फ़ा. सं. 1फ़ा. सं. 1फ़ा. सं. 1फ़ा. सं. 1----110/एसपी (जैिवक खतरे)/संशोधन110/एसपी (जैिवक खतरे)/संशोधन110/एसपी (जैिवक खतरे)/संशोधन110/एसपी (जैिवक खतरे)/संशोधन----1/एफ़एसएसएआई/20181/एफ़एसएसएआई/20181/एफ़एसएसएआई/20181/एफ़एसएसएआई/2018.— खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) विनियम, 2011 का और संशोधन करने के लिए कतिपय विनियमों का निम्नलिखित प्रारूप जिसे भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, के न्,ीय सरकार के पूर्व अनुमोदन से खाद्य सुरक्षा और मानक अिधिनयम, 2006 (2006 का 34) की धारा 16 के साथ पठित धारा 92 की उपधारा (2) के खंड (ड़) द्वारा प्रदत्त शक्तियों का प्रयोग करते Bये, बनाने का प्रस्ताव करता है, को उक्त अधिनियम की धारा 92 की उपधारा (1) के अधीन यथापेक्षित उनके द्वारा संभाE प्रभावित सभी Eक्तियों की सूचना के लिए प्रकाशित किया जाता है और नोटिस दिया जाता है कि उक्त प्रारूप विनियमों पर उस तारीख से जेबी राजपत्र की प्रतियाँ जिनमें प्रारूप विनियम प्रकाशित Bए हों आम जनता को उपलब्ध कराये जाने की तारीख से 30 दिन की अवधि की समाप्ति के पश्चात िवचार किया जाएगा;

आक्षेप या सुझाव, यदि कोई हो को मुख्य कार्य पालक अधिकारी, भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, एफडीए भवन, कोटला रोड़, नई दिल्ली-110002 को या ईमेल द्वारा [email protected] को भेजे जा सकें गे;

आक्षेप या सुझाव, जो उक्त प्रारूप विनियमों के संबंध में, इस प्रकार कि विनिTदष्ट अवधि के अवसान पूर्व किसी Eक्ति से प्राप्त Bये हों, पर भारतीय खाद्य सुरक्षा और मानक प्राधिकरण द्वारा विचार किया जाएगा।

2. खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) िवनयम, 2011, के परिशिष्ट 'ख' में,-

((((क) शीर्षक ''''स्तर जहां माइWोबायोलॉजी मानक लागू होंगे'''' में मौजूदा शब्दों के बाद,,,, निम्नलिखित वाक्य को अंत:स्थापित किया जाएगा,,,,----

""""तािलक-2ख (खाद्य सुरक्षा मानदंड) के सूZम जैविकीय मानक बैच/लॉट की स्वीकार्यता परिभाषित करते हैं यह मानक उत्पादों के विनिर्माण प्रWिया के अंत में और बाजार में उनके शेल्फ लाइफ के दौरान लागू होंगे।";;;;

(ख) शीर्षक "असंतोषजनक परिणाम के मामले में कार्यवाही" वाक्य तािलक-2 ख खाद्य सुरक्षा मानदंडलाट की स्वीकार्यता परिभाशित करती है और बाजार में/में माइWोबॉयोलॉजिकल मानक बैंच यह जारी करने के लिए उत्पाद के संबंध् में होगा ◌ा ये उनके अंचल जीवन के दौरान बाजार में उत्पादों के लिए लागू होंगा का लो किया जाएगा;

(ग) शीर्षक "प्रतिदर्शन योजना और दिशा -निद_श " के अंतर्गत उप- शीर्षक "िनयामक के िलए" में "अंितम निर्णय इस आधार पर होना चािहए कि माइWोबॉयोलॉजिकल मानदंडों के िलए पुनःपरीक्षण का कोई प्रावधान नहa होगा।" शब्दों के स्थान पर "अंितम निर्णय इस आधार पर होना चािहए कि माइWोबॉयोलॉजिकल मानदंडों के िलए तािलक-2ख (खाद्य सुरक्षा मानदंड) के अलावा पुनःपरीक्षण का कोई प्रावधान नहa होगा।" शब्दों को प्रतिस्थापित किया जाएगा।;

F. No. 1-110/SP (Biological Hazards)/Amendment-1/FSSAI/2018.—The following draft of certain regulations, further to amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, which the Food Safety and Standards Authority of India proposes to make with previous approval of the Central Government, in exercise of the powers conferred by clause (e) of sub-section (2) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) is hereby published as required under sub-section (1) of section 92 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft regulations shall be taken into consideration after the expiry of the period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public.

Objections or suggestions, which may be received from any person with respect to the said draft regulations before the expiry of period so specified, shall be considered by the Food Safety and Standards Authority of India.

