का.आ. का.आ. का.आ. का.आ. 111199996666(अ)(अ)(अ)(अ)....————जबकि भारत सरकार के पेट्रोलियम एवं प्राकृ तिक गैस मंत्रालय द्वारा दिनांक- 15.05.2019 को पेट्रोलियम एवं खिनज पाइपलाइन (उपयोगकर्ता के भूिम पर अिधकार का अधि!हण ) अिधिनयम, 1962 (50/1962), (एत%प&ात 'उक्त अिधिनयम' द्वारा संद)भत) की धारा 3 की उपधारा (1) के अंतर्गत एस॰ओ॰ संख्या 2008(ई) के माध्यम से जारी अिधसूचना, जो भारत के दिनांक 20.06.2019 को संख्या 1796 वाले असाधारण राजपत्र में प्रकाशित 0ई थी,के द्वारा कें 1ीय सरकार ने ओएनजीसी द्वारा टीएनजी #3से एमडीएम सीपीएफ़ पाइपलाइन तक गैस परिवहन के िलए पाइपलाइन िबछाने के उद्देश्य से इसी अिधसूचना के साथ संल6 अनुसूची के अंतर्गत स्पष्टीकृ त उपयोगकर्ता के भूिम पर अिधकार के अधि!हण का मन्त: घोिषत किया था।

और जबकि, उक्त राजपत्र अिधसूचना की प्रतियां जनसामान्य को उपलब्ध करा दी गई थी।

और जबकि, जनसामान्य द्वारा दर्ज आपत्तियों को सक्षम प्राधिकारी द्वारा स्वीकार कर उन्हें िनराकृ त किया जा चुका है।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और जबकि, सक्षम प्राधिकारी द्वारा अिधिनयम के धारा 6 की उपधारा (1) के अंतर्गत अपनी रिपोर्ट भारत सरकार को प्रस्तुत की जा चुकी है।

और जबकि, भारत सरकार ने रिपोर्ट को स्वीकार कर और संतुष्ट होकर कि उक्त भूिम पाइपलाइन िबछाने के िलए आवश्यक है, निर्णय िलया है कि यहाँ उपयोगकर्ता के अिधकार को अधि!हीत किया जाए।

अब, अतः, उक्त अिधिनयम की धारा 6 की उपधारा (1) द्वारा प्रदत्त शक्तियों के अCयास में, भारत सरकार एतDारा घोषणा करती है कि इस अिधसूचना में संल6 अनुसूची में स्पष्टीकृ त भूिम पर उपयोगकर्ता के अिधकार को पाइपलाइन िबछाने के िलए एतDारा अधि!हीत किया जाता है।

और, आगे, उक्त अिधिनयम की धारा 6 की उपधारा 4 के अंतर्गत प्रदत्त शक्तियों के अCयास में, भारत सरकार एतDारा यह निदEश देती है कि पाइपलाइन िबछाने के िलए भूिम पर उपयोगकर्ता के अिधकार, भारत सरकार में िनिहत होने के स्थान पर, आज इस घोषणा के प्रकाशन की दिनांक पर, सभी प्रकार के ऋणभारों से निमु र्क्त होकर ओएनजीसी िलिमटेड में िनिहत हो जाएँगे।

NOTIFICATION

New Delhi, the 3rd January, 2020

S.O. 196(E).—Whereas by notification of the Government of India, Ministry of Petroleum and Natural Gas S.O.No.2008 ( E ) dated 15.05.2019 issued under sub section ( 1 ) of section 3 of Petroleum and Minerals Pipelines (Acquisition of Right of User in land) Act , 1962, ( 50/1962 ), (hereinafter referred to as the said Act), published in the Extraordinary Gazette of India No.1796 dated 20.06.2019, the Central Government declared its intention to acquire the Right of User in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for transportation of gas through TNG # 3 to MDM CPF pipeline by the Oil and Natural Corporation of[भाग II—ख(cid:2)ड 3(ii)] भारत का राजपत्र : असाधारण 7 India Limited.

And whereas, the copies of said Gazette Notification were made available to the public;

And whereas, the objections received from the public to the laying of pipeline have been considered and disposed of by the Competent Authority;

And whereas, the Competent Authority has under Sub- section (1) Section 6 of the Act, submitted its report to Government of India;

And whereas, the Government of India after considering the said report and on being satisfied that the said land is required for laying the pipelines, has decided to acquire the Right of User therein;

Now, therefore, in exercise of the powers conferred by Sub-section ( 1 ) of the Section 6 of the said Act, Government of India hereby declares that the Right of User in the land specified in the Schedule appended to this Notification is hereby acquired for laying the pipeline;

And, further, in exercise of the powers conferred by Sub-section 4 of Section 6 of the said Act, Government of India hereby directs that the Right of User in the land for laying the pipeline shall, instead of vesting the Government of India, vest, on this date of the publication of the declaration, in the ONGC Limited, free from all encumbrances.
