सा.का.िन.सा.का.िन.सा.का.िन.सा.का.िन. 1205120512051205((((अअअअ).).).).————के न्(cid:21) सरकार, रेल अिधिनयम, 1989 (1989 का 24) की धारा 87 की उप-धारा (2) के खंड (घ) के साथ पठित उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते +ए, रेल (मालडिब्बों के अिधक लदान के िलए दंडात्मक प्रभार) नियम, 2012 में आगे और संशोधन करने के लिए एतद् द्वारा निम्निलिखत िनयम बनाती है, अर्थात्:—
1. (1) इन नियमों को रेल (मालडिब्बों के अधिक लदान के लिए दंडात्मक प्रभार) द्वितीय संशोधन िनयम, 2018 कहा जाएगा।
(2) ये सरकारी राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. रेल (मालडिब्बों के अधिक लदान के लिए दंडात्मक प्रभार) नियम, 2012 में, अनुसूची में,-
(क) स्थिति-क शीर्षक के अंतर्गत,
(i) भाग-I में, उप -शीर्षक में , शब्द "बीसीएनएचएल और बीसीसीडब्ल्यू वैगनों को छोड़कर, अन्य वैगनों के िलए" के िलए, शब्द "बीसीएनएचएल, बीसीसीडब्ल्यू और बीएफएनएसएम22.9 मालडिब्बों को छोड़कर, अन्य मालडिब्बों के िलए" प्रतिस्थापित किया जाए;
(ii) भाग-II में, मद (ii) में, उप-शीर्षक में, शब्द "बीसीसीडब्ल्यू मालडिब्बों के िलए" के िलए, शब्द "बीसीसीडब्ल्यू और बीएफएनएसएम22.9 मालडिब्बों के लिए" प्रतिस्थापित किया जाए।
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) स्थिति-ख शीर्षक के अंतर्गत,(i) भाग-I में, उप-शीर्षक में, शब्द "बीसीएनएचएल और बीसीसीडब्ल्यू वैगनों को छोड़कर, अन्य वैगनों के िलए" के लिए, शब्द "बीसीएनएचएल, बीसीसीडब्ल्यू और बीएफएनएसएम22.9 मालडिब्बों को छोड़कर, अन्य मालडिब्बों के िलए" प्रतिस्थापित किया जाए;
(ii) भाग-II में, मद (ii) में, उप-शीर्षक में, शब्द "बीसीसीडब्ल्यू मालडिब्बों के िलए" के िलए, शब्द "बीसीसीडब्ल्यू और बीएफएनएसएम22.9 मालडिब्बों के िलए" प्रतिस्थापित किया जाए।

टिप्पणीटिप्पणीटिप्पणीटिप्पणी :::: मूल िनयम सा.का.िन. 570(अ) दिनांक 17 जुलाई, 2012 द्वारा भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में प्रकाशित किए गए थे तथा अधिसूचना संख्या सा.का.नि. 898(अ) दिनांक 17 दिसम्बर, 2012, सा.का.िन. 550(अ) दिनांक 10 जुलाई, 2015 एवं सा.का.नि. 278(अ) दिनांक 26 मार्च, 2018 द्वारा संशोधित किए गए थे।

NOTIFICATION
New Delhi, the 14th December, 2018
G.S.R. 1205(E).—In exercise of the powers conferred by Sub-section (1) read with clause (d) of Sub-section (2) of Section 87 of the Railways Act, 1989 (No. 24 of 1989), the Central Government hereby makes the following rules further to amend the Railways (Punitive charges for overloading of wagon) Rules, 2012, namely:- 1. (1) These rules may be called the Railways (Punitive charges for overloading of wagon) Second Amendment Rules, 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Railways (Punitive charges for overloading of wagon) Rules, 2012, in the SCHEDULE,- (a) under the heading Situation-A,-
(i) in Part-I, in the sub-heading, for the words "for wagons other than BCNHL and BCCW wagons", the words "for wagons other than BCNHL, BCCW and BFNSM22.9 wagons" shall be substituted;
(ii) in Part-II, in item (ii), in the sub-heading, for the words "for BCCW wagons", the words "for BCCW and BFNSM22.9 wagons" shall be substituted.
(b) under the heading Situation-B,-
(i) in Part-I, in the sub-heading, for the words "for wagons other than BCNHL and BCCW wagons", the words "for wagons other than BCNHL, BCCW and BFNSM22.9 wagons" shall be substituted;
(ii) in Part-II, in item (ii), in the sub-heading, for the words "for BCCW wagons", the words "for BCCW and BFNSM22.9 wagons" shall be substituted.
