काकाकाका....आआआआ.... 6262626244449999((((अअअअ))))....—यतः, के न्(cid:16)ीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का. आ. 863(अ), तारीख 01.04.2013 द्वारा महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग संख्या 13 (नया रारा-52) के [सोलापुर- बीजापुर खंड के 13.500 कि.मी. से 30.340 कि.मी. (सोलापुर-महाराष्ट्र/कर्नाटक सीमा)] और कर्नाटक राज्य में [सोलापुर- बीजापुर खंड के 30.340 किमी से 102.000 किमी तक (महाराष्ट्र/कर्नाटक सीमा से बीजापुर तक)] भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके प=ात् 'प्राधिकरण' कहा गया है) को सAपा है;

और यतः, प्राधिकरण ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 14 के प्रावधान के अनुसरण में डिजाइन, निर्माण, वित्त, प्रचालन और हस्तांतरण (डीबीएफओटी) टोल आधार पर, राष्ट्रीय राजमार्ग विकास परियोजना चरण-III के अधीन, रारा-13 (नया रारा 52) के सोलापुर बीजापुर सेक्शन के 0.000 कि.मी.

से 110.542 कि.मी. (डिजाइन लंबाई 109.08 किमी ) तक (जिसे इसमें इसके प=ात ''उक्त खOड'' कहा गया है) को चार लेन का बनाने और उक्त खOड के प्रचालन और अनुरक्षण हेतु, 21.07.2017 को प्रस्तुत बोली के लिए मैसर्स विजयपुरा टोलवे प्रा. लि., जिसका पंजीकृ त कार्यालय 1-89/1, प्लॉट न. 42 और 43, तीसरा और चौथा तल, कवुरी हिल्स, फे ज-1 मधापुर, हैदराबाद-500081, भारत में है (जिसे इसमें इसके प=ात ''रियायतUाही'' संदVर्भत किया गया है) के साथ 14.12.2017 को करार किया है (जिसे इसमें इसके प=ात ''उक्त करार'' कहा गया है)।

अतः अब, के न्(cid:16)ीय सरकार, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संUहण) िनयम, 2008 के िनयम 3 के साथ पठित और बोली प्राप्ति की अंतिम तारीख तक किए गए संशोधन के साथ पठित राष्ट्रीय राजमार्ग अिधिनयम 1956 (1956 का 48) की धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते [ए, उक्त राष्ट्रीय राजमार्ग के उक्त खOड के निर्माण, अनुरक्षण, प्रबंधन और प्रचालन पर [ए \य, िनवेिशत पू ंजी पर ब्याज, युक्तियुक्त प्रत्यागम, यातायात के दबाव और प्राधिकरण तथा रियायतUाही के बीच [ए उक्त करार की अविध को ध्यान में रखते [ए, एत'ारा यह अिधसूिचत करती है कि चार या अिधक लेन के खOडों के उपयोग के िलए यांत्रिक वाहनों पर, सड़क खOड की निवल लम्बाई 87.075 कि.मी. (0.997 कि.मी.

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] लम्बाई की संरचना को छोड़कर (जिनकी लम्बाई 60 मीटर से अिधक है) और जिसकी समकक्ष लम्बाई 9.97 कि.मी. है (िजसे इसमें इसके पश्चात ''आधार दर'' कहा गया है), डेढ़ गुना के िहसाब से सारणी 1 के स्तम्भ (2) में विनिcर्दष्ट दरों पर (िजसे इसमें इसके पश्चात ''आधार दर'' कहा गया है) और बाइपासों की कु ल 20.811 कि.मी. लम्बाई हेतु (0.192 कि.मी. की संरचना को छोड़कर, जिनकी लम्बाई 60 मीटर से अिधक है और समकक्ष लम्बाई 1.92 कि.मी. है) नीचे सारणी 1 के स्तम्भ (2) में विनिcर्दष्ट आधार दरों के 150 % के िहसाब से शुल्क उfहीत किया जाएगा और उक्त रियायतUाही को उक्त नियमों और उपयु र्क्त करार के प्रावधानों के अधीन और के अनुसार प्राधिकरण द्वारा घोषित वाणिज्यिक प्रचालन की तारीख (सीओडी) को और उस तारीख से तथा प्राधिकरण से समापन प्रमाणपत्र अथवा अनंितम प्रमाणपत्र, जैसी भी स्थिति हो, प्राप्त करने पर अथवा इस अिधसूचना के राजपत्र में प्रकाशन पर, जो भी बाद में हो, शुल्क को संUहीत तथा प्रतिधारित करने हेतु प्राधिकृ त करती है,

1. नीचे उfहीत एवं संUहीत शुल्क, निम्नलिखित शुल्क प्लाजा (प्लाजाओं) पर, ऐसे शुल्क प्लाजा (प्लाजाओं) के लिए विनिcर्दष्ट सड़क की निवल लम्बाई हेतु शोध्य और संदेय होगाः

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित बाइपास (बाइपासों), जिनकी लागत 10 करोड़ iपए अथवा अधिक है, के उपयोग के लिए निम्नलिखित शुल्क प्लाजा (प्लाजाओं) पर, ऐसे शुल्क प्लाजा (प्लाजाओं) के लिए विनिcर्दष्ट बाइपास (बाइपासों) की निवल लम्बाई हेतु, निम्नलिखित शुल्क भी शोध्य और संदेय होगाःभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 3

