का.आ. 110(अ).—जबकि के न्(cid:7076) सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का.आ. 1401(अ), दिनांकित 31 मई, 2013 के द्वारा तमिल नाडु राज्य में राष्ट्रीय राजमार्ग सं.- 532 (कु डालोर से वृ(cid:7373)ाचलम तक) के कि.मी. 0.800 से कि.मी. 51.000 तक के खंड को तमिल नाडु राज्य सरकार को सुपुर्द कर दिया है।

अत: अब, राष् ट्रीय राजमार्ग फीस (दरों का अवधारण और सं(cid:7061)हण) नियम, 2008 (जो इसके आगे ''नियम'' के रूप में उल्लिखित है) के नियम 3 के साथ पठित, राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:7263)ए, के न् (cid:7076)ीय सरकार, एतदद्वारा तमिल नाडु राज्य में राष्ट्रीय राजमार्ग सं. 532 (किमी 0.800 से किमी 51.000) तक कु डालोर से वृ(cid:7373)ाचलम तक के खंड के प्रयोग के लिए निम् नलिखित तालिका 1 के कॉलम (1) में विनि(cid:7416)दष् ट वाहनों के प्रकार पर 45.1302 किमी की निवल सड़क खंड लंबाई और किमी 0.968 (0.0968 किमी लंबाई) की समतुल्य संरचना लंबाई (60 मीटर से अधिक की लंबाई) के लिए तालिका 1 के कॉलम (2) में विनि(cid:7416)दष् ट आधार दर के 60% तथा 5 किमी निवल सड़क खंड की लंबाई के लिए तालिका 1 के कॉलम (2) में विनि(cid:7416)दष् ट आधार दर के 100% की दर पर यांत्रिक वाहन से फीस उदगृहीत करती है तथा भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को उसके अधिकारियों अथवा किसी ठेके दार के माध्यम से उक्त फीस के सं(cid:7061)हण के लिए प्राधिकृ त करती है, अर्थात्:-

तालिका-I

1. इसके अंतर्गत उ(cid:7006)गृहीत और संगृहीत की जाने वाली फीस ऐसे पथकर प्लाजा के लिए विनि(cid:7416)दष्ट निवल सड़क लंबाई हेतु पथकर प्लाजा पर देय और संदेय होगी, अर्थात्:-

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित टोल प्लाजा (प्लाजाओं) पर 60 मीटर से अधिक लंबाई वाली निम्नलिखित अवसंरचनाओं के उपयोग के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को परिव(cid:7414)तत करके निम्नलिखित फीस भी देय और संदेय होगी:-

* संरचनाओें (> 60 मीटर लंबाई) का ब्यौरा निम्नानुसार है:-

3. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किमी की दूरी के भीतर निवास करने वाले (cid:7018)यक्ति के लिए मासिक पास की दर वर्ष 2019-20 के लिए 265.00 (cid:7271). (दो सौ पैंसठ (cid:7271)पए मात्र) है और यह उक्त नियमों के उपबंधों के अनुसार प्रत्येक वर्ष संशोधन के अध्यधीन है।

4. राजमार्ग खंड पर ब(cid:7263)ल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्

5. फीस प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए फीस उस (cid:7088)ेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशत(cid:7287) कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई स(cid:7414)वस रोड या वैकल्पिक सड़क उपलब् ध न हों।

6. संबंधित (cid:7088)ेणी के वाहनों के लिए विनि(cid:7416)दष् ट अनु(cid:6980)ेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी (cid:7018) यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल सं(cid:7061)हण एजेंसी को ऐसी (cid:7088)ेणी के वाहनों के लिए उक्त नियमों के नियम 10 के उप-नियम 1क में विनि(cid:7416)दष् ट फीस के समतुल्य फीस का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नह(cid:7277) होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नह(cid:7277) जाता।

7. सभी परिभाषाएं, यांत्रिक वाहनों की (cid:7088)ेणी, इनके अनु(cid:6980)ेय भार, छू ट प्राप्त वाहनों की (cid:7088)ेणी, स(cid:7414)वस रोड, वैकल्पिक सड़क इत्यादि उक्त नियमों में विनि(cid:7416)दष्ट परिभाषाओं के अनुरूप होंगी।

8. फीस की दरें उक्त नियमों के नियम 12 के अनुसरण में प्रयोक्ताओं के सूचनार्थ प्रद(cid:7414)शत करनी होंगी।

9. यांत्रिक वाहनों से फीस की वास्तविक राशि उपयु र्क्त तालिका-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी फीस की आधार दर के आधार पर प्रभारित होगी और छू टों की गणना प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अं(cid:7061)ेजी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 10. परियोजना की अनुमानित पू ंजीगत लागत 157.93 करोड़ रू. है। प्राप्त प्रयोक्ता फीस के माध्यम से वसूल की गई पू ंजीगत लागत का भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा रिकार्ड रखा जाएगा तथा पू ंजीगत लागत की वसूली के पश्चात् उद(cid:7061)ा(cid:7405) फीस घटाकर दरों के 40% तक कर दी जाएगी और कथित नियमों के अनुसरण में वा(cid:7414)षक रूप से संशोधित की जाएगी।

NOTIFICATION

New Delhi, the 7th January, 2020

S.O. 110(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O.1401 (E) dated 31st May 2013, issued under section 5 of the National Highways Act,1956 (48 of 1956), the Central Government has entrusted the stretch from Km. 0.800 to Km. 51.000 (from Cuddalore to Vridhachalam section) of National Highway No.532, in the State of Tamil Nadu to the State Government of Tamilnadu

Now, therefore in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection)Rules,2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at sixty percent of the base rate specified in column (2) of the Table 1 for net road section length of 45.1302 Km. and for equivalent structure length (having length more than 60m) of 0.968 km. ( having length of 0.0968 km.) and at one hundred percent of the base rate specified in column (2) of Table(1) for net road section length of 5.00 km. on the type of vehicles specified in column (1) of the Table 1 below of Cuddalore to Vridhachalam section (from km. 0.800 to km. 51.000) of National Highway number 532 in the State of Tamil Nadu and authorises National Highways Authority of India (NHAI) to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified for such Fee Plaza(s) namely:-

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60 m at the following Fee plaza(s), by converting the length of structures into an equipment length of highway by multiplying the length of such structures by an equalization factor of 10, at the base rate mentioned in Table 1 above:

The rate of Monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.265 (Rupees Two Hundred and Sixty Five Only) for the year 2019-20 and is subject to revision every year as per the provisions of the said rules.

4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:-

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.

8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.

9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India (NHAI) on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.

10. The estimated capital cost of the project is Rupees 157.93 crore. National Highways Authority of India (NHAI) shall maintain a record of the recovery of capital cost through user fee realized and after recovery of capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
