सासासासा.... काकाकाका.... िनिनिनिन.... 1201201201202222((((अअअअ))))....———— राष्ट्रपति, संिवधान के अनु(cid:10)छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:23)ए, भोपाल मेमोरियल अस्पताल और अनुसंधान कें (cid:31), स्वास्थ्य अनुसंधान िवभाग, स्वास्थ्य और परिवार कल्याण मंत्रालय में फिजियोथेरेपी सुपरवाइज़र के पद पर भर्ती की प.ति का िविनयमन करने के िलए निम्नलिखित िनयम बनाते हैं, अर्थात :-

1. संक्षिप्त नाम और प्रारंभ - (1) इन नियमों का संक्षिप्त नाम भोपाल मेमोरियल अस्पताल और अनुसंधान कें (cid:31), फिजियोथेरेपी सुपरवाइज़र (समूह 'ख' पद) भर्ती िनयम 2018 है।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन मैट्रिक्स या वेतनमान में स्तर- उक्त पद की संख्या, उसका वर्गीकरण और वेतन मैट्रिक्स या वेतनमान में स्तर वह होगा जो इन नियमों से उक्त अनुसूची के स्तंभ (2) से स्तंभ (4 ) में विनि=र्दष्ट हैं।

3. भर्ती की प.ति, आयु-सीमा, अर्हताएं आदि- भर्ती की प.ति, आयु-सीमा, अर्हताएं और उससे संबंिधत अन्य बातें वे होंगी जो पूवDक्त अनुसूची के स्तंभ (5) से (13) में विनि=र्दष्ट हैं।

4. प्रारंभिक गठन- ऐसे Eक्ति जो इन नियमों के प्रारंभ की तारीख को िनयिमत आधार पर भोपाल मेमोरियल अस्पताल और अनुसंधान कें (cid:31) में फिजियोथेरेपी सुपरवाइज़र का पद धारण कर रहे हैं, इन नियमों की अनुसूची में उल्लिखित तत्स्थानी पदों के अधीन नियुक्त किए गए समझे जाएंगे और उक्त पदों पर इन नियमों के प्रारंभ से पूर्व िनयिमत आधार पर 7305 GI/2018

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] उनके द्वारा की गई सेवाएं अगले उGतर Hेड में प्रोन्नति के िलए परिवीक्षा की अविध ज्येष्ठता और पात्रता का विनिMय करने के िलए गणना में ली जाएंगी।

5. निरर्हता - वह Eक्ति -

(क) िजसने ऐसे Eक्ति से िजसका पित या जिसकी पNी जीिवत है, िववाह किया है; या िववाह की संिवदा की है

(ख) िजसने अपने पित या पNी के जीिवत रहते (cid:23)ए किसी Eक्ति से िववाह किया है; या िववाह की संिवदा की है उक्त पद पर नियुक्ति का पात्र नहO होगा:

परंतु यदि कें (cid:31)ीय सरकार का यह समाधान हो जाता है कि ऐसा िववाह उस Eक्ति और िववाह के अन्य पक्षकार को लागू स्वीय िविध के अधीन अनुPेय है और ऐसा करने के िलए अन्य आधार है तो वह किसी Eक्ति को इस िनयम के प्रवर्तन से छू ट दे सके गी।

6.िशिथल करने की शक्ति - जहां कें (cid:31)ीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण हैं उन्हें लेखब. करके , तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के Eक्तियों की बाबत, आदेश द्वारा चित्रित कर सके गी।

7. Eावृत्ति- इन नियमों की कोई बात, आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहO डालेगी, िजनका कें (cid:31)ीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूिचत जातियों, अनुसूिचत जनजातियों, अन्य िपछड़े वगS, भूतपूर्व सैनिकों और अन्य िवशेष प्रवर्ग के Eक्तियों के िलए उपबंध किया जाना अपेक्षित है।

अनिवार्य: (क) (i) किसी मान्यता प्राप्त वि\विद्यालय से फिजियोथेरेपी में ^ातक डिHी। (ii) सरकारी अस्पताल या प्राइवेट अस्पताल में फिजियोथेरेपी में दो वर्ष का Eावहारिक अनुभव। या (ख) (i) किसी मान्यता प्राप्त संस्थान या अस्पताल से फिजियोथेरेपी (तीन साल से कम नहO) में डिप्लोमा। (ii) किसी मान्यता प्राप्त अस्पताल के फिजियोथेरेपी िवभाग में तीन वर्ष का Eावहारिक अनुभव। ि टप्पण टिप्पण----1:1:1:1:---- अर्हताएं, अन्यथा सुअXर्हत अWयXर्थयों की दशा में, उन कारणों के िलए जो लेखब. किए जाएं, संघ लोक सेवा टिप्पण टिप्पण आयोग के िववेकानुसार िशिथल की जा सकती हैं। ि टप्पण टिप्पण----2:2:2:2:---- अनुभव संबंधी अर्हता (अर्हताएं) उन कारणों के िलए जो लेखब. किए जाएं कर्मचारी चयन आयोग के टिप्पण टिप्पण िववेकानुसार अनुसूिचत जातियों और अनुसूिचत जनजातियों के अWयXर्थयों की दशा में तब िशिथल की जा सकती हैं, जब चयन के किसी प्रcम पर कर्मचारी चयन आयोग की यह राय है कि उनके िलए आरक्षित रिक्तियों को भरने के िलए अपेक्षित अनुभव रखने वाले उन समुदायों के अWयXर्थयों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहO है।

NOTIFICATION

New Delhi, the 10th December, 2018

G.S.R. 1202(E).— In exercise of the powers conferred by the proviso to article 309 of the constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Physiotherapy Supervisor in the Bhopal Memorial Hospital and Research Centre, Department of Health Research, Ministry of Health and Family Welfare, namely:-

1. Short title and commencement. - (1) These rules may be called the Bhopal Memorial Hospital and Research Centre, Physiotherapy Supervisor (Group 'B' Post) Recruitment Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and level in pay matrix or pay scale.- The number of the said post, its classification and the level in the pay matrix or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said post, shall be as specified in columns (5) to (13) of the said Schedule.

4. Initial constitution. - The persons holding the post of Physiotherapy Supervisor in the Bhopal Memorial Hospital and Research Centre on regular basis on the date of the commencement of these rules shall be deemed to have been appointed under these rules and the services rendered by them in the said post on regular basis before the commencement of said rules shall be taken into account for deciding their period of probation, seniority and eligibility for promotion to the next higher grade.

5. Disqualification. - No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concession required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

SCHEDULE

Essential: (A) (i) Bachlor's Degree in Physiotherapy from a recognised University. (ii) Two years practical experience in Physiotherapy from a Government Hospital or Private hospital. Or (B) (i) Diploma in Physiotherapy (not less than three years) from recognised Institute or Hospital. (ii) Three years practical experience in Physiotherapy Department of a recognised Hospital. D esirable: Masters degree in physiotherapy in any branch from a recognised University/ Institute. Note 1: Qualifications are relaxable at the discretion of the Staff Selection Commission for reasons to be recorded in writing, in the case of candidates otherwise well qualified. N ote 2: The qualifications regarding experience are relaxable at the discretion of the Staff Selection Commission, for reasons to be recorded in writing in the case of candidates belonging to the Scheduled Castes or the Scheduled Tribes if at any stage of selection the Staff Selection Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.
