का.आ. 237(अ).—सेवाओं या लाभों या सहायिकीयों के परिदान के लिए एक पहचान दस्तावेज के रूप में आधार का उपयोग सरकारी परिदान प्रक्रियाओं का सरलीकरण करता है, पारदर्शिता और दक्षता लाता है और लाभार्थियों को सुविधापूर्वक और निर्वाद रीति से उनकी हकदारियों को सीधे प्राप्त करने में समर्थ बनाता है और आधार किसी व्यक्ति की पहचान को साबित करने के लिए विभिन्न दस्तावेज प्रस्तुत करने की आवश्यकता को समाप्त करता है ;
और, भारत सरकार में गृह मंत्रालय (जिसे इसमें इसके पश्चात् मंत्रालय कहा गया है) "भारत के राज्यक्षेत्र में आतंकवाद/सांप्रदायिक/वामपंथी उग्रवादी हिंसा तथा सीमा पार से गोलीबारी तथा माइन/आईईडी विस्फोटों से पीड़ित सिविलियन/ पीड़ित सिविलियन के कु टुम्ब को सहायता सम्बन्धी के न्द्रीय स्कीम" का प्रशासन कर रही है जिसके अधीन राज्य सरकार के संस्थानों अर्थात् संबंधित कलेक्टरों और जिला मजिस्ट्रेट (जिसे इसमें इसके पश्चात् कार्यान्वयन अभिकरण कहा गया है) के माध्यम से पात्र सिविलियन पीड़ित या पात्र पीड़ित के कु टुम्ब सदस्यों (जिसे इसमें इसके पश्चात् लाभार्थी कहा गया है) को वित्तीय सहायता (जिसे इसमें इसके पश्चात् लाभ कहा गया है) प्रदान किया जाता है ;
और, उपयु र्क्त स्कीम में भारत की संचित निधि से गत आवर्ती व्यय अन्तर्वलित है ;
अतः, अब, के न्द्रीय सरकार आधार (वित्तीय और अन्य सहायिकीयों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (2016 का 18) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 7 के उपबंधों के अनुसरण में निम्नलिखित अधिसूचित करती है, अर्थात् :-
1. (1) इस स्कीम के अधीन लाभ प्राप्त करने के लिए पात्र लाभार्थियों से यह अपेक्षित है कि वह आधार संख्या को रखने का सबूत प्रस्तुत करें या आधार का अधिप्रमाणन पूर्ण करें ।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) इस स्कीम के अधीन लाभ प्राप्त करने के इच्छु क पात्र ऐसे लाभार्थी को, जिसके पास आधार संख्या नहीं है या जिसने अभी तक आधार के लिए नामांकन नहीं कराया है, आधार का नामांकन करने के लिए आवेदन करना होता है परंतु यदि वह उक्त अधिनियम की धारा 3 के उपबंधों के अनुसार आधार प्राप्त करने के लिए हकदार होता है और ऐसा लाभार्थी आधार नामांकन के लिए किसी आधार नामांकन के न्द्र [सूची भारतीय विशिष्ट पहचान प्राधिकरण (यूआईडीएआई) की वेबसाइट www.uidai.gov.in पर उपलब्ध है] में जा सकते हैं ।
(3) आधार (नामांकन और अद्यतन) नियम, 2016 के विनियम 12 के अनुसार कार्यान्वयन अभिकरण के माध्यम से मंत्रालय, ऐसे पात्र लाभार्थियों के लिए आधार नामांकन प्रसुविधा उपलब्ध कराने की अपेक्षा की जाती है जिन्होंने अभी तक आधार के लिए नामांकन नहीं कराया है और यदि सम्बन्धित ब्लॉक या ताल्लुक या तहसील में कोई आधार नामांकन के न्द्र अवस्थित नहीं है, मंत्रालय अपने कार्यान्वयन अभिकरण के माध्यम से, भारतीय विशिष्ट पहचान प्राधिकरण के विद्यमान रजिस्ट्रारों के साथ समन्वय से सुविधाजनक अवस्थानों पर या स्वयं भारतीय विशिष्ट पहचान प्राधिकरण रजिस्ट्रार बनकर आधार नामांकन की सुविधाएं उपलब्ध कराएगा:
परंतु उस समय जब तक कि लाभार्थी को आधार समनुदेशित किया जाता है, स्कीम के अधीन निम्नलिखित दस्तावेज को प्रस्तुत किए जाने के अधीन रहते हुए लाभ दिया जाएगा, अर्थात् :-
(क) यदि उसने नामांकन करा लिया है तो उसकी आधार नामांकन पहचान स्लिप ; और
(ख) निम्नलिखित में से कोई –
(i) फोटो सहित बैंक या पोस्ट ऑफिस पासबुक ; या
(ii) मतदाता पहचान पत्र ; या
(iii) स्थायी खाता संख्या (पैन) कार्ड ; या
(iv) राशन कार्ड ; या
(v) पासपोर्ट ; या
(vi) किसान फोटो पासबुक ; या
(vii) मोटरयान अधिनियम, 1988 (1988 का 59) के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी चालन अनुज्ञप्ति ; या
(viii) सरकारी पत्र शीर्ष पर किसी राजपत्रित अधिकारी या तहसीलदार द्वारा जारी ऐसे व्यक्ति के फोटो वाले पहचान का प्रमाणपत्र ; या
