shall be omitted;

(k) serial number 15 relating to "Endosulfan Sulphate" and the entries relating thereto in columns (3) and (4) shall be omitted;

(l) serial number 16 relating to "Fenitrothion" and the entries relating thereto in columns (3) and (4) shall be omitted;

(m) serial number 17 relating to "Heptachlor (combined residues of heptachlor and its epoxide to be determined and expressed as Heptachlor)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(n) serial number 21 relating to "Gamma (λ) Isomer (Known as Lindane)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(o) serial number 24 relating to "Parathion methyl (combined residues of parathion methyl and its oxygen analogue to be determined and expressed as parathion methyl)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(p) serial number 32 relating to "Formothion (Determined as dinethoate and its oxygen Analogue and expressed as dimethoate except incase of citrus fruits where it is to be determined as formothion)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(q) against serial number 33 relating to "Monocrotophos", the following entries in columns (3) and (4) shall be omitted,namely:-

(s) serial number 50 relating to "Fenthion (sum of fenthion, its oxygen analogue and their sulphoxides and sulphones expressed as fenthion)" and the entries relating thereto in columns (3) and (4) shall be omitted;

(t) in serial number 52, for the entries in column (2) of item (a) relating to "Dimethyl dithiocarbamates residue resulting from the use of ferbam or ziram" the following entries shall be substituted, namely;- "Dimethyl dithiocarbamates residue resulting from the use of ziram";

(u) serial number 55 relating to "Simazine" and the entries relating thereto in columns (3) and (4) shall be omitted;

(v) serial number 60 relating to "Captafol" and the entries relating thereto in columns (3) and (4) shall be omitted;

(II) after the clause (2) and the Table occurring thereunder but before the Explanation, the following clause shall be inserted, namely:-

"(3) The following insecticides mentioned in column (2) are banned as per the Insecticides Act, 1968 (46 of 1968):-

Note : The Extraneous MRL of the above mentioned banned insecticides shall be 0.01 mg/kg except for DDT for which it shall be 0.05 mg/kg. "
