2. प्रक्रिया पुस्तक 2015-20 के मौजूदा पैरा 4.07 के नीचे एक नया पैरा 4.07क जोड़ा गया है, जो निम्नानुसार हैः-

(i) अनुसमर्थन स्कीम से संबंधित नीति विदेश व्यापार नीति (2015-20) के पैरा 4.07क में प्रदान की गई है। परिशिष्ट-4ड. के अनुसार आवेदन पूर्ण ब्यौरे के साथ ऑनलाइन फाइल करना होगा और साथ ही परिशिष्ट-4ट के अनुसार सनदी इंजीनियर से प्राप्त प्रमाणपत्र भी प्रस्तुत करना होगा। ऐसे प्रमाणपत्र जारी करने के लिए सनदी इंजीनियर को अपनी क्षमता के क्षेत्र में ही कार्य करना होगा।

(ii) पैकिंग सामग्री और र्इंधन हेतु नीति सहित मानक निविष्टि उत्पाद मानदंड नामक पुस्तक में दी गई सामान्य टिप्पणी इस स्कीम पर भी लागू होगी जहां तक कि वे इस स्कीम के असंगत न हों।

(iii) आवेदक को 8 अंकीय आईटीसी (एचएस) वर्गीकरण सहित विशिष्ट विवरण सहित निविष्टियों हेतु आवेदन करना होगा। जहां भी निर्यात उत्पाद और/अथवा निविष्टियों का विवरण ब्रांड नाम में दिया गया हो, तो सही रासायनिक/तकनीकी नाम का भी उल्लेख आवेदन में करना होगा।

(iv) क्षेत्रीय प्राधिकारी यथा आवेदित अग्रिम प्राधिकार पत्र जारी कर सकता है जो विदेश व्यापार नीति और प्रक्रिया पुस्तक (2015-20) में विनिर्दिष्ट शर्तों के अधीन होगा। यथा आवेदित निविष्टि उत्पाद मानदंड और आवेदक द्वारा दावा की गई क्षति को अंतिम माना जाएगा। मानदंड समिति द्वारा इसका अनुसमर्थन अपेक्षित नहीं है।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] (v) आवेदक अथवा उसके सहायक विनिर्माता/सह-लाइसेंसधारी को प्रत्येक प्राधिकार पत्र के निमित्त शुल्क मुक्त आयातित/स्वदेश में प्राप्त निविष्टियों की खपत और उपयोग का समुचित लेखा-जोखा रखना होगा, जैसा कि परिशिष्ट 4-ज में निर्धारित किया गया है। ईओडीसी हेतु आवेदन परिशिष्ट 4ज के साथ निर्धारित प्रपत्र में संबंधित क्षेत्रीय प्राधिकारी को प्रस्तुत करना होगा। क्षेत्रीय प्राधिकारी परिशिष्ट-4ज के ब्यौरे को प्राधिकार पत्र में अनुमत निविष्टियों के साथ तुलना करेगा। ऐसे रिकॉर्डों को प्राधिकार पत्र धारक/विनिर्माता द्वारा प्रक्रिया पुस्तक के पैरा 4.51 में यथा विनिर्दिष्ट अवधि के लिए सुरक्षित रखा जाएगा।

(vi) इस स्कीम के अंतर्गत निर्यात मद के उत्पादन और खपत संबंधी रिकार्ड का डीजीएफटी अथवा किसी प्राधिकृत/नामित अभिकरण (अभिकरणों) अथवा समय-समय पर नामित अधिकारियों के दल द्वारा लेखा-परीक्षण किया जाएगा। ऐसा लेखा परीक्षण जोखिम आधारित प्रबंधन प्रणाली (आरबीएमएस) पर आधारित प्राधिकार-पत्र को जारी करने की तिथि से तीन वर्षाें की अवधि के अंदर संचालित किया जा सकता है। निर्यातकों को लेखा पुस्तकों अथवा अन्य दस्तावेजों के सत्यापन की सुविधा प्रदान करना तथा लेखा परीक्षण के समय पर पूरा किए जाने के लिए यथा अपेक्षित सहयोग प्रदान करना अपेक्षित है। डीजीएफटी समय-समय पर प्रशासनिक आदेशों के माध्यम से लेखा परीक्षा के दलों का गठन करेगा तथा लेखा परीक्षा के तरीके को विनिर्दिष्ट करेगा।