(ix) महात्मा गांधी राष्ट्रीय ग्रामीण रोजगार गारंटी स्कीम जॉब कार्ड ; या
(x) मंत्रालय द्वारा यथाविनिर्दिष्ट कोई अन्य दस्तावेज :
परंतु यह और कि पूर्वोक्त दस्तावेजों की जांच इस प्रयोजन के लिए मंत्रालय द्वारा विशिष्ट रूप से अभिहित किसी अधिकारी द्वारा की जाएगी ।
2. इस स्कीम के अधीन लाभार्थी को सहज और निर्बाध लाभ उपलब्ध कराने के लिए मंत्रालय कार्यान्वयन अभिकरण या अन्य माध्यम से सभी अपेक्षित प्रबंध करेगा जिससे यह सुनिश्चित किया जा सके कि स्कीम के अधीन आधार की अपेक्षा के बारे में लाभार्थी को जागरूक करने के लिए मीडिया के माध्यम से व्यापक प्रचार किया गया है । 3. सभी मामलों में जहां आधार का अधिप्रमाणन लाभार्थी के खराब बायोमैट्रिक के कारण या किसी अन्य कारण से विफल होता है, निम्नलिखित उपचारात्मक तंत्र को अंगीकार किया जाएगा, अर्थात् :-
(क) खराब अंगुलियों की छाप मात्रा के मामले में अधिप्रमाणन के लिए, आंख की पुतली का स्कै न या चेहरा अधिप्रमाणन की सुविधा को अंगीकार किया जाएगा जिसके द्वारा मंत्रालय कार्यान्वयन अधिकरण के माध्यम से बाधारहित रीति में लाभ के परिदान के लिए अंगुलियों की छाप अधिप्रमाणन के साथ आंख की पुतली का स्कै न या चेहरा अधिप्रमाणन के लिए व्यवस्था करेगा ;
(ख) अंगुलियों की छाप या आंख की पुतली का या चेहरा अधिप्रमाणन के माध्यम से बायोमैट्रिक अधिप्रमाणन के मामले में सफलता प्राप्त नहीं होने पर, जहां भी संभव हो और स्वीकार्य हो यथास्थिति, आधार एक समय पासवर्ड (ओटीपी) अथवा समय आधारित एक समय पासवर्ड (टीओटीपी) द्वारा अधिप्रमाणन का प्रस्ताव किया जाएगा ;
(ग) उन सभी मामलों में, जहां बायोमैट्रिक या ओटीपी या टीओटीपी का अधिप्रमाणन संभव न हो, वहां मूल आधार पत्र के आधार पर लाभ प्रदान किया जा सकता है जिसका अधिप्रमाणन आधार पत्र पर छपे 3 भाग II खण्ड (ii) भारत का राजपत्र : असाधारण
क्यूआर कोड के माध्यम से सत्यापित किया जा सकता है और क्यूआर कोड को पढ़ने का आवश्यक प्रबंध कार्यान्वयन अभिकरण के माध्यम से मंत्रालय द्वारा सुविधाजनक अवस्थान पर किया जाएगा ।
4. यह अधिसूचना असम और मेघालय राज्य के सिवाय, सभी राज्यों और संघ राज्यक्षेत्र प्रशासनों में राजपत्र में इसके प्रकाशन की तारीख से प्रभावी होगी ।

NOTIFICATION
New Delhi, the 14th January, 2020
S.O. 237(E).—Whereas, the use of Aadhaar as identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner and Aadhaar obviates the need for producing multiple documents to prove one's identity;
And whereas, the Ministry of Home Affairs (hereinafter referred to as the Ministry) in the Government of India is administering the "Central Scheme for Assistance to Civilian Victims/Family of Victims of Terrorist/Communal/LWE Violence and Cross Border Firing and Mine/IED Blasts on Indian Territory" (hereinafter referred to as the Scheme) under which financial assistance (hereinafter referred to as the benefit) is given to the eligible civilian victim or eligible family members of the victim (hereinafter referred to as the beneficiary) through the State Government Institutions, viz. the Collectors and District Magistrates concerned, (hereinafter referred to as the Implementing Agency);
And whereas, the aforesaid Scheme involves expenditure incurred from the Consolidated Fund of India;
Now, therefore, in pursuance of the provisions of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Central Government hereby notifies the following, namely:-
1. (1) An eligible beneficiary desirous of receiving the benefit under the Scheme is hereby required to furnish proof of possession of Aadhaar number or undergo Aadhaar authentication.
