का.आ.का.आ.का.आ.का.आ. 1331133113311331((((अ)अ)अ)अ)....————जबकि के न्(cid:8) सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का.आ. 28(अ), दिनांकित 5 फरवरी, 2017 के द्वारा आं3 प्रदेश राज्य में राष्ट्रीय राजमार्ग सं. 67 के कर्नाटक सीमा - गु=ी – नेल्लोर - कृ ष्णाप=नम पत्तन तक के खंड को आं3 प्रदेश राज्य सरकार (जो इसके बाद ''प्राधिकरण'' के रूप में उल्लिखित है) को सुपुर्द कर दिया है;

और जबकि, कें (cid:8)ीय सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 9 द्वारा प्रदत्त शक्तियों का प्रयोग करते Jए राष्ट्रीय राजमागL के खंडों, स्थायी पुलों, बाइपासों, सुरंगों के उपयोग के लिए फीस संQहण हेतु सा.का.िन. 838(अ), दिनांकित 05 दिसंबर, 2008 के तहत राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संQहण) िनयमावली, 2008 तैयार की है तथा सा.का.िन. 950(अ), दिनांकित 03 दिसंबर, 2010, सा.का.िन. 15(अ), दिनांकित 12 जनवरी, 2011, सा.का.िन. 756(अ), दिनांकित 12 अक्टूबर, 2011, सा.का.िन. 778(अ), दिनांकित 16 दिसंबर, 2013, सा.का.िन. 26(अ), दिनांकित 16 जनवरी, 2014, सा.का.िन. 831(अ), दिनांकित 21 नवंबर, 2014, सा.का.िन. 02(अ), दिनांकित 29 दिसंबर, 2014, सा.का.िन. 220(अ), दिनांकित 23 मार्च, 2015, सा.का.िन. 585(अ), दिनांकित 8 जून, 2016, सा.का.िन. 1114(अ), दिनांकित 2 दिसंबर, 2016 और सा.का.िन. 248(अ), दिनांकित 14 मार्च, 2017 के तहत संशोधित की है;

अत: अब, राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संQहण) िनयम, 2008 के िनयम 3 के साथ पठित और समय- समय पर संशोिधत (जो इसके आगे ''िनयम'' के रूप में उल्लििखत है) राष्ट्रीय राजमार्ग अिधिनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते Jए, के न्(cid:8)ीय सरकार, एतदद्वारा आं3 प्रदेश राज्य में राष्ट्रीय राजमार्ग सं. 67 के मौजूदा किमी 589/000 से मौजूदा किमी 741.950 तक माइदुकु र से नेल्लोर खंड के उपयोग के िलए नीचे दी गई तािलका 1 के कॉलम (1) में विनिWर्दष्ट वाहनों के प्रकार पर फीस (इसके आगे 'आधार दर' के रूप में उल्लििखत है) पेXड शोल्डर सिहत दो-लेन खंड के उपयोग हेतु 145.370 किमी [(i) 2.800 किमी की समतुल्य लंबाई सहित 0.280 किमी की संरचना (60 मीटर से अधिक की लंबाई वाले) और (ii) 3.850 किमी के दो बाइपासों को छोड़कर] 145.370 किमी की िनवल सड़क खंड लंबाई के िलए

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] तािलका 1 के कॉलम (2) में विनिWर्दष्ट आधार दर के 60% पर उदगृहीत करती है तथा प्राधिकरण को उसके अधिकारियों अथवा किसी ठेके दार के माध्यम से उक्त फीस के संQहण के िलए प्राधिकृ त करती है, अर्थात्:-

1. इसके अंतर्गत उ\गृहीत और संगृहीत फीस ऐसे पथकर प्लाजाओं के अंतर्गत विनिWर्दष्ट दूरी हेतु निम्निलिखत पथकर प्लाजाओं में देय और संदेय होगी:-

2. उपयु र्क्त के अतिरिक्त, ऐसे टोल प्लाजा के लिए विनि(cid:22)र्दष्ट बाइपास की िनवल लंबाई के लिए निम्नलिखित टोल प्लाजा (प्लाजाओं) पर 10 करोड़ $. अथवा अिधक लागत वाले बाइपास (बाइपासों) के उपयोग हेतु निम्निलिखत फीस देय और संदेय होगी:-

र्क्त के अतिरिक्त, निम्नलिखित टोल प्लाजा (प्लाजाओं) पर 60 मीटर से अिधक लंबाई वाली निम्निलिखत 3. उपयु अवसंरचनाओं के उपयोग के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को परिवbर्तत करके निम्नलिखित फीस भी देय और संदेय होगी:-

****60 मीटर से अधिक लंबाई वाली अवसंरचनाओं का ब्यौरा निम्नानुसार है:-

4. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किमी की दूरी के भीतर निवास करने वाले Xयक्ति के लिए मासिक पास की दर वर्ष 2017-18 के िलए 245.00 d. (दो सौ पैतालीस dपए मात्र) है और यह राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संQहण) नियम, 2008 के उपबंधों के अनुसार प्रत्येक वर्ष संशोधन के अध्यधीन है ।