Draft Regulations

1. Short title and commencement.—These regulations may be called the Food Safety and Standards (Food Products Standards and Food Additives)….. Amendment Regulations, 2018.

2. In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, in Appendix B,-

(1) below Table 2B related to Microbiological Standards for Milk and Milk products – Food Safety Criteria,-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (a) after the existing texts under the title 'Stage where the Microbiological Standards shall apply', following statement shall be inserted,-

"The Microbiological Standards in Table-2B (Food Safety Criteria) define the acceptability of a batch/lot and shall be met in respect of the product for releasing it in the market. These shall be applicable to the products at the end of the manufacturing process and the products in the market during their shelf- life.";

(b) the statement "The Microbiological Standards in Table-2B (Food Safety Criteria) define the acceptability of a batch/lot and shall be met in respect of the product for releasing it in the market. These shall be applicable to the products at the end of the manufacturing process and the products in the market during their shelf- life." under the title 'Action in case of unsatisfactory result' shall be omitted;

(c) in the sub-title "For Regulator" under the title "Sampling Plans and Guidelines", the texts "The final decision shall be drawn based on results with no provision for retesting for microbiological parameters." shall be substituted by the texts "The final decision shall be drawn based on results with no provision for retesting for microbiological parameters except for Table -2B (Food Safety Criteria).";

(d) after existing texts under the title 'Reference Test Methods', the following statement shall be inserted, namely,-

"Test methods prescribed in FSSAI Manual of Methods of Analysis of Foods (Microbiological Testing) may also be referred along with the IS/ISO methods specified for Process Hygiene Criteria and Food Safety Criteria.".

(2) below Table 4B related to Microbiological Standards for Fruits and Vegetables and their Products – Food Safety Criteria,-

(a) after the existing texts under the title 'Stage where the Microbiological Standards shall apply', following statement shall be inserted,-

"The Microbiological Standards in Table-4B (Food Safety Criteria) define the acceptability of a batch/lot and shall be met in respect of the product for releasing it in the market. These shall be applicable to the products at the end of the manufacturing process and the products in the market during their shelf-life.";

(b) the statement "The Microbiological Standards in Table-4B(Food Safety Criteria) define the acceptability of a batch/lot and shall be met in respect of the products at the end of the manufacturing process and the products in the market during their shelf-life." under the title 'Action in case of unsatisfactory result' shall be omitted;

(c) in the sub-title "For Regulator" under the title "Sampling Plans and Guidelines", the following statement shall be shall be inserted at the end of the paragraph,-

"The final decision shall be drawn based on results with no provision for retesting for microbiological parameters except for Table -4B (Food Safety Criteria).";

(d) after existing texts under the title 'Reference Test Methods', the following statement shall be inserted, namely,-

"Test methods prescribed in FSSAI Manual of Methods of Analysis of Foods (Microbiological Testing) may also be referred along with the IS/ISO methods specified for Process Hygiene Criteria and Food Safety Criteria.".

(3) in Table 5B related to Microbiological Standards for Meat and Meat Products – Food Safety Criteria, in third Column, the word "Salmonella" shall be substituted by "Salmonella$".

(4) below the Table 5B related to Microbiological Standards for Meat and Meat Products – Food Safety Criteria,-

(a) after existing texts, the following shall be inserted, namely,-

" $ For poultry meat the requirement shall be applicable for Salmonella enterica serovars Typhi, Typhimurium and Entritidis";

(b) after the existing texts under the title 'Stage where the Microbiological Standards shall apply', following statement shall be inserted,-

"The Microbiological Standards in Table-5B (Food Safety Criteria) define the acceptability of a batch/lot and shall be met in respect of the product for releasing it in the market. These shall be applicable to the products at the end of the manufacturing process and the products in the market during their shelf- life.";

(c) the statement "The Microbiological Standards in Table-5B (Food Safety Criteria) define the acceptability of a batch/lot and shall be met in respect of the product for releasing it in the market. These shall be applicable to the products at the end of the manufacturing process and the products in the market during their shelf- life." under the title 'Action in case of unsatisfactory result' shall be omitted;

(d) in the sub-title "For Regulator" under the title "Sampling Plans and Guidelines", the texts "The final decision shall be drawn based on results with no provision for retesting for microbiological parameters." shall be substituted by the texts "The final decision shall be drawn based on results with no provision for retesting for microbiological parameters except for Table -5B (Food Safety Criteria).";

(e) after existing texts under the title 'Reference Test Methods', the following statement shall be inserted, namely,-

"Test methods prescribed in FSSAI Manual of Methods of Analysis of Foods (Microbiological Testing) may also be referred along with the IS/ISO methods specified for Process Hygiene Criteria and Food Safety Criteria.";

(f) in the table below the title 'Reference Test Methods', in the row at serial no. 9, in column 2, the words "Clostridium perfringens" shall be substituted with the words "Clostridium botulinum".