(2) Any eligible beneficiary desirous of receiving benefit under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall have to apply for Aadhaar enrollment provided he is entitled to obtain Aadhaar as per the provisions of section 3 of the said Act and such beneficiary shall visit any Aadhaar enrolment centre (list available at Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) for Aadhaar enrolment.
(3) As per regulation 12 of Aadhaar (Enrolment and Update) Regulations, 2016, the Ministry through the Implementing Agency, is required to offer Aadhaar enrolment facilities for the eligible beneficiary, who is not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Ministry through the Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of Unique Identification Authority of India or by becoming Unique Identification Authority of India Registrars themselves;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]Provided that till the time Aadhaar is assigned to the beneficiary, benefit under the Scheme shall be given to such beneficiary subject to the production of the following documents, namely:–
(a) If he has enrolled, his Aadhaar Enrolment Identification slip; and
(b) Any one of the following:
i. Bank or Post office Passbook with Photo; or
ii. Voter Identification Card; or
iii. Permanent Account Number (PAN) Card; or
iv. Ration Card; or
v. Passport; or
vi. Kisan Photo Passbook; or
vii. Driving license issued by Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or
viii. Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or
ix. Mahatma Gandhi National Rural Employment Guarantee Scheme Job Card; or x. Any other document as specified by the Ministry:
Provided further that the aforesaid documents shall be checked by an officer specifically designated by the Ministry for that purpose.
2. In order to provide convenient and hassle free benefit to the beneficiary under the Scheme, the Ministry through the Implementing Agency or other means shall make all the required arrangements to ensure that wide publicity through media is given to the beneficiary to make them aware of the requirement of Aadhaar under the Scheme.
3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiary or due to any other reason, the following remedial mechanisms shall be adopted, namely:-
(a) in case of poor fingerprint quality, IRIS scan or Face Authentication facility shall be adopted for authentication, thereby the Ministry through the Implementing Agency shall make provisions for IRIS scanners or Face Authentication along with fingerprint authentication for delivery of benefits in seamless manner;
(b) in case of biometric authentication through fingerprints or IRIS or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password (OTP) or Time-based One-Time Password (TOTP) with limited time validity, as the case may be, shall be offered;
(c) in all other cases where biometric or OTP or TOTP authentication is not possible, benefit may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the QR code printed on the Aadhaar letter and the necessary arrangement of QR code reader shall be provided at the convenient locations by the Ministry through the Implementing Agency;
4. This notification shall come into effect from the date of its publication in the Official Gazette in all the States and Union Territories Administrations, except the States of Assam and Meghalaya.