(vii) आवेदक द्वारा लेखा परीक्षण दल को निर्धारित दस्तावेजों/सूचना और इसके तहत बनाए गए नियमों और आदेश उपलब्ध न कराने पर यथा संशोधित विदेश व्यापार (विकास एवं विनियमन) अधिनियम, 1992 और इसके तहत बनाए गए नियमों और आदेश के प्रावधानों के तहत वह दंडात्मक कार्रवाई के लिए उत्तरदायी होगा। यदि वस्तुओं का शुल्क मुक्त आयात/प्राप्ति अधिक मात्रा में अथवा पूर्णतः प्रयुक्त नहीं पाई जाती है तो आवेदक को स्वतः सीमा शुल्क प्राधिकारी को लागू ब्याज सहित शुल्क का तत्काल भुगतान करना होगा। तथापि यदि लेखा परीक्षण दल को यह पता लगता है कि शुल्क मुक्त वस्तुओं का आयात अधिक मात्रा में किया गया है तथा वास्तविक उत्पादों में वह पूर्णतः प्रयुक्त नहीं हुआ है तथा स्वतः शुल्क और ब्याज का भुगतान नहीं किया गया है तो आवेदक को विदेश व्यापार (विकास एवं विनियमन) अधिनियम/सीमा शुल्क अधिनियम के तहत अन्य दंडात्मक कार्रवाई के अतिरिक्त यथा संशोधित विदेश व्यापार (विनियमन) नियमावली 1993 के नियम-7 के तहत अस्वीकृत इकाई सूची (डीईएल) में डाल दिया जाएगा। विदेश व्यापार (विकास एवं विनियमन) अधिनियम की धारा 11(2) के प्रावधानों के तहत सनदी इंजीनियर भी उकसाने के लिए दंडात्मक कार्रवाई हेतु उत्तरदायी होगा। (viii) अग्रिम प्राधिकार पत्र स्कीम के सभी प्रावधान भी इस स्कीम पर लागू होंगे जहां तक कि वे इस स्कीम के विशिष्ट प्रावधानों के असंगत न हों।

3. संशोधित परिशिष्ट-4ट को इस सार्वजनिक सूचना के साथ संलग्न किया जाता है।

4. मर्चेन्ट निर्यातक द्वारा आवेदन के मामले में, प्रमाणपत्र के पैरा 3 में दिए गए ब्यौरे सहायक विनिर्माता के होंगे जिसका नाम अग्रिम प्राधिकार पत्र में पृष्ठांकित किया जाना है।

Subject: Amendments in Handbook of Procedures 2015-20- reg.

F. No. 01/94/180/356/AM17/PC-4.—In exercise of powers conferred under Paragraph 1.03 of the Foreign Trade Policy 2015-2020, as amended from time to time, the Director General of Foreign Trade makes the following amendment in Hand Book of Procedures 2015-20:

2. Below the existing para 4.07 HBP 2015-20, a new para 4.07A is added as follows:-

Para 4.07A Self -Ratification Scheme

(i) Policy related to Self ratification Scheme is provided at Para 4.07A of ForeignTrade Policy (2015- 20). Applications shall be filed online along with completedetails as per Appendix-4E along with a certificate from Chartered Engineer inAppendix-4K. For issuance of such a certificate, the Chartered Engineer shallact only in the domain of his/her competence.

(ii) General Notes given in the book titled Standard Input Output Norms includingpolicy for packing material and fuel shall also be applicable to this scheme in sofar as they are not inconsistent with this scheme.

(iii)The applicant shall apply for inputs with specific descriptions along with 8digit ITC (HS) Classification. Where ever the export product and/or inputs aregiven in brand names, the correct chemical /technical name shall also be givenin the application.

(iv) RA may issue Advance authorisation as applied for subject to the conditionsspecified in FTP and Handbook of Procedures (2015-20). Input Output Normsas applied and wastage claimed by the applicant shall be treated as final.Ratification of the same by NC is not required.