5. राजमार्ग खंड पर बJल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्

6. फीस प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए फीस उस eेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशतf कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई सbर्वस रोड या वैकल्पिक सड़क उपलब्ध न हों ।

7. संबंधित eेणी के वाहनों के लिए विनिWर्दष्ट अनुiेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी Xयक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संQहण एजेंसी को ऐसी eेणी के वाहनों के लिए अनुप्रयोज्य फीस के समतुल्य दस गुणा फीस का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहj होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहj जाता ।

8. सभी परिभाषाएं, यांत्रिक वाहनों की eेणी, इनके अनुiेय भार, छू ट प्राप्त वाहनों की eेणी, सbर्वस रोड, वैकल्पिक सड़क इत्यादि पूवkक्त नियमों में विनिWर्दष्ट परिभाषाओं के अनुरूप होंगी ।

9. फीस की दरें उक्त नियमों के नियम 12 के अनुसरण में प्रयोक्ताओं के सूचनार्थ प्रदbर्शत करनी होंगी ।

10. यांत्रिक वाहनों से फीस की वास्तविक राशि उपयु र्क्त तािलका-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के िलए प्रति किमी फीस की आधार दर के आधार पर प्रभारित होगी और छू टों की गणना प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंQेजी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा ।

11. परियोजना की प्राक्किलत पू ंजीगत लागत तालिका 6 में दी गई है । पू ंजीगत लागत परिवर्तन के अध्यधीन है क्योंकि भूमि अधिQहण, जनोपयोगी सुविधाओं के अंतरण, पेड़ों को काटने आदि कार्यकलापों को अभी पूरा किया जाना है । अंितम पू ंजीगत लागत को पृथक रूप से अधिसूचित किया जाएगा । प्राप्त होने वाली प्रयोक्ता फीस के माध्यम से वसूल की गई पू ंजीगत लागत का प्राधिकरण द्वारा रिकॉर्ड रखा जाएगा तथा पू ंजीगत लागत की वसूली के पश्चात् उदQाo फीस घटाकर दरों के 40% तक कर दी जाएगी और उक्त नियमों के अनुसरण में वाbर्षक रूप से संशोधित की जाएगी ।

NOTIFICATION

New Delhi, the 9th March, 2018

S.O. 1331(E).—Whereas by notification of the Government of India in the erstwhile Ministry of Road Transport and Highways number S.O. 28(E) dated 5th January, 2017 issued under section 5 of the National ighways Act, 1956 (48 of 1956), the Central Government has entrusted the stretch from Karnataka border - Gooty – Nellore - Krishnapatnam Port of National Highways No. - 67 in the State of Andhra Pradesh to the State Govt. of Andhra Pradesh (hereinafter referred to as the "Authority");

And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011, G.S.R 778(E) dated 16th December, 2013, G.S.R 26(E) dated 16th January, 2014, G.S.R. 831(E) dated 21st November, 2014, G.S.R. 02(E) dated 29th December, 2014, G.S.R. 220 (E) dated 23rd March, 2015, G.S.R 585(E) dated 8th June 2016, G.S.R 1114(E) dated 2nd December 2016 and G.S.R 248 (E) dated 14th March 2017, for collection of fee for the use of sections of national highways, permanent bridges, bypasses, tunnels;

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the "said Rules"), the Central Government hereby levies the fee at 60% of the base rates specified in column (2) of Table 1 for net road section length of 145.370 Kms [excluding (i) 0.280 kms of structures (having length more than 60m) with equivalent length of 2.800 kms & (ii) 3.850 kms of two nos. bypasses] for use of Two laning with paved shoulder section (hereinafter referred as "base rate") on the type of vehicles specified in column (1) of table 1 below, for use of the Mydukur to Nellore section of National Highways No-67 from existing Km. 589/000 to existing Km. 741.950 in the State of Andhra Pradesh and authorizes the Authority to collect, either through its officials or through a contract, the said fee, namely:-

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for the distance specified for such Toll Plaza(s):-

2. In addition to above, the following fee shall be due and payable for use of bypasses costing Rs. 10 crores or more at following Toll Plazas for net bypass length specified for such Toll Plaza.

3. In addition to above, the following fee shall also be due and payable for the use of following structure having length more than 60m at the following Toll Plaza, by converting the length of structure into an equivalent length of highway by multiplying the length of such structure by an equalization factor of 10:-

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs.245/- (Rupees Two Hundred and Forty Five only) for the year 2017-18 and is subject to revision every year as per the provisions of National Highways Fee (Determination of Rates and Collection) Rules, 2008.

5. For multiple journey on the highway section, passes shall be issued at the following rates, namely :-

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] collecting agency, equal to ten times of the fee applicable to such category of Mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service

road, alternative road, etc., shall be as per the definitions specified in the said Rules.

9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said Rules.

10. Based on the Base rate of Fee per km for the base year 2007-2008 as mentioned in Table 1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.

11. The estimated capital costs of the project is given in Table 6. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost; the fee leviable shall be reduced to 40 % of the rates and shall be revised annually in accordance with the said rules.
