सासासासा-काकाकाका-निनिनिनि- 1229(अअअअ).—निम्नलिखित प्रारूप नियमों जिन्हें केन्द्र सरकार मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती हैं,, को इस अधिनियम की धारा 212 की उप-धारा (1) के द्वारा यथावष्यक इसके द्वारा प्रभावित होने की संभावना वाले व्यक्तियों की जानकारी के लिए एतदद्वारा प्रकाषित किया जाता है; और एतदद्वारा नोटिस दिया जाता है कि इन प्रारूप नियमों को उस तारीख से 30 दिन की अवधि समाप्त होने के बाद विचारार्थ स्वीकार कर लिया जायेगा जिसको सरकारी राजपत्र में यथा प्रकाषित इस अधिसूचना की प्रतियां जनता के लिए उपलब्ध करायी जाती हैं।

उक्त प्रारूप नियमों के संबंध में विनिर्दिश्ट अवधि समाप्त होने के भीतर किसी भी व्यक्ति से प्राप्त होने वाली आपत्तियों या सुझावों पर केन्द्र सरकार द्वारा विचार किया जायेगा;

इन प्रारूप नियमों के संबंध में आपत्तियों एवं सुझावों, यदि कोई हो, को संयुक्त सचिव (एमवीएल), ई-मेल: [email protected], सड़क परिवहन एवं राजमार्ग मंत्रालय, परिवहन भवन, संसद मार्ग, नई दिल्ली-110001 के पास भेजा जा सकता हैं।

संक्षिप्त नाम एवं प्रारम्भ-(1) इन नियमों को केन्द्रीय मोटर यान (...............संषोधन) नियम, 2018 कहा जायेगा।

(2) इन नियमों में अन्यथा उपबंधित के सिवाये, ये सरकारी राजपत्र में उनके अन्तिम रूप से प्रकाषन की तिथि को लागू होगें।

केन्द्रीय मोटर यान नियम, 1989 (जिन्हें आगे उक्त नियम कहा गया हैं), नियम 96 में-

(क) उप नियम (4) में, खण्ड (दो) में, प्रथम परन्तुक के पष्चात, निम्नलिखित परन्तुकों को अंतःस्थापित किया जायेगा, अर्थात:-

परन्तु यह और कि एम 1 श्रेणी के नये मॉडल की दषा में, 1 अप्रैल, 2020 और इसके पष्चात तथा सभी मॉडल की दषा में 1 अप्रैल, 2021 से, निर्मित यानों के ब्रेक प्रणाली समय-समय पर यथा संषोधित आईएस:१५९८६:२०१५ या एआईएस:१५१:२०१८ मानक के अनुरूप होगें:

परन्तु यह और कि एम 2, एम 3,एन 1, एन 2, एन 3 श्रेणी के लिए नये माडलों की दषा में, 1 अप्रैल 2020 और इसके पष्चात तथा सभी मॉडलों की दषा में 1 अप्रैल 2021 से, निर्मित यानों के ब्रेक प्रणाली समय-समय पर यथा संषोधित आईएस 11852:२०१३ मानक के अनुरूप होगें:

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] परन्तु यह भी कि एन 1 श्रेणी के आईएस 15986:२०१५ मानक के अनुरूप यानों को आईएस 11852:२०१३ मानक की आवष्यकताओं के अनुरूप समझा जायेगा:

परन्तु यह और कि यदि एम 1 तथा एन 1, श्रेणी के नये मॉडल की दषा में, 1 अप्रैल, 2020 और इसके पष्चात तथा सभी मॉडल की दषा में 1 अप्रैल, 2021 से, निर्मित यानों के ब्रेक सहायता प्रणाली समय-समय पर यथा संषोधित एआईएस:१५२:२०१८ मानक के अनुरूप होगें:

(ख) उप नियम (4 ख )में ,

(1) खण्ड (दो), में प्रयुक्त शब्द एवं अंक ''1 अप्रैल, 2019 को और उसके पष्चात...............'', के पूर्व शब्द ''निर्मित'' अंतःस्थापित किया जायेगा;

(2) प्रयुक्त शब्द एवं अंक ''आईएस:१५९८६:२०१५'', के स्थान पर शब्द एवं अंक '' समय-समय पर यथा संषोधित

आईएस:१५९८६:२०१५ या एआईएस:१५१:२०१८'' अंतःस्थापित किया जायेगा;

(3) अन्त में, निम्नलिखित परन्तुक अंतःस्थापित किया जायेगा, अर्थात:-

परन्तु यह कि एम 2 श्रेणी के नये मॉडल की दषा में, 1 अप्रैल, 2020 और इसके पष्चात तथा सभी मॉडल की दषा में 1 अप्रैल, 2021 से, निर्मित यानों में एन्टी लॉक ब्रेक प्रणाली समय-समय पर यथा संषोधित आईएस:१५९८४:२०१५ मानक के अनुरूप होगें:

(ग) उप-नियम (5) एवं उप-नियम (6) का विलोप किया जायेगा;

