सा.का.िन. 21(अ).—के न्(cid:10) सरकार, रेल दावा अिधकरण अिधिनयम, 1987 (1987 का 54) की धारा 30 के उपखंड (2) के खंड (ग), (ड़), (च) और (छ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:25)ए, रेल दावा अिधकरण (प्र(िcid:27)या) िनयम, 1989 में और संशोधन करने के िलए एत(cid:30)ारा निम्निलिखत िनयम बनाती है, अर्थात:-
1. संक्षिप्त नाम एवं प्रारंभ-(1) इन नियमों को रेल दावा अिधकरण (प्र(िcid:27)या) संशोधन िनयम, 2020 कहा जाएगा.
(2) ये सरकारी राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे.
2. रेल दावा अिधकरण (प्र(िcid:27)या) िनयम, 1989 में, िनयम 8 के िलए, निम्निलिखत िनयम को प्रतिस्थािपत किया जाए, अर्थात:-
''8. दुर्घटना या अप्रिय घटनाओं संबंधी दावों में प्रतिकर के िलए आवेदन फाइल करने का स्थान – रेल अिधिनयम, 1989 (1989 का 24) की धारा 124 या 124-क के अधीन संदेय प्रतिकर के िलए आवेदन, जहां दुर्घटना अथवा अप्रिय 180 GI/2020
(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] घटना होती है या जहां दावेदार सामान्यतया िनवास करता है, उस स्थान पर प्रादेशिक अधिकारिता रखने वाली न्यायपीठ के समक्ष फाइल किया जाए.''

NOTIFICATION
New Delhi, the 10th January, 2020
G.S.R. 21(E).—In exercise of the powers conferred by clauses ( c ), ( e ), ( f ) and ( g ) of sub-section (2) of section 30 of the Railway Claims Tribunal Act, 1987 (54 of 1987), the Central Government hereby makes the following rules further to amend the Railway Claims Tribunal ( Procedure) Rules, 1989, namely :-
1. Short title and commencement.—(1) These rules may be called the Railway Claims Tribunal (Procedure) Amendment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Railway Claims Tribunal (Procedure) Rules, 1989, for rule 8, the following rule shall be substituted, namely:- "8. Place of filing application for compensation in accident or untoward incident claim.- An application for compensation payable under section 124 or 124-A of the Railways Act, 1989 (24 of 1989) may be filed before the Bench having territorial jurisdiction over the place where the accident or untoward incident occurs or where the claimant normally resides".
