काकाकाका....आआआआ.... 6666222266661111 ((((अअअअ))))....————के न्(cid:13)ीय सरकार ने, राष्ट्रीय राजमार्ग अिधिनयम, 1956 (1956 का 48) (िजसे इसमें इसके प(cid:25)ात् उक्त अिधिनयम कहा गया है) की धारा 3क की उपधारा (1) के अधीन जारी की गई भारत सरकार के पोत परिवहन सड़क परिवहन और राजमार्ग मंत्रालय, सड़क परिवहन और राजमार्ग िवभाग की अिधसूचना संख्या का.आ. 3268 , तारीख 29. 6. 2018 जो भारत के राजपत्र, असाधारण, भाग II, ख'ड 3, उपखंड (ii) तारीख 29. 6. 2018 में प्रकाशित की गई थी, द्वारा मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या NH -752-B के कि.मी. 3+150 से कि.मी.42+510 तक ब्यावरा - मकसुदन रोड़ के भूख'ड के निर्माण,(चार लेन का बनाने /चौड़ा करने ) अनुरक्षण, प्रबंधन और प्रचालन के िलए उस अिधसूचना से उपाब8 अनुसूची में विनि9दष्ट भूिम का अर्जन करने के अपने आशय की घोषणा की थी ;

और उक्त अिधसूचना का सार उक्त अिधिनयम की धारा 3 क की उपधारा (3) के अधीन दैिनक भास्कर में मंगलवार 31 जुलाई 2018 और <ी प्रेस में बुधवार 1 अगस्त 2018 को प्रकाशित किया गया था

और सक्षम प्राधिकारी को किसी =क्ति से कोई आक्षेप प्राप्त नह@ Aए हैं;

या

और आक्षेप प्राप्त Aए थे और सक्षम प्राधिकारी ने उन पर िवचार कर िलया है और आक्षेपों को अननुEात कर दिया है ;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और सक्षम प्राधिकारी ने उक्त अिधिनयम की धारा 3घ की उपधारा (1) के अनुसरण में, के न्(cid:13)ीय सरकार को अपनी रिपोर्ट दे दी है ;

अतः अब, के न्(cid:13)ीय सरकार, सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त हो जाने पर और उक्त अिधिनयम की धारा 3घ की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते Aए, यह घोषणा करती है कि उक्त अनुसूची में विनि9दष्ट भूिम का पूवIक्त प्रयोजन के िलए अर्जन किया जाना चािहए ;

और अब, के न्(cid:13)ीय सरकार, उक्त अिधिनयम की धारा 3घ की उपधारा (2) के अनुसरण में यह घोषणा करती है कि इस अिधसूचना के राजपत्र में प्रकाशन पर, उक्त अनुसूची में विनि9दष्ट भूिम सभी विल्लंगमों से मुक्त होकर आत्यन्तिक रूप से के न्(cid:13)ीय सरकार में िनिहत हो जाएगी ।

NOTIFICATION

New Delhi, the 21st December, 2018

S.O. 6261(E).—Whereas by the notification of the Government of India in the Ministry of Shipping Road Transport and Highways, Department of Road Transport And Highways number S. O. 3268 dated 29/06/2018 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intension to acquire the land specified in the Schedule annexed to the said notification for (Widening/Four - Laning, etc.) Maintenance, management and operation of NH752-B on the stretch of land from Km 3.150 to Km 42+510 K.m. in Guna in the state of MADHYA PRADESH.

And whereas the substance of the said notification has been published in "Dainik Bhaskar" 31 July 2018 Teusday; and "Free Press" 1 August 2018 Wednesday under sub-section (3) of section 3A of the said Act;

And whereas no objections has been received From Any person By The Competent Authority;

Or

And whereas objections have been received and the same have been considered and disallowed by the competent authority;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