3 उपयु र्क्त के अतिरिक्त, निम्नलिखित संरचनाओं, जिनकी लम्बाई 60 मीटर से अिधक है, के उपयोग के िलए ऐसी संरचनाओं की लम्बाई को समकरण गुणक 10 से गुणा करके राजमार्ग की समकक्ष लम्बाई में परिवVर्तत करते [ए, निम्नलिखित शुल्क प्लाजा (प्लाजाओं) पर, निम्नलिखित शुल्क भी शोध्य और संदेय होगाः

*60 मीटर से अधिक की लम्बाई वाली संरचनाओं का ब्यौरा निम्निलिखत है:

3. जिस \क्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त [आ हो और वह टोल प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता हो, उसके लिए वर्ष 2018-19 के लिए मासिक पास की दर 255.00/- रूपए (दो सौ पचपन रूपए मात्र) होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संUहण) िनयम, 2008 के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा ।

4. राजमार्ग खOड पर ब[यात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्ः

5. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस yेणी के लिए वाहन के लिए निर्धारित शुल्क का 50% होगा बशतz के ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सVर्वस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो।

6. जो यांत्रिक वाहन अपनी yेणी के लिए निर्धारित अनुwेय भार की अपेक्षा अधिक भार से लदा [आ होगा उसके चालक अथवा मालिक अथवा प्रभारी \क्ति को ऐसे अधिक भार से लदे [ए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संUहण एजेंसी को ऐसी yेणी के यांत्रिक वाहनों के लिए लागू शुल्क के दस गुना के बराबर शुल्क का भुगतान करना होगा और उसे राजमार्ग खOड का उपयोग करने की तब तक अनुमति नह{ होगी जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटाया नह{ जाता।

7. यांत्रिक वाहनों की yेणी, उनके लिए अनुwेय भार, छू ट-प्राप्त वाहनों की yेणी, सVर्वस रोड, वैकल्पिक सड़कआदि सहित सभी परिभाषाएं नियमों में विनिcर्दष्ट परिभाषाओं के अनुसार होंगी ।

8. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदVर्शत किया जाएगा ।

9. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और छू ट की गणना राजमार्ग परियोजना के पूरे कर लिए भाग की लम्बाई के आधार पर प्राधिकरण द्वारा की जाएगी। उसे प्राधिकरण द्वारा रियायतUाही के माध्यम से अंUेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित करवाया जाएगा और तत्प=ात उक्त नियमों के नियम 5 के अनुसार उसमें वाVर्षक तौर पर संशोधन किया जाएगा और प्रकाशित किया जाएगा, परन्तु शर्त यह है शुल्क में पिछली बार किए गए संशोधन की तारीख से 6 (छह) महीने की अवधि के भीतर कोई संशोधन नह{ किया जाएगा।

NOTIFICATION

New Delhi, the 21st December, 2018

S.O. 6249(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 863 (E), dated 01.04.2013, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 13.500 to km 30.340 [(Solapur- Maharashtra/Karnataka Border) of Solapur Bijapur Section] in the State of Maharashtra and km 30.340 to km102.000 [(Maharashtra / Karnataka Border to Bijapur) of Solapur Bijapur Section] in the State of Karnataka of National Highway No. 13 (New NH 52) to the National Highways Authority of India (hereinafter referred to as the "Authority");

And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement on 14.12.2017 (hereinafter referred to as said agreement) with M/s Vijayapura Tollway Private Limited having its registered office at 1-89/1, Plot No.- 42&43, 3rd & 4th Floor, Kavuri Hills, Phase-1, Madhapur, Hyderabad-500081, India (hereinafter referred to as the "Concessionaire"), for the bid submitted on 21.07.2017 for the development of Solapur – Bijapur Section from km 0.000 to km 110.542 (design length 109.08 km) on National Highway No. 13 (New NH-52) (hereinafter referred to as the "said section") to four laning and operation and maintenance of the said section under NHDP Phase-III on Design, Build, Finance, Operate and Transfer (DBFOT) Toll Basis.

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 read along with its amendment till bid due date, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said Section of said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length 87.075 km {excluding 0.997 Km of structure (having length more than 60 m) with equivalent length of 9.97 km} (hereinafter referred to as "base rate") for use of the four and more lane sections (hereinafter referred to as "base rate") and at one and one half times the base rate for bypasses having an aggregate length6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] of 20.811km {excluding 0.192 Km of structure (having length more than 60 m) with equivalent length of 1.92 km} at 150% of the base rates specified in column (2) of Table-1 below and authorizes the said Concessionaire to collect and retain the fee on and from the date of Commercial Operation (COD) declared by the Authority and on getting the Completion Certificate or the Provisional Certificate, as the case may be, from the Authority or publication of this Notification in the Official Gazette, whichever is later, subject to and in accordance with the said rules and the provisions of the aforesaid agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Fee Plaza for the distance specified for such Fee Plaza(s):

In addition to above, the following fee shall also be due and payable for the use of the following bypass(es) costing more than Rs. 10 crores at the following Fee Plaza(s) at one and half times of the base rate mentioned in Table-1 above for the length of bypass(es) specified for such Fee Plaza(s):

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 255.00 (Rupees Two Hundred Fifty Five only) for the year 2018-19 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.

8. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.

9. Based on the Base rate of Fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed portion of the length of the Project Highway. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each in English and vernacular language and thereafter revised and published annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of Fee.
