30 मई, 2013 और का. आ. 701(अ) तारीख 10 मार्च, 2016 के साथ पठित औषध (कीमत नियंत्रण) आदेश, 2013 के पैरा 5, 11 और 15 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण (जिसको संक्षिप्त रूप में एनपीपीए कहा जाता है), नीचे की सारणी के स्तंभ (6) में विनिर्दिष्ट खुदरा मूल्य को उक्त सारणी के स्तंभ (3), (4), और (5) में तत्स्थानी प्रविष्टियों में विनिर्दिष्ट प्रबलता, इकाई (यूनिट) और विनिर्माता और विपणन कम्पनियों के नाम सहित स्तंभ (2) में की तत्स्थानी प्रविष्टि में से प्रत्येक की, वस्तु एवं सेवा कर, यदि कोई है, को छोड़कर अधिकतम खुदरा मूल्य के रूप में नियत करती है।

(क) उपर्युक्त दी गई विनिर्दिष्ट फॉर्मूलेशन के विनिर्माता अर्थात जो "नई ड्रग" डीपीसीओ, 2013 के पैराग्राफ 2(यू) के तहत उपर्युक्त दी गई सारणी के स्तंभ (6) में विनिर्दिष्ट खुदरा मूल्य निर्धारित करेंगे।

(ख) अगर निर्माताओं ने उपर्युक्त सारणी के स्तंभ (6) में वर्णित अधिकतम कीमत पर सरकार को वास्तव में भुगतान किया है या यह देय है तो वे वस्तु एवं सेवा कर को जोड़ सकते हैं।

(ग) औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराग्राफ 11 में दिए गए प्रावधानों के तहत निर्माताओं को उपर्युक्त सारणी के स्तंभ (6) में विनिर्दिष्ट खुदरा मूल्य के आधार पर अनुसूचित विनिर्मितियों के पैकों के लिए खुदरा मूल्य निर्धारित करें। निर्माता औषध (मूल्य नियंत्रण) आदेश, 2013 के पैराग्राफ 24 के तहत फॉर्म V में अधिसूचना की तारीख से एक मूल्य सूची एनपीपीए को आईपीडीएमएस के माध्यम से जारी करें तथा उसकी कापी राज्य औषधि नियंत्रकों और विनिर्माता वितरकों को जारी करें।

(घ) औषध (मूल्य नियंत्रण) आदेश, 2013 के 24 (4) के उपबंधों के अनुसार प्रत्येक फुटकर विक्रेता और वितरक विनिर्माता द्वारा दिए गए रूप में ऐसे परिसर, जहां कारबार को इस प्रकार किया जा रहा है कि उससे परामर्श के इच्छुक किसी व्यक्ति के लिए पहुंच आसान हो, वहां उसके किसी सहजदृश्य भाग पर कीमत सूची और पूरक सूची, यदि कोई हो, को संप्रदर्शित करेगा।

(ड.) उपर्युक्त गैर अधिकतम कीमत (खुदरा मूल्य) केवल उपर्युक्त निर्माता/विपणन के लिए लागू है जैसा कि उन्होंने औषध (मूल्य नियंत्रण) आदेश, 2013 के तहत अनुबद्ध मूल्य निर्धारण/संशोधन के लिए फॉर्म I पर जमा किया गया था और सरकार द्वारा निर्धारित सभी लागू वैधानिक आवश्यकताओं की पूर्ति के अधीन प्रासंगिक विधियों/नियमों के अन्तर्गत जैसा कि [भाग II—ख(cid:2)ड3(ii)] भारत का राजपत्र : असाधारण

केन्द्रीय/राज्य लाइसेसिंग ऑथोरिटी के सक्षम प्राधिकारी द्वारा मेन्यूफेक्चरिंग लाइसेंस मंजूरी के तहत संबंधित विनिर्मित निर्माता/विपणन कम्पनियां जो अनुपालन करती है।

(च) विनिर्माता या विपणन कम्पनी, उपरोक्त विनिर्मितियों और विनिर्दिष्ट शर्तों का पालन नहीं करती हैं तो वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डीपीसीओ, 2013 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे।

(छ) इस आदेश में उपरोक्त सारणी के स्तंभ (2) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट विनिर्मितियों के पैकों की खुदरा मूल्य नियत होने के परिणामस्वरुप, आदेश जो कि इस आदेश से पूर्व जारी हुए है, स्वतः ही निरस्त हो जाएंगे।

ORDER

New Delhi, the 31st December, 2019

S.O. 4725(E).—In exercise of the powers conferred by paragraphs 5, 11 and 15 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated the 30th May, 2013 and S. O. 701(E) dated 10th March, 2016 issued by the Government of India in the Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority (hereinafter referred as NPPA), hereby fixes, the price as specified in column (6) of the table herein below as the retail price, exclusive of goods and services tax, if any, in relation to the formulation specified in the corresponding entry in column (2) of the said Table with the strength, unit and name of manufacturer & marketing company, as specified in the corresponding entries in columns (3), (4) and (5) thereof.

Note:

(a) The manufacturer of above mentioned formulations i.e. "new drug" under paragraph 2(u) of the DPCO, 2013 shall fix the retail price as specified in column (6) of the table hereinabove.

(b) The manufacturer may add goods and services tax only if they have paid actually or it is payable to the Government on the retail price mentioned in column (6) of the above said table.

(c) The retail price for a pack of the aforesaid formulation shall be arrived at by the concerned manufacturer in accordance with the retail price specified in column (6) of the above table as per provisions contained in paragraph 11 of the DPCO, 2013. The manufacturer shall issue a price list in Form–V from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers.

(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same.

(e) The above mentioned retail price is applicable only to the individual manufacturer / marketer as mentioned above i.e. who have applied for the same by submitting Form-I for price fixation / revision as stipulated under DPCO, 2013 and subject to fulfilment of all the applicable statutory requirements as laid down by the Govt. under relevant statutes/ rules, including manufacturing license permission from the Competent Authority i.e. the Central/State Licensing Authority, as may be applicable, by the concerned manufacturer/marketing companies.

(f) In case the retail price of any of the aforesaid formulations is not complied with, as per instant price notification and notes specified hereinabove, then the concerned manufacturer/marketing company shall be liable to deposit the overcharged amount along with the interest thereon under the provisions of the DPCO, 2013 read with the Essential Commodities Act, 1955.

(g) Consequent to the issue of ceiling price of such formulation as specified in column (2) of the above table in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of notification, stand(s) superseded.
