काकाकाका....आआआआ. . . . 109109109109((((अअअअ))))....———— यतः, के न्(cid:9)ीय सरकार ने, राष्ट्रीय राजमार्ग अिधिनयम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अिधसूचना संख्या का. आ. 465 (अ), तारीख 26 अप्रैल, 2002 द्वारा असम राज्य में राष्ट्रीय राजमार्ग संख्या–31 के 961.500 कि.मी. से 1126.000 (गुवाहाटी- नलबाड़ी िबजनी) और राष्ट्रीय राजमार्ग संख्या–31सी के 0.000 कि.मी. से 93.000 कि.मी. (िबजनी से प#िम बंगाल/असम सीमा) तक का ख%ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (िजसे इसमें इसके प#ात् 'प्राधिकरण' कहा गया है) को स,पा है;

अतः अब, के न्(cid:9)ीय सरकार, समय-समय पर यथा संशोिधत राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं सं0हण) िनयम, 2008 (िजसे इसमें इसके प#ात् "उक्त िनयम" कहा गया है) के िनयम 3 के साथ पठित राष्ट्रीय राजमार्ग अिधिनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते 6ए, और अिधसूचना संख्या 141 GI/2020

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] का.आ. 20 (अ) तारीख 01.01.2015 के अधि8मण में, िसवाय उन बातों के जो ऐसे अधि8मण से पहले कर ली ग: हैं अथवा करने में लोप करा दी ग: हैं, एत<ारा यांत्रिक वाहनों पर चार और उससे अिधक लेन ख%ड के उपयोग हेतु सारणी 1 के स्तम्भ (2) में विनि@दष्ट दर से सड़क खंड की िनवल लंबाई 111.887 कि. मी. और 19.99 कि. मी. की संरचना समकक्ष लंबाई (जिसकी लंबाई 60 मी. से अिधक है) (लंबाई 1.999 कि.मी.है) हेतु नीचे सारणी 1 के स्तम्भ (1) में विनि@दष्ट वाहनों पर असम राज्य में राष्ट्रीय राजमार्ग संख्या 31 के गुवाहाटी से नलबाड़ी-िबजनी सेक्शन के 961.500 कि. मी. से 1013.000 कि. मी. और राष्ट्रीय राजमार्ग संख्या- 31सी के िबजनी से प#िम बंगाल/असम सीमा सेक्शन के 30.000 कि. मी से 93.000 कि. मी. तक पर शुल्क उGहीत करती है एवं प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संिवदाकार के माध्यम से उक्त शुल्क को सं0हीत करने के िलए प्राधिकृ त करती है, अर्थात्-

1. नीचे उGहीत एवं सं0हीत शुल्क, निम्नलिखित शुल्क प्लाजा पर, ऐसे शुल्क प्लाजा के लिए विनि@दष्ट सड़क की िनवल

संरचनाओं की लम्बाई को समकरण गुणक 10 से गुणा करके राजमार्ग की समकक्ष लम्बाई में परिवTतत करते 6ए, निम्नलिखित शुल्क प्लाजा )प्लाजाओं (पर , निम्नलिखित शुल्क भी शोध्य और संदेय होगाः

3. िजस Wक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के िलए पंजीकृ त 6आ हो और वह शुल्क प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता हो, उसके िलए वर्ष 2019-20 के िलए मािसक पास की दर 265.00/-रूपए (दो सौ पैंसठ रूपए मात्र) होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं सं0हण) िनयम, 2008 के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा।

4. राजमार्ग ख%ड पर ब6यात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्ः

5. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृ त वाणिज्यिक वाहन(राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर)के लिए शुल्क उस ^ेणी के लिए वाहन के लिए विनि@दष्ट शुल्क का 50505050% होगा बशत_ के ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सTवस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो।

6. जो यांत्रिक वाहन अपनी ^ेणी के लिए निर्धारित अनुaेय भार की अपेक्षा अधिक भार से लदा 6आ होगा उसके चालक अथवा मालिक अथवा प्रभारी Wक्ति को ऐसे अधिक भार से लदे 6ए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क सं0हण एजेंसी को रारा शुल्क नियम,

2008 के िनयम 10 )1ए (के अनुसार शुल्क का भुगतान करना होगा

तक अनुमति नहb होगी जब तक कि ऐसे यांत्रिक वाहन से अधिक भार और उसे राजमार्ग ख%ड का उपयोग करने की तब को हटा न दिया जाए।

7. यांत्रिक वाहनों की ^ेणी, उनके लिए अनुaेय भार, छू ट-प्राप्त वाहनों की ^ेणी, सTवस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनि@दष्ट परिभाषाओं के अनुसार होंगी।

8. उक्त नियमों के नियम 12121212 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदTशत किया जाएगा।

9. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007200720072007----08080808 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जाने वाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा खंडों की पूरी कर ली गई लम्बाई के आधार पर की जायेगी और उसमें उक्त नियमों के िनयम िनयम िनयम िनयम 5555 के अनुसार वाTषक तौर पर संशोधन किया जाएगा तथा उसे, तदनुसार, अं0ेजी और स्थानीय भाषा के कम -से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।

10. इस परियोजना की पू ंजीगत लागत की वतर्मान लागत (12)1216.72 2045.30 करोड़ eपये और 828.58 करोड़ eपये है। पू ं जी लागत में परिवर्तन हो सकता है क्योंकि भूिम अर्जन, जन-उपयोिगता सेवाओं का स्थान बदलने, पेड़ों की कटाई आदि जैसे 8ियाकलाप अभी पूरे किए जाने शेष हैं। अंितम पू ंजीगत लागत को अलग से अिधसूिचत किया जाएगा। प्राधिकरण द्वारा प्रयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पू ंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पू ंजीगत लागत की वसूली हो जाने के पश्चात, लगाए जाने वाले शुल्क की दरों को घटाकर 40% कर दिया जाएगा और उक्त नियमों के अनुसार इस में वाTषक तौर पर संशोधन किया जाएगा।

NOTIFICATION

New Delhi, 7th January, 2020

S.O. 109(E).—Whereas by notification of the Government of India in the erstwhile Ministry of Road Transport and Highways No. S.O. 465 (E) dated 26th April'2002 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from Km.0.000 to Km. 93.000 (Bijni to West Bengal/Assam Border) of National Highway No. 31C and Km.961.500 to Km.1126.000 (Guwahati – Nalbari Bijni) of National Highway No. 31 in the State of Assam to the National Highways Authority of India (hereinafter referred to as the "Authority");

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the "said Rules") and in supersession of the notification number S.O. 20 (E) dated 01.01.2015, except as respects things done or omitted to be done before such supersession, the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length of 111.887 km. for the use of four and more alone section and for equivalent structure length (having length more than 60m) of 19.99 km. (having length of 1.999 km.) on the type of vehicles specified in column (1) of the Table 1 below of Bijni to West Bengal/ Assam border section from km 30.000 to km. 93.000 of NH-31C and Guwahati to Nalbari- Bijni section from km 961.500 to km 1013.000 of NH-31 in the State of Assam and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee levied and collected hereunder shall be due and payable at the following Fee Plaza for the length specified for such Fee Plaza:

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.265.00 (Rupees Two Hundred Sixty Five only) for the year 2019-20 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, as per Rule 10 (1A) of NH Fee Rule 2008 and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.

10. The present value of capital cost of the project is Rupees 2045.30 Cr. (Rs.1216.72 Crore. and Rs.828.58 Cr.) The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