(घ) उप-नियम (9) में खण्ड चार (द), निम्नलिखित परन्तुक अंतःस्थापित किया जायेगा, अर्थात:-

''परन्तु यह कि एम 3, एन 2, एवं एन 3 श्रेणी के यान, ट्रैक्टर-ट्रेलर संयोजन को छोड़कर, जो परिसंकटमय माल तथा तरल पेट्रोलियम गैंस ढोने हेतु प्रयुक्त हेां, के नये माडलों की दषा में, 1 अप्रैल 2020 तथा उसके पष्चात और सभी मॉडलों की दषा में 1 अप्रैल 2021 से, निर्मित यानों के एन्टी लॉक ब्रेक प्रणाली समय-समय पर यथा संषोधित आईएस:११८५२:२०१३ मानक के अनुरूप होगें:

(ड.) उप-नियम (6) के पष्चात, निम्नलिखित उप-नियम अंतःस्थापित किया जायेगा, अर्थात:-

''(10) एम 1 तथा एन 1, श्रेणी के यान यदि उनमें एन 1 श्रेणी के, 1 अप्रैंल, 2020 और उसके पष्चात निर्मित यान गतिषील स्थिरता नियंत्रण प्रणाली से युक्त होने की दषा में समय-समय पर यथा संषोधित एआईएस:१३३:२०१६ में यथा विनिर्दिश्ट आवष्यकताओं के अनुरूप होगें, जब तक कि ब्यूरों आफ इण्डियन स्टैण्डर्डस अधिनियम, 2016 (2016 का 11) के अन्र्तगत तत्समान ब्यूरों आफ इण्डियन स्टैण्डर्डस विनिर्देषनों को अधिसूचित न कर दिया जाय

3. नियम 96 ब में, प्रथम परन्तुक के पष्चात, निम्नलिखित परन्तुक बढ़ा दिया जायेगा, अर्थात:-

''परन्तु यह कि 1 अप्रैल 2020 और उसके पष्चात निर्मित एम 1 श्रेणी के यान, समय-समय पर यथा संषोधित जो आईएस:15986-२०१५ मानक के अनुरूप हो, को इस नियम के मानक की आवष्यकताओं के अनुरूप समझा जायेगा।''

G.S.R. 1229(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of Motor Vehicles Act, 1988 (59 of 1988) is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India are made available to the Public.

The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid will be considered by the Central Government;

Draft rules

1. Short title and commencement. -(1) These rules may be called as the Central Motor Vehicles (………..

Amendment) Rules, 2018.

(2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989 (hereafter referred as the said rules), in rule 96.-

(a) in sub-rule (4), in clause (ii), after the first proviso, the following provisos shall be inserted, namely: –

"Provided further that Braking System for M1 category of vehicles manufactured, on and from 1st April 2020 in the case of new models and 1st April 2021 in case of all models, shall conform to IS 15986:2015 or AIS:151:2018 as amended from time to time:

Provided further that Braking System for M2, M3, N1, N2, N3 categories of vehicles manufactured, on and from 1st April 2020 in case of new models and 1st April 2021 in case of all models, shall conform to IS 11852:2013, as amended from time to time:

Provided also that N1 category of vehicles conforming to IS 15986:2015 shall be deemed to comply with the requirements of IS 11852:2013:

Provided further that Brake Assist System if provided in M1 and N1 category of motor vehicles manufactured, on and from 1st April 2020 in the case of new models and 1st April 2021 in case of all models shall conform to AIS: 152:2018 amended from time to time.".

(b) In sub-rule (4B),

(1) in clause (ii), before the word and figure "on and after the 1st April 2019………", the word "manufactured" shall be inserted;

(2) for the words and numbers "IS:15986:2015", the words and numbers"IS:15986:2015 or AIS:151:2018, as amended from time to time" shall be inserted;

(3) at the end,the following proviso shall be inserted, namely: -

"Provided that vehicles of category M2 manufactured on and after 1st April, 2020 in case of new models and 1st April 2021 in case of all models,shall be fitted with Anti-Lock Braking System conforming to the IS:15984:2015 as amended from time to time.";

(d) in sub-rule (9) after clause iv(d),the following proviso shall be inserted,namely: -

"Provided that vehicles of category M3, N2 and N3 other than tractor-trailer combination meant for carrying hazardous goods and liquid petroleum gas,manufactured on and after 1stApril, 2020 in the case of new models and 1stApril, 2021 in case of all models, shall be fitted with Anti-Lock Braking System conforming to IS: 11852:2013, as amended from time to time.";

(e) after sub-rule (9), the following sub-rule shall be inserted, namely: -

"(10) M1 and N1 categories ofvehicles, if provided with Electronic Stability Control Systems manufactured on and after 1st April, 2020, shall conform to the requirements as specified in AIS:133-2016, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).".

3. in rule 96B, after the first proviso, the following proviso shall be inserted, namely: -

"Provided further that M1 category of vehicles manufactured on and after 1st April, 2020, having braking system conforming to IS: 15986- 2015, as amended from time to time,shall be deemed to comply with the requirements of this rule.".