(v) Applicant or his supporting manufacturer/co-licensee shall maintain a properaccount of consumption and utilization of duty free imported / domesticallyprocured inputs against each authorisation, as prescribed in Appendix-4H.Application for EODC shall be submitted in prescribed format along withAppendix-4H to the Regional Authority concerned. Regional Authority shallcompare the details of Appendix-4H, with that of the inputs allowed in theAuthorisation. Such records shall be preserved by the authorisationholder/manufacturer for a period as specified in Para 4.51 of HBP.

(vi) Production and consumption records of the export item under this schemeshall be audited by DGFT or any Authorised/nominated agency(ies) or team ofofficers as may be nominated from time to time. Such audit may be conductedwithin three years from the date of issue of Authorisation based on Risk BasedManagement System (RBMS). Exporters shall be required to provide necessaryfacility to verify Books of Accounts or other documents and assistance as maybe required for timely completion of the audit. DGFT shall constitute the auditteams and specify the manner of audit from time to time through administrativeorders.

(vii) Non providing of prescribed documents/information to the Audit team by theapplicant shall make him liable for penal action under the provisions of FT(D&R)Act, 1992, as amended and Rules and order made there under. In case itemsimported/procured duty free are found to be in excess or not consumed fully, theapplicant shall suomoto pay immediately duty with applicable interest to theCustoms Authority. However, if Audit team found that duty free items wereimported in excess and not consumed fully in the resultant products and duty andinterest have not been paid suomoto, the applicant shall be placed underDenied Entity List (DEL) under Rule 7 of FT(Regulation) Rules, 1993, asamended, in addition to other penal action under FT(DR) Act/Customs Act. TheChartered Engineer shall also be liable for penal action for abetment under theprovisions of Section 11(2) of the FT(DR)Act.

(viii) All the provisions of Advance Authorisation scheme shall also be applicableto this scheme in so far they are not inconsistent with the specific provisions ofthis scheme.

3. The amended Appendix 4K is annexed to this Public Notice.

Effect of this Public Notice : With this Public Notice, a new para 4.07A is added in Handbook of Procedures 2015-20

Format of Chartered Engineer Certificate for fixation of SION / Adhoc norms under para 4.07A of

HBP/Self Ratification Scheme.

(To be furnished on the letterhead of the Chartered Engineer)

1. I am a Chartered Engineer with Registration No. ______ dated ______(copy enclosed). My domain competence is in (example Chemicals, mechanical, electrical, textiles etc……)_______________.

2. I have examined the details of requirements of inputs of the applicant/manufacturer M/s ________________, ________________ (Name applicant/manufacturer and address of factory where goods would be manufactured) with regard to their application for advance Authorisation. I have examined Appendix-4E along with technical details thereof filed by the applicant and requirements of raw materials etc. with regard to their technical description/ specification and the quantity against each item of import as given in 'AayatNiryaat Form' and having due regard to proper technical norms of consumption and after technical scrutiny of relevant process, designs and drawings of the export product, I do hereby certify that they are correct in all respects and are actually required for the execution of the export order for which the application is made.

3. I hereby certify the export product and the requirement of inputs thereof as follows:

(a) Details of product(s) to be exported / supplied under the Authorisation:

(b) Details of inputs required for manufacturing export product.

4. At any point of time the statements / facts certified above by the undersigned if found to beincorrect, I will be liable for penal action under the provisions of Foreign Trade (Development &Regulation) Act, 1992 (as amended), Rules and Orders framed there under and the provisions of anyother Act, inforce.

1. Note for Appendix-4K:

1. Complete Appendix-4E along with technical details shall be submitted.

2. Unless and otherwise provided for, solvent(s) shall be allowed maximum upto 25% of the requirement of solvents indicated in for the purpose of advance authorisation. However, in cases where recovery is not possible and the solvent gets poisoned, full quantity of solvent shall be allowed. Chartered Engineer shall verify and certify the same accordingly for the details of solvents required as in Table 3(b) above.

3. Wherever value of by-products and recoverable wastage generated during manufacturing process is more than 5% of CIF value, corresponding quantity of main input shall be reduced from the entitlement to the extent that value of disallowed quantity is equal to the value of by-products and recoverable wastage generated during manufacturing process. Chartered Engineer shall verify and certify the same accordingly in Table 3(b) above.

4. In case of application by merchant exporter, the details to be given at para 3 of Certificate shall be of supporting manufacturer whose name is to be endorsed in the advance authorisation.
