dk-vk- 64¼v½.—के न्(cid:4)ीय सरकार ने पेट्रोलियम और खिनज पाइपलाइन्स (भूिम में उपयोग के अिधकार का अर्जन) अिधिनयम, 1962 (1962 का 50) (िजसे इसमें इसके प(cid:22)ात उक्त अिधिनयम कहा गया है) की धारा 3 की उप–धारा (1) के अधीन जारी की गई, भारत सरकार के पेट्रोलियम और प्राकृ तिक गैस मंत्रालय की अिधसूचना संख्या का.आ. 439 तारीख 22.03.2019 िजसका प्रकाशन भारत के राजपत्र संख्या 13 , भाग II, ख#ड 3, उप–ख#ड (ii) तारीख मार्च 24- मार्च 30, 2019, अिधसूचना संख्या का.आ. 1075 तारीख 18.06.2019 िजसका प्रकाशन भारत के राजपत्र संख्या 26, भाग II, ख#ड 3, उप–ख#ड (ii) तारीख जून 23 – जून 29, 2019 में किया गया है। इस अिधसूचना में संल' अनुसूची में विनि)दष्ट आं- प्रदेश राज्य के कामावरपुकोटा, को/यालागुदेम, पोलावरम, चितलापूड़ी और टी.

नरसापुरम मंडल वेस्ट गोदावरी िजला की भूिम में, ओडीशा राज्य में पारादीप से तेलंगाना राज्य में हैदराबाद तक पेट्रोलियम उत्पादों के परिवहन के िलए इंिडयन ऑयल कॉप<रेशन िलिमटेड के द्वारा >ियान्वित किए जा रहे "पारादीप- हैदराबाद पाइपलाइन परियोजना" के संबंध में पाइपलाइन िबछाने के प्रयोजन के िलए उपयोग के अिधकार का अर्जन करने के िलए अपने आशय की घोषणा की थी।

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और उक्त राजपत्र अधिसूचना की प्रतियाँ जनता को उपलब्ध करा दी गई थF। और उक्त अधिनियम की धारा 6 की उपधारा (1) के अनुसरण में सक्षम प्राधिकारी नें के न्(cid:4)ीय सरकार को अपनी रिपोर्ट दे दी है।

और के न्(cid:4)ीय सरकार ने उक्त रिपोर्ट पर िवचार करने के प(cid:22)ात और यह समाधान हो जाने पर कि उक्त भूिम पाइपलाइन िबछाने के िलए अपेक्षित है, उसमें उपयोग के अिधकार का अर्जन करने का विनिष्चय किया है:

अतः अब, के न्(cid:4)ीय सरकार उक्त अिधिनयम की धारा 6 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते Lए एतद् द्वारा घोषणा करती है कि इस अिधसूचना से संल' अनुसूिच में विनि)दष्ट भूिम में पाइपलाइन िबछाने के उपयोग का अिधकार अMजत किया जाए:

और के न्(cid:4)ीय सरकार उक्त अिधिनयम की धारा 6 की उपधारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते Lए, यह निद<श देती है कि उक्त भूिम में उपयोग का अिधकार इस घोषणा के प्रकाशन की तारीख से के न्(cid:4)ीय सरकार में िनिहत होने के बजाए सभी बिल्लंगमों से मुक्त होकर इंिडयन ऑयल कॉप<रेशन िलिमटेड में िनिहत होगा।

NOTIFICATION

New Delhi, the 27th December, 2019

S. O. 64(E).—Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas, published in the Gazette of India No. 13, Part-II, Section 3, Sub-section (ii) dated March 24 – March 30, 2019 vide S.O. Number 439 dated 22.03.2019, Gazette of India No. 26, Part-II, Section 3, Sub-section (ii) dated June23- June 29, 2019 vide S.O. Number 1075 dated 18.06.2019 issued under Sub-section (1) of Section 3 of the Petroleum and Minerals pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central Government declared its intention to acquire the right of user in the land situated in Kamavarapukota, Koyyalagudem, Polavaram, Chintalapudi and T Narsapuram mandals of West Godavari district of Andhra Pradesh State, specified in the schedule appended to that notification for the purpose of laying pipeline for the transportation of petroleum products from Paradip in the State of Odisha to Hyderabad in the State of Telangana by the Indian Oil Corporation Limited for implementing the "Paradip–Hyderabad Pipeline Project".

And whereas the copies of the Gazette were made available to the public. And whereas the Competent Authority has under Sub-section (1) of Section 6 of the said Act, has submitted his report of Central Government. And whereas, the Central Government after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of the user therein;

Now, therefore, in exercise of the powers conferred by Sub-section (1) of Section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user of the said land for laying the pipeline shall, instead of vesting in the Central Government, vests on the date of publication of the declaration, in India Oil Corporation Limited, free from all encumbrances.
